BY-LAW NO. 2008-159
A By-law to Regulate the Removal and Piling of Snow
within the Township of Oro-Medonte
WHEREAS the Highway Traffic Acf, R.S.Q. 1990, Chapter H.B, Sectian 181, states that no
person shall deposit snow ar ice an a roadway without permission in writing sa to da from
the Ministry or the road authority responsible far the maintenance of the road;
AND WHEREAS the Municipal Act, 2001, S.Q. 2001, c.25, Section 11, as amended,
defines spheres of jurisdiction under which a municipality may pass by-laws;
AND WHEREAS the spheres of jurisdiction include highways, including parking and traffic
on highways;
AND WHEREAS the Municipal Act, 21101, Sectian 27(1), as amended, provides that a
municipality may pass by-laws in respect of highways aver which it has jurisdiction;
AND WHEREAS the Municipal Act, 2001, S.Q. 2001, c.25, Section 224, as amended,
states that it is the Tale of Council to ensure that administrative practices and procedures
are in place to implement the decisions of Council;
AND WHEREAS, Council deems it necessary and expedient, to enact a By-Caw to govern
and control the removal and piling of snow within the Municipality;
NOW THEREFORE the Council of the Township of Oro-Medonte heref~y enacts as follows:
1. Administration of the By-law
1.1 No person shall place snow from private property upon any public sidewalk, road ar
street, or upon any allowance for a road ar street within the municipality.
1.2 No person shall pile, redistribute, ar otherwise cause the accumulation of snow on
the travelled portion of any road ar street, including sidewalks, within the
municipality, in such a manner as to obstruct traffic, ar the view of traffic, or obstruct
in any way the movement of snow-clearing equipment under the jurisdiction of the
Transportation and Environmental Services Department.
1.3 The provision of this By-law shall not apply to Municipal snow-clearing operations.
2. Enforcement and Fines
2.1 Every person who contravenes any provision of this By-law is guilty of an offence
and shall be liable to a fine in the amount to be determined pursuant to the
Provincial Offences Act, R.S. Q. 1990, Chapter P.33, and every such fine is
recoverable under the Provincial Offences Act.
3. That this by-law shall take effect an the final passing thereof.

PART I
IT IS ORDERED pursuant to the provisions of the Provincial Offences Act and
the rules for the Ontario Court of Justice that the amount set opposite each of the
offences in the attached schedule of offences under the Provincial Statutes and
Regulations thereunder and Municipal By-law No. 200&159, for the Corporation
of the Township of Oro-Medonte, attached hereto is the set fine for those
offences. This Order is to take effect December 2nd, 2008.
