Dear Sirs:
We have been the legal owners of property described as 9 Mohawk Heights, Plan M9 Lot
126, in the Subdivision known as Sugar Bush, in the Township of Oro-Medonte, since
July 1988. Also, we might add, we have been paying taxes, which steadily increase, in a
timely manner.
We approached Century 21 in Barrie last July with the intention oflisting for sale the said
prope.rty and spoke to an agent by the name of Pat Boland (705-721-9182), Ms. Boland
called us today to discuss her recent research on the land and to review why, in her
opinion, it was not selling. She is available to answer your questions at the above
number. What she found and related to us has been very disturbing to us. A brief
overview follows:
. Construction of a culvert was carried out and work done by the Township of Oro
Roads Department. We have determined that Gerry Ball is Roads Supervisor.
. We had no prior knowledge, NOR gave our permission for your crews to enter
our property and commence any sort of work in this regard. Was this trespass?
. Both sides of Mohawk Heights are drained to a culvert on our property following
this work. In turn, the run-off flows down the hillside on Lot 126, This has
allowed a new drainage channel to form causing some large trees to heave and
become loosened. Naturally, in time the water damage will cause the trees to die
and fall. A good strong wind will likely topple them in time, and who will be
responsible for the damage should they come dmvn on another neighbours home?
. This is not a natural water course and will in time erode the ground and cause
untold damage to the surrounding land area. This situation, ifleft, could cause
further damage to the homes below our lot, possibly washing out basements. It

is beyond comprehension why this would have been allowed to go ahead in the
first place, especially since the property owners were never advised.
We were initially involved in the legal action taken by Mrs. Piantoni, in 2000 for
property damage, when her septic system was washed out. Mrs. Piantoni executed a full
and final release in our favour on July 3, 2003. Mrs. Piantoni lives next door to the
property in question. The final outcome of the former litigation was not made known to
us, but at that time we did hear talk of a culvert which had caused the intitial damage,
We were not aware to what extent nor that the culvert was in the middle of our property,
nor the seriousness of this situation until our real estate agent walked the lot and followed
up with us. You own the problem, and we think you should purchase the land to go with
it!
WE NEED ANSWERS. WE NEED RESOLlJTIONS.
We would appreciate your immediate attention to this situation.

My wife and myself own a home in the Arbourwood subdivision.
We have a number of questions to ask In respect to Ms. Zieleniewskl's letter in respect to the possible disposal of
lands within the subdivision.
These questions are in reference to the current status of the subdividers agreement and the schedule for assumption of the
subdivision by the municipality, the dedication of the parcels of land, current title status to the lands being considered and a
number of other general questions In respect to the proposal.
We are also very Interested In the economic plan for the possible disposal of these blocks of land because we as property
owners are by the fact we purchased our property in the subdivision economic parties to these properties.
Please advise, should we direct these questions to you, some other administrative person or to an elected representative?
It is very important any surrender of public lands should only be completed after a full, crystal clear exchange of Information
and a comprehensive dialogue between ALL interested parties has taken place and a policy/ plan has been developed and
fully explained to all interested parties, ie the subdivision property owners

RE: Librarv Services Contract
I am writing In response to your letter of April 4, 2006,
The fee of $3270.00 has been paid annually to the Springwater Library since amalgamation in
1994. Costs for all township services have increased significantly since that time.
On March 7, 2005, I sent a letter to your attention stating that 104 households had used the
Springwater Library during 2004 and that our rate per household had Increased to $60.00,
That would have made your contribution $6240.00 versus $3270.00 that was received for that
year.
Our new non-resident rate for 2006 is $70,00 per household and based on a user count of 89
households for 2005 the contract fee will be $6230.00 for this yeer.
Oro-Medonte residents receive the same quality of service as residents of Springwater, and they
have enjoyed this opportunity for many years. If you feel that Oro-Medonte is unable to make full
payment for library services, the Library Board will be terminating the agreement with Oro-
Medonte.
I would appreciate your decision by the end of May, so that Ore-Medonte patrons can be notified
of your decision.

Please be advised that your letter of March 27,2006 was reviewed by the Council
of the Township of Oro-Medonte during its budget deliberations.
Council determined that they could not support a 90% increase over last year's
contribution of $3,270. Council determined to increase its contribution by $1,000 per
year until the full non-resident fee is achieved. As such, the Township of Oro-Medonte
proposes to contribute $4,270 for 2006.

Thank you for your e-mail of MAY 5TH.
IN GENERAL it seems logical to my wife and myself the township would focus on the development of block 101 as' The parkland
in the subdivision'.
This could POSSIBLY lead to the disposal of blocks 102 and 103 as is proposed for consideration AS NON REQUIRED PARK
LAND.
HOWEVER IT SEEMS OTHER PROPERTY OWNERS IN THE SUBDIVISION HAVE OTHER THOUGHTS. WE ARE
INTERESTED IN THEIR THOUGHTS AND THEIR RATIONALE FOR POSSIBLY KEEPING BLOCKS 102 AND 103 AS OPEN
SPACE. I must say' Standards of Township Maintenance' of these two blocks as open space would be a very important issue to
weigh if the blocks were to be kept as public open space.
We assume:
Blocks 101, 102 and 103 were dedicated to the township by the developer under the sub-dividers agreement or other
agreements.
Where the 3 blocks dedicated as parklands or parklands and/or municipal use ?
Why have we heard blocks 102 and 103 referred to as ' Water Management Lots" ? Is there some need to
keep these lots as open space for water management?
Would the revenue from the possible sale of Blocks 102 and 103 belong to the township?
What percentage of the LARGE net revenue from the land sale would be re-invested in the development
of the subdivision park?
We assume there are lot development charges dedicated to the township based upon the 110 lot subdivision and a portion of
these charges would be used for park development purposes. We also assume these per lot charges were substancial and there
would be considerable monies available for the development of the park in Block 101.
Because of the development charges we are interested in the township's rationale for the need to use some of the revenue from
the sale of blocks 102 and 103 to help offset the development costs for the park. We are of the opinion adequate monies are
available in development charges to develop the park and additional revenues from the sale of the blocks should not be
required.
It seems to us there is a need for a lot of dialogue between all interested parties in regard to the possible sale of these blocks
because there is a large variety of thought among the local property owners. A decision to sell the blocks must NOT be made until
all interested parties have had the opportunity to express their views and have given their rationale for their views. THEN
DECISIONS CAN BE MADE. It is our wish we be included in the process.

Please be advised that we are totally opposed to the sale of lots 102 and 103. We need and want the parklands
that were promised in the planning and development of the Arbourwood subdivision.
It was very evident at the council meeting April 26 that the vast majority of residents are against the "proposed"
sale of these lots.
It was also very disappointing that council was not receptive to listening to us, with the exception of Deputy-
mayor Harry Hughes. He was our sole supporter! In view of this, in our first dealings with this council, it is
very hard to respect the other governing officials that can't seem to hear the people's wishes!

The purpose of this letter is to express the strong objection that both my wife and I have
to any disposition of lands within the Arbourwood subdivision. In point form, the
following are some of our reasons for feeling so strongly about this issue.
_ the lots were paid for by everyone in Arbourwood through their original purchase price.
_ two parks enhance the community and make it a safer place for all of our children.
_ the Agreement of Purchase and Sale included a "feature sheet" and a "site plan" showing
two seperate and distinct parks.
_ the subdivision is not yet fully populated and future residents would have no input in
this important issue.
_ per the April 4th letter from Jennifer Zieleniewski, if the sale was to proceed, only a
portion of the proceeds would benefit the subdivision.
_ everyone in the subdivision wants close proximity to a park and this can only be
accomplished by developing the two parks we all were promised.

Re: Potential Sale of Block 101 & 102
It has come to our attention that Council is trying to sell the land in the Arbourwood subdivision known as block 101 &
102. This land was originally committed as park land.
When my wife and I invested our life savings in the area known as Arbourwood the parks were a real selling point for
us. Don't take our parks. We paid for them and we expect them as part of the deal that was originally struck with the builder
& developers. Leave these parks alone. We take our child into Barrie regularly to visit the various parks while we wait
patiently for our parks to be ready.
It was also our understanding that no chain link fence was to be used in the subdivision. Could some one please tell me
why surrounds the park situated between Walnut Drive and Basswood? At what point can we expect this park to be
completed? Does an empty field constitute a park? If so since when?
In closing I would strongly encourage that the land designated as park land be kept as park land! Leave our parks alone.

TO WHOM IT MAY CONCERN:
When we purchased our property in Arbourwood Estates it was with the agreement that
the above mentioned lots were to be preserved as parkland and green space.
We strongly oppose the addition of these lots being redeveloped into housing. The area
in question should be left as green space for the enjoyment of the community and nature.

1- When we purchased our new lot, the " site plan" that was given out by the builder
was showing 2 separate parks which attracted our interest to move to this new subdivision
2-Two separate parks would hardly be enough for our subdivision and the surrounding
areas where there is no extra parks for them.
3-The township should encourage the new subdivisions to have more parks not to build houses on lots
designated to be parks.

I wish to make a few comments on the proposed sale by the Township
of Blocks 102 and 103 on the ARBOURVfOOD SUBDIVISION.
I was the developer of this subdfvision, and therefor am knowledge-
able about it. One of the strict requirements for approval of thi.s
subdivision was that a minimlAU of 5 percent of the land area be ded-
icated as parkland. Two narks were dedicated,. beiM APJ30URWOOD park
being Block 101 containing 1.5 HA or 3.7 acres, and Elf;ILY park,being
Block 103 containing .73 HA or 1.8 acres. The total of both parks is
5.5 acres. The total area of the subdivision is 44.03 HA or 108.8 ac.
Five percent of this area is 5,44 acres. Therefor the park land area
requirement was met by the dedication of these two land areas of 5.5
acres. I was surprised to learn that what was a firm requirement of
the Township and the l1inistry of Municipal Affairs to obtain their
approval of my subdivision, is now being subverted.
I am opposed to the sale of Block 103, and consider that Elf;ILY park
which was named after my grand-dau~hter should be developed for the
purpose planned.
As to Elock 102. this was stipulated to be the detention pond. hhen
my neighbour refuse&\ to grant a drair~ge easement, I then purchased
i5~ acres of his land and the detention pond was moved to this prop-
erty, Block 102 was then not required for its intended purpose.
Block 102 contains .86 or 2.12 acres . This parcel adjoins EMILY park
and would make an excellent addition to this park, givir~ it an area
of 3.92 acres. I am of the opinion that Block 102 should be added to
Block 103 to form a Dark large enough for the developlllent of recreatii
anal facilities.

Chronology of Request - Knox Presbyterian Church Cemetery Board
1.
January 11, 2006 - Committee of the Whole defeated the Request for
GranVSubsidy** from Robert Currie on behalf of the Knox Presbyterian
Church Cemetery Board. The request was in the amount of $750.00 to
be applied to the cost of new fencing.
2.
February 8, 2006 - Committee of the Whole received correspondence
dated January 26, 2006 from Robert Currie on behalf of the Knox
Presbyterian Church Cemetery Board**. The correspondence
requested that Council consider waiving the rezoning fee incurred in
2005 when 2.5 acres was added to the Cemetery grounds. This
request was referred to staff for a report.

As you can see there are only three sources of income for us at the present time, the sale
of plots, donations and interest.
As you can well understand our income will fluctuate from year to year. It is influenced
by the level of donations we receive mainly at our memorial service (weather can playa
large part) and from time to time during the rest of the year. The sale of plots will vary
from year to year as well. Interest on GlCs and other bank deposits is very inadequate to
begin with. Mueh of the principal of the GlCs has been used to pay for the additional land
and more will be required for the fencing and Ianeways. Henee the income from this
source will be depleted.
Knox Cemetery is one of the oldest pioneer cemeteries in Simcoe County. Its historical
significance andjmpact on the communities it has served in Oro-Medonte is a proud part
of our heritage.

In view of the fact that we did not qualify for a grant and after discussing the situation
with Chris Carter, 1 was wondering if you would consider refunding all or part of the
rezoning application fee that we incurred when wc added the 2.5 acres to Knox last year.
Jf the refund were granted it would be applied toward the cost of new fencing around the
property at Knox.
As you all can well appreciate, in community organizations such ours, anywhere that we
can save money will benefit the community which we serve.

II BACKGROUND:

On January 26,2006 the Township of Oro-Medonte received a letter from the Knox Presbyterian Church
Cemetery Board requesting if the Township would consider refunding all or part of the zoning application fees
which were incurred for the their application to facilitate the addition of 2.5 acres to Knox Cemetery. The
correspondence was formally received by Council of the Township Of Oro-Medonte at the Committee of the
Whole meeting of February 8, 2006. Staff comments and recommendation is the subject of this report.
II PROPOSAL:

In September of 2004, the Committee of Adjustment approved Consent Application 2004-B-45 to add
approximately 1 hectare (2.5 acres) to the Knox Cemetery lands as an expansion to the existing cemetery.
The Committee of Adjustment imposed a condition of consent that the lands being conveyed to the Knox
Cemetery be rezoned to (I) Institutional to reflect the intended use. By-law 2005-023 was subsequently
passed by Council on April 6, 2005 rezoning the lands to Institutional (I) Zone to satisfy the severance. The
consent application has since been finalized which facilitated expansion of the cemetery lands.
II ANALYSIS:

By-law 2005-043, a by-law to provide for the imposition of fees or charges was passed by Council on May 4,
2005. Schedule E set out the fees imposed by the Planning Department related to amendments to the Zoning
By-law as a condition of provisional consent. The application and processing fee for an amendment to the
Comprehensive Zoning By-law when the amendment is a Condition of Consent is $600.00.

.. '. Application fees are designed to offset the staff time required to process and facilitate different development
applications for site-specific properties. While staff understand the needs of the Cemetery Board, it is noted
that the fee in question does not at present fully recover the staff time required to process the application. The
fee by-law and staff time recovery matter is currently being reviewed by the Director of Building and Planning.
It is also noted that the refund of development application fees could set a precedent for other applicants to
corne forward for other similar requests in the future.

1. THAT Report BP 2006-011 be received and adopted;
2. THAT that the request by Knox Presbyterian Church Cemetery Board for refunding the Zoning

2008628 Ontario Limited agrees to:
1. Provide the Township with funds totaling $153,150.68, which represents their
share of the cost of constructing a private recreational facility ($260,000.00/219
lots x 129 lots), with 50% of the funds payable by March 1,2006 and the
remaining 50% of the funds payable by May 1, 2006. This amount may be
reduced by an amount equal to the labour cost of constructing a recreation
facility, if some or all of the labour is provided by 2008628 Ontario Limited
pursuant to a Facility Development Agreement.
2. Pay the Township cash-in-Iieu of parkland at the time of the entering into the
Subdivision Agreement, with the cash-in-lieu amount being at least $20,000.00.
3. Dedicate all lands not to be used for residential lots to the Township as
environmental land at no charge and free of any encumbrances as part of the
Subdivision Agreement.
1452711 Ontario Limited agrees to:
1. Provide the Township with funds totaling $98,538.81, which represents their
share of the cost of constructing a private recreational facility ($260,000.00/219
lots x 83 lots), with 50% of the funds payable by March 1, 2006 and the
remaining 50% of the funds payable by May 1, 2006.
2. Provide the Township with funds totaling $40,000.00, which represents the raw
value of the two new premium lots that the Township will allow to be added to the
Plan of Subdivision, with 50% of the funds payable by March 1, 2006 and the
remaining 50% of the funds payable by May 1, 2006, subject to approval being
obtained from the Ontario Municipal Board.

3. Revise the Plan of Subdivision to provide for a 10.0 metre wide pedestrian/
emergency access to the parkland block owned by the Township of Oro-
Medonte.
4. Dedicate all lands not to be used for residential lots to the Township as
environmental land at no charge and free of any encumbrances as part of the
Subdivision Agreement.
850892 Ontario Limited agrees to:
1. Provide the Township with funds totaling $8,310.50, which represents their
share of the cost of constructing a private recreational facility ($260,000.00/219
lots x 7 lots), with 50% of the funds payable by March 1, 2006 and the
remaining 50% of the funds payable by May 1, 2006.
In exchange for the above, the Township of Oro.Medonte agrees to:
1. Provide a credit against 50% of the Development Charges payable for recreation
to 2008628 Ontario Ltd. in the amount of $46,569.63 ($3,427.00 x 21.4%-
$733.37 per 10t/2 x 129 lots).
2. Provide a credit against 50% of the Development Charges payable for recreation
to 850892 Ontario Ltd. in the amount of $2,566.83 ($3,427.00 x 21.4% -
$733.37 per 10t/2 x 7 lots).
3. Provide a credit against 50% of the Development Charges payable for recreation
to 1452711 Ontario Limited in the amount of $30,435.27 ($3,427.00 x 21.4%-
$733.37 per 10t/2 x 83 lots).
4. Provide a credit of 100% of the Development Charges payable for recreation to
1452711 Ontario Limited in the amount of $1 ,466.75 ($3,427.00 x 21.4% -
$733.37 per lot x 2 lots) for the two new lots that the Township will permit on
the subject lands.
5. Agree to collect the Development Charges at the building permit stage, except
for that component of the Development Charges that is dedicated to recreation.
6. Agree to establish the Development Charges amount at $3,427.00 per lot (or a
lesser amount adopted by Council) to be collected at the building permit stage.
7. Support amendments to the Draft Conditions at the Ontario Municipal Board to
implement this agreement.
8. Prepare the site plan for the property and manage the construction of the facility
on the Sweetwater Park lands.
9. Use the funds generated by this agreement ($400,305.11) for the construction of
the facility on the Sweetwater Park lands.

10. Initiate construction of the facility on the Sweetwater Park lands in 2006.

Parks and Public Use of the Enacted By Council;
Recreation Oro African Church NHS
Purpose
To establish a policy for public use of the Oro African Church NHS.
Policy
The Oro-Medonte History Association shall manage the Oro African Church NHS on behalf of
the Township of Oro-Medonte. The following guidelines will be used to determine use of the
National Historic Site by the public.
1. Conditions of Use:
a) A History Association member will be responsible for opening and closing the
Church for pre-booked tours and during normal hours of operation.
b) The maximum number of persons allowed in the Church building at anyone
time is 20.
c) No open flame articles are allowed on site.
d) The raised platform at the front of the Church is not to be used for events and is
off limits to the general public.
e) All donations for the site will be accepted by a member of the History
Association and deposited with the Township Treasurer. All cheques are to be
made payable to the Township of Oro-Medonte (African Church).
f) Information pamphlets, as developed for visitor information, interpretation and
further contacts will be made available.
2. General Public Access:
a) General public access to the building will be through established hours of
operation.
b) Visitors will be asked to sign a Visitor Log Book.
c) Any request for public access to the church building outside the established hours
of operation must be pre-booked at least two weeks in advance through the Parks
and Recreation Department of the Township.

3. Special Events:
Special events such as the Oro African Church Anniversary Service, Doors Open
Ontario events, etc. will be organized by the History Association in conjunction with
Township Council and staff.
4. Events by Organizations/General Public:
a) Any event must reflect the history and spirit of the site.
b) Any request for use of the site for events by organizations/general public must
be pre-booked at least two weeks in advance through the Parks and Recreation
Department of the Township.
c) Church Services - All Church services are to be held outside the building. All
items brought to the site for the service must be removed the same day.
d) School Tours/Historical tours - All tours will be organized and conducted by the
Oro-Medonte History Association.
e) Extra seating or washroom facilities will not be provided by the Township.
f) The organizer of a group tour or event must sign a standard waiver of liability.
g) Large groups may be subject to a deposit for cleanup and damages.

In the Career Centre's endeavour to better provide employment resources and
career counseling services to the residents of Oro Medonte Township, we would
like to request our fees to be waived or subsidized by the township.
Considering that this type of satellite service is a new Outreach component to the
Career Centre, we will need to assess the times and locations that will best
service the community. Therefore, we are submitting a 4 month request to be
reviewed again in July. Here are the lists of facilities we have booked from March
2006 till June 2006:
A) Guthrie Arena
3x in March @ $25 p/hr @ 2 hrs ea. time
4x in April @ $25 p/hr @ 2 hrs ea. time
5x in May @ $25 p/hr @ 2 hrs ea. time

Total monies requested for subsidy (with GST incl.) equal $ 866.00 for the four
months.
Due to the fact that we are operated by two public service organizations; the
Simcoe County District School Board and the Simcoe Muskoka Catholic District
School Board and are funded by the Government of Canada, there are no funds
allocated to facility usage in the Outreach Development. However, we are able to
provide resources and staff to provide this support to the residents of the township
if we are permitted to use the indicated facilities.

The purpose of the grant/subsidy would be used to cover the cost of using the baseball diamonds at Vasey Park for
the Vasey Minor Ball teams during the 2005 season.
Traditionally, we have been able to pay our park fees in tbe past. However, in 2005 there were unforeseen
increases in the Georgian Ball Minor Softball League insurance rates, registration fees & umpire fees. Another
factor was that although we were fortunate enough to have (2) more teams registered in our organization, we were
faced with buying new equipment/unifonns to get our new teams up & running.
Vasey Minor Ball has been a cornerstone in the Vasey Community since 1978 which now covers (2) generations of
players. 1 have been fortunate enough to both play in the Vasey Minor Ball organization as a player & now I am
watching my son playas a coach/father and president. This grant would enable our organization to continue as an
intricate part of our community and would be very much appreciated.
