I have been retained by Ms. Andria Leigh, of MHBC Planning, to provide an arborist consulting report concerning the above subject site. The purpose of this report is to determine the number of trees that are directly involved with two proposed roadway locations and subsequently assess the impact each location will have on such trees. History and Definition of Assignment: I have been advised by Ms. Leigh, that the above subject site is subject to an application for development, which includes the construction of a new proposed 7.0 metre wide roadway within either Assessment Area #1 (Bay Street) or Assessment Area #2, as per attached aerial photo in Appendix A. My assignment is as follows: 1. Survey all trees 20 -cm or greater in diameter within proposed 7.Om wide road located in Tree Assessment Area #1 and #2, determine species, DBH, and condition. 2. The areas surrounding the proposed roadway primarily consist of sugar maples with similar species composition and are in fair -good condition. This area consists of a mixture of white ash (24 %), eastern white cedar (15%), $tilgar maple (1511/o), tirch (13 %) and white spruce (12 %) with Scots pine, American beech, basswood and eastern hemlock (21 %) scattered throughout. Seventy (70 %) percent of the trees in this area are 40em or less in diameter with forty- three (43) trees larger then 40cm. All surveyed trees are healthy, in fair -good condition and are growing in a wooded area that has been previously disturbed t tract an existing interior dirt driveway traversing along the entire length of th ite see site plan survey in Appendix B for details. Approximately 60 -7 o of the trees s rveyed are located along the outer perimeter of the assessed area and are well clear of the existing 3. With the above in mind, it is my professional opinion that the proposed roadway should be constructed within Assessment Area #2 for the following reasons: A. This area requires fewer trees to be removed. B. The area contains an existing dirt driveway and has been predisposed to construction disturbance and is not considered a natural wooded area like Assessment Area # 1. C. Significant trees are located along the perimeter of the site and are clear of the existing dirt driveway and are less apt to be disturbed. I trust this report meets your needs. We understand that a letter proposing a collaborative solution to matters related to that application has been submitted to the Township, jointly signed by Mr. McCowan, Ms. Sarjeant, Dr. Boehlau, and Ms. Nixon on behalf of the Bay Street neighbours. Since that letter proposes a transfer of a strip of lands to The Couchiching Conservancy in order to link the western end of The Church Woods to Ridge Road, we are writing to confirm that we are aware of this proposal and are in agreement in principle with its intent. In our view, the parties involved in this matter have created a workable compromise which satisfies multiple objectives, and which deserves municipal support. If the Committee of Adjustment and Council chooses to endorse this proposed outcome, the Conservancy would be happy to enter into discussions with the Township about the process necessary to implement our part of the recommended package. Sincerely, Ron Reid Executive Director Cc: Jane Ball, President DEPUTATION TO: THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ORO- MEDONTE RE: 2243 Ridge Road West, Shanty Bay - Ron McCowan Committee of Adjustment Application No. 2007 -B -17 DATE: November 28, 2007 at 7 p.m. Your Worship, Mayor Hughes, members of Council and staff, This evening Council is faced with making a decision that will affect the quality of life in the Village of Shanty Bay for the next several generations. The decisions you make tonight will be planning decisions that we hope you will make in the context of the Official Plan of the Township and in the context of the wishes of those Township residents who will be most affected. The Committee of Adjustment has made a decision to consent to the creation of a new lot for Mr. McCowan. The Committee's decision is conditional upon Council deciding upon access to the new lots. Here is the background to this decision: Mr. Mc Cowan owns a piece of property in the Village of Shanty Bay [shown on the screen here]. He would like to sever it into two lots. I would like to point out the location of Mr. McCowan's property in relation to the rest of the Village of Shanty Bay: You can see from the map [shown here] that the Village is rural in character. It is blessed with tree lined streets and roads, a Village Green and an historic church. The Rail Trail passes along the northerly part of the Village and the villagers recently worked together to create a new park by the rail trail for the enjoyment of people using the rail trail, Brewis Park [shown here]. The Church Woods, the jewel of our community, is a 25 acre parcel of old growth forest [shown here]. As you know, the entire Village of Shanty Bay and many other residents of Oro - Medonte, including the Township itself, participated in the unprecedented project of raising nearly three quarters of a million Dollars to purchase the Church Woods and to save the trees in the Woods just this year. The piece of property owned by the Township adjacent to the Church Woods is a continuation of the same woods. The trees on these lands are the same as in the Church Woods — mature maples, walnuts, butternuts and conifers. MBDOCS_3750996.1 By this community project of raising money to purchase the Church Woods, you can see the commitment of the people of the Village to preserving the rural character of the Village. The people who participated in this project have a vision: We want to preserve and protect the health of Lake Simcoe; We want to preserve and protect the environment; We want to preserve and protect habitat for wildlife and birds. We want to protect from incompatible development significant woodlands and wildlife habitat areas. We would like to see less development and more walking trails. We have a vision that one day we will have a walking trail connecting the entire village, through the village green, through the Church Woods to the rail trail. [through the route shown here on this slide]. This is a walking trail that would benefit not just the Village, but also the people of the Township who use the Rail Trail. Our vision is the same as that stated in the Township's Official Plan: "According to the people of Oro Medonte, the excellent quality of life is what makes the Township a desirable place to live. This quality of life is created, in large part, by the rural character of the community, the open countryside, farmland, extensive wooded areas.... " (Official Plan, Page 4) One of the strategic objectives set out in the Official Plan is: "To protect from incompatible development significant woodlands and wildlife habitat areas and the ecological functions they provide" (Official Plan, Section A2.1.2.(f)). The Parkland Secondary Study (May 2002) indicates that residents of the Township want more walking trails and more trails linked to one another. Mr. McCowan has applied for a severance of his property. To qualify for a severance, Mr. McCowan's property must front on and be accessed by a public road that is maintained on a year round basis by the Township or the County. (Official Plan Section D2.2.1). Mr. McCowan's property does not currently front onto a public road. His property is accessed by a private laneway, a right of way that crosses private property from the Ridge Road. [entrance shown on slide]. Access to the neighbour's property, Ms. Sarjeant, is also by the same laneway right of way over the property to the north. This right of way is provided by written agreement that can be terminated on nine months' notice. Ms. Sarjeant and Dr. Boehlau jointly own a laneway that runs along the northern boundary of Mr. McCowan's property up to the parcel of land owned by the Township that would be the extension of Bay Street. Ms. Sarjeant has received a commitment from Township Council some years ago, agreeing to grant her access to Ridge Road from the end of this laneway. A proposal has been made by Township Planning Department to accommodate Mr. McCowan's severance requirements. This proposal would involve the construction of a road, an extension of Bay Street, up to municipal standards from the current westerly end of Bay Street [to here], together with a turning circle [here]. MBDOCS_3750996.1 2 We do not think that this proposed access will serve the interests of many parties. Here are a few reasons why: 1. the Township must extend services all the way from here to here [shown on the map] for only these two lots, forever. 2. There will have to be construction of a road close to Lake Simcoe, resulting in runoff and drainage issues for the Lake 3. The building of a road here will involve destruction of wildlife habitat right next to the Church Woods. 4. We have been advised by Township staff that according to an arborist's report, such road construction would involve the destruction of many mature trees 5. Bay Street in Shanty Bay is not a through road. It ends here [as shown on this slide] Bay Street is a quiet, rural street. The residents of Bay Street would very much like to keep it that way. The extension of Bay Street in the short term will serve only two lots (Mr. McCowan's severed and retained lots). We admit that this will not result in much of an increase in traffic on Bay Street. But it does mean the following: There is a risk that in the future, the owners of the lots to the west of Mr. McCowan (Ms. Sarjeant and Dr. Boehlau), or their successors, will want to have their laneway opened to the Ridge Road. At that point, it would be only too easy to simply open Bay Street all the way to the Ridge Road. This is what the residents of Shanty Bay and in particular, the residents of Bay Street do not want. They are of the view that to open up Bay Street to the Ridge Road would destroy the rural character of their street and the entire village forever. When this proposal to extend Bay Street was made at the initial hearing of the Committee of Adjustment in June, we objected. The Committee deferred its decision and asked us to work out an access proposal that would benefit all parties. We are a group of neighbours. We want to get along with our neighbours. We decided that we would not simply oppose the severance, although we respectfully submit that we had many good arguments against the severance. Instead, we decided try to find an alternative access. We worked proactively and very hard with Mr. McCowan's planner and our neighbours and with Township staff to try to come to an agreement on access to the new lots that would serve all parties and meet several other objectives. Here are our objectives: 1. To enable Mr. McCowan to have access to a public road from his lot and severed lot. 2. To enable Mr. McCowan's neighbours, Mary Jane Sarjeant and Dr. Boehlau to have legal access to the Ridge Road. MBDOCS_3750996.1 3. To prevent the creation of a through road from the west end of Bay Street to the Ridge Road. 4. To persuade Township Council to donate surplus land to the Couchiching Conservancy for a walking trail connecting the Church Woods to the Ridge Road. 5. To set up a walking trail from the west end of Bay Street to the Ridge Road. 6. To minimize the tree cutting required for access and minimize road construction runoff to Lake Simcoe. 7. To preserve and protect the environment wherever possible and to preserve and protect wildlife habitat and the health of the watershed and Lake Simcoe wherever possible. 8. And finally, but we think quite importantly, to minimize the costs to the Township for services such as maintenance, snow ploughing, garbage collection etc. We met at the site with the interested parties; we met with Township staff both on the site and at the Township offices. Finally, at the end of this summer, we settled upon a plan set out in a letter addressed to Council. A copy of this letter, dated August 31, 2007, is included in your materials. This letter was signed by Dr. Boehlau, Ms. Sarjeant, Mr. McCowan and Catherine Nixon on behalf of the neighbours, on the basis that we would support and not object to the application for consent to sever as long as certain arrangements were made for access as set out in the letter. These proposed access arrangements are as follows: That the westerly half of the property owned by the Township from the Ridge Road, south to approximately the north east corner of the McCowan property be conveyed from the Township to the joint ownership of Mr. McCowan's property (both the retained and the severed lots), Ms. Sarjeant and Dr. Boehlau. We asked Council to approve the conveyance of the balance of the lands to the Couchiching Conservancy for purposes of a walking trail. This proposed access route meets with our objectives as follows: 1. Mr. McGowan will have access to a public road (i.e. Ridge Road) from his lot and severed lot. (He will need a minor variance to approve this). 2. Mr. McCowan's neighbours, Mary Jane Sarjeant and Dr. Boehlau will have legal access to the Ridge Road. 3. This plan will make the creation of a through road from the west end of Bay Street to the Ridge Road unnecessary. 4. This plan will leave surplus land for Township Council to donate to the Couchiching Conservancy for a walking trail. 6. This plan will minimize the tree cutting required for access and minimize road construction runoff to Lake Simcoe; no turning circle will be required. We would prefer to leave all the trees intact, but that is not feasible in any plan that we have been able to arrange. 7. Finally, this plan will involve zero costs to the Township for services such as maintenance, snow ploughing, garbage collection etc. By this plan, everyone gains something, but the Township does not have to pay for it. Is this good planning? We think so. Does it satisfy the objectives of the Official Plan? We think so. Does it satisfy the residents of the Township and those most affected ? Yes; we are here tonight to confirm that it does. MBDOCS_3750996.1 4 In fact, we have a letter from the Couchiching Conservancy, supporting this proposal [circulate letter]. As well, we have a petition signed by 57 residents opposing the extension of Bay Street, but supporting the northerly Ridge Road access. This petition is included in Council's materials. Our support for the severance is conditional upon this access plan being adopted by Council. There is one other option that has been proposed. That is to construct a new municipal road south from the Ridge Road to Mr. McCowan's new lot with a turning circle. This would be a longer, Township road, not a private laneway. [This option is shown on the slide here]. We are concerned that the construction of a Township road on this route will result in a municipal road similar to the one recently constructed and shown on the slide [here]. This road would be significantly longer and wider than the laneway proposed in our letter to Council and will result in the destruction of more trees, more road construction and consequent runoff into Lake Simcoe as well as much more destruction of habitat. Our letter to Council does not contemplate such a municipal or township road on this route. We also point out that this proposal would set a precedent: the Township would be extending full municipal services down this route to accommodate Mr. McCowan's severance. We doubt that the taxpayers of Oro - Medonte would approve of the expenditure of Township resources to service these lots when for the last 100 years, these same lots have used a shared driveway and arranged for their own snow ploughing and maintenance. At the very least, if Council is to consider such a municipal road south from the Ridge Road, we would request that consideration be given to snaking the road as narrow as possible, to minimize tree loss. We would also request Council to consider locating the proposed turning circle on Mr. McCowan's property, which has no trees (as they have been cut down) rather than on Township property (which is heavily forested with mature walnut and other species of trees in the location of the proposed turning circle). I would now like to turn to the issue of the Arborist's Report, prepared by Mr. David Carnivale of the Tree Specialists, Inc. dated October 26, 2007. We are advised by Township staff in their Planning Report dated November 15, 2007 that the arborist's report concludes that the northerly route of the proposed road, from the Ridge Road would involve the destruction of 72 trees, whereas the southerly route, from Bay Street, would involve the destruction of 30 to 35 trees. This caused us a great deal of consternation. As you know, our group is dedicated to preserving trees. We were concerned to be advocating a route that would involve the destruction of many more trees than the other route. Actually, on close reading, the Arborist's Report [circulate highlighted copies to Council] contains some interesting information, but also some assumptions that would cast doubt upon the conclusions reached. • the chart on page 2 indicates that in Assessment Area 1 (this is the northerly route, running south from the Ridge Road) there are 72 trees and 5 different species of trees. • the chart for Assessment Area 2 (this is the southerly route, the extension of Bay Street) indicates that there are 143 trees and 9 different species of trees. We do not see walnuts listed in the species list. We wonder why not, as we have seen walnut trees in this area. In fact, I have been advised that in the area of the proposed turning circle there is a group of walnuts described as "the finest stand of walnuts within a hundred miles ". MBDOCS_3750996.1 Here is why the walnuts are not listed: you will note on 3 of the report that Mr. Carnivale has made an incorrect assumption. He states: "In the event that the proposed roadway is constructed in the same location as the existing dirt driveway, approximately 30 to 35 trees would require removal to facilitate construction." In actual fact, the arborist has not counted the trees that would be destroyed by constructing the roadway and the turning circle. I spoke to the arborist, Mr. Carnivale, last night and he confirmed that he counted only those trees in the area from the west end of Bay Street to the east boundary of Mr. McCowan's property. In that area alone, he found 143 trees and 9 different species. But he did not count the trees in the proposed turning circle. He did not know that there was to be a turning circle. I submit that a great many more trees would have to be cut down for the southerly route than stated and also that there would be a greater number of species, including the stately walnuts, than stated in Mr. Carnivale's report. • I note that the arborist sets out on page 2 of his report that in Assessment Area 1 (the northerly route from Ridge Road), by far the most prevalent species is the Acer saccarum (sugar maple). These sugar maples comprise 75 % of the species in this area. Mr. Carnivale states: "The existing grade is generally even throughout and sugar maples are hardy, native trees that are tolerant to disturbance ". We submit that this is a good argument for locating the road in the northerly location: the species here are "tolerant to disturbance" and the existing grade is generally even throughout, rather than in the southerly area, where sugar maples comprise only 14 % of the species located there. • The arborist's report does not mention the stream that runs just south of the proposed southerly road. This stream runs directly into Lake Simcoe. *When I spoke to the arborist, I asked him where exactly he had done the tree assessment in Area 1. The map attached to his plan shows that the Assessment Area 1 covers the entire 66 foot width of the Township property. He confirmed that he counted the trees between survey stakes he found on the ground. I asked him whether the survey stakes were 66 feet apart, or 33 feet apart or 20 feet apart. He did not know. He did not measure the area. He simply counted the trees between the stakes and concluded they would all have to go. We are confused as to how it is possible in the southerly area to conclude that only 35 of 143 trees have to be cut down, whereas in the northerly area all 72 of 72 trees have to be cut down. • I invited Mr. Carnivale to attend tonight's meeting to discuss his findings in his report, but he declined. I respectfully submit that the Arborist's Report reaches conclusions with respect to numbers of trees and species of trees that should be questioned as it appears to be based upon incorrect assumptions and missing information. It should not be relied upon in making a decision between the northerly route or the southerly route for the proposed roadway. I submit that it would support the proposition that we should build a "laneway" rather than a municipal road in the northerly assessment area (from Ridge Road), as such a laneway would be much shorter and narrower than a municipal road would need to be. MBDOCS_3750996.1 6 In conclusion, we sincerely hope that members of council will decide that the access route proposed in our letter that has been agreed upon by the people most affected is the preferable route. We hope that Council will look upon this as an opportunity to make a planning decision that will have beneficial consequences to the Village for years to come. We hope that Council will also agree to donate its surplus lands to the Couchiching Conservancy to connect the Church Woods to the Rail Trail. Council has an opportunity do something good for the environment, to make a decision that will protect the environment of Oro - Medonte, will protect the Lake Simcoe watershed, will protect the Church Woods, will honour the stated objectives of the Official Plan and will engender good will among the residents of the Township. September 6ffi, the Barrie Public Library Board Planning Committee met with the City Planning Office to discuss the south end satellite library. 2. September 11`x, the CEO attended the special Development Charge explanation meeting delivered by the City Treasurer and consultant, Connie Kilgour, to local Barrie developers. In keeping with legislative requirements, 4 meetings will be held with developers and another three with the Barrie community to discuss charges prior to Council's approving a new by -law for 2008. 3. September 19th, the CEO was invited to participate on the Barrie Social Action Committee (formerly the Barrie Downtown Stakeholders Action Team). The purpose of the committee is to bring visibility to underlying development issues downtown. Social issues were identified as high priority this year. Formerly a committee established by the mayor (Rob Hamilton), it is now a Business Improvement Association (BIA) committee. 4. September 21St, the Library held an all staff meeting that included a presentation from Simcoe Community Services on individuals with special needs. 5. Ann Andrusyszyn, Development Officer, attended Phase 11 training with ESAO as management representative on the Library's Health and Safety Committee. Attendance is a legislative requirement. 6. Ann also conducted a special tour for library staff members of the Administrators of Urban -Rural Libraries of Ontario (ARUPLO). 7. Lori Penrice, Library Assistant II in the Circulation Department, resigned effective September 28tH 8. Joanne Comper has agreed to serve on one of the Canadian Association of Public Libraries' (CAPE) committees to either select the annual Brodart Outstanding Public Librarian award or nominate new CAPL officers. 10. Shonna Froebel, Manager Adult Information Services, and Jane Salmon, Manager Children's and Youth Services, participated in an electronic audio conference called "Setting up the New Stuff: Planning and Implementing Library 2.0." 2. 388 donations were added to the collection in September. 3. Anne Dorsey, Business Librarian, created information and links on the Library's cl Webpage providing information on the referendum and the Ontario electoral system. 4. Anne also participated in the Go Venture program by providing market analysis. Ann also assisted the Greater Barrie Business Enterprise Centre by providing assistance in preparing a business plan and market analysis for a new business venture being undertaken by one their clients. 5. Elizabeth Bufton created two very popular book displays in September called "Fiction for the Non - fiction Reader" and "Non- fiction for the Fiction Reader." 6. Patricia Roebuck created a display on adult literacy materials in September. 7. Information Barrie distributed 1963 brochures in September including those as part of Newcomer Information packages. 8. Janet Graham and Elizabeth Bufton provided materials for 7 Nursing and Retirement Homes in September. 9. Anne Dorsey attended a Women in Networking Growing Strong (WINGS) photo session September 10th. The photo and profile will be included in their 2008 Directory. 10. Anne also conducted a tour for the Self Employment Assistance (SEA) organization September 17th 11. Anne made a presentation to the Go Venture program September 18th 12. Anne attended the Chamber of Commerce Business After 5 event September 19th, the WINGS breakfast September 26th and the SEA -to -Sea annual trade show at the Business Enterprise Resource Network September 26th 13. On September 27`h, Anne set up a display at the Mr. Bob Trade Show. 14. Janet Graham initiated and hosted a brainstorming /idea sharing meeting for area libraries who offer programs for seniors. Orillia, Innisfil, Clearview, Gravenhurst, Penetanguishene, Huntsville and Newmarket participated. 15. Janet Graham also provided a book review and list of upcoming events for the Focus 50+ senior's newspaper in September. 16. Patricia Roebuck was contacted by the Royal Victoria Hospital to receive a DVD in French on pediatric surgery. The Hospital recognized that the one provided in English was very popular with parents. 17. Patricia Roebuck continues to be the contact person for the new Community Literacy Collection working with community partners to integrate these collections with the Library. Donna Vaillancourt from the French cultural centre, La Cle d'la Baie is very pleased with the success the Library has experienced in integrating the AlphaPlus material provided to the Library. 18. Shonna Froebel, Manager Adult Information Services, attended a meeting of the Ontario Library Association's (OLA) Readers' Advisory Committee on September 7th 19. In September, Adult Information Services delivered 18 programs including computer workshops, tours, book clubs and community events to a total of 144 people. 20. Anne Dorsey provided press releases and flyers to register participants for the Workplace Health and Safety program to be held October 15`h at the Library. 21. Robyn Zuck, Laurie Wright and Shonna Froebel participated in a teleconference call to discuss the Library's role with "OurOntario." OurOntario provides guidelines, software, storage and assistance to libraries for local history materials and customized library branding. Barrie's collection will be called the "Barrie Public Library Digital Collection." MEN 22. Robyn Zuck, as a member of the Ask Ontario Training Task Force, participated in a teleconference to determine how the project will work and the timelines involved. t VI Children and Youth Services 1. A large donation of children's videos was received by the Library. While the Library is phasing this format out in favor of DVDs, many of the titles are still popular and were added to the existing collection. 2. 12 Storytime Kits were circulated in September. 3. Debra Smith completed a bibliography on "Teen Humour" to use with the Teen Read Week display, LOL@Your Library. Debra also completed a bibliography of "Mystery Fiction for Teens" for the Teen Book Club "Mystery Night." 4. Children's staff experienced many requests for information to support those teachers preparing lessons for classes in September. Some of these included different cultural versions of the Cinderella fairy tale, 1867 pioneer life, early Canadian history for grade 3 and material on families. 5. September 7`h, Debra Smith provided a tour focusing on Ready Reference for young adults and children for a group of grade 8 students from Hillcrest Public School. 6. Ruby Meijers assisted Anne Dorsey by representing the Library at the Welcome Wagon Wedding Show September 12th. Many people attending were surprised that the library provided such information and asked "How do I get a library card?" 7. September 12`h, SEEDS Daycare visited the library for a tour. 8. Sunday, September 16`h, Jane Salmon promoted the library at the Road to Reading Festival. Approximately 332 people visited the Library tent and Jane talked to many parents about library programs. 9. September 25th, Brenda Jarvis presented the Library's first of the fall session of "Library on the Loose" at Zehrs. 62 people attended the 9:30 am storytime and 64 attended the 10:30 am program. 12. September 26th, Nancy Woods provided a tour for 24 parents and children from a local playgroup. 13. September 27`h, Debra Smith and Nancy Woods provided tours for 88 grade 8 students from Ferndale Woods Public School focusing on both print and online resources. 14. September 27th, Jane Salmon presented a library display to Good Shepherd Catholic School at the school's parent Open House night. Jane spoke to approximately 50 parents. 15. Cindy Pomeroy-White sent thank you letters to all the businesses who donated to the Teen Advisory Board's (TAB) "Survivor" summer program. Cindy also reconnected with Pizza Hut for future pizza donations for TAB meetings. 16. The first TAB meeting for the fall was held with 3 new members to replace the 3 members leaving. Work has started on Teen Read Week. All future teen programs will include promotion on Facebook. 17. Nancy Woods and Alison Brurnwell are preparing the "Who Read That" contest for October. 18. Jane Salmon participated in a teleconference call September 25th as part of her new responsibilities as a member of the Ontario Public Library Association (OPLA) Children's and Youth Services Committee. The committee is currently working on revising the Rights of the Child in the Public Library. i 19. September 26`h, Jane Salmon attended a meeting of the Simcoe County Best Start Committee to describe the Library's Every Child Ready to Read initiative. Jane has since y received an invitation from the YMCA Vice President of Children's Services to present information about this initiative to parents of YMCA programs. 20. In September, the Library provided 20 programs including storytimes, tours, community visits and Teen programs with 1,040 people in attendance. 21. Joanne Comper, Manager Circulation Services, participated in a conference call as part of the planning committee for the SirsiDynix User Group (OHDUG). The call was to prepare for the October 17`h meeting in Brantford and Joanne has volunteered to chair the Public Library discussion group at the meeting. 2. Lori Penrice assisted Ann Andrusyszyn with the ARUPLO tour by answering all the members' questions about Circulation. IV TECHNICAL SERVICES 1. Dunja Conroy, Manager Technical Services, continues to monitor the proposed development and migration timelines for SirsiDynix's new computer library software. 2. Laurie Wright continued to work on the Library's Web during September updating the Dragon Boat Site as well as the Library's site and Kids Zone page. 3. Laurie is working with the City's IT department to look at a new network design to resolve some of the issues in connecting all our stations with the City. 4. Laurie started work in September on creating e- newsletter templates to support staff program needs. 5. Laure was required to spend additional time working on the Children's CD -ROM stations in September to repair existing stations and install new French CD -ROM products and configure the system to support these programs. r t V COiVLNIUNITY DEVELOPMENT 1. The Dragon Boat Committee held a wrap -up meeting to discuss improvements for the 2008 Festival. 2. Ann Andrusyszyn, Development Officer, sent handwritten thank you cards to all the volunteers and sponsors involved with the Dragon Boat Festival with some additional writing help from the Board Chair. 3. Ann has been contacted by the Sudbury Dragon Boat Festival in order to share information and explore a joint marketing strategy. 4. Ann attended the monthly Executive meeting of the Planned Giving Counsel in September and participated in a "Meet and Greet" opening event. 5. The Barrie Folk Society held another Unplugged Saturday Night September 8th with approximately 58 people in the audience. 6. Ann attended the monthly meeting of the working Board of the Barrie Community Foundation. 7. Ann also provided two columns for the October issue of Barrie Life and Times and another column for North Simcoe County News. As well, the Library's fall newsletter was published. 8. Ann attended the Association of Fundraising Professional's (AFP) conference on "Writing Tight" for online grant proposals. VI VOLUNTEER PROGRAM 1. Julie provided two volunteers to help with activities at the Road to Reading Festival as well as hired and trained new volunteers. The City has determined that a roofing repair over the Georgian Room is required and work will start work in October. 2. A date to replace the carpeting in the meeting rooms and high traffic areas has not been decided by the City. 3. Work on the Library's pigeon deterrent system has been completed. At the Committee of Adjustment hearing of lune 21, 2007, Committee adopted the following resolution: "Be it resolved that... Committee defer Application 2007-,B- 17 until such time that the applicant provides further information with respect to environmental and drainage concerns, and until such time that comments are received from the Lake Simcoe Region Conservation Authority with respect to the proposed severance". The applicant has subsequently submitted materials with the intent of addressing the above concerns of Committee. MUNICIPAL POLICY, ZONING AND PREVIOUS APPROVALS Official Plan Designation — Rural, Rural Settlement Area Zoning By-law 97-95 — Residential Limited Service - Hold (RLS[H]) Zone Previous Applications — AGENCY COMMENTS Lake Simcoe Region Conservation Authority — No objection to severance Simcoe County — No objection to severance Public Works — Road has to be brought up to Township Standards by property owner Building Department — Applicant to verify that sewage system meets minimum required setbacks as per Part 8 of the Ontario Building Code Engineering & Environmental Services — No Concerns Fire Department — No Concerns BACKGROUND The subject property is located in Shanty Bay, and has two vehicular access points, one being directly from Ridge Road West via a lengthy driveway that runs over private property to the north, and a secondary driveway through a laneway that follows the unopened portion of the Municipally-owned Bay Street road allowance to the east. it is staff's understanding that the lengthy driveway has been historically used to access the applicant's dwelling. This driveway is shared with two other dwellings located west of the subject land, fronting on Lake Simcoe. As outlined in the staff report dated June 21, 2007, the Planning Department recommended appmval of the consent based on, but not limited to, a condition that Bay Street be extended from its existing terminus to effectively create frontage on a municipal road for the severed and retained lots. Since the June 21, 2007 deferral by Committee, the Township has received numerous letters of concern with respect, to the potential for loss of trees that may occur if Bay Street is extended; the agent for the applicant has met with residents and Township staff with the intent of working toward a favourable solution with respect to access for both the proposed retained and severed lands. The applicant has subsequently submitted a "Tree Survey and Impact Assessment Report ", the findings of which are discussed below. With respect to the reasons for deferral, namely "environmental and drainage concerns... and... that comments are received from the Lake Simcoe Region Conservation Authority with respect to the proposed severance ", the Township is in receipt of the following correspondence from the Lake Simeoe Region Conservation Authority: • LSRCA to Adam Kozlowski, Dated June 15, 2007 —No Objection to severance • LSRCA to Ron McCowan, "Creation of a Pond" — [Pond] does not require permit As such, the issue of the creation of the pond on the proposed severed lands did not require a permit from the LSRCA. As well, the same agency had no objections to the creation of a new residential lot. DISCUSSION As noted above, the applicant has submitted a "Tree Survey and Impact Assessment Report", completed by Davide Carnevale, Registered Arborist, and dated October 26, 2007. The report set out three objectives, based on the two access options discussed between the Township, applicant, and residents: "assessment area #1 ", being a roadway extending southerly from Ridge Road West to provide frontage for the proposed severed and retained lands, or, "assessment area #2 ", being the extension of Bay Street east and then northerly. The report objectives were to: 1. Survey all trees 20 cm or greater in diameter within the proposed 7 metre wide road located in tree assessment areas #1 and #2 2. Provide a report analyzing the impact the proposed roadway will have on trees within assessment areas #1 and #2 3. Determine which site is best suited to construct the proposed roadway given the impact it will have on the trees The report found that extending Ridge Road southerly a distance of 226 metres would require the removal of "72 trees ", while the extension of Bay Street 187 metres, as originally proposed, and would require the removal of "30 to 35 trees ". The report concludes that "the proposed roadway should be constructed within assessment area #2 for the following reasons: A. This area requires fewer trees to be removed; B. The area contains an existing dirt driveway and has been predisposed to construction disturbance and is not considered a natural wooded area like assessment area #1; C. Significant trees are located along the perimeter of the site and are clear of the existing dirt driveway and are less apt to be disturbed ". Site visits by Township staff would concur with the observations and conclusions of the arborist's report. With respect to the Official Plan, the subject property is partially contained within two land use designations: the proposed retained parcel is wholly designated Rural, while the proposed severed lot is partially designated Rural, and partially designated Rural Settlement Area. However, as the proposed severed lot and subsequent development of a residential dwelling will occur within the portion of lands having the Rural Settlement Area designation, where severances are permitted, it is on this land use policy that the application is being considered. The proposed future residential development, in the form of a single detached dwelling, would take place within the Rural Settlement Area designation, and therefore would constitute a permitted use in accordance with the Official Plan. The Township Planning Department report of June 21, 2007 supported the proposal based on the extension of Bay Street, to municipal standards, as a condition of consent to provide frontage for both the severed and retained lands in accordance with the Official Plan. It is noted that a second option does exist in being with respect to road frontage for the severed and retained lands, bei . the construction of a municipal road southerly from Ridge Road. As discussed above, this option would require a longer road be constructed to provide frontage for the lot, and thus the removal of more trees than the ' Bay Street extension option. Township staff are of the opinion that the extension of Bay Street remains the best option for the purpose of providing access to the subject lands, and is the preferred option with respect to tree preservation. CONCLUSION The proposed consent application for the creation of a new residential lot continues to conform to the policies of the Official Plan, and would comply with the minimum lot provisions of the Shoreline Residential (SR) Zone upon completion of a Zoning By-law Amendment, to be 'included as a condition of Consent. RECOMMENDATION It is recommended that the Committee grant provisional consent to Application 2007-B-17 for the creation of a residential lot, having an area of 0.97 hectares and a frontage of 43.5 metres on Bay Street, subject to the following conditions: 1. That three copies of a Reference Plan of the parcel severed be prepared by an Ontario Land Surveyor be submitted to the Committee Secretary-Treasurer; 2. That the applicant construct a municipal road up to Municipal Standards for the severed and retained lands, to the satisfaction of the Township Public Works Department; 3. That the applicant apply for and obtain a Driveway Entrance Permit from the Township Public Works Department for the land to be severed; 4. That the applicant's solicitor prepare and submit a copy of the proposed conveyance for the parcel severed, for review by the Municipality; 5. Urban Design / Community Planning Landscape Architecture Natural Resource and Aggregate Planning Expert Evidence and Mediation Project Management Also attached is a copy of the correspondence received from the LSRCA regarding the pond which has been constructed on the subject property. As noted the pond which has been constructed is located outside of the regulated area on the site. Site visits have occurred with Ms. Burkart and the appropriate sediment control measures were implemented as requested. The lands subject to the Consent application are designated Rural Settlement Area and Rural and do not designate any of the lands Environmental Protection in the Township's " Official Plan. On this basis, there is no legislative authority to request the completion of any environmental studies in conjunction with the proposed consent application. As part of the building permit process for the proposed single detached dwelling engineering /grading plans will be required to be submitted and approved by the Township. Also at the meeting, the Committee members encouraged discussion between the applicant and the neighbours in an effort to resolve comments made at the time of the hearing. Several meetings and a site visit have occurred between members of Council, neighbours, Township staff, and the applicant's consultant. Discussions between the neighbours and the applicant were proceeding towards a resolution which would have required Council to consider the sale of the Bay Street lands, construction of a joint laneway on these lands with the lands being jointly owner by a number of the neighbours. This matter has not proceeded forward as we have not been able to resolve matters between all of the parties. On this basis we are proceeding back to the Committee of Adjustment with two proposed Options for consideration. Option #I proposes a roadway extension to Bay Street that would provide access to both the severed and retained lands with a total road length of 187 metres. This is intended to be constructed over the location of the current dirt driveway shown on the survey prepared by Eplett & Worobec dated September 27, 2007. Option #2 proposes a roadway extending,,, from Ridge Road West that would again provide access to both the severed and retained lands with a total road length of 226 metres. The Tree Specialists Inc., on behalf of the applicant, have prepared a Tree Survey and Assessment Report which reviews both of these options and is being provided to the Township under separate cover for their consideration. On the basis of the above, we would respectfully request that our application be circulated for the November 15, 2007 hearing of the Committee. The rezoning application applies to the proposed residential lot that was conditionally approved for severance from the applicant's overall 39.2 hectare land holding. The proposed residential lot fronts on Line 4 North, approximately 0.4 km south of Moonstone Road. The lot is proposed to be severed from a 39.2 hectare rural parcel described as West Part of Lot 15, Concession 5 in the Township of Oro - Medonte (formerly Township of Medonte). As part of provisional approval for the Consent application, the applicant must apply for a rezoning for the future lot, which is proposed to be rezoned from the Agricultural /Rural (A/RU) Zone to the Rural Residential Two *Hold (RUR2[H]) Zone. OFFICIAL PLAN: The subject lands are designated Rural by the Official Plan, and is covered by the Environmental Protection Two Overlay. Section C2.3.1 of the Official Plan permits one G6 residential severance provided that the subject lands a) exceed 36 hectares in size, and b) a severance has not been granted after March 23, 1973. As a result of Consent Application 2005 -B -52, the retained lands will not be eligible for further residential lot creation. With respect to the Environmental Protection Two (EP2) overlay, the applicant was required to prepare an Environmental Impact Study (EIS) in support of the proposed severed lot. The EP2 overlay identifies and protects natural features such as woodlands and wildlife habitat. The EIS was reviewed by the County of Simcoe and the Nottawasaga Valley Conservation Authority, where neither agency had objection to the creation of a new residential lot, provided that future residential construction adhere to the recommendations of the EIS. The lot is intended to be used for single detached dwelling, which constitutes a permitted use in the Rural designation. With respect to the EP2 overlay, Section B3 sets out policies for development on the subject lands, where more specifically subsection B3.3 states "the uses permitted in these areas shall be those permitted by the underlying designation provided the use conforms to the policies of this section ". As discussed above, staff have, through review of the EIS, determined that residential development is appropriate on the lands subject to rezoning. • The Zoning By -law Amendment Application will rezone the lot from the Agricultural /Rural (A/RU) Zone to the Rural Residential Two *Hold (RUR2[H]) Zone to accurately reflect the intended residential use of the property. The lot will have a frontage of 100 metres, a depth of 100 metres, and an area of 1 hectare. These dimensions would comply with the minimum requirements of the RUR2 Zone for the subject lands, where the minimum frontage is 45 metres, and the minimum lot area is 0.4 hectares. With respect to the *Hold provision included with the rezoning application, the EIS prepared on behalf of the applicant identified several natural features on the proposed lot that were worthy of protection. In particular, an endangered tree species (Butternut) and watercourse were discovered on the subject lands. The *Hold provision attached to the proposed zoning will require the applicant, at the time of future residential construction, to enter into a Site Plan Agreement with the Township to ensure that the above - mentioned natural features are preserved. Review of the future Site Plan Application will include review from the Nottawasaga Valley Conservation Authority (NVCA), particularly with respect to appropriate buffering from the watercourse and endangered tree species. A conceptual site plan has been prepared by the applicant, and depicts buffering from the environmental features. NVCA staff has indicated that the conceptual site plan is acceptable, which also provides a generous building envelope for the future construction of a single detached dwelling. A statutory Public Meeting was held on November 7, 2007 with respect to this application. No comments in either verbal or written form were received from external agencies or members of the public. IBC • The subject land is designated Agricultural by the Official Plan. The parcel to which the subject lands are being added are also designated Agricultural. The Official Plan recognizes boundary adjustments provided no new building lot is created and the boundary adjustment will not affect the viability of the agricultural parcels affected. The property to be enhanced currently has a single detached dwelling and accessory buildings. The parcel to be conveyed as a result of Consent Application 2007 -B -20 totals 0.82 hectares (2 acres) — as such, this application does not propose to remove significant agricultural land from production, and will not reduce the agricultural resource base or adversely affect the viability of the retained agricultural parcel. The sloping topography of the subject lands creates a challenge and impediment to utilize the lands for viable crop production. Therefore, this application generally complies with the objectives of the Township Official Plan. • s The subject property is currently zoned Agricultural /Rural (A/RU) Zone in the Township's Zoning By -law. The lot to be enhanced, 590 15/16 Sideroad, is currently zoned Rural Residential Two (RUR2) Zone. The minimum area for a lot in the RUR2 Zone is 0.4 hectares, whereas the current property consists of 0.25 hectares and therefore is non complying. In effect, the application at hand would bring the present, non - conforming lot into conformity, as the new lot area would exceed 0.4 hectares. The lot to be enhanced, 590 15/16 Sideroad will increase in area from 0.25 hectares (0.63 acres) to 1.07 hectare (2.64 acres), and the frontage will remain 57 metres (187 feet). The minimum area for lots in the Rural Residential Two Zone is 0.4 hectares (0.98 acres). The County's Official Plan provides residential consent lots should be developed to an approximate maximum size of one hectare. The retained lands, 696 15/16 Sideroad will decrease in area from 39.61 hectares (97.88 acres) to 38.80 hectares (95.88 acres). On this basis, the enhanced and retained lands would appear to generally comply with the requirements of the RUR2 Zone. ANALYSIS: As noted above, the resulting lot size and lot frontage meets and exceeds the minimum lot standards for a lot zoned Rural Residential Two (RUR2) Zone, and recognizes the intended use of the lands for residential purposes. The size, shape and use of the enhanced lot are more consistent with a Rural Residential Two (RUR2) Zone than with the Agricultural /Rural (A/RU) Zone. The resulting lot is similar in size, shape and use as lots in the surrounding area. The resulting lot as approved by Consent Application 2007 -B -20 is consistent with policies of Official Plan and is consistent with the zone standards of a RUR2 Zone in terms of use and size. The proposed residential use complies with Zoning By -law 97 -95 and the residential use also conforms to the policies of the Agricultural designation of the Official Plan. A number of Department Heads currently utilize individual Personal Electronic Devices to assist in task and schedule management. Computer Network The existing network server is located in a shared office with the Manager of Information Technology, serviced by aging air conditioning equipment. I ANALYSIS: Electronic Communication Email connectivity and access to individual calendar schedules is available to staff and members of Council by remote access to the Township network through micro computers. Voice communication is managed with cell phones and pagers. Consolidation of voice and data technology in one device would provide the existing ability to respond to voice calls/messages and much greater flexibility in responding to information requests; confirmation of meeting schedules, responding to email. The technology being considered - a blackberry device - has been successfully deployed and proven world wide. A blackberry device (personal electronic device - provides mobile access to voice and data information) requires the Blackberry Enterprise Software application to operate on the network server. A BES Server (Blackberry Enterprise Software) is the software application required to be installed on the computer network to facilitate electronic communication with individual handheld blackberry units. The cost to install and license the BES server is in the order of 4400.00 if purchased separately. If an organization deploys ten blackberry units, the cost for the BES server is waived. The BES application is applicable to a maximum of 20 users, with no additional license fees. The initial phase of implementation of the blackberry technology is recommended for the Township Department Heads/Senior Managers. The second phase of deployment is recommended for members of Council in early 2008. Computer Network The current air conditioning unit that services the network server room is not capable of maintaining required cooling for optimal operation of the network server. To maintain uninterrupted network operation it is recommended to replace the existing aged air conditioning unit in the server office. Hvozda Date: November 20, 2007 Motion Date: Mr. John Hvozda via email and a presentation to Council has expressed concern relating to the safety of his vehicular access point, which has in part, stemmed from a Canada Post safety review requesting relocation of Mr. Hvozda's mail box. Specifically, Mr. Hvozda has requested that the Township install stop signs east and west bound on Ingram Road at Line 5 making this intersection an all way stop. It is Mr. Hvozda's contention that this would alleviate speeding local traffic and hazards associated with logging trucks through this intersection. ANALYSIS: In analyzing this situation, staff and Council have conducted site visits of this area to determine sight distances and related safety concerns. Traveling west bound from Line 4 there is approximately 325 metres of sight distance from the horizontal curve to Mr. Hvozda's driveway. Traveling east from the Hvozda driveway towards Line 5 intersection the sight distance is reduced to approximately 65 metres of sight distance due to a substantial growth of Spruce trees on the front yard property line of Mr. Hvozda. The sight distance from Line 5 intersection easterly to the next horizontal curve is approximately 400 metres. Thus both sight distances from the east and west curves eliminate the need for installing Stop signs to create an all way stop intersection. ;L As part of staff's analysis, a brief discussion was held with Breens Lumber Mill to determine the number of transports that utilize Ingram Road to move products in or out of the lumber mill located on Ingram Road, east of Line 4. The number of transports traveling on Ingram Road varies from week to week, however the average equates to approximately 12 trucks per week. Breens Lumber also advised that 50% of this traffic would enter Ingram Road off of Hwy 93 and would exit using the same route. Thus these trucks would not pass through the Line 5 intersection or by Mr. Hvozda's property. There have been no recent traffic counts taken on Ingram Road, however, traffic is assumed to be light considering that the required maintenance to maintain this road section as a Class 3 road, as per the Roadway Service Standards, is low. [§§�CLUSIION: Upon reviewing this information staff confirm that the sight distance traveling west bound or east bound along Ingram Road to the Line 5 intersection are well within the required 135 metres safe sight stopping distance of Ministry of Transportation guidelines for an 80 km/h speed zone. The east bound sight distance from Mr. Hvozda's driveway however is limited (65 metres). It is staff's position that the most straightforward solution is to have the owner remove or trim the line of trees on the Hvozda property line to rectify this matter and possibly move the mailbox to the south side of the road for improved access. The Township would also undertake some minor work involving trimming, on the two approaching curves which would together improve the situation. In reviewing this matter, staff has investigated another approach whereby a secondary entrance could be gained via the unopened Line 5 road allowance. The owner would be required to construct a circular driveway that would exit onto Line 5 north of Ingram Road, essentially creating a "U" shaped driveway. This would require Council to grant an easement over this road section and authorize an exemption to By-Law No. 2004-119 which prohibits the use of motorized vehicles on highways within the Township of Oro-Medonte. Such an easement would require the owner to commission a reference plan and be responsible for all associated costs, including legal costs. Habitats in Oro Medonte are as diverse as the plants and animals that live in them, ranging from the obvious such wetlands, streams, lakes, forests and fields, to small vernal pools that are necessary to sustain creatures like the wood frog. Most plants and animals are uniquely adapted to survive in a specific habitat, and if that habitat is destroyed, the plant or animal's survival is severely threatened. Habitats do not function independently of each other: wetland creatures need forests and fields to provide upland cover for nesting. Woodland creatures need wetlands and streams for water and food. Fields provide hunting opportunities for the variety of raptors — such as the Great Gray Owl - that stage in our forests. Nor can habitats function in isolation: a lonely stand of trees in the middle of a residential area serves neither deer nor residents very effectively. When wild animals cross through developed areas to get to sources of food and water, conflicts inevitably arise. For habitats to function effectively they must be healthy and connected, allowing plants to thrive and animals to pass through safely according to their natural habits. Habitats do not just benefit plants and animals. Wetlands improve water quality, woodlands help reduce carbons in the air and streams feed the lakes we enjoy for recreational purposes and as a source of water. We are all connected: the destruction of one type of habitat starts a negative chain reaction that will indisputably end up at our doorsteps and reduce quality of life in this township and beyond. All habitats are essential in the fight against, and adaptation to, climate change. Oro Medonte is blessed to be home to a rich diversity of habitats. This is part of the cultural fabric that makes up this township and the reason why many choose to live here. It is an interesting paradox then that because this is such a desirable place to live, habitats are under significant and constant threat. This is most recently evidenced in a communication from the Committee of Adjustment which has formally expressed its dismay at the number of applications resulting in the needless destruction of healthy, mature trees. The township must assess its habitats holistically and in their entirety, balancing the interests of humans, plants and animals alike, to sustain the quality of life here and ensure that these essential places are not needlessly destroyed. For all of these reasons, we would ask council to give favourable consideration to the establishment of a Habitat Working Group under OMEGA that would research, assess and make recommendations on issues pertaining to habitats in Oro 'Nledonte. An educational component would provide information about the moraine& its significant natural features for moraine residents. Several small amendments were made to these recommendations but were technical in nature. Old Business: ❖ St. George's Fairvalley Anniversary report: Allan thanked Geoff and Julianne for assisting him. The day was successful with a good turnout and Allan was able to scan some early pictures that are in our collection already but now using the originals it gives us better clarity. He scanned 200-300 images. ❖ No update for the Guthrie church sub-committee, as they have not met since summer. ❖ Quotes for the repairs to the African church: Bruce has contacted two more contractors to get quotes and we are still waiting for Don Robinson's quote. •- Trillium grant process: email as circulated from Sheila regarding her conversation with John Pugsley about our eligibility for a grant and the process. Discussed this issue and suggestions made include 1. Approach Mayor Hughes again about availability of portables this year. 2. Approach Council about funding to hire a fundraiser to do basic research regarding the feasibility of an Interpretive Centre. ❖ Geoffrey contacted the History Department of Laurentian University and Brad Rudachyk suggested considering hiring a university student(s) to do the work on contract over the summer. Moved by Bruce Wiggins that the Township consider hiring I to 2 summer university students to do the research to create the registry of historic sites of interest as required by the Ontario Heritage Act. Seconded by Geoffrey Booth. All in favour and no abstentions. Municipal heritage committee comparison was briefly looked at. All the surrounding Municipalities have at least one Council member on their committee and Council appoints the members. We seem to be unique! ❖ Oro Fair: Display was well attended and the average visitor went through the entire display with many interested in the Hobart trestle train bridge. Bruce thanked Allan and Geoffrey for all their assistance. National Historic Sites Alliance conference: Margaret informed us that she could not attend the conference. Much discussion ensued about Margaret's time as well as our expenses. Moved by Bruce Wiggins and seconded by Geoffrey Booth that we reiterate to Council that we , already made a budget submission with approval for all the History Association members to have their expenses covered to attend the National Historic Sites Alliance annual conference. Margaret declared a conflict of interest and abstained from voting. Vote in favour was unanimous. Allan will email Mayor Hughes regarding this motion and issue. As it stands Jadeen and Allan will be able to attend the conference. Margaret was able to get some subsidies to cover much of the expense of the conference. They would like to make a request to have some Oro - Medonte lapel pins donated for an upcoming tournament. These 9 -10 year old boys have been selected to represent Oro- Medonte in an International Tournament in Ottawa with the chance to exchange pins with numerous teams within Canada, the USA and Overseas countries. The lapel pins would be a welcome addition to the Hockey pins that the children will also be exchanging with these teams. The tournament is during the Christmas break, so we would need them by December 21'. If possible, we would like about 5 or more pins per child attending the tournament. THEREFORE BE IT RESOLVED THAT: 1 Waterloo City Council call on the Federal government to immediately review and confirm the safety and efficacy of all chemical pesticides that have been approved for use in Canada by the federal government or federal agencies; 2) Waterloo City Council also call on the Ontario Provincial government to immediately review and verify the safety of all chemical pesticides that the provincial government or provincial agencies have approved for sale and use in the province of Ontario; 3) Waterloo City Council remind the Ontario Provincial government of its promise to legislate on the use and sale of cosmetic chemical pesticides in the province of Ontario.
