Part V of the Township's Development Charges By -law provides for the indexing of the development
charge on the first day of January in each year, beginning January 1, 2005. The development charge
shall be adjusted in accordance with the Statistics Canada Quarterly Construction Price statistics.
ANALYSIS:
The said index reflects a 10.8% increase in construction prices for the year ending December 31,
2006. Accordingly, the development charge per single detached dwelling should be increased from
the present $4,286.96 by 10.8% to $4,749.95, being an increase of $462.99. The development
charge per other dwelling unit should be increased from the present $3,627.42 by 10.8% to
$4,019.18, being an increase of $391.76.
RECQMMENDATIQN S
1. THAT Report No. TR2007 -06 be received and adopted.
2. The Township's development charge per single detached dwelling unit be increased by $462.99
to $4,749.95.
3. The Township's development charge per other dwelling unit be increased by $391.76 to
$4,019.18.
4. The said increases shall be effective March 15, 2007.

BACKGROUND:
On August 11, 2006, the Ontario Municipal Board issued a decision approving Official Plan Amendment
21, Zoning By -law 2005 -082 and a draft Plan of Subdivision for the Moon Point Corporation. Condition
No. 3 of the approved draft plan of subdivision requires the Owner to receive approval from the
Township of Oro - Medonte for a name of Street A of the plan of subdivision. The purpose of this report is
to consider the proposed street name submitted by Moon Point Corporation for Street A of approved
draft plan of subdivision file No. 2004 - SUB -01.
ANALYSIS:
In considering proposed street names, the Township of Oro - Medonte has the following Street Naming
Policy in place:
When naming or changing street names in the Township, consideration be given to one of
the following:
a. A historic name which once identified the location;
b. The surnames of local pioneer families in the immediate vicinity;
c. Any prominent geographic, natural or practical feature which makes the location unique
or identifiable;
d. The names of local servicemen who made the ultimate sacrifice;

e. The names of prominent former residents who contributed to the betterment of the
Township through their community involvement, athletic or business achievements.

subdivision, at least one street name will have regard to the

comment prior to Council approval.
The duplication of street names used in adjacent municipalities shall be minimized as not to
conflict with emergency response addresses. Circulation of proposed new names will be
made by the Township to the neighbouring municipalities for comment when deemed
appropriate.
A report will be submitted to Council for the approval of the proposed names.
Originally, the applicant proposed four names for consideration which were circulated to internal
departments and surrounding municipalities for comments. The applicant only needs one street name
for the Moon Point subdivision. The applicant's preferred choice of street name is "Greystone Court".
No conflicts were noted by internal departments; however a concern was raised by the City of Barrie.
The City of Barrie has an existing street named Grey Lane. In consideration of a possible conflict with
proposed street name of Greystone Court, the Director of Emergency Services has determined there is
sufficient difference in street names between Greystone Court and Grey Lane not to cause a conflict for
emergency services.
The applicant has provided staff with information to determine how the proposed street name of
Greystone Court would comply with the Street Naming Policy. Greystone Court was chosen to signify
one of the physical characteristics of the site. The subject site was used for agricultural purposes in the
past and a prominent stone row fence was created. Some of the stones were placed along the
shoreline and now forms part of the berm that is along the lake side of the lots. It is anticipated that
some of the stones will be utilized in the entrance way feature of the subdivision.
In consideration of the above noted information, Staff is of the opinion that the proposed street name of
"Greystone Court" is generally in keeping with Section 1(c) of the Street Naming Policy for the Township
of Oro - Medonte.
RECOMMENDA
On the basis of the above, it is recommended:
1. THAT Report No. BP 2007 -004 be received and adopted.
2. THAT the proposed street name of "Greystone Court" be assigned to Street "A" of Moon
Point Corporation approved draft Plan of Subdivision 2004 - SUB -01, Part of Lots 15 and 16,
Concession 3 (Orillia).
3. THAT the Clerk bring forward the appropriate by -law for Council's consideration.

IBACKGROUND:
The purpose of this report is to consider a proposed Zoning By -law Amendment Application
submitted by Doug Shelswell on December 14, 2006. This rezoning application has been
submitted to fulfill a condition of approval for Consent Application 2006 -B -11, which was
granted by the Committee of Adjustment on November 16, 2006.
The rezoning application applies to lands described as 191 Line 13 South, being Concession
14, Part of the West 'h of Lot 18, in the Township of Oro - Medonte (formerly Township of Oro).
The subject land is proposed to be rezoned from the Agricultural /Rural (A/RU) Zone to the
Agricultural /Rural Exception 170 (A/RU "170). Consent Application 2006 -B -11 will create a 2
hectare (4.96 acre) lot containing an existing "surplus" farmhouse and other outbuildings. The
severance was submitted as a result of a farm consolidation. As part of provisional approval for
the Consent, the applicant must apply for and obtain a rezoning on the subject lands, which will
prohibit the future construction of a single detached dwelling in order to preserve the remaining
parcel for agricultural uses.
OFFICIAL PLAN:
The property to be rezoned is currently vacant, and is being actively farmed by the applicant.
The severed parcel containing the "surplus dwelling" totals 2 hectares — as such, this application
does not propose to remove lands currently being used for agriculture from active production,
and will not adversely affect the continued farming operation on the retained agricultural parcel.
Further, as the lot to be created contains an existing "surplus dwelling" and accessory building,
the new lot will not serve as a "building lot" for any new residential uses.
ZONING BY -LAW:
The subject property is 191 Line 13 South, Part of the West '/2 of Lot 18, Concession 14
(formerly Oro Township). As a result of Consent Application 2006 -B -11, the new lot containing
the "surplus dwelling" will have a frontage of 110 metres (360 feet), a depth of 183 metres (600
feet), and an area of 2 hectares (4.96 acres). The required minimum frontage for a lot in the
Agricultural /Rural Zone is 45 metres.
The retained agricultural lot is zoned Agricultural /Rural (A/RU) Zone, and will consist of 40.8
hectares (101 acres), and will continue to serve as active agricultural lands as part of the
applicant's overall farming operation. The minimum lot size in the A/RU Zone for an agricultural
use is 2 hectares (4.94 acres). As such, this application generally complies with the
requirements of the A /RU Zone as prescribed in the Zoning By -law.
ANALYSIS:
Upon review of the 2005 Provincial Policy Statement (PPS), the following Section applies to
this Application:
"2.3.4 Lot Creation and Lot Adjustments
2.3.4.1 Lot creation in prime agricultural areas is discouraged and may only be permitted for:
c) a residence surplus to a farming operation as a result of a farm consolidation,
provided that the planning authority ensures that new residential dwellings are
prohibited on any vacant remnant parcel of farmland created by the severance."
As stated above, the PPS policy allows the creation of a lot for a residence surplus to a farming
operation as a result of farm consolidation. The Committee of Adjustment was satisfied that
Consent Application 2006 -B -11 met with the intent of the PPS.
However, the PPS also gives the local municipality authority to regulate future development on
the retained agricultural lands, and as a result of conditional approval for Consent Application
2006 -B -11, the applicant must rezone the retained lands to the Agricultural /Rural Exception 170
(A/RU *170) Zone to prohibit the construction of a single detached dwelling. However, in this
case, the construction of agricultural buildings (such as silos and livestock facilities) will be
permitted, to reflect the intended continued agricultural use on the retained lands.

As the proposed Zoning By -law Amendment intends to prohibit residential development on
significant agricultural lands, the rezoning would therefore conform with the intent of the 2005
Provincial Policy Statement. On this basis, it is recommended that the Zoning By -law
Amendment Application 2006 - ZBA -14 proceed to a statutory Public Meeting.
RECOMMENDA
It is recommended:
1. THAT Report BP 2007 -005 Re: Zoning By -law Amendment for Doug Shelswell,
West % Lot 18, Concession 14, (Oro), Township of Oro - Medonte, 191 Line 13 South
be received.
2. THAT Zoning By -law Amendment Application 2006 - ZBA -16, West '/2 Lot 18,
Concession 14, (Oro), Township of Oro - Medonte, 191 Line 13 South, proceed to a
Statutory Public Meeting in accordance with the provisions of the Planning Act.

1BACKGROUND:
The purpose of this report is to consider a proposed Zoning By -law Amendment Application
submitted by Ted Pickard and Lisa Truax on January 8, 2007. This rezoning application has
been submitted to fulfill a condition of approval for Consent Applications 2005 -B -32, B -33, B -34,
B -35, and B -36, which were granted by the Committee of Adjustment on September 14, 2006.
The rezoning application applies to the future five lots that were recently approved by Consent
Applications 2005 -B -32 to 36. The lots front on the north side of Moonstone Road (County
Road 19), approximately 0.4 km west of Line 8 North. The lots will be severed from a 17
hectare (42 acre) rural parcel, described as 128 Moonstone Road East, being Concession 8,
Part of the East' /2 of Lot 16, in the Township of Oro - Medonte (formerly Township of Medonte).
As part of provisional approval for the Consent applications, the applicant must apply for and
obtain a rezoning for the future lots, which will reflect the intended residential use for each
property. The subject lands are proposed to be rezoned from the Agricultural /Rural (A/RU)
Zone to the Residential One Exception 171 (R1 *171) Zone (see attached schedule).
OFFICIAL PLAN:
The lands subject to the rezoning are located within the Moonstone Settlement Area, and are
designated Rural Settlement Area by the Official Plan. Section D4 of the Official Plan contains
policies with respect to development within rural settlements such as Moonstone. Specifically,
Section D4.2 lists permitted uses within such settlements, including `low density residential
uses, small scale commercial uses that serve the needs of the settlement area and the
surrounding rural area, [and] small scale industrial development..." The lots are intended to be
used for single detached dwellings, and are to be contained wholly within the Moonstone

ANALYSIS:
The Zoning By -law Amendment Application will rezone the lots from the Agricultural /Rural
(A/RU) Zone to Residential One Exception 171 (R1'171) Zone to accurately reflect the intended
residential use of each property. All five lots will have an average frontage of 31.5 metres (103
feet), an average depth of 50.8 metres (167 feet), and an average area of 0.16 hectares (0.4
acres).
While the frontage provisions for the R1 Zone will be achieved by the future lots, it has been
determined that the original lot dimensions, as approved by the Committee of Adjustment,
raised issues with respect to the Moonstone Settlement Area Boundary. The approved lots
have an average depth of approximately 65 metres (213 feet), giving each lot an average area
of 0.2 hectares (0.5 acres), which complies with the lot area provisions of the R1 Zone.
However, the Moonstone Settlement Boundary lies approximately 55 metres (180 feet) north of
the County Road 19 right -of -way; as a result, a small portion of each of the proposed lots would
be partially outside of the Moonstone Settlement Area. Through discussion with the applicant, it
was determined to amend the lot boundaries to ensure that each property will be wholly
contained within the Moonstone Settlement Area. The resulting lot area for each lot will be
approximately 0. 16 hectares (0.4 acres). The new lot boundaries are necessary for the lots to
conform with the Moonstone Settlement Area Boundary and meet the general intent of the
Official Plan.
In addition, a condition of Consent requested by the County required the applicant to convey a
+/- 5 metre (16.4 foot) strip of land along the frontage of each lot for future road widening. The
decision to reduce each lot's depth, coupled with the County road widening condition, has
created a situation where none of the proposed lots consist of the 0.2 hectare (0.5 acre)
minimum area required for the R1 Zone. By including "Exception 171" to this rezoning
application, the deficiency in lot area will be identified and acknowledged in the text and
relevant schedule in the Zoning By -law.
The application to rezone 5 approved residential lots was listed as a condition of consent. In
addition, the applicants have an additional 12 conditions to fulfill over the next 6 months. The
applicants have been working to clear these conditions, including the completion of survey work
depicting the new lots for Township review, and most notably the conveyance of lands for right -
of -way widening along Moonstone Road. Correspondence received on February 6, 2007 from
the County Roads & Engineering Department, indicates that the applicant's draft reference plan
depicting the lands to be conveyed for road widening is acceptable.

As the applicants are actively working toward clearance of the conditions of Consent, it is
appropriate for Zoning By -law Amendment Application 2007 - ZBA -01 to proceed to a statutory
Public Meeting.

Truax, East '/2 Lot 16, Concession 8, ( Medonte), Township of Oro - Medonte, be
received.
2. THAT Zoning By -law Amendment Application 2007 - ZBA -01, East '/Z Lot 16,
Concession 8, ( Medonte), Township of Oro - Medonte, proceed to a Statutory Public
Meeting in accordance with the provisions of the Planning Act.
