NOVEMBER 16, 1999

Proposed Rezoning
In Attendance: Glen Stewart, Applicant, and Gary Bell, Applicant's
Consultant

41 Ms Leigh explained the status of the proposed rezoning application and
indicated that all the required studies had been completed and submitted to the
Township for review. The traffic, environmental, and hydrogeological studies
were sent for peer reviews and all comments had now been received.
Comments had not yet been received from the County of Simcoe in relation to
the traffic study. Ms Leigh indicated that a response to the peer review
questions was required from the applicant prior to a final planning report being
prepared.
Mr. Gary Bell summarized the findings of all the studies for the Committee's
purposes. He indicated to the Committee what the recommended course of
action was in relation to berms, road improvements, and mitigation measures.
Mr. Bell indicated that the application had been submitted to the Ministry of
Natural Resources in accordance with the Aggregate Resources Act and an
open house has been established for Wednesday January 5, 2000 at the Rugby
Community Hall from 4 -7 p.m to allow the community to review all the
information.

"it is recommended that Development Application P -75198 a
proposed Zoning By -law Amendment proceed to the December
meeting of the Committee with the final planning report on all reports
completed and reviewed. And further that Skelton Brumwell provide
a response to the three peer review letters by December 8, 1999 to
the Township Planner. And further, that Council should consider
establishing a special Public Meeting date in January for the
proposed rezoning."

Proposed Official Plan Amendment and Rezoning
- Verbal Status Report from Planning Consultant
In Attendance: Gary Bell, Applicant's Consultant
Mr. Bell provided the Committee with an update on the status of the
studies being completed in accordance with the Official Plan requirements
including: traffic, environmental, and hydrogeological. Mr Bell indicated
that he hoped to have these studies to the Committee for review at the
December meeting.

Concession 9, West Part of Lot 16 (Medonte)
Proposed Rezoning
In Attendance: No One
Ms. Leigh described the proposal for a rezoning of the former Moonstone
Administration building. She indicated that this application has arisen from a
potential purchaser of the property who is interested in a mail order business
with a showroom and assembly area. The property is within the Rural
Settlement Area designation and would allow the proposed use subject to a
rezoning to the Local Industrial (LI) zone. The property would be subject to site
plan control for the construction of any additional buildings which would enhance
the buffering to other existing properties.

"It is recommended that the proposed rezoning for Concession 9,
Part of Lot 16 (Medonte) to the Local Industrial (LI) Zone proceed to a
Public Meeting in accordance with the Planning Act."

Concession 14, West Part of Lot 9 (Medonte)
Proposed Rezoning
In Attendance: Derek Vernon, Applicant
Ms. Leigh explained the proposal for a rezoning to permit a business on
property located on Highway 12 just north of the Mount St Louis Road.
She indicated that there were a number of issues to be addressed with
this application:
1. Ministry of Transportation approval for an industrial entrance;
2. Simcoe County District Health Unit approval for the 4000 square foot
building;
3. Exact measurements for the amount of the property to be rezoned;
The Applicant indicated he had submitted an application to the Health Unit
for approval and that he would contact the Ministry of Transportation
about an entrance approval. He further indicated that he would advise the
Township Planner with respect to the amount of land to be rezoned.

"It is recommended that Development Application P -97/99 a
proposed Zoning By -law Amendment proceed to a Public Meeting
and that the applicant obtain the necessary approvals from the
Ministry of Transportation and the Simcoe County District Health

We have reviewed the three technical peer reviews conducted for the municipality on the Hillway
Equipment Ltd. pit rezoning application. This letter provides our response to the issues raised.
I. Hvdrogeology
To respond to the Jagger Hims Limited, November 8t, 1999 review we have provided
directly to JHL the requested water well records, tables and map figures submitted and
used by Dixon Hydrogeology Limited. This establishes a basis for the elevation of the
water table.
• References to the aggregate resource on site is found in Section 5 of our Technical
Background Report.
• There is not a known watercourse on the southeast corner of the site. A review of
the detailed topography in the Site Plan Existing Features and discussion in Section
7 of the Technical Background Report and in Sections 1.4 and 5.2 of the
Environmental Report reveals this. There is surface flow due to topography but a
watercourse is not apparent.

• To provide for additional certainty that the pit will not extract below 1.5 metres
above the water table, Hillway Equipment will, if required, put down test pits as it
proceeds with deeper extraction to confirm avoidance of the water table.
2. Natural Heritage
To respond to the review of Natural Heritage aspects of the proposed pit by LGL Limited
of November 5i°, 1999, we advise:
A more detailed description of plant features which would be removed through
extraction is not needed as the hedgerow and vegetation patches will be extracted
and these plant species are of no significant consequence.
The proposed 50 metre extraction setback will provide some area for continuing
complimentary habitat adjacent the ANSI forest.
• There will be reliance on the hydrogeologieal identification and confirmation of the
elevation of the groundwater table to ensure extraction remains 1.5 metres above it.
This is further addressed in Section 1 of this letter.

• A review of the rare species numbers with OMNR information is being done. ,1 , <
There may be an error in numbering, not in the proximity of rare species.
• The combined impacts of this pit with other area pits is discussed in the Technical
Background Report, Section 15, as per Official Plan policy.
• There is no subsequent rezoning of adjacent lands to the pit required or available in
this application.
• Slope revegetation is provided for the site plans with "indigenous perennial or
annual grass mix or a nursery crop as determined by the landowners ". The
landowners are farmers or owners who rent to farmers.
Traffic and Haul Route
The response to the MRC review November 12' , 1999 is:
The available shoulders of the selected access to the County Road 11 haul route can
be easily checked during detailed design of upgrades required.
No further evaluation table is required at this time and we believe the conclusions
would remain the same.

We do not suggest that the Township host further meetings to consider any viable
private road access unless there is an indication that there is willingness by a
landowner to reasonably permit haul route access.
Township staff and a Council member attended one set of meetings with the
landowners and it was evident that private access routes were not available.
• Bass Lake Sideroad is not further assessed as it is not selected as the access to haul
route.
• The additional time and expense of traffic count analysis from Big Cedar Estates is
not warranted now as the volumes are not expected to be large and there is not a
recommendation to take pit truck traffic by Big Cedar Estates.
• The Traffic Report has identified that the maximum licenced tonnage would result
in an average of 248 trips per day. The reason to present this as an average hourly
volume of up to 21 trips is unclear. The typical annual maximum volume of
extraction would result in an average of 186 trips per day, May - November.
There is not an average hour due to shipping practicalities of most pits.
• If the Township or County requests, with justification, additional traffic counts,
then the relevant analysis is of AM and PM peak hour traffic. We expect that in a
rural area, the "A" level of service will be readily maintained. This is a matter to
be expressed in any Development Agreement.
• Any assessment on County Road 1 I would be required and undertaken by the
County Roads Department.
• For reference on community impact, all three tonnage scenarios are provided.
• The Noise Evaluation by Valcoustics Canada, identified "the noise impact of
adding the pit truck traffic is considered very minor ".
• Capital cost consideration and ongoing public maintenance cost considerations of
the access to haul route are valid matters. No criteria or reason was identified to
conclude other than the south haul route is best.
• Being within 10% of the alternative pit traffic calculation methods is appropriate as
our analysis was based on the company's actual truck fleet not observed general
truck types.

• We do not see merit in weighting the considerations such that the conclusion may
be changed. On an overall basis the south route is preferred.
• The proponent, with the Township and County, will do additional traffic analysis at
the W Line and County Road 11 as part of detailed design of improvements
required, all under an agreement to be established prior to adoption of a rezoning
by -law.
We trust that these references adequately respond to the matters raised in the peer reviews. We
certainly think that the information, reports, site plans and consultations have been clear and
complete to the point where formal public review and input is required. The pit licence
application open house is scheduled for January 5`h, 2000. A public meeting regarding rezoning
soon after that is requested.
