proposed boathouse shall not exceed 9.14 metres (30 feet) above the average high water
mark elevation of 219.15 metres for Lake Simcoe; and that the location of the boathouse be
in confo ~ty with e site plan submitted with the application and approved by
Co ~ttee;
2. That an Ontario band Surveyor provide verification to the 'T'ownship of compliance with
the Committee's decision by verifying in writing by way of survey/real property report that
the height of the boathouse not exceed 9.14 metres (30 feet)9
3. That the boathouse not be used for human habitation, and comply with all other boathouse
provisions as contained in Section 5.6 of Zoning By-law 97-95;
4. That the appropriate building permit be obtained from the Township's Chief Building
Official only after the Committee's decision becomes final .and binding, as provided for
within the Planning Act R.S.O. 1990, c.P. 13.
5. That the appropriate permit(s) and any other necessary approval(s) be obtained from the

~1ith respect to the Zoning ~y-law, the primary purpose of prohibiting structures wi 30 metres
(98 feet) of the boundary of the Environmental Protection Zone is to ensure that development does
not occur on lands that contain hazardous slopes or are susceptible to floo ' g.
Through a review of mapping provided by the Nottawasaga Valley Conservation Authority (NVCA),
staff has determined that the pool and sheds are all located within the "Regulated Area" of the
NVCA. Under Ontario Regulation 172/06, Conservation Authorities have identified buffers around
watercourses and other features, where structures within the Regulated Area may warrant review
with respect to potential "interference with wetlands and alterations to shorelines and watercourses°'.
This office leas circulated the application to the NVCA for co ent, and as of the date of this
hearing has not received a reply.

The subject property is designated "Horseshoe Valley I,ow Density Residential" by flee (7fficial flan.
Permitted uses in this designation include single detached dwellings, home occupations, private
recreational uses and accessory uses. For the purpose of this application, an accessory use, in this
case a sanitary sewage pumphouse, would be considered as an accessory use to the existing
residentsal development designation of the subject lands.
Section D2.2.4 of the ~ffacial Plan lists policies for the creation of new lots for utility uses. e
Plan states:
"~'he creation of nesv lots for public utilities, communication utilities and seater and server
infrastructure may be permitted provided.°
a) the area of the proposed lot is minimised and r~lects what is required of the use; and
b) the implementing Zoning By-lase, as a condition of Provisional Consent, only permits uses

According to the applicants, the lot size has been determined so as to accommodate a sewage
