of Cabinet. regarding the status of the Hillsdale Correctional Camp in the Township of Oro-
Medonte As i am now the Minister with responsibility for the Ontario Realty Corporation
(ORC). I am pleased to respond to you.
As noted by His Worship, J. Neil Craig, Mayor of the Township of Oro-Medonte, the Hillsdale
Correctional Camp was ciosed. At that time, provinoial payments lor this site to the Township
should have changed from a levy for institutionai services to payment-in-lieu of taxes. ORC has
contacted the Ministry of Municipal Affairs and Housing (MMAH) and has advised them of the
effective date of closure 01 this facility and that they need to make payments-in-lieu 01 taxes lor
2004 and 2005. I am confident that MMAH will resolve any payment adjustments as applicabie
to the Township.

The purpose of this letter is to provide you with our Association's view as it relates to the renewed requests
from the Professional Engineers of Ontario (PEO) and the Ontario Association of Architects (OAA), to be
exempt from the provincial qualifications and insurance requirements mandated in the Building Code Act
and Ontario Regulation 305/03 (as Amended).
As you are aware, the BRRAG/Bill124 process has undergone an extensive public consultation and dialogue
which allowed for input from stakeholders including the OAA and PEO. During the consultation process it
became evident in part that municipalities were experiencing great difficulty processing building permit
applications prepared by design professionals, whom appeared to demonstrate a low level of building code
specific knowledge. As a consequence, the Ministry of Municipal Affairs & Housing (MMAH)
commissioned an engineering firm, "Trow Consulting Engineers Ltd." in order to substantiate and document
the level of concern with respect to substandard design submissions. The report revealed that Municipal
concerns were both valid and widespread.
Our Association is aware that the creation of the provincial qualifications is having an impact on several
Associations, including the Ontario Building Officials Association (OBOA), and while we also understand
that the PEO and OAA have self regulatory status under law, we believe the central issue is the "safety of the
public" and to that end, all of the participants in the building industry should demonstrate a competent level
of building code specific knowledge and skill.
The OBOA finds it difficult to rely solely on credentials of any professional where it can be consistently and
objectively shown that there has been a failure to be fully cognizant of applicable building code specific
knowledge. Further, we understand that most academic curriculums on which professional credentials are
based do not currently contain the necessary level of building code specific training. Based on these
observations we are unclear how this demonstrates sufficiency in place of the exam requirements for the new
qualifications for these organizations.
The OBOA has up to this point, and continues to be, in support of many of the initiatives flowing from the
Bill 124 legislation. The original recommendations of the Bill recognized the interdependent nature of the
proposed legislation. Unfortunately the continued refinements, including the possible exemption of
Architects and Engineers will erode the integrity of the Bill. Notwithstanding the overly aggressive
implementation of these reforms, most municipalities are generally committed to completing the
requirements provided there are no additional adverse amendments.
Providing exemptions to Architects and Engineers would constitute a fundamental change in the
Government's position of sufficient magnitude that the OEOA could no longer support the Government in
this matter. Ultimately, municipalities and building officials would remain as the primary entities affected by
the legislation.

While our Association has in the past refrained from seeking the direct involvement of Members of
Provincial Parliament, we are currently asking all OBOA members to take this opportunity to contact their
local MPP and voice their strong objection to exemptions from the provincial qualifications and insurance
requirements mandated in Ontario Regulation 305/03 for specific organizations.
The OBOA continues to be willing to meet with the PEO, OAA as well as the Ministry of Municipal Affairs
and Housing and Attorney General in order to resolve this issue.

Your Worship, Council Members:
I understand that at your meeting last night Council did not adopt Staff Sgt. Whinnery's
proposal regarding the operational plan for our road.
Further, I understand that Council did not adopt this plan on the advice of our public
works department. Specifically it appears that Jerry Ball did not recommend the plan
because he is - I paraphrase - 'concerned that all similar roads in Oro-Medonte are
treated the same' .
Mr. Ball must not be very familiar with the township he serves. There is no road quite
like ours in Oro-Medonte. Further, to suggest that all roads need to be given similar
treatment is simply absurd.
The most senior, respected members of our opp felt that our road needed extra care to
maintain our safety. With their expertise and experience on road safety, they took time
and care to present a comprehensive plan to present to Council. The plan was simple, easy
to monitor, and, at the very least, could have been modified through discussion rather
than be simply thrown out.
Every member of Council has heard about the danger on our road for many, many months. I
honestly believe that most of you recognize that our residents face danger on our road
every day. I know that you take the personal safety of your constituents very seriously.
What I can't understand is why this issue is taking so long to resolve.
Surely as our elected representatives you can help us more expeditiously. Is it impossible
for our council to get agreement on a plan that would ensure our safety?
Since you have rejected the OPP proposal, would you please let me know what immediate plan
you will present to the residents of my road?

I have just received a copy of Jerry Bail's Report To Council via your clerk Janette Teeter.
I wish to comment on page 12a - 2 paragraph 4. For those of you who do not have this at hand it states:
"The suggested 5 hours per week of enforcement commitment on Line 15 during the identified problem times is
approximately 12% of the number of dedicated patrol hours for the entire Township."
if this is indeed the case and as I learned all but one of you agreed to this stated fact in Jerry Ball's report. then that means the
hours of patrol within the Township are approximately 2200 hours per year. the equivalent of one officer full time. Remember
now. the O.P.P. were only dedicating 260 hours per year to our road so this indeed is 12% of one man's time. I foolishly believed
and calculated my 1 % and 2% respectively as time dedicated to our road given the fact that our Policing Budget in whole gave us
the residents close to 24,000 hours of service. In addition to this new information is the fact that it has been stated that there are
3500 calls for service. This equates to an average of 4.9 hours for each call for service in order to achieve the dollars spent.
If you think my questions and conclusions are absurd you need only to take out a calculator to realize that what Jerry Ball has
stated and you have all agreed to is even more so if indeed this is what is being paid for by out tax dollars.
Having stated the above and requested other information in my last email dated October 6. 2005 of which I have not had a reply, I
again respectfully request your immediate response to my information as requested. Again here are my questions:
1) What other 1.5 km stretch ot narrow residential road has an AADT of 2.200 vehicles?
2) What other 1.5 km stretch of narrow residential road has trucks; trailers: liatbeds: farm machinery: ambulances: police vans:
haulage trucks. heavy construction equipment and vehicles that use it as a short cut and speed way to get where they are going?
3) What other small stretch of narrow residential road is threatened with more of the above with the development of the West
Ridge Housing Deveiopment which will eventually have two exits and entrances leading out of same onto our road?
4) What other small stretch of narrow residential road is again threatened by more of fhe above with the purchase of the Horne
Farm (on line 15 North south of Bass lake Side Road) by the City of Orillia for future Industrial Development purposes?
Since Jerry Ball states that there are other "roads within the Township with similar AADT rates and traffic enforcement
concerns," we want to know that he is comparing apples with apples when making this statement. As this statement is now on
record, this information must be obtainable within records held by the Roads Department either on computer or simply on paper in
Ihe form of a report. I am a proponent of "working" with you on this but am also aware thaf this information can be retrieved
through other measures.
I await a response from either Your Worship or the Roads Superintendent.

To All Members of Oro-Medonte Council:
It was with great disappointment that I was nolified of the news that this council chose to disregard Staff/Sgt. Ed Whinery's
Operational Pian for Line 15 North and that Jerry Ball's report was accepted by all but one of you. You have all acknowledged
that the situation on Line 15 North is a unique one, yet the only concern seems to be Jerry Bali's claim the Operationai
Plan provides the residents of our road preferential treatment compared to other roads in the Municipality. I respectfully request
you to provide the names of the other residential roads in the township that are comparable to Line 15 North and experience the
same problems as we do. The O.P.P. Operational Plan is by no means excessive or extraordinary. It only contains what every
resident in this Township is entitled to...that being police presence to enforce the law. no matter what road you happen to live on.
Should the residents of other areas in this township feel they are not receiving adequate police coverage to enforce their problems
then they are free to act just as we have and attempt to do something about the problems they face.
What is Council's plan of action with regard the problems we continue to have on Line 15 North, given that you have chosen
to disregard a commitment of 5 hours per week of police presence on our road based on Jerry Bali's report. I did not see any
alternate recommendations in that report nor have I heard of any commitment from this council that would dispatch Bylaw
Enforcement personnel to this road to enforce the Bylaws that have been enacted or the "No Parking" signs that have been
erected. Will Byiaw Enforcement Officers now work 24/7. on weekends and holidays as do the O.P.P.?
Perhaps the REAL issue here is the cost of policing in this Township!!! If the Township is receiving approximateiy 3200
hours of service at a cost of 1.5 million dollars, then each and everyone of you should be asking some serious questions and
demanding some answers. I am appalled that there are members of Councii and Township employees who feel that this is
acceptable and good value for the money. I, as a tax payer in Oro-Medonte. am requesting from Councii. a complete and accurate
accounting of how the approximately 1.5 million dollar policing budget is spent.

Dear Deputy Mayor Harry Hughes:
I'm requesting your assistance to solve an issue about traffic congestion and speed on Ridge
Road. I live on Ridge Road in the township of Oro-Medonte. My family has lived here for 17
years. I attend Eastview Secondary School, in Barrie, and I travel on Ridge Road daily. I feel that
the road has become very busy and that cars travelling on it are going much faster than the
indicated speed limit. This has become a problem for my family and the community.
When my family first moved in, Ridge Road was much quieter. Over the years we have had
trouble getting out of our driveway, biking on the road and walking our dog safely. Since the
road goes through the village of Shanty Bay where children are always crossing the road and
biking around, it has become unsafe. There have been a number of accidents on the road, some
which caused serious injuries and death. Ridge road was originally an old county road designed
for horses and buggies not as a high-speed modern highway. It is a narrow road with many blind
spots.
I believe that the speed limits on the road are reasonable but they should be reduced in areas
with housing such as through the village of Shanty Bay. Since the speed limits are not at all
abided by, they should be monitored and enforced. Police should be around more often. Perhaps
another road could be created, a by-pass highway, and the traffic could be diverted. Four-way
stops should be placed at each crossing. This would create less traffic congestion and slower
speeds.
Thank you for taking time to consider this important issue. I hope Ridge Road could be
considered and appreciated as a scenic route instead of a highway. Oro-Medonte is a great place
to live and is a wonderful community. Thank you again and I look forward to your response.

In late 2004, Council requested that consideration be given to advertise and tender for required
materials such as dust control, gravel, resurfacing material/asphalt, and winter sand for the 2006
season. It was felt that tendering before the next season would provide for better competitive pricing
and an earlier time completion for most of the contract jobs. In discussions with contractors, it was
believed that late Fall tendering presents two concerns, both being the unknown costs for asphalt
cement and fuel for the Spring of 2006. Thus, by providing tenders prior to Spring, versus late Fall,
contractors could present more realistic costing to supply and apply their product, consequently
benefiting the municipality.
In discussing the 2006 material tenders, the Public Works Department is requesting consideration
being given to applying the funding from the Federal Fuel Tax Allocation and the Ontario Municipal
Partnership Fund to both the operating and capital budgets. These funds could be applied to
additional capital projects, increasing the Hardtop Road Resurfacing program, and changing the dust
control program from calcium to a complete solid spray of Virgin Oil on all gravel roads.

In considering the 2006 material tenders, it is recommended to tender in early February, 2006 to
capitalize on the most competitive pricing for the required products.

SITE PLAN CONTROL AGREEMENT

WHEREAS the Owner has applied to the Township of Oro-Medonte to permit a single
family residence on lands described in Schedule "A". attached hereto;
AND WHEREAS the Township has enacted a By-law to provide for the designation of the
lands as a "Site Plan Control Area";
AND WHEREAS the Owner intends to deveiop the lands in accordance with the Site Plan
attached hereto as Schedule "B";
NOW THEREFORE This Agreement Witnesseth THAT in ccnsideration of the mutual
covenants hereinafter contained. the parties hereto hereby covenant and agree as
follows:

1. COVENANTS BY THE OWNER
The Owner covenants and agrees as follows:
a) The Owner owns the subject lands described in Schedule "A". attached hereto,
and has provided the Township with a Registered Deed containing the legal
description of the subject lands.
b) This Agreement may be registered against title to these subject lands and shall
take priority over any subsequent registrations against the title to the subject lands.
c) No work shall be performed on the lands, nor any use made of the subject lands
with respect to the proposed development. except in conformity with all the
provisions of this Agreement.
d) The Owner shall, prior to the execution of this Agreement. obtain all necessary
permits and approvals from the Township and from all Ministries and Agencies,
including, but not limited to. the County of Simcoe.
e) The Owner shall, prior to the execution of this Agreement, pay all municipal taxes
and charges related to obtaining the approval of these lands for the intended use.
f) The Owner shall pay a refundable deposit for such reasonable ccsts as may be
involved to the Township in having its solicitor, engineer, planner and staft, perform
any work in connection with this Agreement. including the preparation. drafting,
execution, and registration of this Agreement. The Owner acknowledges and
agrees that the Owner shall be responsible for the cost of performance of all the
Owner's obligations hereunder. unless the context otherwise requires. Every
provision of this Agreement, by which the Owner is obligated in any way, shall be
deemed to include the words "at the expense of the Owner", unless specifically
stated otherwise. The refundable deposit for expenses and actual ccst shall be
$1,000.00. The Owner shall replenish the refundable deposit. to its full amount,
when the expenses and actual costs are submitted by the Township.
g) The Owner shall have delivered to the Township. all Transfers/Deeds, Discharges
and Easements, or other documents required by Schedule "C", as well as
certification from the Owner's solicitor that the Transfer/Deeds and Easements
shall provide the Township with good title, free and clear from all encumbrances.
2. COVENANTS BY THE TOWNSHIP
The Township covenants and agrees as follows:
a) That the Township has enacted a By-law to permit a single family home described
on the Site Plan.
b) That the Township agrees that subject to ccmpliance by the Owner with all
relevant Municipal By-laws and Provincial Statutes and Regulations. the Owner
may proceed to develop the subject lands. as indicated on the Site Plan attached
hereto as Schedule "B". subject to the development restrictions contained herein.
3. DEVELOPMENT RESTRICTIONS
The Parties hereto acknowledge and agree that any use of the subject iands by the
Owner shall be on and subject to the following terms and ccnditions:

a) Site Plan

The use and development of the subject iands shall be in accordance with and as
set out on the Site Plan, attached hereto as Schedule "8".
b) Liohtino
All lighting systems installed outside, such as floodlights, shall be directed away
from any adjacent residential use and/or roadway, not to cause interference in any
way.
c) Parkino Areas and Drivewavs
All parking areas and driveways shall be constructed in conformity with Sections
5.19 and 5.20 of By-law No. 97-95, as amended. and the Ontario Building Code
Regulation #419/86, and such parking areas. loading. and access areas shall be
kept free and clear of snow and ice and kept adequately drained. All entrances
shall be constructed. as in Schedule "B" attached. The Owner agrees to obtain
all necessary approvals from the Ministry of Transportation. County of Simcoe and
Township of Oro-Medonte.
d) Outside Storaoe
No outside storage shall be permitted between any buildings on the premises and
any street. Any other outside storage shall be contained in the fenced compound,
as identified on Schedule "B".
e) Garbaoe Storaoe
The Owner agrees to provide suitable storage areas for garbage and waste, as
shown on the Site Plan, and to install and maintain litter containers in and around
development on the lands. All metal scrap and associated refuse contained in the
fenced compound shall be removed on a weekly basis.
f) LandscaDinq
The Owner shall compiete all landscaping and landscaped areas shown on the
Site Plan, attached as Schedule "B", as soon as weather permits, and all grading
and sodding required, according to any Engineering drawings submitted. shall be
done on all lawn areas.
g) Erosion and Siltation Control
The Owner must take all necessary precautions to prevent erosion and
sedimentation of ditches and culverts, slopes, etc., within the Site Plan. and
downstream prior to and during construction. The Owner agrees to maintain all
erosion and siltation control devices in good repair until vegetative cover has been
successfully established.
4. DEVELOPMENT CHANGES
The parties acknowledge and agree that there shall be no changes to this Agreement or
the Schedules attached hereto. unless and until such changes have been approved by all
parties. It is the intention of the parties that material amendments to this Agreement be
properly recorded. Such amendments may take the form of a registered Amending
Agreement. an unregistered Agreement, exchange of correspondence, Memorandum of
Confirmation. or notations on Engineering drawings. The nature of such record of
amendment shall depend on circumstances.

5. SECURITY
Prior to signing the Agreement, the Owner will deposit, with the Treasurer of the
Township, to cover the faithful performance of the obligations of the Owner arising under
this Agreement, including but not limited to the construction of the works and services
identified in Schedule "D" to this Agreement (the "said Work"). the following securities:
a) Cash in the amount of one hundred percent (100%) of the estimated cost of the
said work, as approved by the Township Engineer and Township Council. or:
b) An irrevocable Letter of Credit from a chartered bank. issued in accordance with
the requirements of Schedule "E". with an automatic renewal clause in the amount
of one hundred percent (100%) of the estimated costs of the said works. and as
approved by the Township Engineer. The Letter of Credit shall be for a minimum
guaranteed period of one (1) year. or such time as the Township decides, and
shall be renewed automatically. as necessary, thirty (30) days prior to expiration.
c) The Township reserves the right to accept or reject any of these alternative
methods of providing securities. Prior to depositing the securities, the Owner's
Engineer shall submit an estimate of the cost of the works to the Township
Engineer for approval. When the cost estimate has been approved, it will be set
out in Schedule "D" of this Agreement and will become the basis for the limits of
the securities.
d) Any Letter of Credit or security filed with the Township is based upon the estimated
cost of completing the various matters prescribed by this Agreement. However, all
Letters of Credit and security received by the Township may be used as security
for any item or any other matter which. under the terms of this Agreement, is the
responsibility of the Owner. including without limiting the generality of the
foregoing. payment of engineering. legal. planning or other costs incurred by the
Township, which are the responsibility of the Owner. under the terms of this
Agreement.
e) Upon written notification by the Owner's agent. certifying that all required works
for which the Letter of Credit was submitted have been completed in accordance
with the plans submitted and upon confirmation by the Township or its agent that
the Owner's obligations under this Agreement have been compieted, the
Township will return said Letter of Credit.
f) If in the event of default of the Owner under any of the provisions of this
Agreement, it becomes necessary for the Township to realize on its security or
deposits, then the Township shall give. by registered mail. twenty-one (21) day's
notice, its intent to draw down on the security or deposit.
6. COMPLIANCE
Any action taken by the Township or on its behalf, pursuant to this Agreement. shall be in
addition to and without prejudice to any security or other guarantee given on behall of the
Owner for the performance of its covenants and agreements herein, and upon default on
the part of the Owner hereunder. the Township shall, in addition to any other remedy
available to it, be at liberty to utilize the provisions of Section 325 of the Municipal Act.
R.S.O. 1980, Chapter 302, as amended.
7. CO-OPERATION
The Owner consents to the registration of this Agreement by the Township, upon the title
of the subject lands, at the expense of the Owner and agrees to execute such further and
other documents. consents or applications. as required, for the purpose of securing
registration and giving effect to the provisions of this Agreement.

8. BINDING EFFECT
This Agreement, and everything contained herein, shall be binding upon the successors
and assigns of the parties hereto. and upon the lands described in Schedule "A", attached
hereto, such Schedule being a legal description of the lands. and it is further agreed that
this Agreement shall be prepared. approved and registered on title,
9. SEVERABILITY OF CLAUSES
Should any section. subsection, clause, paragraph. or provision of this Agreement be
declared by a Court of competent jurisdiction to be invalid. the same shall not affect the
validity of the Agreement as a whole or any part thereof. other than the provision so
declared to be invalid.
10. SAVE HARMLESS
The Owner, on behall of itself. its successors and assigns, agrees to indemnify and save
harmless, the Township from and against any and all claims, suits, actions and demands
whatsoever, which may arise either directly or indirectly by reason of any work or service
performed by the Township, its servants or sub-contractors in order to complete the work
or services required to be completed under this Agreement. provided the subject matter
of such action. suits, claims or demands was not caused intentionally or through gross
negligence on the part of the Township, its servants or agents or sub-contractors.
IN WITNESS WHEREOF, the Parties hereunto have affixed their respective seals
under the hands of their proper officers duly authorized in that behalf.

II BACKGROUND:

In 1999, Mr. Frank Lawson was a driving force in the conception of a "roadside clean-up" campaign,
which has been co-ordinated every Spring with "Pitch-In Canada" Week.
With the sponsorship of the Oro District Lions Club, this campaign has grown from a small group of
individuals in 1999 to 34 individuals and groups in 2005.
Along with these community-minded individuals and groups, there are a number of residents, such as
the Malloy's (letter attached for Council's perusal), that clean roadsides in their neighbourhood on an
ongoing basis.
II ANALYSIS:
II
In Mrs. Malloy's letter, she is requesting Council to consider implementing an "Adopt-A-Road"
program; there have been a number of other residents enquiring about this program in the past.
Mr. Chris Doherty of the County of Simcoe has supplied me with Agreements, terms and conditions,
information and safety brochures, and an "Adopt-A-Highway" safety video, all of which could be
adapted in-house for Township use.

The financial implication to the Township for this program would be the start-up costs of signage,
installation and vests. Ongoing costs would include staff time for the collection of garbage, tippage
fees, garbage bags (if not paid for by the Oro District Lions Club), and maintenance of signs.
In the 2005 Public Works budget, $10,100.00 was budgeted for debris and litter pick-up. If Council
were to implement an "Adopt-A-Road" program, there would be a need to increase this budget by
$10,000.00. In 2006, an "Adopt-A-Road" co-ordinator would have to be appointed.
This money would be used to purchase and install signs, being "Adopt-A-Road" (24" x 24"); "Keep
Oro-Medonte Clean" (Tab 24" x 12"); and Sponsor Tab with flip down "Men Working Sign" (24" x 12")
(x 2), one for each end of the road being adopted, as well as to purchase vests. The cost of this is
approximately $600.00 per sponsor. An "Adopt-A-Trail or Park" could also be included in this
program, geared more towards younger children groups, i.e. Cubs and Brownies.
If Council were to adopt this program, it is recommended that consideration also be given to the
continuation of the Spring "roadside clean-up" campaign. This program, at the present time, is very
inexpensive for the Township to operate and allows Township residents to do annual clean-up of
roadsides which they live on, that are not Township roads (County and Provincial roads), and also
allows individuals, such as high school students, to provide clean-up on a one-time basis as part of
their community service work.
II RECOMMENDATION(S):

I would like to request that Council consider implementing an "Adopt-A-Road"
program, similar to that already present in Simcoe County. I am specifically
interested in adopting Line 6 North between Moonstone and Mt. St. Louis Road.
Since we have moved into Oro-Medonte in 1999, my husband and I have
personally worked on an ongoing basis to keep Line 6 N free of trash. Most of
the items we pick up are beer and liquor bottles, fast food wrappers and
beverage containers, cigarette packages, and other waste that has clearly not
blown in from local households. Occasionally someone will dump garbage bags
or bags of compost materials. We do the cleanup because we are proud of
where we live and we do not want road waste material leaving an implied
message that this is acceptable in our community.
Since the inception of the two-bag garbage limit this year, I am uncertain that we
will still be able to incorporate the volume of road material into our household
waste and meet the two-bag limit. (We fully support the two bag limit, incidently.)
Simcoe County will provide free garbage pickup twice a year for the roads
adopted; they ask for notice to arrange for the pickup. I am asking for similar
support from Oro-Medonte.

II BACKGROUND:

The applicant is proposing to construct a single family dwelling on Lot 7, Plan 51M-720, municipally
known as 40 Highland Drive. The lands within this subdivision, including the subject property, are
typically characterized as wooded with significant slopes. In order to ensure that development is
sensitive to the protection of the slope, the lands are zoned R1*147(H) which requires increased site-
specific setbacks from slopes exceeding 3:1. The Holding provision is also applied to the lands
within this subdivision to ensure that a site plan agreement is entered into to ensure compliance with
the increased By-law setbacks regarding steep slopes, as well as ensure that all site works minimize
tree loss.
II ANALYSIS:

The site plan application was presented to the Site Plan Committee on October 12, 2005 and the
Committee had no concerns. The entering into of the requisite site plan agreement is being
recommended by the Director of Engineering and Environmental Services on October 26, 2005. To
this end, it is appropriate to remove the Holding provision respecting the subject property at this time.

1. THAT Report No. PD 2005-059 be received and adopted; and,
2. THAT the Clerk bring forward the appropriate by-law for Council's consideration to remove
the Holding prefix respecting Lot 7, Plan 51 M-720.
