BEING A BY-LAW TO ADOPT OFFICIAL PLAN AMENDMENT NO. 11 TO THE TOWNSHIP OF ORO-MEDONTE OFFICIAL PLAN The Council of the Corporation of the Township ofOro-Medonte, in accordance with the provision of the Planning Act, hereby enacts as follows: 1. The attached explanatory text which constitutes Amendment No. 11 to the Official Plan of the Township of Oro-Medonte, is hereby adopted. 2. The Planner is hereby authorized and directed to make application to the COlmty of Simcoe for approval of Amendment No. 11 to the Official Plan of the Township ofOro-Medonte. 3. The purpose of this Amendment is to amend the land use policies of the Ora Centrellndustrial Commercial designation by adding a site specific policy to the text that will have the effect of permitting the severance from the subject property of a 5.45 ha. (13.4 acres) parcel. The newly created parcel would be combined with a parcel of approximately .42 ha. (1.0 acre) to be provided by the Township of Oro-Medonte. The amendment will also permit the establishment of an institutional church use and overflow parking area for the municipal offices. 2.0 Location This Amendment pertains to a 10.48 parcel of land described as Part Lot 21, Concession 7 in the geographic Township of Oro as shown on Schedule 'A' attached. The subject property legally described as Part of Part 5, Plan 51 R- 15045 is situated south of and abutting Provincial Highway No. 11 on the west side of the municipal road separating the seventh and eighth concessions of the former Township of Oro. The portion of the property subject to the severance application consists of the southerly 5.45 hectares of the above noted property. The Amendment applies to those lands depicted and shown on Schedule 'A' attached to this document. These lands ere situated withir. Schedule 'A"! 0' of the, TvYinship of Gro-:vicdonte Officiai Pian. 3.0 Bas is 3.1 Introduction It The lands affected by this Amendment are subject to an application for severance that is not permitted by the policies of the Official Plan. Although the proposed Institutional church use is included as a permitted use in Section D13.2 of the Official Plan, there is a requirement that before the development of any permitted use a detailed Secondary Plan for the area be prepared. A Secondary Plan has been prepared for the Oro Centre area but not approved due to outstanding issues related to a Highway 11 Corridor Study being undertaken by the Ministry of Transportation. The establishment of the proposed use will not affect or impact the resolving of the outstanding transportation issues of the Secondary Plan. In addition, the contemplated church use will not introduce an incompatible or inappropriate land use or preclude future development. The proposal will also conform to both existing and proposed area planning policies. 3.2 PlanninQ Context The subject site is presently comprised of vacant and idle partially vegetated rural land. The majority of the 5.87ha (14.5 acres) area affected by the proposed f' Schedule 2 PLOI076 Page 3 . church use is non-agricultural land formerly utilized for the purposes of a wayside borrow pit and have been extensively altered by re-grading and earth moving activities. The lands to be retained have an environmentally sensitive area and a vacant commercial building located on them accessed from Highway 11 and the township road between the seventh and eighth concessions. Lands to the east and west of the subject site in the vicinity of the lands to be severed are presently utilized for agricultural field cropping purposes. The subject site is designated Oro Centre Industrial/Commercial by the Official Plan for the Township of Oro-Medonte and is ~ituated within the south-west quadrant of the Oro Centre Secondary Plan Area. The Official Plan identifies the Oro Centre area as a unique area suitable for the establishment of a mix of land uses. Ora Centre is recognized as a potential growth area as it is in close proximity to the Lake Simcoe Regional Airport, possesses major highway exposure, a highway interchange. and is conveniently situated halfway between the cities of Barrie and Orillia. The Oro Centre Secondary Plan was undertaken and completed by the municipality in order to promote the development and redevelopment of these lands to generate long-:term employment opportunities. It is intended that the Oro Centre area be the preferred site for the location of a number of higher order industrial, commercial, and institutional uses and that these uses ultimately be serviced by a series of small communal water and sanitary servicing systems. It The POiJCIe5 01 the Oro Centre Secondary Plan designate the subject site Limited Service Industrial. The policies of the limited Service Industrial designation promote land extensive "dry" industrial uses with outdoor storage. It is the policy of this designation that these areas may not be provided with municipal or communal water sewage services. In addition to industrial uses, the policies of this land use designation also permit the establishment of a variety of uses induding outdoor recreational uses, as well as small-scale commercial and institutional uses. 3.3 Servicing Context It is the intent of the Secondary Plan that the majority of the area ultimately be serviced with communal water and sewage treatment facilities. Policies of the Secondary Plan recognize however that especially during initial phases of development smaller stand-alone systems may be appropriate and feasible. Policies of the Secondary Plan require that in the absence of communal systems any new use conform to the permitted land uses of the designation, the proposed servicing system have no adverse impact on the environment, and that future connections may be made to larger communal area systems. The Plan also requires that development of new uses in the 'limited Service Industrial" designation may only generate minimal amounts of effluent and be supported by a review of servicing strategies and potential impacts. Studi~s supporting the Official Plan Amendment are appended to this document. Scbedule 2 PLOI076 Page 4 3.4 Conformity and Details of Proposal . The Official Plan Amendment allows for the establishment of the Trinity Community Presbyterian Church on a 5.87 ha. parcel of land situated adjacent to the municipal offices. The development supports efforts of the Corporation of the Township of Oro-Medonte to promote Oro Centre as a focus for future industrial, institutional, and commercial activities. The location of the split level 17 ,443 sq. ft. church building in the Oro Centre area represents a significant investment of, approximately $ 1,800,000 and is the first development proposed in the area. The church facility will provide a community benefit by providing additional overflow parking spaces to the adjacent municipal offices. It is envisioned and anticipated that with the associated social functions of the church, the facility will assist with raising the profile of the Oro Centre area and act as a catalyst for further development. t The Amendment complies and supports the policies of the Official Plan in that the project is environmentally sustainable and complies with the Reasonable Use policies of the Ministry of Environment relating to effluent concentrations and will not predude the connection of the facility when communal seiVices become available in the Secondary Plan Area. It is intended that the church will initially be serviced by a Class IV sewage treatment system with a raised septic field and a private well. The leaching bed will be located to the west of the building and will utilize i~ported media. On-site water quar.tity and quality contro:s will be impiemented through the provision of a stormwater management facility to be located at the northeast comer of the site. Drainage will continue to be directed to the north into the abutting property with the exception that post development rates will decrease from pre-development conditions. The Planning and Servicing report also shows that future provision of full municipal servicing systems for the Oro Centre area will not be negatively affected or prejudiced. The Simcoe County District Health Unit have indicated that they have no objection to the Amendment as proposed. The Ministry of Transportation are in the process of planning the construction 'of a highway interchange to the north of the sLibject site. According to preliminary designs, the location of the church building and assoaated infrastructure will not preclude the location of access ramps from Highway 11 or local service reads. . . . It Sch ed ule 2 PLOI076 Page 5 PART B - THE AMENDMENT 1.0 Introduction All of this part of the Amendment entitled Part B - The Amendment, which consists of 'the fonowing text and Schedule "A", constitute Amendment No. ] 1 to the Official Plan of the Township ofOro-Medonte. 2.0 Details of the Amendment The Official Plan for the Township of Oro-Medonte is hereby amended as folJows: 1. Schedule A' 0 of the Official Plan is hereby amended by redesignating lands described as Part of Lot 21, Concession VII, Reference Plan 5IR-30031, Parts I and 2 (fonner Township ofOro) and identified OJ) Schedule "A" attached hereto and fonning part of this Amendment from the Oro Centre Industrial/Commercial designation to a site specific Oro CentTe Industrial/Commercial designation. 2. Section DI3 - Oro Centre Industrial/Commercial, is amended by the addition of the following new subsection "DI3.4 - Exceptions" 3. Section D13.4 - Exceptions, of the Official Plan is hereby amended by adding a new subsection DB.4.l as follows: "Dl3.4 EXCEPTIONS D 13.4.1 Part of Lot 21, Concession VII, RP 51R-30031, Parts 1 and 2 (Oro) Notwithstanding the policies of Section D13.3, the creation and development ofa new lot for the purpose of establishing an institutional church use prior to the adoption and approval of a Secondary Plan for Oro Centre is pennitted on the lands shown to be subject to this Section on Schedule AlO to this Plan.'" 3.0 Implementation The provisions of the Official Plan regarding the implementation of that Plan shall also apply to this Amendment. 4.0 Interpretation The interpretatjon of this Official Plan for the Tovvnship ofOro-Medonte, as amended from time to time, shaH apply to this Amendment.
