File #: D14 27112 Application # 2006-ZBA-07 C.ofW. 0-002-20900 On March 28, 2006 an application for a Zoning By-law Amendment was submitted by Morley Campbell. This application is necessary to fulfill a condition of approval for Consent Application 2006-B-05, which was granted by the Committee of Adjustment on March 16, 2006. The rezoning application applies to lands described as Concession 4, East Part of Lot 20, 184 Line 4 North in the Township of Oro-Medonte (formerly Oro). The subject land is proposed to be rezoned from Agricultural/Rural (A/RU) Zone to Residential One (R1) Zone. Consent Application 2006-B-05 facilitates a small parcel of land to be added to the abutting Residential One (R1) lands being 2037 Highway 11. the Planning was on 26, 2006. no objections were received to Official Plan provides a consent may be permitted for the purpose of modifying boundaries, provided no new building is created and the boundary adjustment not affect the viability of the properties affected. addition, the boundary adjustment will affect the viability agricultural parcels affected. It is staff's opinion that this proposal will not adversely affect the agricultural character of the Township and a new lot is not created by the consent application. Therefore, this application conforms to the policies of the Official Plan. In March, 2006, the applicant was granted a conditional consent (boundary adjustment) which resulted in approximately 0.26 ha (0.65 ac) of a larger agricultural parcel being added to an abutting residential parcel, containing a dwelling at 2037 Highway 11. The boundary adjustment will add mature trees and a grassed area to create a larger lot for the existing residential use. The consent application will increase the area of the newly configured lot to approximately 0.88 ha (2.17 ac). The Committee of Adjustment's decision included a condition of approval to rezone the subject lands to apply a consistent residential zoning throughout the property. This application will rezone the 0.26 ha (0.65 ac) lot addition from Agricultural/Rural (A/RU) to Residential One (R1). The existing lot located at 2037 Highway 11 is zoned Residential One (R1) Zone. As a result of the lot addition, the residential lot at 2037 Highway 11 will have a rear lot line which will be straight and inline with the adjacent properties to the east. The newly configured lot will also have a consistent lot depth with the other adjacent lots. The new lot depth will be in keeping with the adjacent lots in the immediate area. The rezoning application will facilitate a consistent residential zone, (Residential One Zone) and zoning standards (Le. yard setbacks) being applied to the whole of the property. would avoid the property having a spilt zone and eliminating any zoning interpretation conflicts. application has been circulated to all internal departments and necessary outside agencies. Comments received from internal departments and outside agencies have not indicated any concerns. The proposed Zoning By-law Amendment conforms with the policies of the Official Plan and staff is in support of the proposed rezoning of the subject lands from A/RU to R1 Zone. Date: -00500 The purpose of this report is to consider the proposed Zoning By-law Amendment application submitted by Robert Drury on May 29,2006. This rezoning must be obtained as a condition of approval for consent application 2006-B-03, which was granted by the Committee of Adjustment on February 16, 2006. The rezoning application applies to lands described as Concession 1, Lot 12, in the Township of Oro- Medonte (formerly Oro). The subject land is proposed to be rezoned from the Agricultural/Rural Zone to the Rural Residential (RUR2) Zone. Consent application 2006-B-03 resulted in a portion of an agricultural parcel being added to an abutting residential parcel. As part of provisional approval, applicant must and obtain a create a zone ,. The property subject to this rezoning application contains an existing residence and a detached accessory structure. The parcel to be conveyed as a result of Consent application 2006-8-03 totals 0.11 acres - as such, this application does not propose to remove active agricultural land from production, and will not reduce the agricultural resource base or adversely affect the viability of the agricultural parcels. Therefore, this application generally complies with the objectives of the Township Official Plan. In February 2006, the applicant was granted a conditional consent (boundary adjustment) which resulted in approximately 0.04 ha (0.11 ac) of an agricultural parcel, located at 661 Penetanguishene Road, being added to an abutting residential property located at 665 Penetanguishene Road. The boundary adjustment effectively added several medium-sized trees, and created a larger lot for the existing residential use. The consent application will increase the area of the existing residential lot to approximately 0.2 ha (0.5 ac), and as well, bring the existing residential dwelling into compliance with the required side yard setback. The existing residential lot located at 665 Penetanguishene Road is zoned "Rural Residential Zone" in Township's Zoning By-law. Staff is of that land be conveyed from the subject property should be rezoned to maintain a consistent residential zoning on the whole property. Therefore, the application's intent to rezone the 0.04 ha (0.11 ac) lot addition from Agricultural/Rural (A/RU) to Rural Residential Two (RUR2), is appropriate. The application has been circulated to all internal departments and necessary outside agencies. Comments received from internal departments have not indicated any concerns. At the time of writing this report, the Simcoe County District School Board and the County of Simcoe Planning Department have advised this office that there are no objections to the application.
