2001-098 To Enter into a Water System Operations Agreement between the Corporation of the Township of Oro-Medonte and the Lake Simcoe Regional Airport CommissionTHE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 2001-98 Being a By-law to Enter into a Water System Operations Agreement between The Corporation of the Township of Oro-Medonte and the Lake Simcoe Regional Airport Commission. WHEREAS the Municipal Act, R.S . 0., 1990, c.M.45, Section 102, as amended, authorizes the Council of a Municipality to enact a by-law for the health and safety of its inhabitants; AND WHEREAS The Corporation of the Township of Oro-Medonte deems it desirable to enter into an agreement with the Lake Simcoe Regional Airport commission to provide opts of the Oneration and ta ri mao Drinki in ntenance of the Airport wter supply and distribution system in order to meet the requiremeng Water Standards; NOW THEREFORE The Council of the Corporation of the Township of Oro-Medonte enacts as follows: 1. That the Mayor and Clerk be authorized to execute the Water System operations Agreement, shown as Schedule "A" attached hereto and forming part of this By-law. 2, That this By-law shall come into full force and effect on its final passing thereof. The Township shall operate the Airport's water supply and distribution system utilizing licensed operators in order to meet the requirements of the Ontario Drinking Water Standards. 2. The Township shall be responsible for all water testing to meet the requirements of the Certificates of Approval and the Ontario Drinking Water Standards. 3. The Township shall be responsible for maintenance of the water system including: chlorine and aquamag chemical feed system (including chemical supply); - water meters (including consumption records); well pumps and wells; valves, blow -offs, curb stops; watermains (including flushing); ancillary items. 4. The Township shall provide all necessary reporting to the Ministry of the Environment and the public in keeping with the Ontario Drinking Water Standards and the Certificates of Approval. 5. The Township will invoice the Commission, via the Airport Manager, on a quarterly basis for the following itemized routine functions: - daily inspection, testing, and routine operations; - weekly testing; - quarterly testing; - annual testing; - chemicals; - watermain flushing, valve operating. 6. The Township will invoice the Commission, via the Airport Manager, for non- routine system repairs. 7. The Township will provide the Commission, in November, with information relating to the operation and maintenance of the water system required to prepare the annual budget for the Commission's approval. 8. The Township shall report to the Airport Manager: - all water testing results including actions taken to remedy any anomalies; - any non - routine system repairs including costs. -3- 9. The Township will only be liable for any fines or claims that arise from the operation and maintenance of the water supply and distribution system for which they have accepted responsibility (per item 1, 2, 3 & 4 above) and shall adequately insure themselves for this eventuality. In this regard the parties agree to each respectively take out adequate insurance in the amount of not less than $1,000,000.00 and to include each of the other as coinsured and to keep such policies in full force and effect. 10. The Commission will pay any invoices received within 45 days of their receipt. 4 11. Delivery of any correspondence shall be deemed to have been received within 3 business days of its mailing by prepaid first class mail when addressed as hereinafter provided: i) to Commission Lake Simcoe Regional Airport Commission R. The parties to this agreement agree that one year's notice by either party, duly served, shall constitute the official notification that this agreement shall be null and void on December 31St on the year following receipt of said notice. 13. The parties agree and acknowledge that each is satisfied as to its jurisdiction to enter into this agreement. Therefore, each of the parties agrees that it shall not question the jurisdiction of the Township or of the Commission to enter into this agreement or question the legality of any portion of the foregoing. The parties hereto, their successors, assigns and lessees are and shall be stopped from contenting otherwise at any proceeding before a court, tribunal or other body. M 14. , The parties hereto agree and acknowledge that the recitals are accurate and shall form part of this agreement. 15. This agreement shall be construed with all changes in number and gender as may be required by the context. 16. Time shall be of the essence in this agreement. 17. This agreement shall be binding upon and enure to the benefit of the parties hereto, their respective successors and assigns. -• 18. In this agreement, words denoting the singular include the plural and vice versa. 19. If any individual provisions of this agreement are determined by a court of competent jurisdiction to be illegal or beyond the power, jurisdiction or capacity of either of the parties bound hereby, such provision shall be severed from this agreement and both the Commission and the Township agree that the remainder of the agreement shall remain in force and effect mutates mutandis. In such case, the Commission and the Township agree to negotiate in good faith to amend this agreement in order to implement the intention as set out herein. The Permit Holder shall immediately notify the District Manager of any complaint arising from the taking of water authorized under this Permit and shall report any action which has been taken or is proposed with regard to such complaint. 5. For Surface -Water Takings, the taking of water (including the taking of water into storage and the subsequent or simultaneous withdrawal from storage) shall be carried out in such a manner that streamflow is not stopped and is not reduced to a rate that will cause interference with downstream uses of water or with the natural functions of the stream. 6. For Ground -Water Takings, if the taking of water is forecast to cause any negative impact, or is observed to cause any negative impact to other water supplies obtained from any adequate sources that were in use prior to initial issuance of a permit for this water taking, the Permit Holder shall take such action necessary to make available to those affected a supply of water equivalent in quantity and quality to their normal takings, or shall compensate such persons for their reasonable costs of so doing, or shall reduce the rate and amount of taking to prevent the forecast negative impact or alleviate the observed negative impact. Pending permanent restoration of the affected supplies, the Permit Holder shall provide, to those affected, temporary water supplies adequate to meet their normal requirements, or shall compensate such persons for their reasonable costs of so doing. 7. No water may be taken under authority of this Permit after the expiry date of this Permit, unless the Permit is renewed, or after the expiry date shown on any subsequent renewal of this Permit, unless it is likewise renewed. Prior to the taking of water under the authority of this Permit to Take Water, the Permit Holder shall ensure that the works complies with Section 52 of the Ontario Water 04 Resources Act, R.S.O. 1990. 9. Prior to the taking of water under the authority of this Permit to Take Water, the Permit Holder shall ensure that the discharge complies with Section 53 of the Ontario Water Resources Act, R.S.O. 1990. a, 10. The Permit Holder shall report to the Director any changes of address or telephone number, or change of ownership of the property for which this Permit is issued and shall report to the Director any changes in the general conditions of water taking from those described in the permit application within thirty days of any such change. The Permit Holder shall not assign his rights under this Permit to another person without the written consent of the Director. 11. This Permit does not release the Permit Holder from any legal liability or obligation and remains in force subject to all limitations, requirements, and liabilities imposed by law. This Permit shall not be construed as precluding or limiting any legal claims or rights of action that any person, including the Crown in right of Ontario or any agency thereof, has or may have against the Permit Holder, its officers, employees, agents, and contractors. 12. The Permit Holder must forthwith, upon presentation of credentials, permit Ministry personnel, or a Ministry authorized representative(s) to carry out any and all inspections authorized by Section 15, 16 or 17 of the Ontario Water Resources Act, R.S.O. 1990, Section 156, 157 or 158 of the Environmental Protection Act, R.S.O. 1990 or Section 19 or 20 of the Pesticides Act, R.S.O. 1990. SPECIAL CONDITIONS 13. The combined maximum amount of water taken daily from the wells described in Table 1 of Schedule "A ", shall not exceed 36,486 Litres. 14. The requirements of this Certificate of Approval are imposed pursuant to Section 52 of the Ontario Water Resources Act. The issuance of this Certificate in no way 'abrogates the Owner's legal obligations to take all reasonable steps to avoid violating other applicable provisions of this legislation and other legislations and regulations. 3. (a) The requirements of this Certificate are severable. Should any requirement of this Certificate, or the application of any requirement of this Certificate to any circumstances, is held invalid, the application of such requirement to other circumstances and the remainder of this Certificate shall not be affected thereby. (b) In all matters requiring the interpretation and implementation of this Certificate, the conditions of the Certificate shall take precedence, followed in descending order by the owner's application and the documentation, referred to in this Certificate, which is submitted in support of the application. 4. The owner shall comply with all the terms and conditions of this Certificate. Non-compliance constitutes a violation of the Ontario Water Resources Act and is grounds for enforcement. 5. The Owner shall forthwith upon the request of either the Director or the Regional Director or the District Manager furnish any, requested information concerning compliance with this Certificate including any records required to be kept by this Certificate. 6. The owner shall notify the Director and the Regional Director in writing of any of the following changes within thirty (30) days of the change occurring: (a) change of Owner or operating authority or both; (b) change of address or address of the new Owner. 7. (a) The Owner shall prepare a complete set of drawings showing the water works as constructed within one year of substantial completion of the works. The Owner shall make available these drawings to Ministry personnel upon request. (b) A complete set of the "as constructed" drawings, with any amendments as made from time to time incorporated, shall be kept by the owner as long as the water works are kept in operation. i - Iinistry of ,finis are ce CERTIFICATE OF APPROVAL --nvironmeni WA TER -na Energy -=i ce NUMBER 7-0681-93-946 Ontario Page 4 of 10 WERATIONS AND MAINTENANCE (a) The Owner shall endeavour to take all necessary steps, within his authority, to ensure protection of the source of water supply (ground water aquifer) from contamination. (b) Subsequent to construction of, or repairs to, the works and prior to employing the works for supplying potable water, the Owner shall ensure that the works are disinfected adequately. (c) The owner shall ensure that, at all times, the works as well as all related equipment and appurtenances are properly operated and maintained. Proper operation and maintenance includes effective performance, adequate funding, adequate operator staffing and training, adequate laboratory and process controls, use of process chemicals, and other substances, that come in contact with the treated water which are suitable for the process, compatible with each other and appropriate for drinking water. (d) The owner shall prepare an operating and maintenance manual before commencing operation of the works and keep it up to date. The Owner shall make the manual available, upon request, to Ministry personnel. (e) The Owner shall ensure that contingency plans and procedures are established as well as adequate equipment and material are available to cope with any emergency, upset conditions and equipment breakdowns in the works. (f) The - owner shall establish procedures to notify the District Manager and other relevant authorities in the case of an emergency and record the measures taken to deal with each situation. PERFORMANCE 9. Subject to Condition No. 13 the owner shall operate the entire water supply and treatment system in such a manner, and with such facilities, that water supplied to the consumers serviced by the system satisfies the water quality objectives, guidelines and requirements as set out in the publication "Ontario Drinking Water Objectives" 1983, as amended from time to time by more recently published editions. 10. (a) The owner shall operate the chlorination system in such a manner and with such facilities that a minimum total, chlorine residual of 0.2 milligram per litre in the treated water, after fifteen minutes contact time, is maintained at all times prior to the first point of usage. (b) In case of identification of poor bacteriological water quality as defined in the "Ontario Drinking Water objectives" or as directed by the District Manager, the Owner shall operate the chlorination system in such a manner and with such facilities that a minimum total chlorine residual of 0.5 milligram per litre in the treated water, after fifteen minutes contact time, is maintained at all times prior to the first point of usage. (c) The owner shall notify the District Manager and the Medical Officer of Health forthwith in the event that unchlorinated*water is put into the distribution system. MONITORING AND REPORTING 12. (a) The Owner shall maintain and operate f lowmeters with calibration made at intervals not exceeding one year to ensure accuracy to within, plus or minus, ten percent for the entire range of flows and particularly for the average flow rate of the system in order to measure: i. the withdrawal flow rate of each groundwater well; ii. the quantity of treated water supplied daily to the distribution system. (b) The data generated in accordance with subsection (a) above shall be deemed to be conclusive as to the maximum flow rates for the purposes of determining compliance with and enforcing of this Certificate. 13. The Owner shall ensure that the following monitoring program is carried out. Sampling locations shall be established to the satisfaction of the District Manager prior to commissioning of the works. (b) Subject to subsection (e) of this condition, once a year, the raw water and treated water samples shall be collected and analyzed for parameters as listed in Table 1 and 2 of the "Ontario Drinking Water Objectives" 1983, as amended from time to time by more recently published editions. (c) The sampling and analyses required by subsections (a) and (b) of this condition shall be performed in accordance with the "Guide to the Collection and Submission of Samples for Laboratory Analysis", Ministry of the Environment, 1985, and the "Handbook of Analytical Methods for Environmental Samples", Ministry of the Environment, 1983, or as described in Standard Methods for the Examination of Water and Wastewater!' 16th Edition, 1985, as amended from time to time by more recently published editions. (d) The owner shall submit the analytical results obtained pursuant to this condition to the District Manager within thirty (30) days of collection of the samples or within such longer period of time as the District Manager may agree. (e) Following review of any analytical results or any of the reports required by Condition No. 14 of this Certificate, the District Manager may alter the frequencies and locations of sampling and parameters for analysis required by this condition upon either the request of the Owner with the submission of satisfactory supporting documentation or if deemed necessary to assess properly the quality of the water being supplied. Should the owner monitor any of the parameters required by subsection (b) of this condition, at locations designated for this purpose and in accordance with subsection (c) above, more frequently than required by this condition, the analytical results of all such samples, both required and additional, shall be included in reporting of the values required by this Certificate, and the increased frequency, or all dates of sampling, shall be detailed in the reports. The owner shall prepare and submit a performance report to the District Manager on an annual basis. The first such report-shall cover the period form the commencement of operation of the water supply after modifications to the end of the calendar year and shall be submitted within ninety (90) days following such reporting period. Each subsequent report shall be submitted within ninety (90) days of the completion of the calendar year being reported upon. The reports shall contain, but need not be limited to, the following information in a format acceptable to the District Manager: (a) a summary and discussion of the quantity of water supplied altogether, and individually by each well, during the reporting period compared to the design parameters listed in the description of this Certificate including peak flow rate ' s and monthly average flows together with the related water levels in the wells; (b) a summary and interpretation of analytical results obtained in accordance with Condition No. 13 of this Certificate of Approval; (c) a tabulation and description of all actions taken for all emergency and upset conditions which occurred during the period being reported upon; (d) a summary of the chemicals used in the treatment processes with special reference to any abnormal usages. 15. No service connections are to be made on the 450mm waternain from the pumphouse as well as on 31 metres to the east as well as west of the subsequent 150mm watermain along the access road. Condition Nos. 6 and 7 are included to ensure that the Ministry records can be kept accurate and current with respect to approved works and to ensure that subsequent owners of the works are made aware of the Certificate and continue to operate the works in compliance with it. 7. Condition No. 8 is included to ensure that the works will be operated, maintained, funded, staffed and equipped in a manner enabling compliance with the terms and conditions of this Certificate and that the owner can deal with contingency and/or emergency situations. 8. Condition Nos. 9 and 12 are included to ensure that the water quality delivered by the works satisfies the current "Ontario Drinking Water Objectives" in order to protect public health and to ensure that the water is aesthetically acceptable. 9. Condition No. 10 is included to ensure that the peak flow rate of water through the works is within the approved treatment capacity of the works. 10. Condition Nos. 11, 13 and 14 related to the flow metering, sampling and monitoring program and performance report are being imposed to ensure that all pertinent data are available for the water works performance evaluation and to ensure that the water works is operated and maintained at a level consistent with the design objectives, and is effective in producing water of an acceptable quality at all times. 11. Condition No. 15 is to ensure that the water supplied is disinfected adequately before the first point of usage.
