TO THE ZONING BY -LAW
OF THE TOWNSHIP OF ORO-MEDONTE

TAKE NOTICE that the Council of the Corporation of the Township of Oro-Medonte will hold a Public Meeting on
Monday, October 24, 2005 at 7:00 p.m. in the Municipal Council Chambers. The purpose of the public meeting is
to obtain public comments on a proposed amendment to the Zoning By-law. under Section 34 of the Planning Act,
R.S.O. 1990 c. P. 13.
THE PURPOSE of the Zoning By-law Amendment would be to rezone the lands described as Concession 7, East
Part of Lot 1 (formerly within the Township of Oro). The subject lands are currently zoned AgriculturalfRural
(AfRU) and Environmental Protection (EP). The applicant is applying to re-zone the lands from the AfRU and EP
Zones to an Agricultural/Rural Exception (AfRU*) Zone to permit a site specific use. The uses proposed as part of
the application are the storage, restoration, and sale of used military equipment (Jeeps) and related parts.
A KEY MAP illustrating the location of the subject lands is provided below.
ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of or in
opposition to the proposed Amendment.. If a person or public body that files an appeal of a decision of the Township
of Oro-Medonte in respect of the proposed Amendment does not make oral submission at the public meeting or make
written submissions to the Township before the proposed Amendment are adopted, the Ontario Municipal Board may
dismiss all or part of the appeal.
If you wish to be notified of the decision of the Township of Oro-Medonte in respect to the proposed Zoning By-law
Amendment, you must make a written request to the address below.

I wish to express my opposition to the proposed amendment to the lands described as
Concession 7, East Part of Lot 1 (formerly in the Township ofOro) from
Agricultural/Rural and Environmental Protection to Agricultural/Rural Exception Zone,
to permit a site specific use (storage, restoration, and sale of used military equipment and
parts.
I object to this rezoning on the grounds that this use is not an agricultural/rural use and
it is out of character with the land uses in the surrounding area, It would turn what was a
beautiful rural area into a used car lot and auto body shop, next to an environmentally
sensitive area bordered by a large, natural pond. I feel that this rezoning could result in
expansion of this operation over the entire property. As it is, I believe it has already
devalued the surrounding properties, as it looks like a large auto wreckers/scrapyard,
Rezoning would legitimize in perpetuity the illegitimate land use that is currently taking
place, Would you want this next door to you? I hope Council will take into
consideration the precedent this rezoning would set for future land uses in
environmentally sensitive areas.

We would like to register our opposltlon to the proposed amendment.
1) The proposed rezoning as defined to permit: "outdoor stoR/ge, repairs, restoration & s81e of military
jeePs, equipment and pans" is no different than conducting any auto repair and mechanical storage
operation on the property. This use directly contravenes By Law 97-95 for home industry usage It is
our feeling that this business is not in compliance with the existing rural nature of the surrounding
area, and negatively impacts the desirabUity and value of adjacent properties, An approval of this
activity by council would serve to further expand this activity and further promote devaluation,
2) The property is also designated as "lOP', environmentally protected. We maintain that an approval of
the proposed activity on this site would be an approval of unnatural 'development' hazardous to this
protected designation, In a recent published study of the Oro Moraine. Oro Madonte council states:
"the protection of the environment shBlI tB1ce precedence over devs/opment. T11e focus of the new
poIk:18s is to protect ecoIogicBlle8tures and functions and the function of the Oro Morsine as a major
recharge area white directlflg devetopmefll to appropriate loCtJtlons ~ Therefore we feel il is the
responsibility of Council to follow their mandate to protect this 'EP' property designation. It should be
noted that there are existing adjacent lots :wned as "EP', harboring a large spring fed pond and
designated .wildlife sanctuary' and "managed forest". The inevitable leaching of hazardous
matarials including gasoline, oils, radiator fluids. etc. Into the watershed and their obvious detrimental
effects should not be Ignored.
3) An existing use of the property indudes the occasional hosting of 'war games' and the rental and
testing on site of large and small artillery, munitions and automatic weaponry, This is disturbing 10 us
as neighbors, frightens our seniors and grandchildren, panicS the wildlife on the pond and in the
forest, and is not something that we would want approved as permissible activity in a residential
area.
4) As a recent precedent in Oro, a farm on the 3'. Line just North of the Old Barrie Road (across from
#2072and adjacent to #2129) whiCh was in the business involving the outdoor storage. repair,
restoration and sale of wood palettes was shut down by Council. In Ihis case, Council sel Ihe
precedent refusing to allow this activity on the property. We maintain Ihat in the proposed
application, the activity is equally if not more unsightly and the materials (metals, oil, gas, etc) far
more unfavoreble and hazardous 10 the environment.
5) As mentioned in the Township Report. #PD2005-052 the SUbmitted survey sketch. originally
requested in March of 2004, Is not acceptable as it does not shOw all "the required information as set
out in Section 41 of the planning act~ Therefore we feel that since it is not an accurate reflection of
the full impact of the planned activity, it cannot be used by Council to make an approval of the
application.

Please accept this letter and photos of the said property as our formal opposition to the
rezoning application.
(1) It is our understanding that before an EP designation is removed, a completed
Environmental Assessment study must be nndertaken. On Nov. 3, 2004 PAC requested further
information from the applicant. Why was an environmental assessment not requested at that
time? As per photo #1 the property in question is outlined in pen. Notice the
pond/springs/marshy area is immediatley adjacent to and becomes part of said property.
(2) Though zoned agrieculturaVEP, and though several building permits on the subject property
were granted under the auspices of agricultural use, the aerial photograph clearly shows the land
is not in fact used for agricultural purposes. The planning department of Oro Medonte was
gravely misled by the applicant.
(3) The applicant is trying to legalize what has, in fact, been a misuse ofland for commercial
useage- as is visible in many photos (#2,#3,#4) taken from concession 7. Photos indicate
quantities of trailers, transport trailers, tractor trailers, military gas cans, military parts and jeeps
strewn all over the property, including being buried in bushes immediately to the south of the
house, amongst a further compound of military equipment (#5).
(4) Aside from existing large structures (barn #9, garage # 10), the applicant has built 3 additional
structures: compound area (#6), red-roofbuilding(#7) and a large white canvas covered structure
(#8). Despite the fact that these buildings exist, military equipment is littered everywhere, This
useage is an eye sore for the neighbourhood and has been for many years.
(5) PAC never addressed the sound that this existing/proposed useage creates. On Nov 3, 2004,
why did PAC not ask the applicant to have a Sound Study undertaken?
(6) As you can see in photo #4, large areas of the property have been stripped of topsoil and filled
in with a compact granular material preventing normal drainage. Has the applicant ever been
asked to address Storm Water Run-OfflManagement and why was this not requested by the
planning department? This property drains toward the pond and springs on the adjacent property.

This is of major environmental concern considering gas, oil, radiator fluid and other
contaminants are all part of parking lot run off.
(7) The applicant currently has numerous road access points to his property. Are these acceses
regulated by the township as to number and size? If this venture is permitted and continues to
grow, should a Traffic Study not be conducted?
(8) The applicant repairs/stores motor vehicles. As per By-Law 97-95, the applicant should not
be permitted to continue the misuse of this land nor be allowed to transform his illegal deeds into
legal useage by re-zoning.
(9)The applicant appears to have been very successful in running his operation as it has grown
continuously. If current useage continues or is permitted, land value of adjacent properties will
also be affected.
As is clearly evident, this operation belongs in a commercial/industrial site where
traffic, noise, storm water run-off and environmental concerns have already been
addressed.

The Nottawasaga Valley Conservation Authority has reviewed this application in
accordance with Natural Heritage and Natural Hazard policies established under
the Provincial Policy Statement.
The NVCA recommends deferral of the application at this time. As you may be
aware, part of the property is located within the provincially Significant West
Coulson Swamp. The Provincial Policy Statement states that development and
site alteration shall not be permitted within Provincially Significant wetlands and
therefore we believe the wetland should remain in an Environmental Protection
zoning. Though the NVCA has no objection to the area currently utilized for
storage and restoration of vehicles which is outside of the wetland and the
floodplain, we believe the area permitting this use should be limited through
zoning. Further expansion of the operation should be deferred until an
Environmental Impact Statement has been produced which demonstrates the
expanded use will have no negative impacts on the environmental features and
functions of the area. Areas critical to the protection of environmental features and
functions. as well as any floodplain or erosion hazard areas, should be placed into
an Environmental Protection zoning.
It should be noted that our comments reflect the intent of Natural Heritage and
Natural Hazard policies of the Provincial Policy Statement. We also note a
significant part of the property has been included within the Greeniands
designation of the County of Simcoe Official Plan,

We wish to oppose the application to re-zone the land from the A/RU and EP Zones to an
AgricultutaIlRural Exception (AlRU*) Zone to permit a site specific use as storage,
restoration and sale ofusro military equipment and related part;;.
We currently own the land adjacent to this proposed rezoning and raise objections to this
new application as well as his current use of the property. We have taken great care and
expense over the 40+ years to try and protect our large, environmenUllly sensitive, natural
pond to protect what little wildlife we have left in this area. This is, and we woUld like it
to continue, to be a wildlife sanctuary. This pond is also the first in a line of ten others
which could potentially be affected by pollution seeping into the water table. .

Because of the nature of his business the equipment is constantly being tested (not just
Jeeps) the resulting noise levels and frequency are proving to be a huge Source of
irritation to ourselves and surrounding neighbors. If the business were expanded in this
way it could only lead to an increase of noise and disruption to the local popullrtion and
to the wildlife we try so hard to protect.
We are also concerned about the disposal of the existing pollutants in the form of oil and
other hazardous waste protects in the existing business being so close to the un4ergrOlmd
natural springs, '
A large added concern would be the devaluation of properties in our surroundillg area, if
what is already an eyesore, is permitted to expand.

In my opinion Report PD2005-052 did not present a balanced picture of what this application involves
to the Planning Advisory Committee and it does not present a balanced picture to CounciL
It is asking that the "A/RU' and "EP" zone be changed to an "A/RU" exception zone. There is not one
word about the Environmental Protection Zone in the Report, There should have been a detailed
summary of why this area was zoned EP and what scientific data there is to justify changing this
classification.
There is no map showing the EP zone, Attachment 3 showing the house and buildings leaves the area to
the west, where the EP zone is located, blank, There is a large building not shown on Attachment 3,
The Report should be revised by the Director of Planning to include data on the Environmental
Protection Area and a map showing its location,
Then the revised Report should be sent back to the Planning Advisory Committee for a new vote.
On page I it reads, "The uses proposed.. ,are the storage, restoration and sale of used military equipment

Mr. MacDonald have you ever visited this property? There are large army trucks, trailers, and a flatbed
to haul a tank, three I 8-wheeler trailers. 1 have seen ambulances, personnel carriers and other trucks on
the property.
I question your rationalization of this operation as a "home industry", My hero the late Winston
Churchill might have commented: "Some home! Some industry!"
I've always thought of a "home industry" as a weaver, potter or woodworker.
You were paid hundreds of thousands of tax dollars to write the Official Plan and hundreds of thousands
more to revise it. As an ethical professional planner I would think you should be defending your plan.
Planning reports to the Planning Advisory Committee and Council should be objective. They should
clearly layout the possible benefits and negative consequences of the application. This has not been the
case. In 10 years I cannot remember a balanced planning report. For example look at the Report on the
proposed Moon Point development.

Mayor Craig -I've read in the Packet and Times how proud you are about Oro-Medonte's "Environment
First" policy - so if you really believe in this policy you should vote against this application.
I recognize Mr. MacDonald's planning experience- but it is time for a new era of planning in my
Township, Council hired a new highly qualified and experienced planner and it is time he prepared all
planning reports for Council - as is done in most municipalities in Ontario - for example Simcoe
County.
Mayor Craig and Councillors] respectfully request that Council pass whatever is needed to assure that
all future reports on proposed developments and zoning changes are prepared by the Director of
Planning and his staff.

development of the property conforms to County requirements for development atljacent to a County Road,
the Transportation and Engineering Division requests the development of the above noted property be
subject to site plan control.
In the event the Township is not considering site plan control the County will require the applicant to
submit a conceptual plan to the satisfaction of the County of Simcoe, prior to approval of the application.
In accordance with Section 4.11 of the County of Simcoe Official Plan, this application is also subject to all
other applicable Provincial, County and Local policies and by-laws. Please forward a copy of the decision
to the County of Simcoe.
