The applicant is proposing to convey a block of land having an area of 298.4 square metres (3212 square feet) to the adjacent property to the north, being 19 Hemlock Crescent. No new building lots are proposed to be created as a result of the lot addition. MUNICIPAL POLICY, ZONING AND PREVIOUS APPROVALS Official Plan Designation — Rural Residential Zoning By -law 97 -95 — Rural Residential One (RURl) Zone Previous Applications — AGENCY COMMENTS County of Simcoe - No objection Public Works Department — No concerns Building Department — No concerns Engineering Department - No concerns BACKGROUND The applicant is proposing a boundary adjustment to add approximately 0.029 hectares from the subject property, being Lot 9 of Plan 51M -807, 21 Hemlock Crescent, to the neighbouring residential lot to the north, being Lot 8 of Plan 51M -807, 19 Hemlock Crescent. Both the subject lands and lands to be enhanced contain single detached dwellings. It is staffs understanding that the portion of lands to be conveyed from 21 to 19 Hemlock, while being contained within the property boundary of 21 Hemlock, has in fact been maintained and used by the residents of 19 Hemlock. As such, the residents of 19 Hemlock have approached the applicant to have the lands conveyed into their land holding. No new building lots are proposed to be created as a result of the boundary adjustment. OFFICIAL PLAN The subject lands are designated Rural Residential by the Township of Oro - Medonte, Official Plan (OP). However, policies with respect to the subdivision of land are contained in Section D2 of the OP. Specifically, Section D2.2.2 - `Boundary Adjustments ", provides the following guidance: "a consent may be permitted for the purpose of modifiing lot boundaries, provided no new building lot is created... With respect to the application at hand, no new building lots are proposed. The County of Simcoe Planning Department has also indicated "no objection" to the boundary adjustment as proposed. Therefore, the application for boundary adjustment is deemed to conform to the Official Plan. , ZONING BY -LAW Both the subject property and lot to be enhanced are zoned Rural Residential One (RUR1) Zone. The minim lot area required for a residential use in this Zone is 0.4 hectares, and the minimum required lot frontage is 45 metres. Currently, 21 Hemlock consists of 0.44 hectares, while 19 Hemlock consists of 0.7 hectares. As a result of this application, 298.4 square metres of land is proposed to be conveyed from 21 Hemlock to 19 Hemlock. The conveyance would result in 21 Hemlock retaining a lot size of 0.41 hectares, while 19 Hemlock would increase in area slightly to 0.73 hectares. The frontage of both properties will not be affected by this application, nor will setbacks to the existing single detached dwellings on both lots. Therefore, the application would comply with the provisions as prescribed by the Zoning By -law. CONCLUSION While this application proposes to modify property boundaries that will result in both the retained and enhanced lands having irregular lot line configurations, it should be noted that the majority of lots on Hemlock Crescent are in fact irregular in shape. Given that the parcel of land to be conveyed is relatively small and that the nature of the application is minor, staff is of that opinion that the proposed conveyance will not detract from the overall character of the lot fabric in the area, particularly considering that the lot fabric on Hemlock Crescent does not have the consistency of a "typical' plan of subdivision. In addition, the proposed consent application otherwise conforms to the policies of the Official Plan, and complies with the lot area and use provisions of the Zoning By -law. RECOMMENDA'T'ION It is recommended that the Committee grant Provisional Consent to Application 2008 -B -01. being to convey a strip of land from 21 Hemlock Crescent to 19 Hemlock Crescent, having an area of 0.029 hectares, subject to the following conditions: 1 I 1. That three copies of a Reference Plan for the subject land indicating the severed parcel be prepared by an Ontario Land Surveyor be submitted to the Secretary - Treasurer; 2. That the applicant's solicitor prepare and submit a copy of the proposed conveyance for the parcel severed, for review by the Municipality; 3. That the severed lands be merged in title with Plan 51M -807, Lot 8, known municipally as 19 Hemlock Crescent, and that the provisions of Subsection 3 or 5 of Section 50 of The Planning Act apply to any subsequent conveyance or transaction involving the subject lands; 4. That the applicants solicitor provide an undertaking that the severed lands and the lands to be enhanced will merge in title; 5. That all municipal taxes be paid to the Township of Oro - Medonte; 6. That the conditions of consent imposed by the Committee be fulfilled within one year from the date of the giving of the Notice of Decision.
