We are the owners of 4 Basswood Circle (lot 64) in the Arbourwood subdivision. We
were very dismayed at the recent devastation done to lots 61, 62 and 63, and the large
number of trees cut from these lots. Our property abuts the above lots and the removal of
the trees has had an adverse effect on both our privacy and shelter from the elements.
We have had to put up with the noise and dirt in the leveling of these lots for almost 2
months. We were told by Allan Lees, (TSH engineer) that there was to be a drain running
at the back of lots 62 and 63, running from the corner of our property to the ditch on Red
Oak Cres., however to date there has been do drain installed.
We would like council to hold off on returning to the developer, any monies that it has
held in reserve until at least next summer. We would like to be sure that the altering of
elevations of these lots (lots 61, 62 and 63) has not affected the drainage of our property
in any negative way.
Further we would hope that all the trees removed from the above properties will be
replaced with new trees paid for by the developer, failing that then the reserve money.
We also request that we be notified if this matter is dealt with at a Councilor Committee
of the Whole meeting.

Hawkestone
This correspondence is in response to the receipt of a By-Law report to clear debris and
garbage dumped on our lands in proximity of the trail running through Hawkestone.
The Branch Executive met on a number of occasions to discuss your work order to
address the following issues and is respectfully requesting the Township to consider the
following:
1, Sharing in disposal costs:
Access to the site is also available from the trail (former railroad land) and some
people from the village of Hawkestone use this access to the site to dispose of their
garbage, The site has now been cleaned and cleared at a cost of $8,062.60.
2. Installing Fencing
This is to deny access to our property for people from tbe village or people using the
trail. When the railroad was operational, trespassing was limited presumably because
of the daily train schedules and also because of the fence which existed. By now this
fence has deteriorated and in many instances is not in place.. Now that the trail is
available for public use, trespassing on our property has increased, Since the
Township is the owner of the trail, it is incumbent on it to fence-off its property to
deny trespassing access to private lands.
The Executive believes that these are reasonable requests, The community in our
subdivision is also part of the community at large. And, to that end, as a gesture ofa good
neighbour, a piece of the our land has been leased to the Village of Hawkestone for their

The radar sign was deployed on 11 different occasions within this time period.
The following areas were targeted: Craighurst , Edgar, Rugby, Shanty Bay.
The sign was inoperable for 30 days due to mechanical problems,
The computer program to capture and download speeds has been utilized,
The Detachment Commander will analyze the data and determine which areas
will be targeted for increased enforcement. The data will therefore not be
released as a matter of public record at this time.

Review of policinl! costs - Township of Oro-Medonte
The Council of the Township ofOro-Medonte requests an explanation of the funding
formulae used in calculating the policing costs for our Township.
Our Township has a full time population of approximately 19,000 people and is policed
by the Barrie Detachment of the Ontario Provincial Police (O.P.P.)
Our 2006 estimate for O.P.P. policing was $1,724,052, which is $143,671 per month. In
addition to this monthly cost our Township built a satellite office for the O.P.P. in 2003 at
a cost of almost $600,000. We also pay all of the capital and operating expenses on this
building including telephone, heat, hydro and janitorial costs which, in 2005 amounted to
an additional $32,702.75. Ourtotal policing costs are rapidly approaching $2,000,000.
In 2005 our offsetting revenue was reduced by $150,000 over 2004 due to a drastic
reduction in the number of PO A tickets issued by the officers.
Attached is a copy of the Barrie O.P.P. Detachment 2nd & 3rd Quarter Reports. In this
report you that Oro-Medonte share of the staffing is as follows:

However, when you study the Detachment Incident Data you will note that the total Year
to Date Calls for service in our Township is 2877 and the total hours of patrol in our
Township from April 1 to September 21,2006 is 978 hours and the total number or POA
tickets issued in this period is 364. On an annual basis these figures, on average, work
out to be approximately 3500 calls for service and considerably less than 4000 hours of
patrol in our Township.
On the basis of 17.3 officers assigned to our Township we should be receiving 35,984
hours of patrol based on a 2080 work year. At the current rate of approximately 3500
hours of annual patrol in our Township we are receiving less than two full time
equivalent officers dealing with less than 4000 calls for service at a cost of almost
$2,000,000
By comparison our neighbouring municipalities are receiving the following level of

It is hard to draw accurate comparisons as the O.P.P. refuse to supply information on the
hours of patrol and the number of officers assigned to Severn and Ramara Townships.
The cost figures are obtained from their municipal treasury department.
In summary:
Oro-Medonte is paying almost half as much as the City ofOrillia for O.P.P, coverage
when the Orillia Detachment deals with approximately five times the number of calls for
service to the City of Orillia, provide approximately 17 times the number of patrol hours
at only approximately double the cost that our Township is paying.
Oro-Medonte is paying more than the Townships of Severn and Ramara combined.

As a follow up to my e.mail of August 2, 2006. concerning the Canada-Ontario Affordable Housing Program, I am pleased
to confirm that at its meeting on August 22, 2006. County Council approved the recommendation to provide a grant to
each project within a member municipality that receives funding under the new Canada-Ontario Affordable Housing
Program from the County's Wave 1 allocation of 155 rental and supportive units. Each grant will be equivalent to the
difference between the upper tier taxes that will be levied from a project at the multi-residential rate and the upper tier
taxes that would be levied against a project if it were taxed at the residential rate. Each grant will be provided annually for
the twenty year affordability period of each project under the affordable housing program.
As indicated previously, the County requires a Council resolution from area municipalities wishing to participate in the
affordable housing program, confirming interest in participation and the tax benefit to be provided. In the case of member
municipalities this would likely mean grants in respect of lower tier taxes in the same way that the County has approved
grants in respect of the upper tier taxes,
We intend to issue a County wide RFP in October and it would be greatly appreciated if the resolutions could be
forwarded to me by September 30, 2006.

The Warminster Hall Board has requested that Council waive the requirements of the by-law for the
Warminster Santa Claus Parade to be held on Sunda December 17, 2006 at 2:00 .m,
I ANALYSIS:
The Warminster Hall Board has indicated that the necessary emergency services (O.P.P. and Fire Dept) have
been notified as well as the Public Roads Superintendent. This parade is a yearly event, and Council has
granted permission to hold the parade in the past and has waived the conditions of By-law 2006.038.
The request and parade route are altached as Attachment "A".

2005 REPORT
IMPROVEMENTS IN THE EFFICIENCY AND
EFFECTIVENESS OF SERVICE DELIVERY
The Ministry of Municipal Affairs, pursuant to Section 300 ofthe Municipal Act, 2001,
requires Ontario municipalities to report on:
a) improvements in the efficiency and effectiveness ofthe delivery of services by the
municipality
b) barriers identified by the municipality to achieving improvements in the
efficiency and effectiveness of the delivery of services by them
Please find described below details relating to improvements implemented in 2005.
Council and Staff of the Township of Oro-Medonte shall continue to strive to improve
the efficiency and effectiveness of service delivery.
IMPROVEMENT IN EFFICIENCY & EFFECTIVENESS OF SERVICE
DELIVERY
ADMINISTRATION - SCANNING OF MAPS
2,500 large format drawings/maps were scanned and are now available as an electronic
image allowing staff to more readily access these documents,
ADMINISTRATION - RECORDS MANAGEMENT SYSTEM (RMS) DATABASE
The database was modified to allow for all new building permits and by-law complaints
to automatically create a file in the RMS database eliminating the need for a file creation
request to be submitted and a file to be manually created,
Databases were modified to link RMS file information with the Property management
database allowing staff to easily identify the files which apply to a specific property.
BUILDING DEPARTMENT - INSPECTION REPORTS
Building permit inspection reports are now scanned and linked to the appropriate building
permit in the database, This has eliminated the need for staff to manually enter the
inspector's comments from the inspection report,

In January of 2006, after a public meeting to solicit input with respect to regulations licensing kennels, Council
formed an Ad Hoc Working Group to initiate a review of all regulations contained in the Township's By-law to
"Regulate, License and Control Animals within the Township of Oro-Medonte" (Attachment 1).
Recommendations from this Group were to be forwarded to Council for discussion. The Group was comprised
of six kennel/dog owner residents, three non-kennel/dog owners, a representative of the OSPCA, two
members of Council and one staff member, The Group met twice and spent considerable time discussing the
by,law and formulating recommendations to Council.
II ANALYSIS:
II
The Township is in the process of reviewing the current zoning by-law and staff's intention is to bring the
recommended zoning by-law amendments forward once the mapping is complete. Kennel zoning is
addressed in the current zoning by-law and amendments to that section will be considered along with the
current by-law regulations to prevent duplication in kennel licensing, At this time it is prudent to bring forward
the Ad Hoc Working Group recommendations as they relate to By,law 2006-119 - Animal Control.
The Ad Hoc Working Group reviewed each section of the by-law and their recommendations for amendment
of the by-law are listed here by section number,
Section 2.0 - Definitions
Current:
2,2 "Animmal Control Officer" incudes the persons or Association who has entered into a contract
with the Corporation of the Township of Oro-Medonte to control animals, This includes any
employee appointed by the Corporation,
Group Recommendation:
Amend to read "Animal Control Officer" includes the Qualified persons...."
Staff Recommendation:
That Section 2,0, Subsection 2,2 be amended accordingly,
Appendix A - Licensing, Regulating and Controlling Dogs, Section 4.3
Current:
4,3 No person shall, nor shall anyone household own, possess, or harbour, or board, or license
more than two (2) dogs unless the person or household holds a valid kennel license issued
pursuant to Appendix "6" of this by-law.
Group Recommendation:
Amend the number of dogs from two to three per household. The fee for a licensing dog tag for the
third dog be set at $30,00 for spayed or neutered and $50.00 for non-spayed or non-neutered,
Staff Recommendation:
That Appendix A, Section 4.3 be amended accordingly,

The owner pays to the Police Officer or Animal Control Officer a pound fee as provided
for in Schedule "A" of this by-law for a dog seized and impounded, plus any costs of the

shall increase as provided for in Schedule "A" of this by-law, for each additional
occurrence within a calendar year.
Group Recommendation:
Amend to delete the words "Police Officer or".

he/she sees fit without permitting any person to reclaim the dog or without offering it for sale
and no damages or compensation shall be recovered on account of its killing.
Group Recommendation:
Amend to read:

Appendix 6, Regulating and Licensing of Kennels, Sections 1.4.2 and 1.5

1.4 Every owner applying for a license for breeding purposes shall submit the following
documentation:
1.4.1 Copy of active membership in the Canadian Kennel Club or any other Association
incorporated under the Animal Pedigree Act (Canada);
1.4.2 A written, up-to-date approval from the ONT. SPCA with any costs involved borne
by the applicant; to ensure compliance with this by,law;
1.4.3 Verification of current rabies vaccination or written verification by a veterinarian of
satisfactory rabies protection for all dogs kept or to be kept at the subject kennel for
breeding purposes,
1.5 Every applicant for a kennel license for boarding purposes shall submit the following
documentation:
1.5.1 A written, up-to-date approval from the ONT. SPCA with any cost involved borne
by the applicant; to ensure compliance with this by-law,

Delete Sections 1.4,2 and 1.5 of Appendix B.

That Appendix B, Sections 1.4.2 and 1.5 be amended accordingly.
Appendix 6, Section 1.9:

pertaining to animal cruelty, under the Criminal Code of Canada,

1,9 Prior to the issuance of a license, every applicant shall provide proof that he or she has not
committed and offence pertaining to animal cruelty under the Criminal Code of Canada or the
OSPCA Act.

Group Recommendation:
a) That the licensing fee for non-spayed or non-neutered dogs be increased to provide
incentive to have the dogs spayed or neutered,
b) That the pound fee be increased from $60,00 to $75,00 and that the fee increase in
multiples of $75,00 for each additional offence,
c) That Council consider that no licensing fee be charged for working/special needs
dogs.
Staff Recommendation:
Given that the dog licensing fees were increased in 2006, and the pound fees were instituted in 2005, it
is recommended that the dog licensing fees and impound fees do not increase at this time and that
these fees be brought forward for review by the 2006-2010 Council. It is further recommended that
Council implement the Group Recommendation with respect to waiving the dog licensing fee for
working/special needs dogs.

WHEREAS the Livestock, Poultty and Honey Bee Protection Act, R.S.O, 1990, L.24,
the Animals lor Research Act, R.S.c. 1990, c. A.22, the Pounds Act. R.S.O. c. P.17, the
Dog Owners' Liability Act. R.S.O. 1990, c. D.16, the Health Prolection and Promotion
Act, R,S.O. 1990, c. H.7, contain provisions enabling municipalities to pass By-laws;
AND WHEREAS Section 11 of the Municipal Acl. 2001, S,O. 2001, c.25, as amended,
defines spheres of jurisdiction under which a municipality may pass by-laws;
AND WHEREAS the spheres of jurisdiction Include animals;
AND WHEREAS Section 103 of the Municipal Act. 2001, S.O. 2001, c.25. as amended,
states that if a municipality passes a by-law regulating or prohibiting with respect to the
being at large or trespassing of animals, the municipality may specify procedures and
penalties;
AND WHEREAS Section 150 of the Municipal Act, 2001, S.O. 2001, c.25, as amended,
authorizes a municipality to license, regulate and govern any business carried on within
the municipality for the purpose of Health and Safety;
AND WHEREAS the Council of The Corporation of the Township of Oro-Medonte
deems is advisable to provide for the licensing. reguiating and controlling of dogs and to
provide for the remOllai of dog excrement on public or private property within the
Township of Oro,Medonte;
AND WHEREAS the Council of The Corporation of the Township of Oro-Medonte
deems is advisabie to regulate and license establishments for the breeding and/or
boarding of dogs, within the corporate limits of the Township of Oro-Medonte;
ANDWHEREAS the Council of The Corporation of the Township of Oro-Medonte
deems is advisabie to provide for the regulating and prohibiting the keeping of pigeons
within the Township of Oro-Medonte;
AND WHEREAS the Council of The Corporation of the Township of Oro-Medonte
deems is advisable to exercise the authority to regulate and prohibit the keeping of
animals;
This by-law may be referred to as "The Animal Control By-law".

2.1 "Animal" means any member of the animal kingdom of living beings,

QKennel'" means any premises where dogs are boarded or are kept for the
purposes of breeding,
"license" shall mean a certificate issued by the Township of Oro,Medonte
upon compllance to this by~law permitting an owner to operate a Kennel.
"livestock" means animals or poulfry. designated as livestock and
includes cattle, fur~bearing animals, goats, horses, rabbits, sheep, swine.
fowl, ox.
2,11 "Municipality" means The Corporation of the Township of Oro-Medonte,
2.12 "ONT. SPCA" shall mean the Ontario Society for fhe Prevention of Cruetty
to Animals or any local branch of the Ontario Humane Society.
2,13 "Owner" includes an assessed owner, tenant, occupant or any person
having an interest whether equitable or legal in the land,
2.14 "Planner" shall mean the official or employee at the Township charged
with the duty of administering the provisions of the Zoning By-laws,
2.15 "Police Officer" means a police officer as defined by the Police Services
Act.
2.16 "Prohibited animal" shall mean birds or reptiles.
2.17 "Pure,bred" shall mean any dog that is registered or eligible for registration
with an association incorporated under the Animal Pedigree Act (Canada).
2.18 "Township" shall mean The Corporation of the Township of Oro-Medonte.
2.19 "Under Control" shall mean that when an animal ;s not on the property
where it is usually kept, the animal must be leased or chained, and must
be held securely by the person accompanying the animal and that person
must be physically able to control the animal.

5,0 OFFENCES:
5,1 Every person who contravenes any Provision of this By-law is guilly of an
offence and shall be liable to a fine in the amount to be determined
pursuant to Ihe Provincial Offences Act. R,S,O, 1990, c, P,33, and every
such tine is recoverable under the Provincial Offences Act
5,2 The conviction of an offender upon Ihe breach of any provisions of this By-
law shall not operate as a bar to a prosecution against the same offender
upon any continued or subsequent breach of any provisions of the
Municipal Act, 2001. 5,0, 2001. c,25, Section 442, as amended from time
to time, shall further apply to any continued or repeated breach of this By-
law.
5,3 If any court of competent jurisdiclion finds that any of the provisions of this
By~law are ultra vires the jurisdiction of Council, or are invalid for a reason,
such provision shall be deemed to be severable and shall not invalidate
any of the other provisions of the By-law which shall remain in full force
and effect,

LICENSING, REGULATING AND CONTROLLING DOGS
1,0 Every owner of a dog or dogs shall, on or before the 1 ,I day of March in each and
every year, or upon becoming the owner of a dog or dogs, register such a dog
with The Corporation of the Township 01 Oro-Medonte and procure a licensing
dog tag for each dog owned.
2.0 Every dog fag shall bear the serial number and the year in which it was issued
and a record shall be retained by the Township of Oro-Medonte, for the period of
time as specified in the T ownship's Records Retention By-law. showing the name
and address of the owner and the serial number of the tag.
3.0 The owner shall keep the dog tag securely fixed on the dog at all times and such
tag is non-transferable and shall expire and become void upon the sale, death or
olher means of disposal or transler 01 the dog so registered and licensed,
4.0 The fee charged for the replacement of a lost dog lag shall be as provided for in
Schedule "A" of fhis by-law.
4.1 Every dog tag issued pursuant to this by-law shall expire on the last day of
February. following the year in respect of which it was issued and the
license fee paid to The Corporation of the Township of Oro-Medonte at the
time of issuing of the dog tab shall be as provided for in Schedule "A" of
this by-law.
4,2 No person or persons shall keep a dog or dogs in a single dwelling unit
unless each dog has a dog tag issued pursuant to Appendix "A" of this by-
iaw,
4.3 No person shall, nor shall anyone household own, possess, or harbour, or
board. or license more than two (2) dogs unless the person or household
holds a valid kennel license issued pursuant to Appendix "8" of this by.
law.
5.0 No owner of a dog shall allow the dog to run at large within the limits of the
Municipality of the Township of Oro-Medonte.
5.1 For purposes of this section, a dog shall be deemed 10 be running at large
when found elsewhere other than on the property of the owner and not
under control of a competent and responsible person.
6.0 No owner of a dog shall allow the dog to howl or bark excessively or otherwise
become a nuisance.
7,0 SEIZURE AND IMPOUNDMENT
7.1 Subject to Section 5 of Appendix "A" of this by-law, a Police Officer or an
Animal Control Officer may:
7.1.1 Seize and impound any dog found running at large; and
7,1.2 Restore possession of the dog to the owner thereof, where:
7.1.2.1 The owner claims possession of the dog within live (5) days
(exclusive of statutory holidays and Sundays) after Ihe date of
seizure; and

7,1,2,2 The owner pays to the Police Officer or Animat Controt OHicer
a pound fee as provided for in Schedute "A" of this by-law for a
dog seized and impounded, plus any cosfs of the poundkeeper
chargeable to The Corporation of the Township of Oro,
Medonte. This fee shall increase as provided for in Schedule
"A" of this by~law, for each additional occurrence within a
calendar year.
7,1,2.3 No dog shall be returned to the owner unless it has been
licensed in accordance with the provisions of this by-law and
any purchaser of a dog without a dog tag shall obtain a dog tag
for fhe current year before deiivery is made.
7.2 Where a dog is impounded, the owner. if know, and whether the dog is
claimed from the pound or not. shall be liabie for the pound and
maintenance fees granted by the ONT. SPCA, and shall pay all fees on
demand to the Animal Control Officer,
7,3 Where. af the end of the said five (5) days, possession of the dog has not
been restored to the owner under Sub-section 7.1 of Appendix "A" of this
by-law, the Animal Control Officer may sell the dog for such price as
he/she deems reasonable.
7.4 Where the owner of a dog has not claimed the dog within five (5) days
after its seizure under Sub-section 7.1 of Appendix "A" of this by-law, and
the dog has not been sold. the Animal Control Officer may kill the dog in a
humane manner or otherwise dispose of the dog as he/she sees fit and no
damages or compensation shall be recovered on account of its killing or
other disposition.
7.5 Where a dog seized under Sub~section 7.1 of Appendix "A" of this by-law,
is injured or should be destroyed without delay for humane reasons of
safety to persons or animals, the Police Officer or Animal Control Officer
may kif! the dog in a humane manner as soon after seizure as he/she sees
fit without permitting any person to reclaim the dog or without offering it for
sale and no damages or compensation shall be recovered on account of
its killing,
8.0 Every person who owns, controls or harbours a dog shall immediately remove
any excrement left by such dog on public or private lands within the Township of
Oro-Medanle. and shall dispose of such excrement in a sanitary manner.
9.0 Notwithstanding Section 5 of Appendix "A" of this by-law. proof that the owner is
either a blind person or an otherwise physically disabled person shall constftute a
defense to the prosecution of such an offence.

REGULATING AND LICENSING OF KENNELS FOR BREEDING AND BOARDING
DOGS
1,0 KENNEL LICENSING
1,1 No person shall own, operate. manage, control, supervise, or have on any
properly any kennel unless a license has been issued for such kennel by
the Township of Oro,Medonte.
1.2 Only the owner of the property upon which the kennel is proposed to be
located may apply for and receive a kennel license.
1.3 Every owner who applies for a license shall do so on the form prescribed
by this by-law as Schedule "B- of this by-law.
1.4 Every owner applying for a license for breeding purposes shall submit the
following documentation:
1.4.1 Copy of active membership in the Canadian Kennel Club or any
other Association incorporated under the Animal Pedigree Act
(Canada);
1.4.2 A written, up-to-date approval from the ONT. SPCA with any costs
involved borne by the applicant; to ensure compliance with this by~
law;
1.4.3 Verification of current rabies vaccination or written verification by a
veterinarian of satisfactory rabies protection for all dogs kept or to
be kept at the subject kennel for breeding purposes.
1.5 Every applicant for a kennel license for boarding purposes shall submit the
following documentation:
1.5.1 A written. up,to-date approval from the ONT. SPCA with any cost
involved borne by the applicant; to ensure compliance with this byw
law;
1.6 Every application for a license shall be approved by the Planner for the
Township, in accordance with the Township of OrowMedonte Zoning Byw
law and the Site Pian Control By-law.
1.7 All applications for a license and renewal of a license require an
inspection, by lhe Township of Oro,Medonte's By-law Enforcement
Department or designate, to ensure compliance with all applicable
legislative requirements.
1.8 Prior to the issuance of a license, the applicant shall pay a fee as provided
for in Schedule "A" of this by-law,
1.9 No person shall be granted a license if such person has been convicted of
an offence pertaining to animal cruelty. under the Criminal Code of
Canada.
1.10 Any owner issued a license pursuant to this by-law shaJl apply to the
Township of Oro,Medonte to obtain approval for proposed changes to the
information contained within Schedule "8" and Section 1,6 of Appendix "S-
of this by-iaw,
1.11 Every license issued pursuant to this by~law shall expire on the last day of
February in the year succeeding the date of issue, and every application
for renewal of a license shall be finalized on or betore the same date.

1.12 In the event that the owner fails to renew a license issued pursuant to !i-;is
by-law before the expiry date, the owner shall make application for a new
license.
1,13 A license Issued pursuant to this by-law is non-transterrable.
2,0 MAXIMUM NUMBER OF DOGS
2.1 The maximum number of dogs permitted in anyone kennel for which a
Breeding Kennel License has been issued shall not exceed 25 dogs,
2.2 The maximum number of dogs permitted in anyone kennel for which a
Boarding Kennel License has been issued shall not exceed 50 dogs.
2.3 The maximum number of dogs permitted in anyone kennel for which a
Breeding and Boarding Kennel License has been issued shall not exceed
50 dogs.
3.0 CONFINEMENT OF DOGS
3.1 All dogs shall be confined inside the kennel structure during the hours of
11;00 p,m, to 7:00 a.m,
4.0 REVOCATION OF LICENSE
4.1 Any kennel license application which fails to meet the minimum
requirements prescribed herein, shall be refused for reasons of non-
compliance with the provisions of this by-law. In the event that a license is
refused, the owner has the right to a hearing under the Statutol}' Powers
Procedures Act, R.S,O. 1990. c, S.22, as amended.
4,2 Any license issued under the provisions of this by-law may be revoked
prior to expiration for any breach 01 the provisions of this by.law, in which
case the owner shall have the right to a hearing under the Statutol}'
Powers Procedures Act, R,S.O. 1990, c. S,22, as amended,

REGULATING AND PROHIBITING THE KEEPING OF PIGEONS
1.0 No personal shall keep or have any pigeons or racing pigeons unless such use
conforms with the zoning regula lions and subject 10 Appendix "C" of this by-law.
2.0 Persons may be permitted to keep or have registered racing pigeons, subjec110
the following conditions:
2.1 The owner shall be a member of a pigeon racing club within the Canadian
Racing Pigeon Union,
2,2 An owner must be a member in good standing of a pigeon racing club,
2.3 Racing pigeons shall have a seamless identity band registered to each
owner.
2.4 Racing pigeons must always be under control and never permitted 10 be a
nuisance. Flight times will be supervised.
2.5 The IoU to be deemed an accessory building of standard construction, and
will require a building perml1 pursuant to zoning regulations to erect the
loft,
2.6 The loft position should reasonably be set on the property with due regard
to distances from dwellings,
2.7 The loft must be neat, attractive. painted inside and outside, and well
maintained hygienically.
2.8 The owner shall restrict the number of pigeons in their possession to forty
(40) or fewer provided however that during the months of April to October.
this number may be increased to provide for the raising and racing of
young pigeons hatched that year.
2.9 The racing pigeons shall be contained in the toft subject 10 Appendix "C" of
this by-law.
2.10 Food provided lor racing pigeons shall be contained within Ihe loft.
2,11 The club to which an owner beiongs may be notified about any complaints
so that steps may be taken to rectify a legitimate problem, If the owner Is
in conflict with the bYMlaw provisions, failure to comply will deny him the
racing pigeon exemption.
3,0 INSPECTIONS:
3.1 An Animal Control Officer under this by-law:
3,1.1 Has the power to enter upon and examine any yards, vacant lots,
grounds or buildings, other than a dwelling, at any reasonable time
or times; and
3.1.2 May be accompanied by such other person or persons as they
deem necessary to properly carry out their duties under this by-law.
4.0 REMOVAL OF ANIMALS:
4.1 The Animal Control Officer and/or his/her Agents shall be authorized to
seize any animals of an owner who has con1ravened 1he provisions of this
by-law and refuses to remove the animals. Any costs or charges
associated with the seizure of such animals shall be charged against the
owner 01 the animals.

REGULATING AND CONTROLLING ANIMALS
1.0 No person shall keep, possess or harbour a Prohibited Animal, on any land
within the Township of Oro-Medonte,
2,0 Notwithstanding Section 1, the prohibition shall not apply to:
2.1 A veterinary hospital;
2.2 An ONT, SPCA shelter or the animal control pound which complies with
the Township of Oro-Medonta Zoning By-law;
2.3 Any animal being displayed or exhibited tor a set period of time In a
muniCipally sanctioned event, which is operated in accordance with
Township of Oro-Madonte conditions;
2,4 A bona fide farming operation for the keeping of any cattle, horse, goat,
sheep, swine or chickens as permitted under the Township of Oro~
Medonte Zoning By-law,

A By-law to amend By-law No. 2005-119 (A By-law to regulate, license and control
animals within the Township 01 Oro-Medonte)
WHEREAS Section 11 of the Municipal Act, 2001, 8.0. 2001, c.25, as amended,
defines spheres of jurisdiction under which a municipality may pass by-laws;
AND WHEREAS the spheres of jurisdiction include animals;
AND WHEREAS Council did on December 21,2005, enact By-law 2005-119 to
regulate, license and control animals within the Township of Oro-Medonte;
NOW THEREFORE the Council of the Township of Oro-Medonte hereby enacts as
follows:
1. That the Dog Licensing Fees as identified in Schedule "A" to By-law No.
2005-119 be deleted in its entirety and that the following be substituted therefore:

II BACKGROUND:

Obiectives:
Persons with disabilities represent a significant and growing part of our population. According to
Statistics Canada about 1.9 million Ontarians have disabilities - about 16% of the population.
Disability tends to increase with age. In two decades it is estimated that 20% of the population will
have disabilities. Enhancing the ability of people with disabilities to live independently and contribute
to the community will have positive effects on future prosperity in Ontario.
The Ontarians with Disabilities Act, 2001 (ODA) received Royal Assent on December 14, 2001. The
purpose of the ODA is to improve opportunities for people with disabilities through identification,
removal and prevention of barriers to participation in the life of the province. Even though new
legislation in the form of the Accessibility for Ontarians with Disabilities Act, 2005 (AODA) received
Royal Assent on June 13,2005 and is now the law, the planning requirements of the Ontarians with
Disabilities Act, 2001 (ODA) remain in force until the act is repealed.
Accessibility plans are intended to address existing barriers to people with disabilities and to prevent
new barriers from being established. A great number of our seasonal residents are now retiring to
the Township of Oro-Medonte. Many of them are in their senior years and the demand for
accessibility will increase. The municipality desires to ensure accessibility for its citizens and visitors
alike.
MethedoloQV:
Council appointed the Accessibility Advisory Committee on October 2, 2002 by By-law No. 2002-99.
The Accessibility Advisory Committee met February 13, 2003 regarding Bill 125 and the implication of
Plan for the Township.
An informal site audit was undertaken by the Fire Chief and a structural engineer of all municipally
owned buildings to identify any barriers that may exist and in particular to provide solutions to
removing those accessibility barriers.
The Township Accessibility Plan dated September 2003 was reviewed and items were identified for
the 2006 Budget Upgrades.
II ANALYSIS:

The 2006 Initiatives are as follows:
Edgar Community Hall - Threshold New threshold at door to ramp.

Hawkestone Community Hall - Washroom, Ramp, Threshold, Make washroom into handicap
Inner Entrance washroom. Replace existing
ramp. Make a new threshold.
Increase width of opening.
Completed. $7,506.00
As part of site plans/visits conducted by the Engineering and Environmental Services department to
new construction, adequate handicap parking space compliance is ensured.
The 2006 - 2009 Council will appoint new committee members to ensure continuity of the Oro-
Medonte Accessibility Plan.
II RECOMMENDATION(S):

1. THAT Report No. ADM 2006-052 be received and adopted.
2. THAT this report be forwarded to the Ministry of Intergovernmental Affairs on behalf of the

The proponent is currently the registered owner of the above noted property, which is approximately
1.47 acres, and is located east of Woodland Drive,
On April 19, 2006, Council approved a request from the applicant to temporarily reside in a dwelling
while a new dwelling is being constructed on the same property. As two dwellings on one lot are not
permitted under the provisions of the Township's Comprehensive Zoning By-law No, 97-95, Council
has in the past permitted on a temporary basis the issuance of a building permit for a new single
detached dwelling, Such permission required the entering into of an agreement specifying the terms
of removal of the original dwelling, which includes a financial bond to ensure compliance in the event
of a default.
The agreement specifies that removal of the original dwelling shall be completed within 6 months,
which expires on October 19,2006, The applicant has recently submitted a letter dated August 31,
2006, requesting an extension to June 2007, The reasons for the extension request include the fact
that construction has been slower than a traditional dwelling as the majority of the work is being done
by himself and not contractors. Given this circumstance, coupled with the fact that the financial bond
which is in place will remain, staff have no objections to this request.
II RECOMMENDATION(S):

1, THAT Report No. BP 2006-037 be received and adopted.
2. That Council authorizes the extension of the agreement to the end of June, 2007,
3. That the Mayor and Clerk be authorized to execute the amended agreement to this effect.

This letter serves as a request to extend the grant for continued occupancy in the mobile home
residence currently existing at 371 Moonpoint Drive during the construction of a new dwelling at
the sanJ.e address, It would be appreciated if occupancy could be extended until the completion
of the new dwelling, at which time the mobile home will be removed. Estimated completion date
for the new dwelling is to be June 2007, since we are doing the majority of the work. Upon
acceptance of this request, the bond in the value of Twenty Thousand Dollars shall remain with
the township of Oro-Medonte to ensnte the removal of the mobile home. Your consideration of
this request is appreciated, and we agree to continue to abide by the terms and conditions
required by the township.

The Township of Oro-Medonte is proposing to dispose of municipal property comprising two lots and
the road allowance presently known as Park Drive, which is located on the west side of Charlotte
Avenue north of Owen Road in the community of Hawkestone, As Park Drive is unopened, the
separate lots at the end are zoned Residential Limited Service (RLS), In addition, road allowances
whether unopened or opened do not have a zone category assigned to them. In order to rectify this
matter, it is prudent to rezone these lands to the Shoreline Residential (SR) Zone which would be
consistent with the zoning applying to surrounding properties in this area. The properties affected by
the proposed rezoning are indicated on Attachment #1 to this report.
Planning staff have reviewed the proposed rezoned in terms of conformity with the policies of the
Official Plan. The complied parts resulting in the future lot are all designated "Shoreline" by the
Township of Oro-Medonte Official Plan, This designation permits single detached dwellings. With the
proposed transfer of the Park Drive road allowance, the issue of recognizing development on
unopened or unassumed roads is not a concern as the resultant lots will have direct frontage on
Charlotte Avenue,
The amending Zoning By-law will achieve a number of objectives. The whole of the building lots will
be zoned Shoreline Residential (SR) which is consistent with the surrounding lots. The consistent
zoning of the lots will avoid any zoning interpretation inconsistencies for building structures and
setbacks for future dwellings, as well as accessory buildings such as sheds or pools, which may arise
on lands which are split-zoned. As well due to the disposal of the Park Drive road allowance, the
elimination of the Residential Limited Service (RLS) zone category is appropriate.
II RECOMMENDATION(S):

1. THAT Report No, BP 2006-038 be received and adopted.
2. THAT Council authorize the holding of a statutory Public Meeting as required under the provisions
of the Planning Act for consideration of the proposed Zoning By-law Amendment for lands
described as Part of Lot 24, Concession 11 (Oro) including the Park Drive road allowance.

II BACKGROUND:

Report number FD2006-011 dated July 6, 2006 reported to Council on the progress made by
Fire and Emergency Services to improve the level of services provided to our residents. To
meet the demands of the growing community, the hiring of 50 additional volunteer fire fighters
was approved.
I am pleased to advise Council that we have conducted a recruiting drive and selected 26 new
Recruit Fire Fighters. Our first-ever Recruit School is underway, providing over 60 hours of
training to each Recruit before they are assigned to their home stations. The training will be
completed at the end of October.
In order for these new Fire Fighters to begin serving the community, we have to outfit the
personal protective equipment and pager radios that all Fire Fighters require to perform their
duties. The equipment includes protective pants and jacket, helmet, gloves, protective hood,
boots, uniform shirt and pants.
II ANALYSIS:

The cost for the required equipment for the 26 new firefighters is $2,500.00 per Fire Fighter for
a total of $65,000.00 dollars. It was agreed that these equipment expenditures are growth
related therefore it is recommended that Council give favourable consideration that the funds
be drawn from the Development Charges fund.
The Fire and Emergency department will continue best efforts to recruit the desired additional
24 firefighters to meet the approved goal of 50 additional volunteers for the 2007 budget
deliberations.
I RECOMMENDATION(S):

1. THAT Report No. FD2006-15 be received and adopted.
2. AND THAT the expenditures for the equipment be drawn from the Development Charges Fund.
