Background: In February of 2007, AMO/AMRC released a discussion paper on EPR for consultation to the AMO and AMRC membership. This paper focused on the inequities of the current Blue Box funding mechanism and proposed a new funding mechanism that recommended industry be made to pay 100% of the costs for non-recovered Consumer Packaging and Printed Paper (CPPP). This was accompanied by a list of recommendations of how to improve the effectiveness of the Blue Box through litter reduction initiatives, strengthening recycling markets and encouraging EPR at a federal level. As a result of the comments received during the consultation period from both municipalities and industry, the discussion paper has been modified to recommend aphased-in approach to full EPR for CPPP. The first phase would establish a 50% cost sharing arrangement between industry and municipalities for the full cost of recyclable CPPP, which includes a portion of litter and garbage costs. The second phase would require a full EPR system that requires industry to take on 100% of the full cost all CPPP. Action: AMO is asking its members to review and support the modified version of the discussion paper on Extended Producer Responsibility. Association of 1-1 Municipalities of Ontario 'r Issue: The Association of Municipalities of Ontario (AMO) and the Association of Municipal Recycling Coordinators (AMRC) have prepared a discussion paper proposing changes to the Waste Diversion Act (WDA). We are looking for municipal input about what is being proposed. Background: The WDA came into force in June of 2002, and a review of it is fast approaching. In preparation for the review, AMO and AMRC have prepared a discussion paper for municipal review and input. The establishment of the Waste Diversion Act was an important step in acknowledging and defining the responsibilities of industry stewards who produce, import and market products within this jurisdiction. It also set the framework for the promotion, diversion and recycling of "designated wastes" and provided a financial cost-sharing partnership with industry funding organizations for wastes designated under the Act. 2007 marks the first opportunity to review the provisions and intent of the WDA. While many facets of the Act have served both industry and municipalities well in establishing and governing the cost management framework, AMO and AMRC regard this review as a timely opportunity to provide a needed impetus for policy and program leadership to be reflected within the WDA and the governance structure of Waste Diversion Ontario. It is AMO and AMRC's position that the recommendations contained within this discussion paper continue to ensure fairness and transparency in the legislation as well as meet the needs of our members. AMO/AMRC municipal Waste Management Task Force representatives will be presenting this discussion paper to staff from WDO and Stewardship Ontario in May of 2007. File #: E00-26814 v-002 Date: Roll #: BACKGROUND: The former Moonstone private water system located on the north side of County Road #19 in the Village of Moonstone extends from the Township works yard to the east, house #90 to the west and Line 8 North to #5626 (Ken Hamilton's property). The watermains in this system were constructed in the early 1970's, consisting in size from 1" to 3" in diameter. As a result of the number of watermain breaks in the old system, after being connected to the Robincrest system, the old section of watermain on County Road #19, from Line 8 North to house #102 County Road #19, was abandoned and the existing houses were connected to the new watermain on the south side of the road. The last four houses, #'s 90, 94, 98 and 102 County Road #19, remain connected to the original 1" main, which is tied into the new watermain on the south side of County Road #19 by a 3/d' water line. Mr. Emberson, resident of #72 County Road #19, has requested an extension of the existing 1" watermain on County Road #19 for the purpose of connecting to it. ~, -~- At ameeting on April 16, 2007 and at previous meetings with Mr. Emberson, concerns were raised with the addition of another house to the 1" diameter watermain. Mr. Emberson was asked to supply the Township, at his expense, with an Engineer's evaluation on the effects of adding his property to the Robincrest system. To date, Mr. Emberson has not supplied the Township with this report. If problems did arise as a result of the connection, the cost to upgrade that watermain to today's standards would be in the neighbourhood of $62,000.00. With this in mind, Mr. Emberson's request to extend the existing watermain cannot be supported without an Engineering report for the Township's review. It was also indicated to Mr. Emberson that while it has not been the Township's policy to expand existing water systems, persons have been allowed to connect to the watermain if it presently existed in front of their properties. RECOMMENDA' 1. THAT Report No. EES2007-19 be received and adopted. 2. THAT Mr. Emberson of #72 County Road #19 not be allowed to connect to the existing 1" diameter watermain that presently ends at #90 County Road #19 until the Township is supplied with an Engineer's report for review and consideration. 3. This rezoning application has been submitted to fulfill a condition of approval for Consent Applications 2005-B-32, B-33, B-34, B-35, and B-36, which were granted by the Committee of Adjustment on September 14, 2006. The rezoning application applies to five lots that were conditionally approved by Consent Applications 2005-B-32 to 36. (See attachments) The lots front on the north side of Moonstone Road (County Road 19), approximately 0.4 km west of Line 8 North. The lots will be severed from a 17 hectare (42 acre) rural parcel, described as 128 Moonstone Road East, being Concession 8, Part of the East '/z of Lot 16, in the Township of Oro-Medonte (formerly Township of Medonte). OFFICIAL PLAN: The lands subject to the rezoning are located within the Moonstone Settlement Area, and are designated Rural Settlement Area by the Official Plan. Section D4 of the Official Plan contains policies with respect to development within rural settlements such as Moonstone. Specifically, Section D4.2 lists permitted uses within such settlements, including `9ow density residential uses, small scale commercial uses that serve the needs of the settlement area and the surrounding rural area, (and] small scale industrial development..." The lots are intended to be used for single detached dwellings, and are to be contained wholly within the Moonstone Settlement Area. As such, the application to rezone the property for residential land use would be in keeping with the intent of the Official Plan. DISCUSSION: The Zoning By-law Amendment Application will rezone the lots from the Agricultural/Rural (A/RU) Zone to Residential One Exception Zone to accurately reflect the intended residential use of each property. All five Tots will have an average frontage of 31.5 metres (103 feet), an average depth of 50.8 metres (167 feet), and an average area of 0.16 hectares (0.4 acres). The Zoning Exception is required to reflect a reduced area for the proposed lots, in that so each of the lots will be contained wholly within the Moonstone Settlement Boundary. A Statutory Public Meeting was held in accordance with Section 34 of the Planning Act on April 11, 2007. No written or verbal submissions were received from members of the public or agencies circulated. The applicants have been working to clear the conditions of Consent as required by the Committee of Adjustment, including the completion of survey work depicting the new lots for Township review. Most notably, the applicants have previously conveyed lands to the County of Simcoe for right-of-way widening along Moonstone Road. Correspondence received on February 6, 2007 from the County Roads & Engineering Department indicates that the applicant's Reference Plan depicting the lands conveyed for road widening is acceptable. In conclusion, given that the proposed Zoning By-law Amendment is in keeping with the general intent of the Official Plan, and in the absence of any concerns from the public or agencies, staff therefore support approval of the application.
