03 02 2009 2008-ZBA-13 (Anderson) Public AgendaNOTICE OF PUBLIC MEETING FOR PROPOSED AMENDMENT TO THE ZONING BY -LAW OF THE TOWNSHIP OF ORO- MEDONTE 2008- SUB -01 2008 - ZBA -13 (Andersen) TAKE NOTICE that the Council of the Corporation of the Township of Oro-Medonte will hold a Public Meeting on Monday March 2, 2009 at 7:00 p.m. in the Municipal Council Chambers. The purpose of the public meeting is to obtain public comments on a proposed plan of subdivision and amendment to the Zoning By -law, under Sections 51 and 34 of the Planning Act, R.S.O. 1990 c. P. 13. THE PURPOSE of Applications 2008- SUB -01 and 2008 - ZBA -13 is to consider a proposed plan of subdivision comprised of 22 residential lots. The lots are proposed to have a minimum frontage of 30 metres and a minimum lot area of 0.2 hectares. Each of the proposed lots would have access to and frontage on Merrington Avenue, which is currently being proposed through the abutting plan of subdivision to the east (Homire subdivision). The applicant has applied to rezone the lands from Agricultural/Rural Exception 15 (A/RU'15) Zone to Residential One (R1) Zone. The lands lands described as 9733 Highway 12, Part of Lot 5, Concession 14 (formerly within the Township of Medonte, south of Warminster Sideroad, on the east side of Highway 12. A KEY MAP illustrating the location of the subject lands is provided on the opposite side. ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of or in opposition to the proposed Applications. If a person or public body that files an appeal of a decision of the Township of Oro-Medonte in respect of the proposed Applications does not make oral submission at the public meeting or make written submissions to the Township before the proposed Amendment is adopted, the Ontario Municipal Board may dismiss all or part of the appeal. With respect to the August 2008 CC Tatham & Associates Functional Servicing and Preliminary Stormwater Management Report: • We are satisfied that the proposed development will not likely impact the highway drainage system; a detailed SWMR, however, should be submitted to MTO for review and approval, as a condition of draft approval. • The proposed new watermain on Highway 12 right -of -way will be subject to MTO Encroachment permit approval. Watermain should be situated as close as possible to the Highway 12 property line. Dwg. GS -1 should label setback to property line and identify size of watermain; a profile drawing should also be included if proposed watermain crosses Warminster Rd. / Hwy 12 intersection. Encroachment permit inquiries should be submitted to Mr. Bernie O'Brien, Permits Officer, at 416- 235 -4491. • Dwg. GS -1 shows what appears to be a septic system for Lot 13 adjacent to Highway 12. Please note that a septic tank must be setback a minimum of 8m from Highway 12 property limit; a septic bed may be setback 3m.. The drawing also shows a Highway 12 entrance to this lot; this entrance should be removed from the drawing. With respect to the severance being created for the existing residence fronting on Highway 12, we have no concern with continued use of existing residential entrance for existing house, however we request that a condition be included in the severance requiring that access be relocated to new Street A in the future when this lot is redeveloped, ie. if /when a new house is constructed, the owner should be required to construct a new access to Street A, and remove Highway 12 access and restore the highway ROW to the satisfaction of MTO. In addition, the condition should stipulate that if a new entrance is constructed to Street A at any time, the owner will be required to close the existing Highway 12 entrance and restore the ROW. Please include the following Conditions of Draft Approval: 1. That prior to final approval, the owner shall submit to the Ministry of Transportation for review and approval a detailed ston-nwater management report, in accordance with MTO Stormwater Management Requirements for Land Development Proposals (http://www.mto.�ov.on.ca/english/engineering/drainage/stom-iwater/index.shtml). 2. That prior to final approval, a 0.3m reserve extending across the entire highway frontage (with the exception of the existing entrance to severed lot, ie. Block 23) be conveyed by deed, free and clear of all encumbrances, to the Ministry of Transportation. Please include the following Notes to Draft Approval: MTO Building & Land Use permits are required for all lots within 45m of Highway 12 property limits and within a 180m radius of Highway 12 / Warminster Rd.. MTO permits are also required prior to site grading / servicing / internal road construction, and for site signs. A new Entrance permit is required for the severed lot, and an Encroachment permit is required for works within the Highway 12 ROW. B&LU, Sign and Entrance permit inquiries / applications should be submitted to Ms. Janice Hendrix, Permits Officer in this office (416-235-5382). 2. All above and below ground structures, including land uses considered integral to site operations, must be setback a minimum of 8m from Highway 12 property limits. We have no objection with this proposal and only have one concern, which is run off into the bottom northwest corner. Occasionally with a real heavy downpour we get a flash flood in our back yard, trough the garden and right up to our septic system. We are concerned that this problem will be more frequent with the grading of each individual lot. A simple solution would be a shallow grade for about forty or fifty feet into the park where by it would find its way into the front ditch. We trust that you will give some consideration to our concern before approval is given. The upgrades are as follows: a second we l / a new pump house / and a new reservoir for fire protection. j We are currently cost sharing with the Td Pluck Group which is developing the Homire Sub- Division, on the Warminster Side Itd, At present there are no written cis sharing agreements in place for this developer or any other to contribute to the up-grades. Wye would request that a condition of any re- zoning approval for this development would carry an agreement for this cost sharing with the other developers, put in to pima. The following are our comments on the subject application: Planning The subject application requested a plan of subdivision of 22 residential units and to be retained one exiting residential unit on approx 14.3 acres land with a density unit ratio of 1.6 unit/acre and with the only road access from the Homire Subdivision. The subject property is to be adjoining a draft plan approved 28 residential units Homire Subdivision sited on approx 39 acres land with a density unit ratio of 0.7 unit/acre. The applicant proposed a residential unit density ratio is somewhat inconsistence to the Homire Subdivsion. Since the applicant proposed a road connection thought Hormire Subdivision, therefore, planning principal shall maintain on a similar residential lot design fabric with the abutting Hormire Subdivision. Functional Servicing & Preliminary Stormwater Management The subject application proposed to connects water main distribution, roadways and stormwater management to the Homire Subdivision. As indicated in the applicant's Functional Servicing & Preliminary Stormwater Management report and Planning report a cost sharing of the internal servicing is required. Therefore, we would request a cost sharing agreement to be executed between the applicant and 2063334 Ontario Inc. prior to approval of the subject application is to be granted. Warminster Water Services Upgrades In February 2007, we have been cost sharing with 638230 Ont Ltd, "The Meadow Acres" of the Warminster Water Services Upgrades. Since the subject application is to be connected to the Warminster Water Services, thereby, the applicant is require to join the cost sharing of services upgrades on a prorated basis.
