2002-094 To convey Parts of O'Brien Street, being Parts 1 and 2, Plan 51R30184, and Parts 3, 4 and 5, Plan 51R-28368, being Part of PIN#58554-0051(Lt) e e e e ~ THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 2002-094 A By-law to convey Parts of O'Brien Street, being Parts 1 and 2, Plan 51R- 30184, and Parts 3, 4 and 5, Plan 51R-28368, being Part of PIN#58554- 0051(Lt), (geographic Township of Oro) Township of Oro-Medonte, County of Simcoe. WHEREAS pursuant to Section 297 of the Municipal Act, R.S.O. 1990, c.MA5, as amended, Council is empowered to stop up and close any part of a highway; AND WHEREAS pursuant to Section 315 of the Municipal Act, R.5.0. 1990, c.MA5, as amended, Council is empowered to sell any part of a highway which is legally stopped up and closed; AND WHEREAS Part of O'Brien Street, more particularly described as Parts 1 and 2, Plan 51R-30184, and Parts 3, 4 and 5, Plan 51R-28368, (geographic Township of Oro), Township of Oro-Medonte, County of Simcoe, more particularly described in Schedule "A" attached hereto and forming part of this By-law, has been stopped up and closed by By-law 2000-84, passed by the Township of Oro-Medonte on October 18, 2000; AND WHEREAS the Municipal Act, R.5.0. 1990, c.MA5, sections 191 and 193, as amended, authorize a Council of a municipality to dispose of surplus real property in accordance with the provisions of a by-law passed by the Council, establishing procedures governing the sale of such property; AND WHEREAS Council passed By-law No. 1996-35 on the 17th day of April, 1996, being a By-law to establish procedures to provide for the disposal of real property within the Township of Oro-Medonte, pursuant to Section 193(2) of the Municipal Act, R.5.0. 1990, c.MA5, as amended; AND WHEREAS Council has determined that the said road is not required for municipal purposes, and has by resolution declared parts of O'Brien Street, more particularly described as Parts 1 and 2, Plan 51R-30184, and Parts 3, 4 and 5, Plan 51R- 28368, (geographic Township of Oro), Township of Oro-Medonte, County of Simcoe, more particularly described in Schedule "A" attached hereto and forming part of this By- law, to be surplus to the municipality; NOW THEREFORE the Council of the Township of Oro-Medonte hereby enacts as follows: 1. Authorization of Sale - Council does hereby authorize the sale of Part of O'Brien Street, more particularly described as Parts 1 and 2, Plan 51R-30184, and Parts 3, 4 and 5, Plan 51R-28368, (geographic Township of Oro), Township of Oro-Medonte, County of Simcoe, more particularly described in Schedule "B" attached hereto and forming part of this By-law, to the registered owner from time to time of the abutting lands described as Lots, 7, 8 and 9, Plan 1561, and Parts 7 and 14, 51R- 28161, more particularly described in Schedule "B" attached hereto and forming part of this By-law. 2. Sale Price - In accordance with Section 315 of the said Municipal Act, Council hereby sets the sale price for Parts 1 and 2, Plan 51R-30184, and Parts 3, 4 and 5, Plan 51R-28368, (geographic Township of Oro), Township of Oro-Medonte, County of Simcoe, more particularly described in Schedule "B" attached hereto and forming part of this By-law, at a consideration of amounts as set out in Schedule "B" attached hereto and forming part of this By-law. 41 e e e 3.
