If Council bad accepted tile recommendations I made in 2001 (tbe same as I am
making today) tbey migbt bave saved tbe taxpayers about a million dollars and bave
a scientifically sound plan to protect tbe Oro Moraine.
The Oro Moraine may be s(lcrificed to save the Oak Ridges Moraine,
Developers frustrated hy the development freeze on a Greenbelt centred on the Oak
Ridges Moraine are looking northward. Rumours abound concerning large developments!
Oro-Medonte Council has put out the welcome mat by voting in a secret Council session
to amend the Official Plan to allow a new subdivision at Moon Point - one of the last
unspoilt areas on the Lake Simcoe shore. An unfortunate legal precedent!
Council may be dealing with some of Ontario's largest developers. Their lawyers love
legal precedents.
As well Council hasn't bothered to have the Azimuth Report to provide a scientific and
ecological basis to protect the Oro Moraine completed,
After spending several hundred thousand dollars on Official Plan Amendment # 16 - that
was supposed to protect the Oro Moraine - the key section on Environmental Impact
Statements is full of gaping holes. There is no mandatory requirement for the contents of
an Environmental Impact Statement and no mandatory requirement that an Ecologist ever
assess the Statement.
In the ten years I have lived in the Township about 90% of the Planning Reports lacked
an objective analysis of the "pros and cons" ofthe proposed development or zoning
change; the Reports recommend without qualification that the application be approved;
the Reports did not recommend any conditions before, during or after the construction
work; the Reports were simply the opinion of the author with no input from other
consultants - hydro geologists, ecologists, engineers, etc,
Residents objected to most planning recommendations - but were ignored by the Mayor
and most Councillors.
The next edition of the Official Plan will he in a loose-leafformat

With atypical foresight COl\ncil has hired a new highly qualified and experienced
Director of Planning - Brucll Boppe.
Every Municipality I know routinely receives Planning Reports prepared by the Director
of Planning and the planning staff- for example Orillia and Simcoe County,
It is in the public interest to have balanced and objective Planning Reports.
With the arrival ofMr, Boppe Council can no longer justify spending hundreds of
thousands of tax dollars every year on outside planning consultants,
Part of this money might go to Mr. Hoppe to provide any assistance he needs.
The rest would make a down payment on building a new hockey rink for the kids; a
swimming pool; a curling rink; a library and a centre for old geezers like me, In the ten
years I have lived in Oro-Medonte not one new major recreational facility has been built.
I respectfully request that thll Director of Planning and his staff prepare all Planning
Reports for the Planning Advisory Committee and Council.
I further request that at least one member of the Planning Advisory Committee be an
environmentalist,
Council should appoint an Ecological Advisory Committee.
Only Deputy Mayor Hughes and Councillor Hough have regularly voted for an
environment first and balanced approach to new developments.

Attention: Mayor and Council Members
We have noticed the poor condition of the sidewalk in Craighurst, a feature
of the community since 191O!
Several problems have contributed to the deterioration of the sidewalk: earth
covers some portions, sand and gravel cover other portions, parts are cracked
and other parts are sunk. Over the years some home owners have rebuilt
sections of the walkway, but these parts are now out of line and also
deteriorated. We are enclosing pictures that clearly illustrate the noted
concerns.

At the last meeting of the Craighurst Women's Institute a motion was passed
requesting Council put dollars into the budget for next year for a complete
overhaul of the sidewalk and additional monies be budgeted for ongoing
maintenance.

Crime Stoppers is not a police program nor funded by the provincial or federal government or

In the Career Centre's endeavour to better provide employment resources and career counselling
services to the residents ofOro Medonte Township, we would like to request our fees to be waived
or subsidized by the township.
Considering that this type of satellite service is a new outreach component to the Career Centre, we
will need to assess the times and locations that will best service the community. Therefore, we are
submitting a 3month request to be reviewed again in January. Here is the list of facilities we are
considering booking from November 2005 to January 2006:
A) Guthrie Arena
2 x p/month @ $25 p/hr @ 2 hrs ea, time $300
B) Oro (old) Town Hall
1 x p/month @ $25 p/hr @ 2 hrs ea. time $150
C) Ian Beard Training Hall
I x p/month @ $12 p/hr @ 3 hrs ea, time $108
Total monies requested for subsidy (with GST incl.) equal $558 for the three months.
Our motive in our subsidy request to you is to provide complete employment assistance services and
support job search to the residents of the Township. Our proposal and budget was submitted without
knowing all actual facility costs. We would like the opportunity to demonstrate to you that the
benefit of having an Outreach Counsellor on site in these locations will far surpass the lost revenue
to the Township
Attached is an example of a proposed outreach calendar (DRAFT) that could be posted in various
community sites to promote these services to the residents ofOro-Medonte Township,

My name is Holly Fisher and I am a resident of Oro-Medonte. I am writing to let you
know about a mishap that has happened. My nephew Robert Brown (who also lives in
Oro-Medonte) was badly burned on Saturday September 17th. He has burns to 30% of
his body. He burned both his legs 3rd degree, his right arm from the elbow down 2nd
degree and his left forearm 2nd degree. Robert has permanent nerve damage in his right
leg. He can feel pressure, but will never feel touch to the leg. There will be extensive
physiotherapy in the future for him. He is healing well but has a long way to go. He was
at Sick Kids for 6 weeks and has just come home on Friday. He will still have to go each
week back and forth to Sick Kids to make sure all the skin grafting is healing right. We
are unsure ifhe will have to undergo more skin grafting in the future, however the
doctors say that it is a good possibility because he is only 13 years old and still has lots of
growing to do. Robert is on a lot of medication and some of it is not covered by Ontario
Works, not to mention all the bandages that are needed. My sister Mary, who is Robert's
mom, has gone to Ontario Works for help and as some of you may know you don't
receive very much. It doesn't cover gas back and forth to Toronto or parking and food
while they are there. Robert was sized for leg splints so that he doesn't bend his legs at
night while he is sleeping. This also is not covered. He will also need special clothing to
help the skin heal properly. This clothing will be needed to wear until he finishes
growing. One group will pay for an outfit, but he will need many more.
Weare holding a Dance and Silent Auction on November 12th at the Guthrie Arena to
help cover the costs of things that Robert will need, I am asking all of you to please
waive the fee for the hall, so that all of the money raised would go to this family who
really could use the help. Thank you for your consideration and time in this matter.

Please find attached the OPP costing formula for 2005. It is my understanding that this formula is
applied uniformly throughout the Province.
The only variables for each detachment are:
the portion of the Department's staffing that is allocated between provincial usage and
municipal usage
in cases like Oro-Medonte where facilities are provided, telephone, accommodation, furniture
and equipment and cleaning contract costs are not applicable
It is estimated that 40% of the Barrie Detachment's staffing relates to Oro-Medonte.
The final cost for 2005 will reflect actual equivalent units for Constables.

2005 ESTIMATES
POLICING SERVICES
o Details of the cost allocation methodology are set out in Regulation 420/97 pursuant to the Police
Services Act.
o The estimated number of officers and civilian members providing field services are used to prepare
the 2005 estimates. The number of officers and civilians in each detachment is based on approved
funding.
o The approved costing formula was revised in 2004 to update the various cost components in it to
reflect more up-to-date OPP costs.
o The Provincial Services usage by detachment is calculated using a flat rate of 10% for the estimates.
The actual Provincial Services usage in 2005 will be applied to prepare the reconciliation to actual
costs at year-end.
o The 2005 estimates are obtained using the number of officers and civilian personnel in each
detachment and include the municipal portion of the services provided by the OPP (excluding
provincial responsibilities such as traffic patrol on King's Highways, waterways policing, policing in
provincial parks and unincotpOrated areas).
o Individual municipality's estimates for 2005 are determined by apportioning the detachment cost
attributable to municipal policing provided to each municipality based on its proportien of the
detachment workload.
o The estimates include:
~ direct costs (e.g., salaries, wages and benefits of uniform and civilian members);
~ equipment costs (e.g., vehicles, uniforms, supplies, radio equipment, computers);
~ additional support personnel (e.g., communication operators and prisoner guards); and
~ administrative support costs of the Regional and General Headquarters required to
provide municipal services (e.g., Professional Standards, finance and budgeting, human
resources, legal services).
o The estimates exclude:
~ cost of provincial responsibilities such as traffic patrol on King's Highways, waterways
policing, policing in provincial parks, unincorporated areas, First Nations Territories, and
municipalities providing their own policing services; and
~ mandated special services such as major criminal investigations and investigative
support services.
o Provincial Services usage: estimates have been reduced by a 10% Provincial Services usage to
compensate municipalities for the deployment of officers from the municipality to other areas in the
province to respond to emergencies/disasters/major investigations or other occurrences deemed
provincial responsibilities. The actual Provincial Services usage will be applied for the reconciliation
to actual costs in 2005, with no minimum application.

II BACKGROUND:

On June 1, 2005, the Government of Ontario introduced Bill 206, Ontario Municipal Employees
Retirement System Act, 2005,
OMERS would continue as a defined benefit pension plan, equally funded by employers and plan
members.
Bill 206 introduces a new governance model. Under the present model, the OMERS Board, made up
of six employer representatives, six plan member representatives and one Ontario Government
representative oversees plan administration and Fund investments. The Ontario Government as Plan
Sponsor has final approval on plan design and contribution rates,
The proposed governance model would see the establishment of an Administration Corporation
made up of an equal nurnber of employer and employee representatives that would oversee plan
administration and Fund Investments. A Sponsors Corporation made up of an equal number of
employer and employee representatives would take over the government's role as plan sponsor with
responsibility for plan design and contribution rates,
The composition of the Sponsors Corporation and the Administration Corporation is initially
established by the legislation and subsequently within the Corporation's by-laws (after the first year of
transition).

Bill 206 also provides for the establishment of supplemental plans by the Sponsor Corporation which
would be adopted in localities through the collective bargaining process, Supplemental plans are to
be stand alone plans with no cross subsidy with the primary OMERS plan. Supplemental plans would
provide flexibility in benefit arrangements through bargaining at local levels.
OMERS has identified 8 possible supplemental plans for the Normal Retirement Age (NRA) 65
group:
1) 2,5% reduction per year for early retirement. Current reduction is 5%.
2) 85 factor, up to 10 years before NRA (Service and age add to 85, but cannot retire before 55
years of age on unreduced pension
3) 85 factor, up to 15 years before NRA (service and age add to 85 but cannot retire before 50
years of age on unreduced pension)

4) 80 factor, up to 10 years before NRA I _ 12..

6) 30 years of service and out, no age limit
7) 0.6% integration with CPP instead of current 0.675%
8) Final 3 Year Average Earnings ( generally results in higher average earnings than current
average of 5 years)
The legislation enables an increase of the accrual rate for public safety occupations from the current
2% up to 2.33% but the increase would have to be provided as a supplemental plan. A 2,33% accrual
would allow members in the NRA 60 group (Police and Firefighters) to earn a pension of 70% of
earnings after 30 years of service rather than the present 35 years.
I ANALYSIS:
AMO has grave doubts that the Provincial Government has shown an appropriate commitment to
protecting the best interest of employers, employees and Ontario taxpayers by introducing Bill 206.
The current governance structure provides an opportunity for the Ontario Government to ensure that
the OMERS Fund is managed in a manner that protects the broader public good. This opportunity is
lost under Bill 206.
Due to the diverse nature of member groups, it will not be possible to represent all their interests
under the proposed governance structure,
The costs of supplemental plans will significantly increase labour costs and create pressure to
increase property taxes, Please find attached a summary of supplemental plan costs for the NRA 65
group prepared by OMERS, Please note that pensionable earnings for the Township of Oro-Medonte
as reflected in the 2005 budget are approximately $2,700,000.
Solvency costs are the costs to settle all plan benefits if the plan winds up. OMERS has argued that
the OMERS plan should be exempt from solvency requirements as it is unlikely that such a large
public plan would be wound up or terminated the way a private sector plan would be, With or without
solvency costs, the cost of supplemental plans could have a significant effect on municipal budgets.
As some member groups are funded in part by the Provincial Government, the cost of supplemental
plans could have a significant effect on Provincial expenditures,
The 2.33% accrual option could become more costly if ambulance workers and paramedics are
added to the NRA 60 group.
The administration of the many supplemental plans would present costly administrative challenges,
Each employer could have a number of different supplemental plans under a number of collective
agreements which would all have to be managed and administered by OMERS, With 900 employer
groups, there could be thousands of supplemental plans to administer.
Bill 206 requires that any proposed supplemental plan must go to binding arbitration if a union
requests it. It is not certain if arbitrators would have regard for an employer's ability to pay,
Due to these concerns, the Township of Oro-Medonte should not endorse Bill 206 in its present form.
AMO has provided the attached draft resolution to that effect for Council's consideration.

OMERS - Bill 206 INFORMATION
STATUS UPDATE AND SAMPLE MUNICIPAL RESOLUTION
(All 382 Municipal Governments that are OMERS Employers
should read this Alert immediately)
Issue:
The Standing Committee on General Government intends to hold public hearings on Bill 206, An
Act to revise the Ontario Municipal Employees Retirement System Act, on November 14,16,21,
and 23, 2005 in Toronto. Members are encouraged to make submissions to the Committee.
In addition to participating in Standing Committee hearings, members are encouraged to pass a
resolution expressing concerns with provision in Bill 206, A sample resolution is attached.
Background:
Our review of Bill 206 raises significant issues sufficient to question whether the Government has
shown an appropriate commitment to protect the best interests of employees, retirees,
employers, communities, taxpayers and Ontario's economy, AMO has requested, but not yet
received, technical information from the Province in order to make a fully informed and reasoned
response to the Bill.

Municipal Assistance Needed: Attached is a model resolution that every municipality, which is an
OMERS employer, is asked to pass quickly and forward to Minister Gerretsen and their local
MPP(s).
Model Resolution Re: Bill 206:
WHEREAS the provincial Standing Committee on General Government is currently debating Bill 206, An
Act to revise the Ontario Municipal Employees Retirement System Act; and
WHEREAS the OMERS pension fund is currently equal to approximately 8% of Ontario's annual GDP;
and
WHEREAS the OMERS pension fund serves approximately 900 employers and 355,000 diverse
employee groups including: current and former employees of municipal governments; school boards:
libraries; police and fire departments: children's aid societies; and, electricity distribution companies; and
WHEREAS Ontario's municipalities and their employees depend on the prudent management of the $36
Billion plan and to ensure that employees and employers are paying for benefits they can afford; and
WHEREAS OMERS employer and employee members are facing an increase in OMERS contributions in
2006 of approximately 9% as a result of a significant deficit in the OMERS fund: and
WHEREAS the Bill includes significant, potentially costly and unnecessary changes to the governance
structure of OMERS including a Sponsors Corporation structured to be governed by arbitration; and
WHEREAS the Bill would permit the creation of expensive supplementary plans to provide optional
enhanced benefits that will impose new collective bargaining obligations on municipalities, the operating
costs of which cannot yet be fully assessed; and
WHEREAS the Province has a responsibility to study the potential impact of the changes it is proposing
and to share the results with employers and employee groups; and
WHEREAS AMO and others have urged the government to consider the potential implications of Bill 206
and to ensure the proposed policy changes protect the interests of employers, employees and taxpayers:
and
WHEREAS the Government is moving in haste with a Bill, which in its current form raises significant
technical, public policy and economic issues:
THEREFORE BE IT RESOLVED THAT (Name of municipality) does not support Bill 206, and requests
the that the Government of Ontario reconsider the advisability of proceeding with Bill 206 in its current
form; and
FURTHER IT BE RESOLVED THAT (Name of Local MPP), the Honourable John Gerretsen, Minister of
Municipal Affairs and Housing, the Honourable Dalton McGuinty, Premier of Ontario, and the Association
of Municipalities of Ontario be advised that this Council does not support proposed changes to the
OMERS pension fund contained in Bill 206,

II BACKGROUND:

During the 2005 Budget deliberations Council approved a 100% funding Capital
project (accessibility upgrade) for Hawkestone Community Hall for the purpose to
repair the front landing/wheelchair ramp in the amount of $3,000.00. Staff obtained 2
quotes and the project was awarded to the lowest quote (Don Robinson Carpentry).
II ANALYSIS:

Mr. Don Robinson has recently advised the Township of his inability to complete the
project. After much discussion with the Hawkestone Hall Board Members it was
recommended that Council give favourable consideration to the second quote, based
on the activity at the Hall and the safety of the users.
It should be noted that the Township 2003 Accessibility Plan omitted the required
repairs to the front landing/wheelchair ramp.

The second quote was submitted by Thom Win Construction (Mr. Thompson) in the
amount of $ 6,300.00. Staff contacted Mr. Thompson to ascertain his availability to the
complete the project and to verify that the quote was still valid. Mr. Thompson advised
that he would complete the project by the end of November and also he indicated that
the cost of the materials had increased therefore an additional ten percent would be
added to his original quote (Attachment #1 ).
The approved budgeted amount for this project is $3,000.00 dollars leaving a deficit of
$ 3, 930.00 dollars. The Township recreation reserve is $226,340.00 dollars.
It is recommended that Council give favourable consideration to proceeding with the
renovations for the front landing/wheelchair ramp at the Hawkestone Hall and that the
over expenditure be drawn from the recreation reserve.
It is also recommended that the 2005 Accessibility Report be amended to include the
renovations at the Hawkestone Hall.
II RECOMMENDATION(S):

1. THAT Report No.2005-11be received and adopted.
2, THAT staff be authorized to proceed with the renovations to the front
landing/wheelchair ramp at Hawkestone Community Hall in the amount of
$6,930.00.
3. THAT the over expenditure in the amount of $ 3, 930.00 dollars be drawn from the
recreation reserve.
4. THAT the Accessibility Report be amended to included the renovations at the
Hawskestone Community Hall.
5. And, THAT Thom Win Construction be notified accordingly.

By-Law No. 99-41 regulates the holding of parades or processions/events in the municipality. Section 8 of the
above mentioned by-law permits that in a situation where a parade or procession/event will last for less than
24 hours, Council may dispense with any or all of the requirements of the by-law.
Mr. Dennis Barkley, organizer of the parade, has requested that Council waive the requirements of the by-law
for the Warminster Santa Claus Parade to be held on Sunda December 18, 2005 at 2:00 .m.
ANALYSIS:
Mr. Barkley has indicated that the necessary emergency services (O.P.P. and Fire Dept) have been notified
along with the Roads Superintendent. This parade is a yearly event, and Council has granted permission to
hold the parade in the past and has waived the conditions of By-law 99-41.
The re uest and arade route are attached for information.
I RECOMMENDATION(S):
1. THAT Report No. PR2005-12 be received and adopted.
2. THAT an exemption to By-law No. 99-41 be granted for the Warminster Santa Claus Parade to be held on

Correspondence and a petition were received from Ms, Nicole Matthews and local residents
requesting upgrades to the Mount St. Louis Road from Line 12 North, westerly to Line 11 North, This
request was as a result of Ms, Matthews rolling her vehicle into the ditch on this section of the Mount
St. Louis Road, west of Line 12 North, in early February.
The Mount St. Louis Road is an east/west, Class 3, surface-treated road, connecting Hwy. #93 to
Hwy, #12, with traffic volumes in excess of 1,000 vehicles per day. The section of concern has
become slightly wheel-rutted and is also heavily treed on both sides of the road, making winter
maintenance difficult at times due to reduced sun and ice melting capabilities, The Mount St. Louis
Road, being a Class 3 road, receives a high level of service for both winter and summer
maintenance.
~ ANALYSIS:
~
To address this section of the Mount Road and to assist with winter maintenance operations, the
Public Works Department will schedule this area for trimming and brush removal. This will allow for
considerable sunlight to the road surface to aid in reducing ice build-up and for improving winter road
conditions for the 2005/2006 season, Once the proposed Roads Needs Study is completed (Spring,
2006), future surface upgrades and repairs for the Mount St. Louis Road will be considered in the
Capital budget.

2. THAT the Public Works Department schedules this section of the Mount St. Louis Road for brush
trimming and removal to assist with winter maintenance operations.

Upon reviewing the tenders, it is noted that Don Woodrow's tender price, which is consistent over the
three winter seasons, would be $4,333.50 less over the three year contract. Therefore, it is
recommended that the tender from Don Woodrow be accepted at a low tender amount of
$139,10/hour, with a minimum of 300 hours/season.

For the past number of years, Mr. and Mrs. Ansell have been supplied with water from a private well
located on the north side of County Road #19. The owner of this well had provided notice to Mr. and
Mrs. Ansell that after March of 2006, they would no longer allow connection to the private well.
During construction work at the property of the private well during the weekend of September 17,
2005, Mr. and Mrs. Ansell's water connection was inadvertently damaged, leaving them without
water.
II ANALYSIS:

Mr. and Mrs, Ansell are aware that they must enter into an Agreement with the Township and Bachly
Investments Inc., and receive approval from the County of Simcoe prior to any work being done on
County Road #19.
Mr. and Mrs, Ansell are also aware that all costs incurred for the connection of the water service and
water meter are at their expense and have been informed of the $200.00 inspection fee payable to
the Township.
As Mr, and Mrs, Ansell are presently without water, they are requesting permission to connect to the
existing water main and to work with staff to prepare a Water Service Connection Agreement to be
presented to Council upon completion.

BY.LAW NO. 2004-024
Being a By-law to Amend By-law No. 2003-025, a By-law to Regulate Municipal
Water Systems within the Township of Oro-Medonte
WHEREAS Council of the Township of Oro-Medonte did, on the 181h day of June, 2003,
enact By-law No. 2003-025 to regulate municipal water systems within the Township of
Oro-Medonte;
AND WHEREAS Council of the Corporation of the Township of Oro-Medonte deems it
desirable and necessary to amend By-law No, 2003-025;
AND WHEREAS By-law No, 2003-025 deems that watering of lawns or gardens, or the
filling of swimming pools, are not deemed to be domestic uses under the terms of the
By-law;
AND WHEREAS By-law No, 2003-025 authorizes the Director of Engineering and
Environmental Services to take all such action, as may be necessary, to immediately
terminate the supply of water to any property served by the Municipal Water System;
NOW THEREFORE the Council of the Township of Oro-Medonte enacts as follows:
1, THAT Section 4 of By-law No, 2003-025 be amended by adding the following:
"4,5 No person shall, from a Municipal Water System, water or sprinkle, or
cause or permit the watering or sprinkling of any lawn, garden, tree, shrub
or other outdoor plant, or fill swimming pools, in the Township of Oro-
Medonte through a hose or other attachment except between the hours of
7:00 p,m, - 11 :00 p,m, subject to the following:
a)
Owners or tenants of properties with a municipal address with an
even number are permitted to water lawns and gardens, or fill
swimming pools within the designated times, on even-numbered
days of the month;
Owners or tenants of properties with a municipal address with an
odd number are permitted to water lawns and gardens, or fill
swimming pools within the designated times, on odd-numbered
days of the month:
Owners of newly seeded and/or sodded lawns, upon proof of
installation and subject to the approval of the Director of
Engineering and Environmental Services or his designate, may be
permitted to water their lawn for fourteen (14) consecutive days
regardlesS of the day designated under the3e water restrictions;
Owners of properties which have been sprayed for insects, upon
proof of such spraying and subject to the approval of the Director of
Engineering and Environmental Services or his designate, may be
permitted to water their lawn for seven (7) consecutive days
regardless of the day designated under these water restrictions,

when a total water ban order is in effect.

A By-law of The Corporation of the Township of Oro-Medonte
to provide for the imposition of fees or charges
WHEREAS Part XII, Section 391 of the Municipal Act, 2001, S,O, 2001, c. 25, as
amended, permits a municipality to pass by-laws imposing fees or charges on any class
of persons, for services or activities provided or done by or on behalf of it; for costs
payable by it for services or activities provided or done by or on behalf of any other
municipality or local board; and for the use of its property including property under its
control;
AND WHEREAS Section 11 of the Municipal Act, 2001, S,O. 2001, c, 25, as amended,
provides that a municipality may pass by-laws respecting water production, treatment
and storage;
AND WHEREAS Section 11 of the Municipal Act, 2001, S,O, 2001, c, 25, as amended,
provides that a municipality may pass by-laws respecting matters relating to waste
management;
AND WHEREAS the Council of The Corporation of the Township of Oro-Medonte
deems it necessary to levy waste management charges to finance the annual estimates
for waste management for the year 2004:
AND WHEREAS Section 11 of the Municipal Act, 2001, SO, 2001, c,25, as amended,
provides that a municipality may pass by-laws respecting sewage treatment;
AND WHEREAS The Corporation of the Township of Oro-Medonte operates and
maintains communal tile beds hereinafter referred to as the "sewage works";
AND WHEREAS the Council of The Corporation of the Township of Oro-Medonte
deems it necessary to impose a sewer service charge upon those lands that derive a
benefit from the sewage works;
AND WHEREAS Section 398 of the Municipal Act, 2001, S,O, 2001, c, 25, as amended,
provides the Treasurer of a local municipality may add charges imposed by the
municipality under Part XII of the said Act to the tax roll for the property to which the
public utility was supplied and collect them in the same manner as municipal taxes;
AND WHEREAS Section 69 of the Planning Act, R,S,O" 1990, c.P, 13, as amended,
provides that a municipality may establish a tariff of fees for the processing of
applications;
AND WHEREAS Section 50 of the Condominium Act, R.S,O, 1990, c,C,26, as
amended, provides that a municipality may establish a tariff of fees for the processing of
applications;
AND WHEREAS Section 7 of the Building Code Act, 1992, S,O, 1992, c,23, as
amended, authorizes a municipal Council to pass by-laws concerning the issuance of
permits and related matters;
AND WHEREAS Section 5(0,1) of the Fire Protection and Prevention Act, 1997, S,O,
\ 1997, cA, as amended, authorizes a municipality to establish, maintain and operate a
fire department for all or any part of the municipality,
NOW THEREFORE the Council of The Corporation of the Township of Oro-Medonte
enacts as follows:

1, That this By-law be known as the "Fees and Charges By-law",
That the following Schedules, attached hereto, form part of this By-law:

That Appendix "1" attached hereto lists services and fees Imposed under
separate by-laws, Acts, Ontario Regulations,

Any person desirous of using those services or property of the Township of Oro-
Medonte described in Schedules "A" to and including "J" shall pay the fee set out
opposite the description or name of the particular service or property, as shown
in Schedules "A" to and including "J",
Despite the provision of Section 4, Councilor its delegated authority may, in its
discretion upon appiication to it, waive or reduce the fees set out in Schedules
"A" to and including "J" for any person, on a one time or on a continuing basis,

All fees payable under this by-law shall be payable in advance of providing the
service except for:
a) emergency services;
b) actions taken by the Township of Oro-Medonte to rectify failures or by-law
infractions on the part of a resident;
c) specific fees prescribed in Schedule "E" (Planning) to this by-law; in which
case the fee payable will be in arrears and invoiced subsequent to the
service or activity provided,
7, If for any reason fees owing under this by-law remain unpaid after 30 days, same
shall bear interest at the rate of 1 ,25% per month until paid in full. In addition to
any interest owing, each payment that is not paid when due, shall bear an
administrative penalty of $25,00,
8,
Where a deposit is required under this by-law for services rendered by the
Township, and actual costs exceed the deposited amount, such costs shall be
deemed to be fees owing under this by-law and Section 7 of this by-law shall
pertain to such outstanding costs,
9,
Any fees that are owing to the Township of Ora-Medonte and that are unpaid are
a debt to the Township of Oro-Medonte and, together with all interest and
penalties accrued thereupon, may be collected by the Township of Ora-Medonte
by action or may be collected by the Township of Ora-Medonte on its behalf or
may be collected in like manner a~ taxe~,

10, Should any Section, subsection, clause. paragraph or provision of this By-law,
including any part of the Schedules to this By-law, be declared by a court of
competent iurisdiction to be invalid, the same shall not affect the validity of the
By-law as a whole or any part thereof, other than the provision or part of the
Schedule so declared to be invalid,
11, That By-laws No, 97-66, 98-84, 98-96, 98-102, 99-04, 99-70, 99-78, 2002-136,
2003-30, 2004-32, 2004-033, 2004-077 are hereby repealed in their entirety,
12, Any other By-law or part thereof inconsistent with the provisions of this By-law is
hereby repealed,
13, That this By-law shall take effect and come into force on the day of its final
passing,

WATER
1, DEFINITIONS
For the purpose of this Schedule,
1.1, "Municipal Water Area" shall mean a subdivision within The Corporation of
the Township of Oro-Medonte,
1,2, "Municipal Water Systems" shall include all water works established within the
present Township of Ora-Medonte, and shall further include any present or
future extensions to the water works under any Act or under an agreement
between the Township or its predecessors, but shall not include any private
water works which have not been acquired, established, maintained or
operated by the Township or its predecessors;
1,3, "Owner" shall mean the assessed owner(s) as identitied on the Assessment
Roll for taxation purposes during the current year, as amended.
1.4. "Treasurer" shall mean the Treasurer of The Corporation of the Township of
Ora-Medonte,
1,5, "Unit" shall mean an assessed or assessable unit within a residential.
commercial or industrial building, and shall include an apartment located
within a single family dwelling which is serviced by the Township Water
System, as permitted under the applicable Zoning By-law,
1,6, "Water Works" means any works for the collection, production, treatment,
storage, supply and distribution of water, or any part of such works, but does
not include plumbing or other works to which the Ontario Building Code Act
and its regulations apply,
2, WATER CHARGES, BILLING AND COLLECTION
2,1, As soon as the water connection installation is approved by the Township
Inspector, he shall forthwith turn the water on for owner, The owner will then
be charged at the appropriate water rate, as per Schedule 'J',
2,2, At the end of September each year, the duly authorized employee shall read,
or cause to be read, all meters connected to the Municipal Water System to
determine the amount of water used during the year.
2,3, The Treasurer shall calculate water charges to be assessed against each unit
in a Municipal Water Area, in accordance with the minimum quarterly charge
and rates per cubic meter as set out in Schedule 'J',
2.4. The Treasurer shall, for each calendar quarter, issue bills to each unit based
on the applicable water charges, Water bills shall be due and payable not less
that twenty-one (21) days from the date of mailing,
2,5, Water payments shall be payable to The Corporation of the Township of Oro-
Medonte and may be paid during office hours in person or by mail at the Oro-
Medonte Administration Office, 148 Line 7 South, Box 100, Ora, On LOL 2XO,
or at most financial institutions, Water payments made at a financial
institution shall deemed to be paid on the date shown by the Teller's stamp on
the bill stub, The Township shall not be responsible for any applicable
service charge payable to the bank, Cheques only can be dropped at the drop
boxes located at the Administration Office and Moonstone Fire Hall.

Township be identified as two separate and distinct parts;

Oro-Medonte and be registered on the title of the retained lands, The Site
Plan will identify an area of 0.4 hectares (1 acre) as the building envelope
where the single family dwelling, amenity area, septic system, and
accessory buildings greater than 9 m2 (96,8 ft2) will be located. The
Agreement shall address the preservation of vegetation beyond the 0.4
hectare (1 acre) building envelope.
6. That the applicant pay $ 2,000.00 for the lot created as cash-in-Iieu of a
parkland contribution; and,
7. That the conditions of consent imposed by the Committee be fulfilled
within one year from the date of the giving of the notice,

COMMITTEE OF ADJUSTMENT DECISION to MODIFY CONDITIONS OF
APPROVAL
WHEREAS Committee may modify the conditions of Provisional Consent in
accordance with Section 53 (23) of the Planning Act R.S.O 1990. c.P. 13, as
amended.
WHEREAS Committee deems it necessary to amend the conditions of
Provisional Consent and finds the modifications to be minor and of a
technical nature, and
WHEREAS Committee deems the changes to the conditions to be minor
and therefore, pursuant to Section 53(26) of the Planning Act, no Notice of
the change to conditions is required;
NOW THEREFORE BE IT RESOLVED that:
