The Planner is hereby authorized and directed to make application to the County of Simcoe for approval of Amendment No.8 to the Official Plan of the Township ofOro-Medonte. 3. It THE CONSTITUTIONAL STATEMENT The following Amendment to the Official Plan for the Township of Oro-Medonte consists of three parts. PART A - THE PREAMBLE - consists of the purpose, location and basis for the Amendment and does not constitute part of the actual Amendment PART B - THE AMENDMENT - which sets out the actual Amendment and consists of the text, constitutes Amendment No.8 to the Official Plan of the Township of Oro-Medonte. PART C - THE APENDICES - consists of infonnation pertinent to this Amendment in the fonn of background infonnation. This section does not constitute part of the actual Amendment. ,I, ~ PART A - THE PREAMBLE 1.0 Purpose of tbe Amendment - The purposes of this Amendment is to establish new policies in the Official Plan which would be utilized for assessing applications for new recreational uses or expansions to existing recreational uses. This policy is intended to provide for the development of recreational uses which are compatible with the rural character of the Township and to conserve and protect lands for future recreational uses while preserving and maintaining the existing natural heritage features. 2.0 Location of Lands Affected This Amendment applies to all lands in the Township that are utilized for new recreational uses or for the expansion to existing recreational uses. 3.0 Basis of tbe Amendment After further review it was detennined that it would be more appropriate to consider a new designation in the Official Plan which related to major recreational uses such as golf courses, ski facilities, and campgrounds and established policies for consideration when such a use is proposed. Currently in the Official Plan "Section D6 - Open Space" primarily reflects lands in public ownership (Township, County, or Provincial) and does not establish any development policies to provide any basis for providing for the long tenn recreational needs of the Township. The new policies are being proposed not only recognize these public uses but to also pennit other major private recreational uses, such as golf courses, ski facilities, and campgrounds. This policy would establish a framework for considering all applications which are received for new recreational uses or the expansion of existing recreational uses. All new uses will require an Official Plan Amendment and Zoning By-law Amendment in accordance with the proposed policies and the amendment will not be considered favorably until the policy requirements of Section D6.3 are addressed to Council's satisfaction. This amendment would require all proposed recreational uses to proceed by way of an Official Plan Amendment for consideration by Council. These amendments would ensure that the appropriate background studies being completed to Council's satisfaction to determine potential impacts of such uses on the rural character and the natural environment. , '. \. PART B - THE AMENDMENT 1.0 Introduction - All of this part of the Amendment entitled Part B - The Amendment, which consists of the following text, constitutes Amendment No.8 to the Official Plan of the Township of Oro-Medonte. 2.0 Details of the Amendment The Official Plan for the TO\VI1ship ofOro-Medonte is hereby amended as follows: 1. "Section C 1.6 - Open Space" is hereby deleted in its entirety and replaced with the following: " C 1.6 - Recreational Lands designated Recreational include County of Simcoe forests, the Copeland forest area, Bass lake Provincial Park, all major Township ofOro-Medonte parks, and all major recreational uses." 2. "Section D2.3.8 - Expansion to Existing Tourist Commercial Uses and Recreational Uses", second sentence is hereby deleted in its entirety and replaced with the following: "Minor expansions to existing tourist commercial uses and recreational uses such as golf courses may be pennitted subject to an amendment to this Plan, the policies of Section D6 - Recreational, and the implementing Zoning By-law." 3. Section D3.2 - Pennitted Uses, second paragraph, third sentence, is hereby amended by deleting the reference to "golf courses" as a pennitted use in the second paragraph, third sentence. 4. Section D3.2 - third paragraph, is amended by deleting the first sentence. 5. Section D3.3.2 is amended by deleting all reference to "new golf courses and small scale ski facilities". 6. Section D3.3.3 first paragraph, second sentence is hereby deleted and replaced with the following: "The development of new tourist commercial uses, golf courses, ski facilities. shall require an Amendment to this Plan, be subject to the policies of Section D6 of this Plan, and an amendnlent to the implementing Zoning By-law, and shall be subject to Site Plan Control." ."1 f "" 7. Section D6 - "Open Space", is hereby deleted in its entirety and replaced with the following: <<D6 - RECREATIONAL e D6.1 OBJECTIVES . To conserve and protect lands for future recreational use. . To provide for the development of recreational uses which are compatible with the rural and agricultural character of the Township. . To provide a broad range of recreation and leisure opportunities for the residents of the Township. . To preserve and maintain existing natural heritage features such as valley lands, steep slopes, wooded areas and watercourses, and where feasible, utilize these areas for open space linkages. D6.2 PERMITTED USES Pennitted uses on lands designated Recreational on the schedules to this Plan include passive and active recreational uses including golf courses, conservation uses, ski facilities, campgrounds, municipal utilities, forestry uses in accordance with good management practices and accessory uses, The Township currently owns a number of parcels of land in the municipality. It is the intent of Council to retain these areas in public ownership and to develop and manage these areas in accordance with a Parks and Recreation Master Plan. D6.3 DEVELOPMENT POLICIES D6.3.1 New Uses and Expansions to Existing Uses Given the potential impacts of new major recreation uses and accessory recreational facilities on the pennanent countryside of the Township, only existing uses are recognized by this Plan. 1)1e development of any new major recreation use shall require an Amendment to this Plan and the implementing Zoning By-law and shall be subject to Site Plan Control. Expansions to existing uses on lands that are already within the Recreational shall require an amendment to the implementing zoning by-law and shall be subject to Site Plan Control. Expansions to existing uses onto lands which are not designated Recreational , . . 5. shall require both an Amendment to this Plan and the implementing Zoning By-law and shall also be subject to Site Plan Control. Before considering an Amendment to the Official Plan (if required) and Zoning By-law, Council shall be satisfied that: (a) the proposed use (or expansion) is compatible with the rural character of the area; (b) the development can be designed and sited to blend in with the rural surroundings; (c) the proposed use (or expansion) is located where it would have little or no negative impact on agricultural operations on adjacent lands; (d) the proposed use can be serviced with an appropriate water supply and means of sewage disposal; (e) if an expansion is proposed, the entire use is serviced by an appropriate water supply and means of sewage disposal; (f) appropriate guarantees are in place to ensure that the impacts of the effluent from a private communal sewage treatment system on the lands down gradient water supplies is monitored frequently; (g) sufficient financial securities are available to ensure that downstream water supplies can be replaced in the event of a problem that is directly attributable to the operation of the private communal sewage treatment system on the lands; (h) there will be no negative on-site or off-site impacts resulting from the use of fertilizers, herbicides, pesticides and fungicides; the preparation of a Nutrient Management Plan to the satisfaction of the Township and other governing agencies may be required in order to demonstrate "no negative impacts"; (i) the proposed use (or expansion) is to be accessed by municipal roads that can accommodate the increased traffic generated by the proposed use; (j) the proposed use (or expansion) can be appropriately buffered from adjacent land uses; (k) the proposed use (or expansion) is located where it will not have a negative impact on the ecosystem's significant natural heritage features and on their associated ecological function; and (1) an appropriate monitoring program, which serves to monitor the impact of the use on the quality and quantity of the groundwater, surface waters and the environment in general is developed." Schedules A 1 to A24 are hereby amended by deleting all references to "Open Space" and replacing with "Recreational". 'oi < . . PART C - APPENDICES < , II . - ~ " "- PLANNING ADVISORY COMMITTEE November 29, 2000 Heritag~t:lm.Golf,Cours.;' Partoflot-10and~D, Concession 2 (Oro) Lin.1 Soutbf:: P-83/99" Official;pra~ Currently - Agricultural and Environmental Protection Two Overlay Proposed - Recreational, Environmental Protection One and Environmental Protection Two Overlay Zoning By-law Currently - Agricultural/Rural and Environmental Protection (EP) Zones Proposed - Private Recreational (PR) and Environmental Protection (EP) Zones Planning Department Comments After the last deputation for this application in September, the recommendation to deny the Official Plan Amendment was deferred by Council in order to allow for another deputation to Council from the applicants and to allow all Council members to review the background technical studies and Township peer reviews prior to making a decision on the recommendation. A further report was presented to Council by the Chief Administrative Officer which indicated that the applicant's were amending their application to redesignate from Agricultural and Environmental Protection Two Overlay to a Site Specific Environmental Protection One which would permit the golf course and did not require a County of Simcoe Official Plan Amendment. The recommendation in that report was that the Planner prepare a further report to the Planning Advisory Committee for their reconsideration of the application. Subsequent to the adoption of that recommendation further review was completed by ~he Planner to determine all options which would be available other than the Environmental Protection One Exception. After further review it was determined that it would be more appropriate to consider a new designation in the Official Plan which related to major recreational uses such as golf courses and established policies to be considered if such a use is proposed. 1 Currently in the Official Plan "Section D6 - Open Space" primarily reflects lands e in public ownership (Township, County, or Provincial) and does not establish any development policies (copy of existing section D6 attached). - A new Section 06 - Recreational" is proposed that would not only recognize these public uses but would also permit other major recreational uses, such as golf courses. A new subsection would be incorporated which would establish the criteria to be considered when such an application is received. All new uses will require an Official Plan Amendment and Zoning By-law Amendment in accordance with the proposed policies and the amendment will not be considered favorably until the policy requirements of Section D6.3 are completed to Council's satisfaction. . The new proposed policy requires changes to two other sections of the Official Plan in order to be consistent with the intent of the new Section 06. First under "Section C - Land Use Concept" subsection C1.6 currently indicates lands in this designation are owned by the Township, County, or Province. The proposed wording would be replaced with the following: "C1.6 Recreational Lands designated Recreational include County of Simcoe forests, the Copeland Forest area, Bass lake Provincial Park, all major Township of Oro-Medonte parks, and all major recreational uses." e Section D3 - Rural would also have to be amended to deleted golf courses as a permitted use and to remove from Section D3.3.2 any reference to golf courses. These amendments would ensure that these uses proceed by way of an amendment to the Plan with the appropriate background studies being completed to Council's satisfaction. In accordance with the requirements of the Planning Act, this proposed new Section 06 - Recreational (attached) and the other amendments noted above would be subject to a Public Meeting prior to consideration by Council. The subject property which is currently the area proposed to be utilized for Heritage Hills golf course would be required to be designated Recreational with an Environmental Protection Two Overlay designation on the entire property to protect the features of the property, and also the Environmental Protection One designation would be utilized for the area surrounding the creek on the property. Recommendation It is recommended that the proposed amendments to the Official Plan including the new "Section D6-Recreational" proceed to a Public Meeting in accordance with the requirements of the Planning Act and that Development Application P- 83/99 be considered favorably to proceed under the proposed policy. 3 '" '- SECTION D6 - RECREATIONAL e D6.1 . - . .
