File #: D09 24239 Application # 2005-OPA-04, 2005-ZBA-27 Date: Roll #: 010-010-01700 BACKGROUND: The purpose of this report is to consider proposed Official Plan and Zoning By-law Amendment applications submitted by Jones Consulting Group on behalf of the above noted property owner, and make recommendations to Planning Advisory Committee as to the disposition of the matter. PROPOSAL: The applicant's total land holdings consist of approximately 70 acres with frontage along Poplar Crescent and Line 9. An existing single detached dwelling is located at 38 Poplar Crescent towards the east side of the property. The applicant intention is to create three new residential lots abutting the Line 9 frontage. Lot creation in this current designation is not permitted, therefore applications for Official Plan Amendment and Zoning By-law Amendment have been proposed. The subject applications would serve to redesignate the lands from "Rural" and "Environmental Protection Two Overlay" to "Shoreline" and rezone the property from Agricultural/Rural (A/RU) to Shoreline Residential Zone. The intent of the applications is to redesignate and rezone the lands to facilitate the creation of three residential lots by way of severance. A conceptual site plan, affixed to this report as Attachment #1, shows the proposed lots with 400 sqm dwelling envelopes with associated driveway and filter bed locations. The proposed ~c.~ _ ~ development will be supported by private on-site sewage disposal (septic) and private well(s). The lot areas and frontages for the proposed lots are as follows: Lot 1 has a lot frontage of 107 metres (351 feet) and lot area of 1.03 hectares (2.5 acres), Lot 2 has a lot frontage of 71 metres (233 feet) and lot area of 0.72 hectares (1.8 acres) and lot 3 has a lot frontage of 105 metres (344 feet) and lot area of 1.09 hectares (2.7 acres). There are a number of environmental features contained on the lands such a cedar swamp, intermittent watercourse, vegetation communities and butternut trees which have been addressed with supporting documents. 11 CIRCULATION COMMENTS: I^ Supporting documentation was submitted in support of the proposed development and circulated to internal Township Departments and relevant external agencies. Specifically, the following supporting studies have been submitted and are on file with the Planning Department. Planning Analysis Report from Jones Consulting Group Ltd. Goossens Property Site Evaluation Report, revised September 2006 and additional information submitted on August, 2007 from Michalski Nielsen Associates Limited Report regarding Butternut Issues on the Goossens Property, April 2007 from Michalski Nielsen Associates Limited The subject applications were originally submitted in August of 2005, and given the environmental features on or close to the proposed development area, several revisions and updated technical reports have been provided to both the LSRCA and the MNR. The following written responses have been received: Lake Simcoe Region Conservation Authority - In final review, the LSRCA found the proposed plan to be acceptable subject to five issues reviewed in their letter of August 22, 2007. (Letter enclosed as Attachment No. 2). Ministry of Natural Resources -June 22, 2007. The letter agrees with the consultant report that the property contains two healthy young butternut Trees (identified as Tree #1 in the Michalski Nielsen associates Limited report) which meets the guidelines for retention and that adequate buffer is being proposed. Simcoe County District School Board -Elementary students residing in this area may attend east Oro Public School and secondary students will be bussed to Orillia Park Street Collegiate. No other concerns have been expressed by internal Township Departments ANALYSIS: The subject lands are presently designated "Rural" and are proposed to be redesignated to "Shoreline". The Official Plan has policies which deals with further expansion of the shoreline development area onto lands that are not designated Shoreline. Exceptions may be granted through the approval of an Official Plan amendment if the expansion is small in scale, and is either focused on the shoreline or is considered to be infilling. Infilling is defined as development that abuts a development area on two sides and/or is located within a parcel of land that abuts public roads on at least three sides. The proposed development generally conforms to this policy. The proposed lot frontage and areas exceeds the minimum standard of the "Shoreline Residential" zone contained in the Zoning By-law. Further detailed planning analysis will be provided in a future report to Planning Advisory Committee. ~~-~ As noted above, the subject land exhibits a number of environmental features which have been evaluated and assessed for the possible impact of the proposed development. The applicant's agent through input from the environmental consultants has worked with both with the LSRCA and MNR to address a number of environmental issues. The enclosed correspondence from the agencies indicates their general support of the proposed development and proposed buffers to protect the identified environmental features. At this time, it is staff's position that adequate information has been received in order to proceed to the formal statutory Public Meeting as required under the Planning Act. A full analysis of the planning merits taking into account comments received to-date as well as additional information which may be received during the public comment portion will be assessed by staff and reported back to Committee at a future meeting. RECOMMENDATION On the basis of the above, it is recommended that Planning Advisory Committee recommend to Council: 1. THAT Report No. BP 2007-037 (Jules Goossens) be received and adopted; and 2. That Official Plan and Zoning By-law Amendment Applications 2005-OPA-04 and 2005-ZBA-27, Part of Lot 25, Concession 10 (Oro), Township of Oro-Medonte proceed to a Public Meeting in accordance with the provisions of the Planning Act. "Revised Development Plan over Natural Heritage Features" and provide the following comments: , Under the Provincial Policy Statement (PPS), butternut is defined as an endangered species. Policy 2.1.3 a) of the PPS states that "Development and site alteration shall not be permitted in: a) significant habitat of endangered species and threatened species". Furthermore, the impact of development on adjacent lands to this habitat must also be evaluated. For the purposes of the PPS, only healthy butternut trees should be considered. Determination of tree health can be carried out by examining the proportion of live tree crown and the area of main stem and root flares affected by cankers. The information submitted follows the recommended approach from the USDA Technical Report NC-165 °Butternut -Strategies for Managing a Threatened Tree". The information submitted indicates that two young butternut identified as `Tree # 1" meet the above guidelines for retention. The information indicates that the trees are located "28m away from the edge of any proposed disturbance" on site and that an existing 15m buffer for an intermittent drainage will provide a minimum buffer for the two trees. It is also noted that these tress are located within the protected portion of the woodlot within proposed "Lot 3" indicated on Figure A. This Ministry confirms that the assessment carried out on the Goossen property to determine tres health is appropriate and in keeping with the USDA Technical Report. Furthermore, we concur with the findings of the assessment with respect to the identification of the two small ~~~`~ (2) butternut trees identified as `Tree # 1" as being healthy as well the protection of an intact portion of the woodland whioh will continue to provide the growing requirements for these trees. Further, the proposed lot configurations and the disposition/proposed ownership of Block 7 were to be reviewed. A meeting was held on August 30, 2007 between the applicant, his planner and environmental consultant and staff from both the Township and LSRCA. Various options were discussed, with a key conclusion indicating that Lot 3 is supportable for a single detached dwelling from an environmental perspective (refer to Attachment #1). Following that meeting, a site visit was hosted by the applicant along with staff from Planning, Public Works and the Recreation Department on September 5, 2007. Following the site visit, a memorandum from the Recreation Department was submitted (Attachment #2). Based on this new information, a more appropriate lot fabric has been proposed (Attachment #3). Staff supports the proposed plan, as the resultant lot fabric is consistent with surrounding development. Further, staff support the Township acquiring Block 7 which will ensure the protection in the long term and resultant possibilities for passive parkland and linkage. The proposed amendments would re-designate and re-zone the subject lands to allow for the creation of six new residential lots. We have reviewed the Planning Background Report (January 26, 2007), the Revised Environmental Impact Study (December 6, 2006) and revised Figure 2 - Preliminary Lot Development Plan (September 11, 2407) submitted in support of the above- noted applications. We provide the following comments with respect to the supporting information and the proposed amendments: EIS and Lot Development Plan The revised lot configuration is acceptable from a natural heritage perspective as it respects the conshaints identified in the Environmental Impact Study. The houses should be situated at the front of the lots and vegetation clearing should be kept to a minimum. Vegetation removal should not occur during the breeding bird season. Official Plan Amendment/Zoning By-law Amendment A The LSRCA will require that the proposed Block 7 be designated EP l and zoned Environmental Protection (EP} through this process. We support the Township's recommendation to Planning and Advisory Committee and Council to acquire Block 7. We believe that public acquisition of these lands would ensure their long-term protection. Watetshed Based on the above, the LSRCA has no objections to the approval of the Official Plan amendment and re-zoning of the property subject to the following: for Life 1. That Block 7 be placed in the Environmental Protection 1 designation and zoned Environmental Protection (EP). That development of the proposed lots proceed through the site plan approval process. File #: Recreation and Community Services Date: September 13, 2007 Roll #: Subject: Crawford Lots P/N 04-1892 Background On September 5th, 2007 a site visit was conducted to the above noted lands regarding the proposed development. Specifically, the proposed "Environmental Protection Lands" Block 7 was reviewed on suitability for the Township of Oro-Medonte to acquire the said lands. Analysis Block 7 is a 4.64 ha parcel of land abutting the proposed development. The lands and location have several key features which include: 1) The opened and unopened road allowance (8`h line) links the property to the rail trail and Lakeshore drive. The opportunity exists to create a natural linear park for cycling and walking from the rail trail to Lakeshore providing linkage to Bayview Memorial Park. 2) The (ands contain a variety of forest features including: a. Hemlock Stands b. Wetlands and Peat Bogs c. Variety of shrub species d. Existing trails throughout property The biodiversity of the property creates habitat for a variety of species birds, reptiles and amphibians, small mammals, and insects. The diversity of the property creates an opportunity to create an interpretive natural trail throughout the property providing environmental education and opportunities for wildlife viewing while preserving this biodiversity. S ~' ~ The Parkland Secondary Study 2001, recommends the following: 1) That the Township pursue the development of trails linking parkland 2) That when planning multi-use parkland, open space be included in the form of trails, EP lands with boardwalks and other natural areas 3) That the Township promote the preservation of natural areas such as wetlands and environmentally sensitive lands through education and enhancement programs that would provide for: • Public Education • Development of trails and boardwalks for viewing wildlife and wetland vegetation Financial Analysis In reviewing the Block 7 property the area could very easily be converted into a "Natural Environment Park" with trails and interpretive features at a small expense, future operational expenses would be minimal. Recommendations The Block 7 property has many key features of environmental and recreational significance and for these reasons should be preserved. It is recommended that the Township pursue the acquisition of the said lands as "Open Space" parkland to ensure future preservation of the lands. File #: D1413469 side of Springhome Road Application # 2004-OPA-03, 2004-ZBA-04 Date; Roll #: 010-009-68900 BACKGROUND: The purpose of this report is to analyze applications to amend the Official Plan and Zoning By-law submitted by CRA Development (Tim Crawford), and make recommendations to Planning Advisory Committee in respect to the disposition of the applications. The application was originally submitted to the Township on February 27, 2004 (Attachment #1) and has involved extensive consultation, particularly in regards to the Lake Simcoe Region Conservation Authority which will be expanded later in this report. The subject land has a total land area of approximately 9.1 hectares (22.7 acres), and is located an the south side of Springhome Road, abutting Memorial Crescent to the east, and the road allowance between Concession 8 and 9 to the west. The original proposal was to create seven new residential lots on a portion of the lands, wi#h a large environmental protection block to be created to the south of the proposed residential lots. The lat sizes and shapes vary as a result of refinements intended to address environmental concerns on the lands, which is wooded and contains a stream towards the mid-point of the property. Further, the proposed number of lots was reduced to six (Attachment #2). The Statutory Public meeting for this application as required by the Planning Act was held on January 17, 2005. Two written submissions were received from the public, along with comments from the Lake Simcoe Region Conservation Authority (LSRCA) and a °No Comment" response from the County of Simcoe. The comments from LSRCA and the County will be detailed later in this report. ~~-g Five verbal comments were raised, as outlined in the attached minutes from the Public Meeting (Attachment #3). These will be assessed later in this report. This application was originally submitted to Planning Advisory Committee on June 9, 2004 which recommended that the applications proceed to a Public Meeting once an Environmental Impact Study (EIS) and updated hydrogeology report were submitted. These reports have since been received and circulated to the appropriate commenting agencies. Following the Public Meeting, in recent months the applicant has been working to satisfy the comments of the LSRCA in regards to the environmental issues on site. PROPOSAL• The subject applications would serve to redesignate the site from Rural and Environmental Protection two Overlay Designations to Shoreline and Environmental Protection Two Overlay Designations, and rezone the property from Agricultural/Rural {A/RU) to Shoreline Residential {SR) Zone. The intent of the subject application is to permit the creation of six residential lots, which will be considered by future severancelconsent applications by the Committee of Adjustment. The proposal includes six lots ranging in area from 0.37 to 0.45 hectares (1.2 to 1.5 acres) and a 4.64 ha (11.4 acre) block encompassing the natural heritage features and required buffers located to the south of the proposed lots. The proposed lots front onto Springhome Raad. lot 2 and Lots 4 to 6 are proposed to have frontage of 47 metres (154 ft.) and Lots 1 and 3 having 89 metre {292 ft.) and 80 metre (262 ft.) frontages respectively. Some of the proposed lots have irregular shaped rear yards to address environmental constraints to the south. If the applications are approved, the precise limits of the environmental features will be staked and surveyed in consultation with LSRCA staff as part of the consent approval process. lot boundaries will then be established based an the recommended buffers from the EIS. The southerly 4.64 ha (Block 7) of the site will remain undeveloped. The applicant proposes that it may be transferred to the Township of Oro-Medonte or be included in Lot 3 subject to a Restrictive Covenant on title. The proposed development will be serviced by private on-site sewage disposal (septic) and private well{s). CIRCULATION COMMENTS: J Supporting documentation was submitted in support of the proposed development and circulated to internal Township Departments and relevant external agencies. Specifically, the following supporting studies have been submitted and are on file with the Planning Department: Planning Background Report dated January 2006 from Skelton, Brumwell & Associates Inc. Update of preliminary Hydrogeologic Evaluation Proposed Residential Lots, Crawford Property dated January 2007 from Wilson Associates. Environmental Impact Study Revised dated December 2006 from Skelton Brumwell & Associates Inc. The subject application and relevant studies were also circulated to external agencies and the following responses have been received: Lake Simcoe Region Conservation Authority -After reviewing the Planning Background Report {Jan.107) and the Revised Environmental Impact Study (Dec.106) and the Preliminary Lot Development Plan, the following comments were provided. The revised lot configuration (with the exception of Lot 3) ~~ °~ is acceptable from a natural heritage perspective as it respects the constraints identified in the Environmental Impact Study. The houses should be situated at the front of the lots and vegetation clearing should be kept to a minimum. Vegetation removal must no# occur during breeding bird season. The LSRCA will require that the proposed Lot 3 and Block 7 be zoned Environmental Protection {EP). In addition, to ensure the Tong-term protection of the natural features and their functions identified on the property, a Conservation Easement under the Conservation Lands Act shall be placed over the environmentally protected portions of the property as a condition of consent. County of Simcoe -The County of Simcoe Planning Department has commented that the proposed Official Plan Amendment appears to conform to the intent of the Coun#y Official Plan, most notably Policy 3.6.11. The County of Simcoe has no objection to the proposal provided the no development occurs on the proposed Lot 3 or Block 7 and that these environmentally sensitive (ands are protected through the appropriate zone and Official Plan designation. Furthermore, while it is the County's preference that environmentally protected (ands be held by a public body, a Conservation Easement should be placed on the protected portions of the property if no public body or organization is in a position to take ownership of the lands. Township Engineering Consultant -There are no servicing or drainage constraints for the establishment of the proposed six Tots contained in this application. One condition was recommended that a 0.30 metre reserve be established along the easterly portion of Lot 6 that abuts Memorial Crescent, in order to restrict access to the abutting street (being Springhome Road). No other concerns have been expressed by internal Township Departments. In respect of the two public comments, one simply requested to be informed of any decisions and staff have recently contacted this individual (Mr. Costello) who indicated that he has sold property in this area and therefore has no concerns. The other written submission from Mr. MacGregor enquired about the possibility of a buffer from his residential property directly abutting the subject land to the east. As a result of the environmental work, an 80 metre buffer will be provided which adequately addresses this concern. In respect of the verbs! comments made, there were five individuals who spoke. Staff notes indicate that there were no significant concerns raised which have not been addressed in the revisions to the plan. ANALYSIS• The northern portion of the subject (ands are presently designated "Rural" and the remainder is designated "Rural" with an "Environmental protection Two' overlay designation. The proposed residential lots are located in the northerly portion designated "Rural". The "Rural" designation does not allow the proposed severances because only one new lot can be severed from a lot in the Rural designation that has an area of least 36 hectares. Therefore, in order to implement the proposed plan, an amendment to the Official Plan is required. It is noted that (ands to the north and east of the subject (ands are designated "Shoreline". Section C5.3.4 {Limits of Shoreline development) of the Official Plan provides the following; "?"he further expansion of the shoreline development area onto lands that are nai designated Shoreline is not permitted by this Plan. Exceptions may be granted through the approval of an Official Plan amendment if the expansion Is small in scale, and is either focused on the shoreline or is considered to be infilling. Infilling is defined as development that abuts a developed area on two sides andlor is located within a parcel of .~~~~~ land that abuts public roads on at least three sides. The creation of strip development across from existing development on existing roads is not contemplated by this plan." The proposed Tots abut developed residential areas to the east and the north and also abut Memorial Crescent to the east, Springhome Road to the north and the road allowance between Concession 8 and 9 to the west (extending to Rail Trail Drive). Further the subject land is located within a parcel of land that abuts public roads on three sides. Therefore, staff is of the opinion that this expansion is small in scale and could be considered infilling in accordance with the above policy. The policy also contains criteria for Council's consideration in the consideration of such minor amendments to the Official Plan to redesignate lands for limited shoreline development. Thess conditions are provided below: a) The lots will have a minimum of 0.6 hectares to a maximum of approximately 1.0 hectare, except where larger sizes may be suitable because of environmental constraints or design consideration. Response: The proposed lots are smaller than 0.6 ha and range from 0.37 ha to 0.45 ha. The Tots sizes are dictated by environmen#al constraints and to maintain the environmental integrity of Block 7 as much as possible. b) The majority of the existing tree cover on the proposed lot is retained and protected as part of the approval process. Response: The applicant has identified proposed building envelopes and areas for sewage disposal systems near the front of the lots. The applicant's EIS recommends that tree clearing on the {ots be minimized. Minimizing the clearing of trees and vegetation is stated in comments from the LSRGA and Township's Consulting Engineer. c} The development is compatible, in terms of scale, density and character with existing development. Response: The proposed lots are considered to be compatible with the existing surrounding residential development, most notably on the north side of Springhome which exhibit similar large road frontages and areas to the subject proposal. di The proposed lots are not located on the shoreline. Response: This policy is not applicable as it speaks to water frontages. e) The lots would conform to the general subdivision and consent policies of this Plan. Response: It is proposed that the lots by created by consent rather than Plan of Subdivision since the lots front onto a public road which does not require an extension. The development is considered to be infilling, and the consent process will ensure that the area will be developed in an orderly and efficient manner. The proposed lots are considered to be compatible with the surrounding residential areas. Given the small scale of the development it is not anticipated that the proposed lots will create a traffic hazard. It has already been noted that servicing by private wells and septic systems is appropriate given the small number of lots being proposed. Drainage patterns and hydrogeologic issues have been addressed by the applicant's consultant. Finally, an EIS has been submitted with the application and has been reviewed by the LSRGA with recommendations. The lot sizes were restricted in size in order to conserve other lands in the larger Block 7 for environmental purposes. ~~-c g II ENVIRONMENTAL IMPACT STUDY: __J^ An Environmental Impact Study prepared by Skelton Brumwell & Associates Inc. has been submitted in support of the proposed residential development. The main issues identified in the report are the presence of Significant Woodlands located mainly within Block 7 of the development. In addition, the report notes the sighting of the Yellaw-Breasted Chat on the property which is provincially ranked as S2S3B and is listed as a species of "Special Concern" by the Ministry of tVatural Resources. The significant woodlands are identified on the schedules of the Township's Official Plan. The study reviewed and investigated the following areas: flora and vegetation communities, breeding birds and other wildlife, amphibians, surface, groundwater and aquatic features, significant woodlands, fish habitat and significant wildlife habi#at. The study made the following recommendations: 1. limiting the disturbance to the Significant woodlands to approximately 0.25 ha (0.71 acres); 2. maintaining a 30m vegetated buffer to all identified watercourses an and adjacent to the subject property; 3. establishing a 50m buffer between the habitat of the Yellow-Breasted Chat and the area of development; 4. include lands south of the area of development and buffer areas into Lot 3 v~ith restrictive covenants or transfer those lands to the Township of Oro-Medonte and zone the lands EP Environmental Protection; and 5. stake and survey all buffers for future individual site plans. The applicant's consultant and staff of the LSRCA have worked to revise the EIS over many months of study including four-season analysis. As outlined above and attached to this report, fhe LSRCA is satisfied that all environmental concerns have been addressed, excluding Lot 3, on which no development is supported. CONCLUSIONS: The proposed residential development is considered to be small in scale and represents infilling development, and therefore conforms to the policies regarding expansion of the shoreline development area outlined in the Official Plan. Staff concludes that the subdivision of the lands is appropriate by way of consent (severance), and that a plan of subdivision is not required. The County of Simcoe has commented that the proposed Official Plan Amendment appears to conform to the intent of the County Official Plan. With respect to the environmental features of the property, the supporting studies have been revised and supported by the LSRCA to define the boundaries of the proposed lots to protect the natural heritage features located on the lands. The LSRCA and the County require the proposed Lot 3 and Block 7 be zoned Environmental Protection (EP} Zone. Therefore, the development proposal will be revised to contain flue {5) residential Tots (Lots 1, 2, 4, 5, and 6). Finally, it is recommended that lot 3 and Block 7 be placed within a Conservation Easement through the consent process. it will also be recommended that the proposed Eots be subject to individual site plans as provided for in the Township Official Plan in order to achieve the objectives regarding the extent and timing of individual site development. ~~'' ?~ RECOMMENDATIONS: On the basis of the above, it is recommended that Planning Advisory Committee recommend to Council: 1. THAT Report No. BP 2007-028 {CRA Development) be received and adopted; 2. THAT Official Plan Amendment {2004-OPA-03) and Zoning By-law Amendment Application (2004-ZBA-04) be approved for Lots 1, 2, 4, 5 and 6, CRA Development (Tim Crawford), that would designate lands described as Concession 9, Part of lot 26 (Oro), on Schedule A of the Official Plan from Rural and Environmental Protection Two Overlay Designations to Shoreline, and rezone (ands on Schedule A5 of the Zoning By-law 97-95 from Agricultural/Rural (A/RU) to Shoreline Residential (SR) Zone, subject to a Holding (H) Zone, removal of which shall only be done after an appropriate Site Plan Agreement has been entered into regarding the preservation of trees and timing of site development; 3. THAT Official Plan Amendment {2004-OPA-03) and Zoning By-law Amendment Application {2004-ZBA-04) be approved for Lots 3 and Block 7, CRA Development {Tim Crawford), that would designate lands described as Concession 9, Park of Lot 26 (Oro), on Schedule A of the Official Plan from Rural and Environmental Protection Two Overlay Designations to Environmental Protection Two Overlay Designations, and rezone lands on Schedule A5 of the Zoning By-law 97-95 from Agricultural/Rural (A/RU} to Environmental Protection (EP) Zone; 4. THAT Township staff work with the LSRCA and the Committee of Adjustment in order to implement the registration of a Conservation Easement over Lot 3 and Block 7, through consultation with the applicant and LSRCA as a condition of consent; 5. As I stated at the meeting, it is nut my intention to oppose the development, but I would like to see a buffer area between the new development and our property. I believe that this would be beneficial to both us and the new prospective property owners. When my wife and 1 purchased our property, we were made aware that under the present zoning that nu development could take place. We value our privacy so nxuch so that we purchased the building lot located to the east of our property and went through the committee of adjustments to sever the lot with our neighbors. if there was a fifty foot frontage parcel of land set aside adjacent to our west property line it would still leave a total of one thousand feet on which the developer could place his seven lots. phis would only decrease each lot width by less than eight feet. t would hope that the developer would consider this a.; a possibility since this would also make the most undesirable lot more sell.alate to his prospective buyer. County staff have now had an opportunity to review the proposal in the context of applicable Provincial and County planning policies. The subject lands are currently designated Rural in the Township of Oro-Medonte Official Plan with an Environmental Protection Two overlay an the southern portion of the property. The land is designated Rural and Agricultural in the Simcoe Gounty Official Plan (SCOP) with the rural area policies being applied. The proposed OPA appears to conform to the intent of the County Official Plan, most notably Policy 3.6.11. These applications were submitted in 2004. In accordance with Ontario Regulation 311106, amended to O.Reg. 432106, the policies of Growth Plan for the Greater Golden Horseshoe does not apply to these application. County staff have also had the benefit of reviewing the Lake Simcoe Region Conservation Authority's (LSRCA) comments on the proposed development. With respect to the September 2006 Preliminary Lot Development Plan, we note chat the LSRCA will require that the proposed Lot 3 and Block 7 be zoned Environmental Protection. ;~ -2~ The County of Simcoe has no objection to the proposed development provided the no development occurs on the proposed Lot 3 or Block 7 and that these environmentally sensitive lands are protected through the appropriate zone and official plan designation. Furthermore, while it is the County's preference that environmentally protected lands be held by a public body, a Conservation Easement should be placed on the protected portions of the property i# no public body or organization is in a position to take ownership of the lands. The above information is intended to be comprehensive and all inclusive, however, over time circumstances and requirements are subject to change. Bruce Subject: CRA Developments (Crawford) We have finally completed our review of the Planning Background Report; Environmental Impact Study Report and the Preliminary Lot Configuration Plan for the proposed CRA Development Application, and herein provide our comments. 1. The proposed 6 lots all front onto the existing Springhome Road, which is a local road. We foresee no concerns with access onto this relatively flat road. There are only six driveway accesses which will be consistent intensification as the existing lots to the north. 2. The proposed private welt and private sewage disposal system for the six lots is consistent with the servicing of the existing lots to the north. The Preliminary Hydrogeologic Evaluation indicates that the six proposed lots can be serviced with private wells and septic systems. We therefore have no concern with the water and sewage servicing. 3. Hydra and telephone utilities are readily available as the lots on the north side of Springhome Road are serviced. 4. In order to maintain tree cover on these lots, restrictions for clearing of trees should be enforced through individual site plans of the lots. Tree clearing should be restricted to only the house, septic and driveway envelopes. 5. There will be no significant changes to the drainage patterns on the proposed lots, other than the front of the proposed houses could drain north to Springhome Road. Based on the contour information indicated on Figure 2, the lots would all fall from the front of the Tots to the rear. Lots 1, 2, 3 and the west portion of lot 4 would all drain to the existing watercourses in Block 7. The easterly portion of lot 4 along with lots 5 and 6 would drain to the existing residential lotto the south (#18 Memorial Crescent). A rear yard drainage Swale should be incorporated to direct the drainage away from the existing tot to the south. A proposed swale along the rear of lot 5 and 6 would appear to be able to drain to the east to the road side ditch on Memorial Crescent. The easterly portion of lot 4 appears to have a low area that would drain south through the rear of the existing lots to the south. This drainage may have to be directed through Block 7. 6. We would recommend that a 0.30 metre Reserve be established along the easterly portion of lot 6 that abuts Memorial Crescent; in order to restrict access to the abutting street. Based on our review we of the opinion that there are no servicing or drainage constraints for the establishment of the proposed six Tots in this application. This meeting is not a statutory public meeting in accordance with any Act including the Planning Act. Instead, it is intended to provide the public with an update on the status of the Craighurst Secondary Plan process. Specifically, Council in July 2007 authorized the hiring of Totten Sims Hubicki Associates to complete an engineering report on options for sewage disposal, water supply and stormwater management and make a recommendation on which option is preferred. It is anticipated that their final report will be prepared by the end of 2007. At the public open house, a review of their work to-date is proposed, and comments are encouraged at this time. All input received will be considered and provided to Council for their consideration in making a decision of which option should be selected. Once such an option is selected, a Secondary Plan will be prepared for consideration, which will be the subject of a formal statutory public meeting under the Planning Act in early 2008. Anyone with an interest in the Secondary Plan and the future of the community of Craighurst is encouraged to attend this open house. Servicing Strategy Some of these items are fisted in the first part of the Official Plan entitled "Community Vision" so it may be prudent for everyone to review these first few pages for some other general ideas/discussion. Another suggestion is that we could invite the Conservation Authorities for #10 to explain to the group what their role is and how local policy decisions and processes involve these agencies. As noted, these are simply suggestions at this point, the discussions around which can hopefully help guide policy decisions which can be captured during the Official Plan review process. If anybody has any comments on the list, I would welcome input. I recommend that we discuss the contents of the list at our next meeting, and from that point forward take time at the end of each meeting to deal with each one. This could be an education process for PAC and Council Members, followed by an "open forum" dialogue to solicit input and opinions on how the topic matter could impact future planning documents in the Twp. Lastly, I also wanted to let the PAC members know that the Drury rezoning/subdivision applications have been scheduled to be heard at a Public Meeting set for Wednesday September 12 at 7pm, here in the Council Chambers (see attached notice). The attendance of the Public Members is expected so if there are any public concerns/comments you can be present to hear first-hand. FYI there is another public meeting also scheduled that evening (Anderson), however this deals with a condition of consent so PAC has/will not be dealing with this application.
