Keith, I am writing this email to document my telephone discussion with you yesterday
morning.
The purpose of the building envelope was to protect the trees. I very disappointed that the
two beech trees outside of the building envelope were allowed to be cut down. The reason
given by your self and the contractor was that "they would die in any case as result of the
construction of a retaining wall". Did anyone suggest that perhaps the house could be
moved/adjusted so that the trees could be maintained? A site plan should not be approved
that would jeopardize trees outside the envelope. The retaining wall should of been moved.
Allowing those trees to be cut down adds to the invasion of privacy and reduces my property
value.
I believe the township is liable for these losses. I suggest funds from the $15,000 guarantee
of the lot owner be used to plant replacement trees. The problem of course is that you can't
easily replace 75 year old trees.
I also have trees on my side of the lot line. I do not understand how you can approve a
retaining wall that may affect those trees?
You had my verbal approval that I would allow fill on my lot in order to accommodate the
driveway. I gave this approval on the condition that an written agreement would be entered
into between myself and the owners/contractor of lot 38. This will now not occur. No site
plan should not be approved that includes fill on my property.
