WORA has a mailing list of 300 families and well aver 130 paid members, but we try to represent the best interests of everyone who lives between Barrie, the 12~' line, Horseshoe Valley Road and Lake Simcoe, members ar nat. I am here to talk with you about the importance of some new laws for everyone who lives in and around Lake Simcae. The economic stability of the area and the natural ecosystems which support the lake hang in the balance. Ora-Medonte Council will be asked to submit a brief regarding support for the proposed Lake Simcoe Protection Act and Plan some time this fall. WORA and many of your constituents will be urging you to support the purpose of Bill 99: "An Act to protect and restore the ecological health of the Lake Simcae watershed and to amend the Ontario Water Resources Act in respect. of water quality trading." Recent initiatives such as the Greenbelt Act, Places to Grow Act, Clean Water Act and the Source Protection planning initiatives have been positive, but don't make the mistake of believing that the Lake is now an the mend. Lake Simcoe is in trouble. I have provided a separate sheet outlining just some of the significant threats to our lake. We want to make it clear here that the health of Lake Simcae is absolutely bound to the economic health of our municipality. If the Lake continues to decline, tourism, cottaging, fishing and boating will. also decline along with the economic spinoffs. When Ora- Medonte Council makes its submission to the Provincial Government about the Lake Simcoe Protection Act, the West Oro Ratepayers Association urges you to request the legislation include following seven essential elements: L A recreational policy that limits destructive activities and encourages sustainable ones. 2. No significant shoreline alteration and stricter controls on boathouse construction. 3. Preservation of natural areas that must cover 40 percent of the watershed with as much high quality natural cover as possible such as interior forests. 4. A policy that ensures a 100-metre buffer zone on shorelines and rivers (known as riparian corridors) precluding developments or changes damaging to the ecosystem. 5. A ten percent surface impermeability limit that supports ecosystem health and cold water fish. 6. Protection measures that have adequate and sustained funding. 7. Protection measures that are stringently enforced with a practical, fast-moving system. Thank you for your time. Our delegation would be pleased to answer any questions you might have. The West Oro Ratepayers Association Some of the Current Threats to Lake Simcoe • The Lake has no recreation policy, no consistent shoreline management policy and, despite being perhaps the most intensively studied Lake in North America, will have no broad scale plan far protection until the Lake Simcoe Protection Plan is implemented. • Rapid growth in South Simcoe is in conflict with protecting the health of the Lake. An additiona1250,000 people are expected to be added to the current population to reach the provincial target of 667,000 by 2031. Many expect the real increase could be double. The Lake will not survive this increase without careful management. All municipalities need to develop and adhere to a sustainable growth policy. • There are numerous large developments proposed for the Lake, but it is probably already above sustainable capacity for shoreline development and recreation. No matter what stage they are at in approvals, the new Lake Simcoe Protection Act should apply to all these developments. • The Assimilative Capacity Study model predicts an increase of 25 percent in phosphorus loading to an average of 82.5 tonnes per year in the committed future growth scenario far fake Simcoe. This assumes similar precipitation patterns as occurred during the period from 1997 to 2004 and exceeds the current loading target for Lake Simcoe of 75 tonnes. The new phosphorus load target, based an scientific advice from the provincially-appointed science advisory committee, is likely to be much lower. • When more than ten percent of a lake's shoreline is paved or covered in concrete, its ability to support cold water fish and general ecological health begins to be impaired. The impervious area in the Lake Simcoe area is currently at 15 percent and scheduled to increase. • WORA opposes in principle any amendments to the Oro -Medonte Official Plan that would allow development (urban sprawl) outside of designated settlement areas. Development that converts natural wooded lands to a subdivision is contrary to Provincial Policy Statements and the County Official Plan while providing no benefit to Oro-Medonte. WORA would like to see Council impose a development freeze until the Lake Simcoe Protection Act is in place to ensure future projects meet the new standards. • There are 43 species at risk in the watershed. If we continue to destroy habitat as we are now, this list will grow. • Between 7,000 and 10,000 motor boats use Lake Simcoe every summer, but na one knows what the Lake's ecological carrying capacity is for boat traffic. A developer wants to add another 1,000 slips at Big Bay Point, but the Lake may already be over capacity for boat traffic. • Many WORA members are concerned about the proliferation of large "cigar boats" on the Lake. These boats use large amounts of fuel and the noise disturbs both wildlife and residents over large distances. Earlier this year a truck carrying asphalt rounded the curve and lost control. The truck left the road on both sides doing damage and caused serious safety issues. We are aware that the problem was caused by excess speeds. However, similar occurrences have taken place in the past. On one occasion a vehicle came around the curve and ended up half way up our lawn coming to a stop upon running into our stone fountain. As vehicles do not adhere to speed limits with the result of endangering the safety of those who live in the area we are requesting that the Township take additional measures. One consideration might be the placing of a guard rail or a barrier that would help protect those of us living in the area. Regrettably I am unable to attend the Oct. 2? public meeting and, as such, am submitting this letter in opposition of the application. As I'm sure you are aware, development and urban sprawl has been increasing at an unprecedented rate around Lake Simcoe of late, particularly on its west side and in the Barrie area. More development means more hard surfaces and even more storm run-off into the lake. It also means fewer precipitation-absorbing and filtering surfaces such as fields, forests and wetlands. These areas are vital to the health of the lake and thus also to that of our drinking water supply, our fisheries, our tourist industry and even our quality of life. Some say that we do not know how much development the lake can tolerate, however the signs are clear that, -with our current water treatment infrastructure, agricultural and lawn care practices, and unsustainable urban design, - the lake is in serious trouble. My family has cottaged on nearby Eight Mile Point since 1934, Over the last 75 years we have witnessed the continued and steady degradation of the lake, the demise of shorebirds and fresh water clams, the destruction of the cold water fishery, and the infestation of weeds which accumulate in deep malodorous piles on our shore each August. In the past, on a calm evening, the lake was constantly dotted - as if with rain drops - as fish came to the surface to feed; many of them leaping out to catch a shad fly. Today the surface of the water lies undisturbed. My parents and siblings all remember drinking the water straight from the lake. Latterly we boiled it. Now we purchase our drinking water. In recent years several grass roots citizen groups have sprung up to raise the alarm about the poor health of 1 :~k e Simcoe and the serious adverse effects that over-development is having on the watershed, Continued pressure from these groups resulted in the proposed Lake Simcoe Act, announced in 2007 to protect the watershed and lake. The application in question here should be tabled until the Lake Simcoe Act, with its development plans and restrictions, is finalized and municipalities are given clear direction for smart growth. Of great concern in this particular case is the potential destruction of the forest that makes up the proposed area. Forests are extremely important ~~~i.u~dians of the lake; they anchor soils and prevent erosion, regulate water flow, protect w atersheds, modify climate, cool the air, and provide habitat for a multitude of species of plants and animals. Lake Simcoe needs this forest and many more like it, What it does not need are more large estates with their accompanying hard surfaces and nutrient-laden lawns; all exacerbating the existing phosphorus over-load problem. This style of development is simply unsustainable urban design and, as such, no longer considered acceptable by forward-thinking, Smart Growth municipalities. In the 1970s my father, John McCulloch, purchased the 22 acre plot of land on Lakeshore Rd opposite the proposed subdivision. He had a small vegetable and flower garden and planted hundreds of trees which now cover the farmer pasture lands. My father appreciated and enjoyed the natural beauty of this land so much that, in 2002, he donated it to The Couchiching Conservancy to be preserved in perpetuity. Part of this reserve is provincially-significant wetland, with an active beaver pond that supports great blue herons, green herons, and other wildlife. This small parcel of land, with its water- cleansing wetland, does its part to help the lake. As you might expect, my family would like to see the land under discussion protected tinder its present zoning status, i.e. ruraUagricultural. Finally and from a different, aesthetic perspective, if you have ever travelled this short road in the fall or, for that matter any season, you will be stunned by its beauty; a long archway of towering hardwood trees leading down to the lake. It is truly a valuable and beautiful part of our natural heritage that should be protected (in large part, if not wholly) primarily for the health of the lake but also for the enjoyment of future generations. Should this application be approved please consider restrictive covenants to a) maximize the forest area thus minimizing run-off and protecting the lake and also b) prevent tree cutting along Lakeshore Rd., directing access onto Shoreline Dr. thus preserving the integrity and beauty of Lakeshore Rd. In conclusion, I speak for my family when I respectfully ask that you give serious consideration to our concerns regarding the application in question and that you reject the application for a zoning change. The S homes an tour will be open from 10:00 a.m. to 4:00 p.m. We have advised neighboring residents of the tour as we anticipate increased traffic and parking during those times. One of the homes on the tour is 112 Bay Street, Shanty Bay, the Eisen's home. We have recently become aware that Bay Street is a `No Parking' street. As such, we would like to request special permission to use the north side of Bay Street for the participants to park while they tour this home. We are aware that the road must be kept clear for emergency purposes. With this in mind, we would offer to place our specially printed No Parking signs on the south side of the street. We ask Council to consider our special request in the interest of charity. Subsequently, Council deferred the issue to the Waste Management Subcommittee for further consideration. Attached is the report (WMS 08-014} which was presented for further consideration to the November 3, 2008 Waste Management Subcommittee. The committee approved the following recommendations: THAT bulky item curbside collection be reinstated to interested member municipalities as outlined in Item WMS 08-014; AND TNAT staff be requested to investigate and report back on options regarding the bulky item curbside collection that would encourage maximum waste diversion based on discussions held at the Waste Management Sub committee meeting held November 3, 2008. If approved by Council, the report outlines some changes to bulky item collection including: 1) a change in the tipping fee to the mixed waste rate of $230/tonne 2} haulage costs to potentially deliver bulky material outside of the service area for disposal 3) discontinue accepting televisions and computer monitors The second recommendation was added by the Subcommittee members to require staff to provide a further report for future options. It is staffs understanding that this would not affect bulky item collections in 2009. These recommendations will now go forward to the Corporate Services Committee on November 12t" and for final consideration by County Council on November 25t". Assuming { # ` r that Council approves the recommendation as presented your municipality may consider bulky item collection as an optional service. A tentative date for this was provided in previous correspondence of September 7, 2009. In light of the above potential changes, we request that municipalities advise immediately of their intention with respect to 2009 bulky item collection. B, Section 181, states that no person shall deposit snow or ice on a roadway without permission in writing so to do from the Ministry or the road authority responsible for the maintenance of the road; AND WHEREAS the MunicipaiAcf, 2001, S.Q. 2001, c.25, Section 11, as amended, defines spheres of jurisdiction under which a municipality may pass by-laws; AND WHEREAS the spheres of jurisdiction include highways, including parking and traffic on highways; AND WHEREAS the Municipal Act, 2001, Seetian 27(1), as amended, provides that a municipality may pass by-laws in respect of highways over which it has jurisdiction; AND WHEREAS the Municipal Act, 2001, S.O. 2001, c.25, Seetian 224, as amended, states that it is the role of Council to ensure that administrative practices and procedures are in place to implement the decisions of Council; AND WHEREAS, Council deems it necessary and expedient, to enact a By-law to govern and contra) the removal and piling of snow within the Municipality; NOW THEREFORE the Council of the Township of Oro-Medonte hereby enacts as follows: 1. Administration of the By-taw 1.1 No person shall place snow from private property upon any public sidewalk, road ar street, or upon any allowance for a road or street within the municipality. 1.2 No person shall pile, redistribute, or otherwise cause the accumulation of snow on the travelled portion of any road or street, including sidewalks, within the municipality, in such a manner as to obstruct traffic, or the view of traffic, or abstract in any way the movement of snow-clearing equipment under the jurisdiction of the Transportation and Environmental Services Department. 1.3 The provision of this By-law shall not apply to Municipal snow-clearing operations. 2. Enforcement and Fines 2.1 Every person who contravenes any provision of this By-law is guilty of an offence and shall be liable to a fine in the amount to be determined pursuant to the Provincial Offences Act, R.S. O. 1990, Chapter P.33, and every such fine is recoverable under the Provincial Offences Act. 3. That this by-law shall take effect on the final passing thereof.
