Pt. Lot 5). The land encompassed by the boundry change will allow for another 70 grave lots {and increase the capacity of the cemetery for 50 more years). Currently there are 100 grave lots available on the existing parcel of land. Since 1984, a total of 32 grave lots have been sold. This works out to selling 1.39 grave lots per year over the past 23 years. If the propossed boundary change is approved there will be a total of 170 grave lots available. Using the above noted figures as a guide, the Cemetery Board will have enought grave lots for the next 115 years. The Cemetery Board is requesting Your Worship and Coucillors to consider waiving the Development Application fee of $900.00 as the intent of the application is for the future greater good of the citizens of the Township of Oro-Medonte and not for profit or gain of the Cemetery Board. The savings of all or part of the Development Application fee would be then used to survey the land, transfer the land and pay for the solicitor costs. Please refer to our previous letter dated July 2'"i 2007 wherein we register our continual frustration with "Off Road Vehicles" creating a trail alongside our property and the noise that this activity entails. We wish to express our thanks to you and the other persons whom have responded to our request for Township attention to a growing and annoying problem. Namely Sandy Agnew, Mel Coutanche,Jerry Ball and lastly Staff Sergeant E.J.Whinnery all of whom have investigated first hand on site and understand my untenable situation. But also that there is a clear danger to the high speed users on dirt bike's and ATV's due to the very steep terrain. My first hand observations have been that some of these people travel at very high speeds and could easily sustain injury or fatality by the practice due to hazards along the way! Since Staff Sergeant Whinnery advises me that the OPP can only give a token presence of a voluntary officer to monitor the problem and then not be able to apprehend since the activity is sporadic but significantly more Friday through Sunday. His reassurances are appreciated but clearly will not totally relieve the problem! May we therefore re-visit the possibility for my wife and I to purchase this strip of Township land alongside our fence-line' approx. dimensions 66ft X 1,286ft. When Marilyn Pennycook was still in office for the township she advised us that the Township would be receptive but we would pay the costs of proper survey, and the deemed land value etc. This we are prepared to do we ask only that the Township treat us fairly with respect to the land value since we are only buying to remove a bad problem. My wife Janet and I would gladly attend a council meeting to present our case as you deem necessary. May we ask that this request be dealt with as expeditiously as possible allowing us to conduct our work before winter. RPS 1R7164 Parts 3 & 4. During the first years our property located at the dead end of Blueberry Marsh Road was quiet and idyllic. However during the last 4 years there has been a sharp escalation in "Off Road Vehicles" racing down our road and fence line. Ai times the noise and smell from these vehicles is a real intrusion imo our otherwise peaceful existence! In questioning some of these people as to where they come from we find that they come from as far away as Waverley, WyeBridge and Midland. And that they are using this "Trail" to gain access to the Simcoe County Forest located at the corner of Hwy No 93 and Simcoe Road No 19. Their numbers have increased significantly this past yeaz and their activity is spoiling our enjoyment of our property! Please be advised that the North/South portion o£Blueberry Mazsh Road is concession No.2 of the Township of Oro-Medonte. There is a portion of Concession No.2 which runs along our fence line and is owned by the Township. It is a very steep hill which is probably why it has never been developed by the Township as a continuation of Blueberry Mazsh Road. There is a definate possibility of a serious injury involving one or more of these young riders on dirt bikes racing up and down this hill! They aze for the most part riding an "Un-Licensed" vehicles with careless abandon. This undeveloped section is largely bush and that is part of the attraction to these careless users who display no regard for the disturbance they cause. May we put forward a suggestion for council's consideration in helping us to resolve this Umenable situation. Item I, Positioning ofbarriers at each end ofthis "Un-assumed Township property" along our fence line. Item 2, Signs to be installed at each end stating that this land is closed to recreation vehicles by the Township of Oro-Medonte. We feel that the barriers are necessary because the terrain cannot be properly policed or monitored. ~' The cost of these signs and barriers we would gladly undertake we ask only for the ;~° , Township's installation of same! ~. Is it possible for the appropriate Township representative to meet with us to review and discuss our concerns on sight? Further to the above we would welcome the opportunity to meet with council to present our case and support our claim with relevant data and photograph's. Date: October 6, 2007 ®~e_~~~OSaT~ Attention: Mavor and members of council At its meeting of July 18, 2007, Council directed staff to investigate the possibility of a by-law to prohibit the discharge of firearms on unopened road allowances. It is my hope that the investigation will encourage the Mayor and members of council to quit ignoring the safety issues associated with "sport hunting" and implement the necessary safety regulations to protect the citizens of Oro-Medonte from the hunting minority. With the recent death of Marianne Schmid in November of 2006, the council needs to ask itself, "How many people need to be slaughtered by hunters in order for us to do something? How many lives need to be ruined?" For those who are not familiar with the incident, please take a moment to review the following article posted by the Orangeville Citizen. (Source: http~//www citizen on.ca/news/2006/1109/Local news/008.html Orangeville Citizen November 9, 2006 Hunter charged in shooting death near Mono Mills A walk on a Simcoe County Forest trail near Mono Mills proved fatal Monday fora 67- year-old hiker. Marianne Schmid was fatally wounded when shot in the forest on Adjala's Five Sideroad near her home by a Keswick man who said he mistook her for wildlife. Ontario Provincial Police investigators have charged Frederick Paul Thomas, 60, of Keswick, Ontario with criminal negligence causing death and careless use of a firearm. Family members said Mrs. Schmid wasn't aware of the fact the hunting season began Monday and she normally wouldn't have taken her daily hike had she known. Her son Toby told reporters his mother "was wearing a red turtleneck sweater, red of all colours." Police said the last previous fatal hunting incident in Ontario was in December 2004, when a 62-year-old hunter shot two men as they set up decoys near Hamilton. The hunter claimed to have mistaken the men for ducks, despite the bright orange hat and coats they wore, as Ontario law requires. r~ , Y s Section 119 of the Municipal Act, 2001, S.O. 2001, may, for the purpose of public safety, prohibit or air-guns, spring-guns, cross-bows, long-bows or any c. 25, as amended provides that a municipality regulate the discharge of guns or other firearms, other weapon. The Mayor and council need to utilize this section of the Municipal act to create the following regulations: 1) No one shall discharge a gun or other firearm, air-gun, spring-gun, cross-bow, long-bow, compound bow or any other weapon within a minimum distance of 500 meters from any occupied dwelling. 2) No one shall discharge a gun or other firearm, air-gun, spring-gun, cross-bow, long-bow, compound bow or any other weapon on any parcel of township/county property less than 25 acres in area. 3) No one shall discharge a gun or other firearm, air-gun, spring-gun, cross-bow, Tong-bow, compound bow or any other weapon within a minimum distance of 500 meters from any municipal road. These regulations would help protect both hunters and the public by placing a safety "buffer zone" between them. These proposed regulations are not suggesting that the heritage activity of hunting be stopped, banned or even restricted, instead, they suggest that for those that enjoy the privilege of hunting, they will need to do it away from where people live and play. According to Statistics Canada, in 2006, Oro-Medonte has a land area of just over 585 square kilometers with a population of over 20,000 people. The population has increased almost SO% over. the last five years and the population density has increased from 31.2 people per square kilometer to 34.1 people per square kilometer. The fact is, Oro-Medonte is attracting more people. Some of these people will live outside Barrie and Orillia and move to rural areas near forests. As more and more people live closer and closer to traditional hunting grounds, there is a good chance that encounters with hunters will increase which will also increase the chances of potential accidents. The tragic death of Marianne Schmid should serve as a wake up call to all people in Simcoe County. Something should be done now to prevent another tragedy. WHEREAS in June 2007, the Ministry of Environment released new regulations, which were added to Reg 170/03 of the Safe Drinking Water Act, regarding the numberof annual lead samples to be taken per drinking water system; and WHEREAS under these regulations, the number of annual samples required has increased substantially depending on the population served by a municipality's drinking water system(s); and WHEREAS the additional sampling requirements will result. in increased annual sampling and labour costs which must be covered through increased water rates to the consumer; and, WHEREAS the number of samples required are not proportionate when comparing small drinking water systems to drinking water systems of larger municipalities of 100,000 or more; and WHEREAS due to amalgamations, many small municipalities are responsible for multiple small drinking water systems that are separate systems located in a small geographic area, NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the Township of Wellington North calls upon the government and the Honourable Minister of Environment to reduce the lead sampling requirements for small municipal water systems proportionately to the number of samples required for larger municipalities of 100,000 ormore and FURTHER BE IT RESOLVED THAT amalgamated municipalities with numerous small water systems be allowed to consolidate these systems for the purposes of identifying the total population served and perform the required lead sampling proportionately within their water systems based on the total population served; AND FURTHER that copies of this resolution be circulated to all municipalities acrossthe Province of Ontario with water systems with the request that they pass similar resolutions of support and forward copies of their resolutions of support to their local MPP's and the Ministry of Environment. We are homeowners at 15 Pod's Lane. On Saturday, October 13, 2007 we became aware that Horseshoe Valley Resort would be altering the grading of land on the golf course at the back of our property which abuts the golf course on the 5`h hole of the Horseshoe Highlands Golf Course. This was due to Horseshoe Resort going to try to rectify a drainage problem of water from the golf course currently draining onto 13 Pod's Lane and causing severe flooding issues to our neighbour. We currently have no water flow or flooding concerns on our property. At our request, we met with Mr. Martin Kimble from Horseshoe Resort on Monday, October 15 at our home to seek clarification from him on the plans to alter the grading behind our property at 15 Pods Lane. He indicated that there were plans for Northridge Landscaping to begin work today to alter the grading behind three homeowners on Pod's Lane of which our property was one of them. He also indicated this work has temporarily been postponed for a few days. He indicated they were planning to change the grading behind our property and two other properties to take on more water flow from the golf course to help rectify the situation at 13 Pod's Lane. He verbally explained his ideas on how to change the grading by creating deeper swells, removing some berms and building another berm. We also suggested some alternatives to him to consider as we do not want additional water flowing across our property. A suggestion had been to install a water drain and pipe at 13 Pod's Lane to flow out to the municipal ditch on the street. He indicated to us that he would like to work with us on any changes However, there does not appear to be any current documented grading plans which have been certified by an engineer to ensure the proposed grading will be effective versus "ideas" at this time with no foolproof guarantee it would not have an adverse impact on our property. This causes us grave concern that any "non-certified or approved" grading changes may potentially be made with no guarantee as to their effectiveness or any potential additional water flow onto our property. We respectfully request that council and town look into this matter and assure us that should Horseshoe Resort initiate any alterations to the grading surrounding our property that they provide and seek approval from Oro-Medonte by providing a certified plan from a qualified engineer before any changes to the grading occur and advise us accordingly before any work begins. We want to ensure there will be no future water issues on our property. We will be out of the country beginning on Friday, October 19`h for seven weeks and will not be physically available to monitor any changes to the abutting property. This causes us great worry and concern as we do not want to encounter unforeseen water issues on -~_ our property and any potential subsequent impact on the market value of our property. File #: Date: Roll #: BACKGROUND: Guidelines for fuel oil storage tanks are governed by insurance and Technical Standards & Safety Authority (T.S.S.A) Standards. The guideline for replacement of the tanks set by insurance companies is 20-25 years of the date of installation. Underground fuel oil storage tanks are subject T.S.S.A Standards and specifically under Ontario Regulation 213/01 (the Fuel OiI Regulation). The regulations also require that tanks aged 25 years or older be removed or upgraded by_October 1, 2006. ANALYSIS: Both Hawkestone and Carley Community Halts have above ground fuel oil storage tanks which are older than the 25 year guideline set through insurance providers and require replacement. Hawkestone Community Hail was no longer able to obtain fuel from the fuel provider because of the age of the tank. By-t_aw 2004-112 section 4 provides emergency purchasing guidelines. in consultation with the Acting CAO, Mr. Paul Gravelle regarding the replacement of the Hawkestone Community Hall fuel oil tank be replaced under the emergency purchasing guidelines to ensure the Hawkestone Hali was able to be heated and that the public service would be maintained. The cost of this expense is $1250 plus taxes which will be financed from the facility replacement reserve. Staff also investigated possible conversion to natural gas however Hawkestone Community Hall has a new oil furnace and remaining with oil as a heating source was the most economical. Carley Hail will require replacement prior to the onset of winter the cost to remove the existing two tanks and replacement of one oil tank is at a cost of $1450 ~1.~,- The Arena has an underground fuel oil tank which is older than 25 years and was due for replacement 1 retrofit on Qctober 1, 2006. The regulations also require that underground tanks be cathodically protected and monitored every two years to confirm continuous protection. Because there are no records of this protection retrofit of the existing underground storage tank is not possible. It is recommended that the existing underground fuel oil storage tank be removed, decommissioned and replaced with a 500 gallon double walled above ground tank. The expenses are as follows 1) Removal, report, decommission, of underground tank $5,902 Note: Additional expenses may be incurred for environmental remediation should any contamination of soils be determined in the report. 2) Replace with 500 gallon double walled above ground tank $5,650 It should also be noted that the removal and replacement of the tank will require the existing spruce trees in the front of the arena to be removed. RECOMMENDATIONS 1. That Report No. RC2007-21 be received and adopted. 2. That staff be authorized tc replace the fuel oil tank at Carley Community Hall at an expense of $1,450 plus taxes 3. That staff be authorized to remove the underground fuel oil tank at the Qro-Medonte Community Arena and replace with a 500 gallon above ground tank and at inclusive expense of $11,552 plus taxes 4. And further that the total expenses for the replacement of oil tanks at the Oro-Medonte Community Arena and Carley Community Nall be financed from the facility replacement reserve fund.
