2008-021 Agreement Between the Township of Oro-Medonte and Gord Rankin to Allow For Temporary Residency in a Trailer
THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 2008-021 BEING A BY-LAW TO AUTHORIZE THE EXECUTION OF AN AGREEMENT BETWEEN THE TOWNSHIP OF ORO-MEDONTE AND CORD RANKIN TO ALLOW FOR TEMPORARY RESIDENCY IN A TRAILER WHEREAS the Municipal Act, 2o0~,S.Q. 20x9, c.25, Section 224, as amended, states that it is the role of Council to ensure that administrative practices and procedures are in place to implement the decisions of Cauncil; AND WHEREAS the Council of The Corporation of the Township of Oro-Medonte deems it desirable to enter into an agreement, effective June 22, 2007, fora 12 month period, with Gord Rankin to temporarily reside in a trailer at East Part of fat 13, Concession 10 {Medonte), Township of Ora-Medonte, 3750 Line 10 North. NOW THEREFORE the Cauncil of the Township of C}ra-Medonte hereby enacts as follows: THAT the Mayor and Clerk be authorized to execute the Agreement attached hereto as Schedule "A" and forming part of this By-Law. 2. THAT this by-law shall take effect an the final passing thereof. BY-LAW READ A FIRST AND SECOND TIME THIS 13T" DAY OF FEBRUARY, 2008. D©ugJEas Irwin Schedule "A" AGREEMENTIAFFIDAVIT To By-Law No. 2008-021 S In consideration of receiving a building permit from the Township of Ora-Medonte, I, Gordon Rankin, of the Township of Oro-Medonte (formerly Township of Medonte) in the County of Simcoe, covenant and agree as follows: 1. That I am the registered owner of Con 10 pt lot 13 being more particularly described as 350 Line 10 North C1ro-Medonte. 2. That I have applied. to the Council. of the Corporation of t11e Township of Qro-Medonte for permission to temporarily reside in two trailers on the abo~ e-mentionc~l }ands, at~lte same time as a new dwe}ling is under construction on those sane lands, ti~eherei n such procedure }s not provided for under the provisions of t11e Tawnsl~ip of C?r~~-~1ed<~nte's Zoning By-law as amended. 3. That I hereby acknowledge that permission ltas been ~i~~en b~~ the Council of t1~e Corporation of the Township of C}ro-Medonte subject t~~ the f«llowing pr~~~~sic~ns: a} That such permission is granted for the t~,°e1~-r~ month peri<,d from permit issuance or until oompletin~~ cif tine pr<~i~~~sed ne~~~ d~cellin~;, whichever is t11e lesser period of time; and.. b) That on completion of the new dS~~elting, as evidenced by a T'rrn~isic~nat tJccupancy Certificate, tl~e existing trailer is tabe removed ~cithin oi,te month to the satisfaction of the Ta~~enshih's Chief Uuildin~ Official; and. c} That application to the Township of Qra-~ie~lc~ntefar a tenl}~~~rar~~ use permit will be made forth w i t I ~ (Fr= e X100.041'}. 4. That I hereby agree to the terms and conditions set out above. 5. It is understood that failure to comply with the terms anal conditions as set ouf herein, shall release and save harmless the Corporation of the To~ti°ns11iE, c,f C~rc~-IL~fedonte Erom pursuingsuch litigation, as maybe necessary to seciu-e a~mpliance or conformity ti~-ith any applicable hTunicipal By-law or provincial Regulation as may be }~ro~°idcd for. 6.
