I June 14, 2006 From: Andrea Ronan on behalf of the Harbourwood Playground Committee Re: Development of Shelswell Park Good morning, I am a resident of Harbourwood and a representative of our neighbourhood playground committee. Further to our deputation on May 17th, I would like to further revisit and report to you our progress in the plan of a playground multi-use pad and gathering area for neighbouring residents in the Harbourwood/Shelswell area. Given the history of this subdivision and the surrounding Shelswell area community and its positive contributions to the neighbourhood park already, it is time for us to have a playground for our children to play at, meet other neighbours, safely gather to have fun and develop many skills both physically and socially. A park with a play structure would say to current and future residents that this is a fun, safe and family oriented community. What a great way to promote the physical activity of our children and youth when so many studies say that this important component is lacking in their daily lives. On June 1st our committee invited our neighbours to a meeting to discuss this plan. The neighbours were supportive of the plan and we discussed that the site be located north east of Lakeshore Rd. near the Pine forest in Shellswell Park as opposed to Harbourwood Park. There are essentially 3 portions of parkland in that area, the Harbourwood garden park, the Shellswell treed park, and the waterfront portion of Shellswell Park. Each of these parklands with their different uses would compliment each other nicely, a park with lovely gardens, a park with a playground and possibly multi use pad and gathering place, and a water front park. A playground in Shelswell Park would also be more accessible for the entire community. It is our understanding that Shelswell Park was donated some years ago, but remains seemingly ignored. It is evident that different councils have different priorities regarding the sale and retention of Parks. Developing Shelswell Park would be an important statement of this council's intentions to preserve parkland in this area, Through further research with other communities in Oro Medonte, we have learned that there is more than one neighbourhood park that has been approved for full funding of the project by the township. One example completed a few years ago is the Bayview Memorial Park at Oro Beach. This park not only has a playground on the beach, but a multi use pad, picnic facility and washrooms. It seems that the area and waterfront for both this park and Shelswell park are very 1 /cont'd.... similar, according to a public parkland inventory map provided by the township. Another example of a playground being that in Sweetwater Park in Sugarbush. It is our understanding that this park was developed fairly quickly by council recently with a smaller surrounding population than that of our area and as well. I think that you will agree that the Harbourwood/Shelswell area playground has been in discussion for longer than 5 years with little or no response from the township and it is long overdue to be built for this established community. It is our expectation that the Township would take the initiative and leadership with this project in the same manner that it did with Bayview Memorial Park including providing full funding for the project. The request has been in at council for years now and it is time to act on it, it is long overdue. Our next steps are to move forward with this plan as soon as we hear from council as we have a group of interested residents that are ready and willing to assist. We would like to have an answer back from the Township prior to your recess for the summer months so that we can get the project underway. We look forward to working with you to make this proposal a reality for our neighbourhood and our children. I understand that this is an issue of great importance, particularly to our rural municipalities. My colleagues and I recognize that large investments are required in Ontario's water and wastewater systems in the coming years. As you may know, the Ministry of Public Infrastructure Renewal is currently heading the development of a water investment strategy that will include options for the future organization, governance, investment, financing and pricing of water and wastewater services in Ontario. In August 2004, our government appointed a Water Strategy Expert Panel to provide advice on how best to invest in needed improvements to Ontario's water and wastewater infrastructure. Our goal is to ensure that systems are financially sustainable and that water rates are affordable. The panel's report was released on July 22, 2005. Regulations for driveways Surface of drivewav to a parking area or a parking lot A driveway to any parking area or parking lot shall be maintained with a stable surface, which is treated so as to prevent the raising of dust or loose particles. Width of drivewavs leading to a parking area or a parking lot Driveways that cross a front or eXlerior side 101 line and lead to a parking area or parking 101 shall be a minimum of6.0 metres (19.6 feet) in width for one-way traffic and a minimum of 12.0 metres (39.4 feet) in width for two-way traffic. This provision shall not apply to driveways that provide access to privale garages associated with a residential use. In no case shall the width of a driveway exceed 30 percent of the 10lfronlage. Driveways that cross a frol1l or eXlerior side 101 line and are used for the parking of maIOI' vehicles and/or are used to access single detached or semi-detached dwelling unilS shall be located no closer than: a) 3.0 metres (9.8 feet) to the interior 101 line; and, b) 3,0 metres (9.8 feet) to the exterior side 101 line. if the driveway does not crosS the exterior side lot line. Notwithstanding the above requirements, a driveway may be located closer than 3.0 metre (9.8 feet) to the inlerior 101 line if the driveway is to be shared with a driveway on an abutting 101 and/or the driveway accesses a detached privale garage in the rear yard. From the original meeting hosted by Rama Mnjikaning First Nation, there have been follow up meetings that have begun to crystallize the growing agreement that a regional approach can be a useful way forward. As a concrete move in this direction, and coincident with the Mnjikaning initiative, my Chamber, with the support of our Mayor and Council, has contracted with Sims Latham Associates to undertake a survey and analysis of the current state of economic activity in this region and begin to identify directions for future development. We intend to begin work on July I" with the reporting target of early 2007. As well as discussion with all the local authorities, the initiative has been discussed in detail with our local MP and MPP. Both Mr Stanton and Mr Dunlop, who have been briefed on this project, have indicated full and enthusiastic support and promised to help us in any way possible. You and your Council have also been good enough to provide us with letters of support and we would now like to ask if you would be prepared to go further and become a Partner with us in this initiative. As a Partner we would engage to report to yourselves on our progress in detail, make presentations as requested and focus on your areas of concern in our data collection and analyses. We believe that your agreement to become a Partner would be of great value not only to yourselves, but also to all the others participating in the initiative. As this is only an initial phase of the full project, which it is intended will eventually lead to the creation and implementation of a coordinated Strategic Plan for the region, we are suggesting that the only formal requirement to becoming a Partner for this stage would be your declaration and a nominal contribution to the project funds of$5,000. We have discussed this project with funding organisations at both federal and provincial level. In both cases they stressed that they would be able to approve the project - if it was based on a partnership of business, community and municipalities. Specifically, it has been indicated to us that a joint proposal from ourselves to fund the initial stage would receive a positive response under the RED program and Mr Dunlop has agreed to support this application to Ontario. If you intend to bring this matter to your Council for consideration we would be glad to make a presentation detailing the initiative and the anticipated results and benefits, if you believe that this would be helpful. A Briefing Paper, prepared by the consultants, outlining the work that will be completed in the various stages of the project is enclosed with this letter. Funding bodies will look more favourably on those applications that can demonstrate regional collaboration and financial commitment. The goal was to develop a Children's Camp and Recreation Area for Ukrainian-Canadian Children and their Families to enjoy a retreat from the city each summer. At the same time an area of land was subdivided providing Ukrainian-Canadian families the opportunity to build summer homes. By 1962 both the Camp Ground and the Village were established and in operation. Since then the UNF and the Property Owners Association have made an important contribution to the local community. The UNF and Property Owners Association is submitting this request to the Township of Oro in regard to the amalgamation and re-designation of Leigh Rd. and Taras Boulevard, as part of . the Sokil Community's effort to commemorate the 45th year of establishment, and the 75th anniversary of the Ukrainian National Federation in Canada. Included in this document are the full details of this proposal, as well as signed letters of support from the Sokil Property Owners Association, Ukrainian National Federation, and Individual Property Owners including those owning property on Leigh Rd. and Taras Blvd. It is the hope of the Ukrainian National Federation and the Sokil Property Owners Association that the requests detailed in this document will be met with in open and supportive manner by the Township of Oro-Medonte, and that we will be able to work with the township further in this regard. . This discrepancy was resolved by the Township with the requirement to clearly identify streets in the community for Fire and Rescue Purposes. The UNF and Sokil Property Owners Association understand the convention used for re-designating that part of Shevchenko Crs as Leigh Rd. and the need to clearly identify roads for safety reasons. However the unique character and the important historical significance of the community is such that special consideration with respect to the naming of streets in the community is justifiable. The Sokil Property Owners Association made a request in 2005 for the re- designation of Leigh Rd. as Onipro Blvd. The subsequent report by the Township . indicated that Onipro Blvd did not fall into the naming convention of the township. Furthermore the Property Owners Association was informed that notice of the change was submitted in writing in local newspapers before any changes were made. Given this, and taking into account special considerations for the status of the community the Sokil Property Owners Association, and the Ukrainian National Federation would like to propose the amalgamation and re- designation of Leigh Rd. and Taras Blvd. The proposal takes into account both the Naming Convention used by the Township, and the Important Historical and Cultural significance of the community. . Figure 1 The amalgamated road will be re-named "Sokil Blvd." to commemorate the 45th year of establishment of the community of Sokil and the associated campground, as well as the 75th year of the establishment of the Ukrainian National Federation. The word "Sokil" is the Ukrainian word for "Hawk" referring to the name of the village of Hawkestone. Since the small community, and associated camp ground was established it has used the "Sokil" name, and the Property Owners Association and the Ukrainian National Federation would . like to commemorate this fact by designating the central roadway through the March 1 st 2006 Soki! The community of Sokil has been an integral part of the Village of Hawkestone, not only through the important economic impact that it has had on the community over the years, but also for the diverse cultural impact and community support through the Hawkestone Park land lease. The "Sokil' name represents a "practical feature" of the community and also commemorates the important work that all of the founding members of the community did to establish the village, and build a campground for generations to spend their summers on Lake Simcoe away from the city. Furthermore the proposed name is in line with the naming convention of Oro-Medonte, as well as this particular community, which is distinct from other parts of the greater Oro-Medonte community. Each of the other streets in the village all bare a Ukrainian name, and are named . after important historical figures and geographic locations, important to the people who founded the village 45 years ago. This proposal includes written support from the Ukrainian National Federation (appendix A), the Sakil Property Owners Association (Appendix B), general survey from Property Owners (Appendix C), and written support from the owners of all properties located on Taras Blvd. and Leigh Rd. (Appendix 0). COVENANTS BY THE OWNER The Owner covenants and agrees as follows: a) The Owner owns the subject lands described in Schedule "A", attached hereto, and has provided the Township with a Registered Deed containing the legal description of the subject lands. b) This Agreement may be registered against title to these subject lands and shall take priority over any subsequent registrations against the title to the subject lands, c) No work shall be performed on the lands, nor any use made of the subject lands with respect to the proposed development, except In conformity with all the provisions of this Agreement d) The Owner shall, prior to the execution of this Agreement, obtain all necessary permits and approvals from the Township and from all Ministries and Agencies. including, but not limited to, the County of Simcoe, e) The Owner shall, prior to the execution of this Agreement. pay all municipal taxes and charges related to obtaining the approval of these lands for the intended use, f) The Owner shall pay a refundable deposit for such reasonable costs as may be Involved to the Township in having its solicitor. engineer, planner and staff, perform any work in connection with this Agreement, including the preparation, drafting, execution, and registration of this Agreement The Owner acknowledges and agrees that the Owner shall be responsible for the cost of performance of all the Owner's obligations hereunder, unless the context otherwise requires, Every provision of this Agreement. by which the Owner is obligated in any way, shall be deemed to include the words "at the expense of the Owner". unless specifically stated otherwise. The refundable deposit for expenses and actual cost shall be $N/A. The Owner shall replenish the refundable deposit, to its full amount, when the expenses and actual costs are submitted by the Township. g) The Owner shall have delivered to the Township, all Transfers/Deeds, Discharges and Easements, or other documents required by Schedule "C", as well as certification from the Owner's solicitor that the Transfer/Deeds and Easements shali provide the Township with good title, free and clear from all encumbrances, h) The Owner agrees that prior to issuance of a Building Permit. a Sewage System Permit approval must be received by the Township/Ministry of the Environment I) The Owner acknowledges that the lot does not front on an Improved public road, that the Township does not or is not required to maintain or snowplow the said road, that the Township will not take over or assume the private road as a Township public road or street unless it has been built according to the Township standards, then in force, and that the Township is not liable for any injuries, losses or damages as a consequence of the Township issuing a Building Permit 2. COVENANTS BY THE TOWNSHIP The Township covenants and agrees as follows: a) That the Township has enacted a By-law to permit a 25' x 30' garage described on the Site Plan. b) That the Township agrees that subject to compliance by the Owner with all relevant Municipal By-laws and Provincial Statutes and Regulations. the Owner may proceed to develop the subject lands, as Indicated on the Site Plan attached hereto as Schedule "B". subject to the development restrictions contained herein. 4 3. SECURITY Prior to signing the Agreement, the Owner will deposit, with the Treasurer of the Township, to cover the faithful performance of the obligations of the Owner arising under this Agreement, including but not limited to the construction of the works and services identified in Schedule "0" to this Agreement (the "said Work"). the following securities: a) Cash in the amount of one hundred percent (100%) of the estimated cost of the said work, as approved by the Township Engineer and Township Council, or: b) An irrevocable Letter of Credit from a chartered bank, issued In accordance with the requirements of Schedule "E", with an automatic renewal clause In the amount of one hundred percent (100%) of the estimated costs of the said works, and as approved by the Township Engineer. The Letter of Credit shall be for a minimum guaranteed period of one (1) year. or such time as the Township decides, and shall be renewed automatically, as necessary. thirty (30) days prior to expiration, c) The Township reserves the right to accept or reject any of these alternative methods of providing securities, Prior to depositing the securities. the Owner's Engineer shall submit an estimate of the cost of the works to the Township Engineer for approval. When the cost estimate has been approved, It will be set out in Schedule "0" of this Agreement and will become the basis for the limits of the securities, d) Any Letter of Credit or security filed with the Township is based upon the estimated cost of completing the various matters prescribed by this Agreement. However, all Letters of Credit and security received by the Township may be used as security for any item or any other matter which, under the terms of this Agreement, is the responsibility of the Owner, Including without limiting the generality of the foregoing, payment of engineering. legal, planning or other costs incurred by the Township. which are the responsibility of the Owner, under the terms of this Agreement. e) Upon written notification by the Owner's agent, certifying that all required works for which the Letter of Credit was submitted have been completed In accordance with the plans submitted and upon confirmation by the Township or its agent that the Owner's obligations under this Agreement have been completed, the Township will return said Letter of Credit. f) If in the event of default of the Owner under any of the provisions of this Agreement, it becomes necessary for the Township to realize on its security or deposits, then the Township shall give. by registered mall. twenty-one (21) day's notice, its Intent to draw down on the security or deposit. 6. COMPLIANCE Any action taken by the Township or on its behalf. pursuant to this Agreement, shall be in addition to and without prejudice to any security or other guarantee given on behalf of the Owner for the performance of its covenants and agreements herein, and upon default on the part of the Owner hereunder, the Township shall, In addition to any other remedy available to it, be at liberty to utilize the provisions of Section 427 of the Municipal Act, 2001, S,O. 2001. c. 25, as amended. 7. CO-OPERATION The Owner consents to the registration of this Agreement by the Township, upon the title of the subject lands, at the expense of the Owner and agrees to execute such further and other documents, consents or applications, as required, for the purpose of securing registration and giving effect to the provisions of this Agreement. 6 8. BINDING EFFECT This Agreement, and everything contained herein. shall be binding upon the successors and assigns of the parties hereto. and upon the lands described In Schedule "A", attached hereto, such Schedule being a legal description of the lands. and it is further agreed that this Agreement shall be prepared, approved and registered on title, 9. SEVERABILITY OF CLAUSES Should any section. subsection, clause, paragraph, or provision of this Agreement be declared by a Court of competent jurisdiction to be invalid. the same shall not affect the validity of the Agreement as a whole or any part thereof, other than the provision so declared to be invalid, 10, SAVE HARMLESS The Owner, on behalf of itself, its successors and assigns, agrees to Indemnify and save harmless, the Township from and against any and all claims, suits, actions and demands whatsoever. which may arise either directly or indirectly by reason of any work or service performed by the Township, its servants or sub-contractors in order to complete the work or services required to be completed under this Agreement, provided the subject matter of such action, suits, claims or demands was not caused intentionally or through gross negligence on the part of the Township. its servants or agents or sub-contractors. File #: # Date: RolI#: As a result of a recent decision of the OMB, it has become clear that some slight modifications to the existing cash-in-lieu of parkland by-law are required. These changes have to do with how the value of the land is assessed in determining how much the cash-in-Iieu amount is. The Parkland By-law passed by Council in 2004 established a $2,000 fee for residential lots, a $500 fee for industrial and commercial lots and a $800 for a time share unit. It is not proposed that these numbers be changed at all. The above numbers were based on an assessment of the value of the land on the day before a building permit is issued. However, the $2,000 amount established for a residential lot equates to a lot having a value of only $40,000. At the present time, most vacant lots in the Township sell for more than $100,000. The number was kept artificially low (based on the value before building permit issuance) since $2,000 was a reasonable amount at the time the By-law was prepared. The recent OMB decision in Mississauga dealt specifically with how cash-in-Iieu of parkland is determined; it is therefore clear that the municipality cannot determine the cash-in-lieu amount based on the value of the land before building permit issuance for lots created by plan of subdivision or consent. Instead, the value has to be determined as of the day before the day draft plan approval or provisional consent is granted. However, it continues to be staff's opinion that the cash-In-lieu amounts established In the by-law are appropriate. If a landowner has a concern with the amount, they do have the option of hiring an appraiser and make and argument that the amount should be reduced, This process Is clearly articulated In the By-law. On the basis of the above, the changes In the attached draft by-law (highlighted In italics and bold) are only Intended to clarify how the cash-In-lieu amounts were calculated. As a condition of development, land is required to be conveyed to the Township for park or other public recreational purposes as follows: a) In the case of lands proposed for development for commercial or industrial purposes, land in the amount of two per cent (2%) of the land to be developed; b) In the case of lands proposed for development for residential purposes, land in the amount of five per cent (5%) of the land to be developed; and, c) In the case of lands proposed to be developed for timeshare or fractional ownership purposes, at a rate of two per cent (2%) of the land to be developed. 3, In lieu of requiring the conveyances referred to in Section 2, the Township may require the payment of a fee of $2,000 for each new lot created for residential purposes pursuant to Section 53 of the Planning Act. Nothing herein shall prescribe or limit the Township's ability to require a combination of the conveyance of land at the standards specified or cash-in-lieu. 10.
