II BACKGROUND:
II
The purpose of this report is to consider the proposed Zoning By-law Amendment application
submitted by Mike and Colleen Gartner. The subject lands are located immediately east of the
Shanty Bay settlement area and are designated Rural and Shoreline in the Township's Official
Plan. The property is currently zoned Agricultural/Rural (A/RU) and Shoreline Residential (SR)
in the Township's Zoning By-law 97-95, as amended. The northern half of the property
adjacent to the Ridge Road is the portion designated Rural and zoned Agricultural/Rural (A/RU)
and the southern half adjacent to Lake Simcoe is the portion designated Shoreline and zoned
Shoreline Residential (SR). The lands subject to this application for rezoning have a shoreline
frontage of 84 metres and a lot area of about 3.2 hectares.
The applicant's have applied for a Zoning By-law Amendment for a Site Specific Exception as
follows:
1. That the maximum height for a boathouse, established in Section 5.6 (g) of the
Township's Zoning By-law of 4.5 metres (14.7 feet) above the elevation of average high
water mark, be increased to 9.8 metres (32 feet); and,
2. That an exemption be granted from Section 5.6 (d) of the Zoning By-law to permit the
second storey of the proposed boathouse to be used as an accessory guest premises
providing sleeping and sanitary facilities, but no kitchen facilities. Section 5.6 (d)
specifically states: "[boathouses are permitted], provided they are not used for human
habitation and no kitchen or sanitary facilities exist':

In February 2005 a report was presented to the Planning Advisory Committee which assessed
the application and recommended that the application proceed to the required public meeting in
accordance with the Planning Act.
A Public meeting was held on April 18, 2005 at which time 4 written comments were
received from the County of Simcoe, Lake Simcoe Region Conservation Authority,
Simcoe County District School Board, and neighbour Michael Douglas. No verbal
comments were received at the time of the public meeting. None of the written
comments received objected to the proposed Zoning By-law Amendment.
The subject property is designated Rural and Shoreline in the Township's Official Plan. The
property is split between the Rural designation for the northern half of the property adjacent to
the Ridge Road and the Shoreline designation for the southern half of the property adjacent to
Lake Simcoe. The requested zoning exception applies to the lands designated Shoreline and
therefore the policies of Section 010 - Shoreline would be applicable to this application.
There are three objectives of the Shoreline policies:
. to maintain the existing character of this predominantly residential area;
. to protect the natural features of the shoreline area and the immediate shoreline; and,
· to ensure that existing development is appropriately serviced with water and sewer
services.

While there are no specific policies for considering zoning by-law amendments for this type of
request a review of the objectives and how they are satisfied through this application was
contained in the previous planning report and is added here for easier reference.
"On the issue of maintaining character of the shoreline, this property is located in an area of the
Oro-Medonte shoreline that features large lots, wider shoreline frontages and larger estate style
homes. While the provision of accessory uses such as guest houses may seem at odds with
what is viewed as appropriate for the majority of the Oro-Medonte shoreline, the character of
this area is distinct when compared to the character of other parts of the Oro-Medonte shoreline
which feature narrow shoreline frontages, small lots and smaller dwellings. In the assessment
of this application it is valid to rationalize this distinction to determine if the nature of the
requested exemption is reasonable. At this point it is difficult to establish that the proposal is
unreasonable or represents bad planning solely in the context of protecting the character of the
shoreline.
With respect to the intent of the Official Plan to protect natural features in the shoreline, it is
noted that the Zoning By-law provides the right to utilize up to 30% of a shoreline frontage for a
boathouse. In this case the applicant proposes to use about 16%. Given the stated intent of the
Plan to protect natural features in the shoreline, there may be merit in considering the proposed
height exemption given that it would result in less of the natural shoreline being developed than
would be permitted as-of-right by the Zoning By-law.
In addition to the above, it is reiterated that the subject lands are currently occupied by a 2
storey boathouse. Given that the intent of the proposal is to substantially replace this boathouse
in the same location, it is probable that the overall impact upon natural features in the shoreline
will be low. A permit has been issued by the Lake Simcoe Region Conservation Authority for the
construction of the new boathouse and the shoreline improvements.
The Shoreline policies of the Official Plan also speak to the need for appropriate sewer and
water servicing for new development. The applicant will be required to obtain approval from
the Township's Building Department related to both the septic and the new construction which
will ensure compliance with the Shoreline policies. Given the size of the lot, (3.2 hectares) it is
unlikely that the applicant would not be able to engineer an appropriate septic system and water
supply.
Finally, concerns that this application may represent a precedent or will lead to requests for the
establishment of second dwelling units are acknowledged. In response, it is sU9gested that
while the applicant is requesting exemptions from the Township's Zoning By-law, these
exemptions respect the intent of the Official Plan. "
A copy of the proposed by-law is attached to this report. If the attached Zoning By-law
Amendment is considered favorably it would conform with the intent and policies of the
Oro-Medonte and County of Simcoe Official Plans. On this basis, it is recommended
that the attached Zoning By-law Amendment be given favorable consideration.

Being a By~law to change the zoning on lands within Concession 3, Part of
lots 21 and 28. 51R~33437, Part 1 {Oro) now in the Township of Oro~
Medonte (Gartner - Roll # 43~46-010~007-21100~OOOO).
WHEREAS Zoning By-Jaw 1997.95 was enacted to regulate the use of land and the character,
location, and use of buildings and structures within the Township of Ora-Medonle;
AND WHEREAS the Council of the Corporation of the Township of Oro-Medonte deems it
appropriate to further amend By-law 1997-95, as amended;
AND WHEREAS this By-law is in conformity with Section 010 of the Official Plan of the Township
of Oro~Medonte;
AND WHEREAS the Council of the Corporation of the Township of Ora-Medonle is empowered to
pass By-laws to regulate the use of land pursuant to Section 34 of the P!anning Act, RS.O. 1990,
c.P.13.
NOW THEREFORE the Council of the Corporation of the Township of Ora-Madonte enacts as

1. Schedule 'A2' to Zoning By-law No. 97-95 as amended, is hereby further amended by
changing the zone symbol applying to the lands !ocated in Concession 3, Part of Lots 27
& 28, RP 51R-33437, Part 1 in the former geographic Township of Ora, now in the
Township of Oro-Medonte, from the Shoreline Residentia! (SR) Zone to the Shoreline
Residentia! Exception (SR'"159) Zone as shown on Schedule 'A-I' attached hereto and
forming part of this By-!aw.
2. Section 7.0 to Zoning By-law 97 -95, as amended, is hereby further amended by adding
the following new section:
"7.159 .159 - Concession 3, Part of Lots 27 & 28, RP 51R-33437, Part 1(Oro)
Notwithstanding any other provisions in this By-Jaw, the following provisions apply to the
!ands denoted by the Symbo! .159 on Schedule A2 to this By-law:

The purpose of this report is to review this application subsequent to the Public Meeting held on April
18, 2005 and provide a recommendation on the Official Plan Amendment applying to lands within the
North Part of Lot 3, Concession 11 (Medonte) owned by Mr. And Mrs. Webb. A planning report was
presented to the Planning Advisory Committee in February 2005 which recommended proceeding to
the public meeting on the basis that sufficient information was available to understand the intent of
the amendment.
At the present time, the lands are designated Agricultural in accordance with the Official Plan and
zoned Agricultural/Rural (A/RU) by Zoning By-law 97-95. The policies of the Agricultural designation
permit the creation of new lots by severance for specialized agricultural uses however the existing
veterinary clinic does not completely comply with these provisions. As a result, a change to the
Official Plan designation is required. No Zoning By-law Amendment is required as the
Agricultural/Rural (A/RU) Zone permits a veterinary clinic with a minimum lot area of 4 hectares (9.8
acres).
In January 2005 an application for an Official Plan Amendment was submitted by Ian and Lori Webb,
owners of North Part of Lot 3, Concession 11 (Medonte) located at 3808 Line 11 North. The purpose
of the application is to obtain site specific exceptions to the Official Plan to permit the severance of
the existing veterinary clinic located on the property.
The subject property is a total of 19.8 ha (49 acres) and currently contains the following buildings:

3. An agricultural building:
4. A veterinary clinic.
The specific exception requested by the applicant is for a new policy under Section 02.4 - Exceptions
to permit the creation of a new lot for the existing veterinary clinic.
II POLICY CONTEXT:

The subject property is designated Agricultural in the Township's Official Plan and is subject to the
policies contained in Section 02. Section 02.1 establishes the objectives of this designation as
follows:
To maintain and preserve the agricultural resource base of the Township.
To protect land suitable for agricultural production from development and land uses unrelated
to agriculture.
. To promote the agricultural industry and associated activities and enhance their capacity to
contribute to the economy of the Township.
To preserve and promote the agricultural character of the Township and the maintenance of
the open countryside.
Permitted uses in this designation include agricultural related commercial uses which could include
veterinary clinics.
The development policies contained in this section provide for the creation of new lots for agricultural
purposes and the creation of new lots for non-agricultural purposes (bona fide retiring farmers and
infilling). The applicant's proposal to create a lot for the veterinary clinic does not meet the policies
for either of these purposes specifically. Currently the Official Plan looks at agricultural use as
meaning specialty crop lands, organic farms, or market gardens. A veterinary clinic would be more of
an agriculturally related use.
The applicant had applied for a consent for a new lot for agricultural purposes in 2001; however the
application was deferred by the Committee of Adjustment as the Committee could not determine that
the veterinary clinic was a specialized agricultural use in accordance with the Official Plan.
In reviewing the policies it is clear that a veterinary clinic was not contemplated as a specialized
agricultural use; although such a use is permitted by the Plan.
The Township's Zoning By-law 97-95, as amended, permits a veterinary clinic in the Agricultural/Rural
(AIRU) zone with a minimum lot area requirement of 4 ha (9.8 acres). The applicant was prepared in
2001 to sever a 4 ha parcel in order to ensure compliance with the Zonin9 By-law requirements.
Similar to the policies that apply to the specialized agricultural uses, if the lot is created for the
veterinary clinic it should be placed in a site specific zone that prohibits development of residential
use to ensure the intended use of the property is for the veterinary clinic or other agricultural use.

Consideration of the policies contained in Section J3 - Amendments to the Plan is also required.
These policies indicate that the policies should only be amended when the policies of the Plan have
been found not to address issues or alternatively, issues have been raised with respect to site
specific proposals that must be addressed in a comprehensive manner. This section continues on 10
state that the Township will not consider site specific amendments to the Plan unless they are
specifically anticipated by this Plan for a period of at least five years. Following that five year period,
the Township will review applications for Amendments in the context of the Plan as a whole and
consider whether or not such Amendments should be dealt with in the course of an Official Plan
review.
The five year time period has now passed and an Official Plan review has been completed and
adopted by Council (OPA #17), these policies are however under appeal and the existing policies
continue to apply.
The proposed application while specific to this property, addresses an issue that was not addressed
through the Official Plan but was contemplated through the Zoning By-law provisions for smaller
parcels of land (4 hectare minimum lot area requirement). On this basis the application is deemed to
generally satisfy the intent of this section.
On the basis of the comments above, it is my opinion that the proposal is in general conformity with
the objectives of the Official Plan.
II SUMMARY OF PUBLIC MEETING COMMENTS:

A Public Meeting occurred on April 18, 2005 at that time written comments were received from: Lake
Simcoe Region Conservation Authority, Simcoe County District School Board, and the County of
Simcoe. No objections were received on the proposed amendment.
II OPTIONS:
I
On the basis of the above, Planning Advisory Committee has two options:
Option 1 - Adopt Official Plan Amendment
If this option was selected, the Official Plan Amendment document would be presented to Council for
consideration of adoptions.
Option 2 - Refuse the Application
If this option was selected, the application would be refused and the applicant would then have the
ability to appeal that refusal to the Ontario Municipal Board.
II CONCLUSIONS:
I
It is my opinion that the proposal generally satisfies the general intent of the Official Plan and the
objectives of the Agricultural designation. On this basis, it is recommended that Option 1 be selected
and that it be recommended to Council that favorable consideration be given to Official Plan
Amendment #20 for Ian and Lori Webb on lands described as Concession 11, North Part of Lot 3
(Medonte).

PART I: THE INTRODUCTION

1.0 BACKGROUND
The intent of this Amendment is to place certain lands in North Part of Lot 3, Concession 11
(Medonte) in an Agricultural Exception designation to permit the creation of a specialized
agricultural lot for the existing veterinary clinic.
2.0 LOCATION
This Amendment affects 4.00 hectares (ha) of land in the North Part of Lot 3, in Concession 11
(Medonte).
3.0 BASIS
A comprehensive Planning Report on the application to amend the Official Plan is contained
within Appendices A and B to this Amendment.
3.1 Description of Proposal
This amendment would re-designate a portion of the North Part of Lot 3, Concession 11
(Medonte) from the Agricultural designation to an Agricultural Exception designation. Once re-
designated this would allow for the consideration of an application to create a specialized
agricultural lot for an existing veterinary clinic with a lot area of 4.0 hectares.
3.2 Official Plan Context
The Township Official Plan designates the subject lands as Agricultural. The applicant wishes to
re-designate these lands in accordance with the policies of Section D2 to permit the creation of a
new specialized agricultural lot for an existing veterinary clinic.
3.3 Planning Issues
An analysis of these policies as they apply to the application is contained within Appendix 1 to
this Amendment.
3.4 Conclusions
It is Council's opinion that the applicants have supplied enough supporting information to allow for
a fairly complete assessment of whether establishing the principle of development for the creation
of one specialized agricultural lot is appropriate and ensured compliance with Section J3 _
Amendments to the Plan.

The purpose of this report is to consider the proposed Zoning By-law Amendment application
submitted by 107118 Ontario Limited (DeRossa). The subject lands are within the Oro Centre
Secondary Plan Area and are located on the south side of Highway 11 to the west of Line 7
South.
The existing Oro Centre building which is approximately 4184 square metres (45, 037 square
feet) is split between two designations the front 1/3 is designated in the Highway 11 Special
Policy Area designation and the back 2/3 are designated Oro Centre - Limited Service
Industrial. The lands are currently zoned General Commercial Exception (GC*32) Zone in the
Township's Zoning By-law 97-95, as amended.
The applicant's have applied for a Zoning By-law Amendment for a Site Specific Exception to
permit a micro-brewery and associated retail sales within the existing Oro Centre building.
It is proposed to develop the micro-brewery in two phases. A test phase where 2,000 litres per
week of beer is to be produced is initially proposed. If it is determined that the test phase is
successful, it is then proposed to go to full production, which is estimated to be 10 times the
volume produced in the test phase. This means that up to 20,000 litres per week may be
produced at the facility when full production commences.
Water will be brought to the site from another source. All bottle washing would also be done
off-site, however, the final rinsing of bottles on-site is proposed. While beer will be produced
on-site and shipped to customers from the property, it is expected that there will also be a retail
component to the use as well.
II ANALYSIS:
II
In March 2005 a report was presented to the Planning Advisory Committee which assessed the
merits of the application, indicated that sufficient technical information had been provided
regarding sewage and water servicing for the consideration of this application, and indicated the
general conformity with the Township's Official Plan. This report also recommended that the
application proceed to the required public meeting in accordance with the Planning Act.
A Public meeting was held on April 18, 200S at which time 2 written comments were received
from the Simcoe County District School Board and the Ministry of Transportation. Subsequent
to the Public Meeting comments were also received from the Lake Simcoe Region
Conservation Authority and a revised letter was received from the Ministry of Transportation.
Copies of the additional correspondence are attached to this report. No verbal comments were
received at the time of the public meeting. The written comments received from the Ministry of
Transportation are addressed later in this report.
The Oro Centre building has existed at this location for a considerable period of time. An
extensive range of commercial uses are permitted within the building, provided the building is
not expanded. The proposed use is industrial in nature and therefore different from the range
of commercial uses already permitted in the building. However, the micro-brewery use will have
a retail component, since it is proposed to sell beer from this location. As a result the use could
be considered a mixed industrial/commercial development that is similar to the uses currently
permitted in the Oro Centre building. The proposed use will initially be serviced with existing
infrastructure.
A detailed review of the sewage and water services proposed was contained in the previous
report to the Committee. The applicant's had completed technical reviews that indicated that
sufficient capability would be available for individual water and septic services for the proposed
use. The applicant's will be required to obtain the necessary approvals prior to consideration of
any building permit for the renovations. The planning report further indicated that the micro-
brewery at full production would generate minimal effluent (being approximately 3.7 % of the
recommended maximum identified in the Oro Centre policies) and therefore the proposal
maintain the general intent of the Limited Service Industrial designation.
At the time of the Public Meeting a letter was received from the Ministry of Transportation
indicating the requirement for the closure of the existing entrances off Highway 11 and the
requirement for the completion of a stormwater management and traffic report to be approved
by the Ministry. Subsequently, the applicant met with the Ministry and a reviewed letter (May 3,
2005) was received by the Township indicating that they would not require the closure of the
access off Highway 11 and may require a stormwater management report and traffic report
depending on the scale of development.
The by-law attached proposed a Holding Provision that would not be removed until such time as
a Site Plan Agreement was executed by Council. This agreement would allow for
implementation of wording satisfactory to the Ministry of Transportation regarding completion of
appropriate reports. The Site Plan will allow for consideration of better utilization of the access
from Line 7 South rather than the Highway 11 access. And finally will allow for the water and
sewage servicing to be clearly identified for Phase 1 and 2.

A copy of the proposed by-law is attached to this report. If the attached Zoning By-law
Amendment is considered favorably it would generally conform with the intent and policies of
the Oro-Medon1e and County of Simcoe Official Plans. On this basis, it is recommended that
the attached Zoning By-law Amendment be given favorable consideration.

The ministry has completed its review of the above noted zoning by-law amendment. This
amendment has been considered and reviewed in accordance with the requirements of the Public
Transportation and Highway Improvement Act. The Ministry has no objection in principle to the
proposed By-law amendment.
The subject property falls within the ministry's permit control area (within 395 m of an intersection /
interchange; within 45 m of the highway) and as such requires ministry permits (Building 1 land-Use,
Sign) should construction occur on site or the property owner wish to erect (a) sign(s). The Ministry
requires that any new buildings and structures both above and below ground must be set back a
minimum of 14.0 from the ultimate highway property line.
All access to the site must be from 7th Line. No new access to the site will be permitted from
Highway 11 and existing entrance(s) to Highway 11 must be closed. This will be a condition of
ministry permits and must occur prior to commencement of construction.
The applicant will be required to submit to the Ministry a stormwater management report and traffic
impact study, both for impacts to Highway 11 and 7th Line.

THE CORPORATION OF THE MUNICIPALITY OF ORO-MEDONTE
BY -LAW NO. 2005-
Being a 8y.law to change the zoning on lands within Concession 7, Part of
Lot 21, 51R-15045, Parts 1-4, Part 5, and Parts 8-10 (Oro) now in the
Township of Oro.Medonte (Oerossa - Roll # 43-46-010-009-01700-0000).
WHEREAS Zoning By-law 1997.95 was enacted to regulate the use of land and the character,
location, and use of buildings and structures within the Township of Oro-Medonte;
AND WHEREAS the Council of the Corporation of the Township of Oro-Medonte deems it
appropriate to further amend By-law 1997.95, as amended;
AND WHEREAS this By-law is in conformity with Section ES of the Official Plan of the Township
of Oro-Medonte:
AND WHEREAS the Council of the Corporation of the Township of Oro-Medonte is empowered to
pass By-laws to regulate the use of land pursuant to Section 34 of the Planning Act, R.S.O. 1990.
c.P.13.
NOW THEREFORE the Council of the Corporation of the Township of Orc-Medonte enacts as
follows:
1. Schedule 'A1Q' to Zoning By~law No. 97~95 as amended, is hereby further amended by
changing the zone symbol applying to the lands located in Concession 7, Part of Lot 21,
RP 51R~15045, Parts 1~4, Part 5, and Parts 8~10, in the former geographic Township of
arc, now in the Township of Oro~Medonte, from the General Commercial Exception
(GC*32) Zone to the General Commercial Exception Holding (GG*32*160(H)) Zone as
shown on Schedule 'A-1' attached hereto and forming part of this By-law.
2. Section 7.0 to Zoning By-law 97-95, as amended, is hereby further amended by adding
the following new section:
U7.160 *160 - Concession 7, Part of Lot 21, RP 51R-15045, Part 1(Oro)
Notwithstanding any other provisions in this By-law, an industria! use consisting of a
micro-brewery is permitted on the lands denoted by the Symbol *160 on Schedule A10 to
this By-Iaw~.
3. The Holding Provision shall not be removed until execution and registration of the
appropriate Site Plan Control Agreement.
4. This By-law shall come into effect upon the date of passage hereof, subject to the
provisions of the Planning Act, as amended.
