TOWNSHIP OF ORO We are the planning consultant acting on behalf of the owners of the lands subject to the above referenced zoning by-law amendment application. We are writing to request an opportunity to appear as deputation before the Comminee of the Whole at their meeting scheduled for October 23, 2002. The purpose of the deputation is to speak to a recommendation made by the Planning Committee at their meeting of October 15,2002 with respect to the proposed zoning by-law amendment. Specifically, we wish to speak to the recommendation that deals with that portion of the proposed zoning by-law amendment that seeks a site-specific exception to permit a deck adjacent to the shoreline within the EP zone (Item 6 in the Planning Committee report). It is the Plamring Committee's recommendation that this exception not proceed to a public meeting until confirmation is received from the Lake Simcoe Region Conservation Authority that a deck at this location may be considered, In addition, the Committee has recommended that upon receiving confirmation, this matter come back before the Planning Committee for further consideration, which at the earliest would be November 19,2002. 10.Lt~( 2002 02:49 7057217367 LUCAS & ASSOCIATES PAGE 03 . L/b)/} 2 Our concern with the recommendation as it stands is that it will either result in delaying the entire rezoning application, or it will result in the application being spilt into two parts potentially resulting in two separate public meetings, potentially held on differem dates, with separate approvals. We believe that this is unnecessary especially considering that at this point in time, . Planning Committee's recommendation deals only with the scheduling of a Public Meeting and does not recommend approval or denial of the exception. We are suggesting, and will be requesting of General Comminee, that the site-specific exception to pennit . the deck proceed to a public meeting alongside the remainder of the application. In the meantime, we will undertake to obtain continnation from the Lake Simcoe Region Conservation Authority. It should be noted that an approval for the deck from the Conservation Authority would only be required if the deck, or any part of the deck, is located within 15 metres of the centerline of creek. It is possible that the entire deck could be located further than 15 metres, in which case, a pennit would not be required. However. an exception to the Zoning By-law is required as the entire area in which a deck could physically be located is zoned EP. We acknowledge that notwithstanding the exception to the By-law which would pennit a deck within the EP zone, an approval from the Conservation Authority will still be required if the deck is located within 15 metres of the creek. We are prepared to provide the Committee with additional infonnation regarding the need andjustification for the exception during our deputation, if necessary. Re: Reprint of the book The Oro African Church . As you are aware this book is now out of print. UJtimate]y we wish to expand the book by about 24 pages to include events since 1999, when it was first printed, including the anniversary service that year, the application and subsequent designation of the Church as a national historic site, and, the unveiling of the plaque, now planned for June ],2003. Between now and then there will be a demand for the book, especially before, on and after the unveiling. RECOMMENDA T]ON: that the book The Oro African Church be reprinted b)' tbe original printers, Transcontinental, as per tbeir quote whieh is attached. Other Comments As Transcontinental have the original film used to print the book, it would be most economical to use that printer rather than any other. We should order 300 books. We believe we will sell at least 150 by the end of June 2003, however, the additional cost per book between the ]50 and 300 range is negligible. It is recommended that we acquire the 300 and hold off printing the expanded version until the second printing is sold out. Transcontinental will likely "over-run" by the] 0% mentioned in the standard contract which is also attached. We should budget as follows: 300 books 2164.00 10% over-run@6.13 ]83.90 GST 164.25 Total Commitment $24]2.25 (They pay for shipping) The first printing has made a modest "profit" for the Township. This printing will result in a cost of each book of$7.31, well under the $9 wholesale price which Council has established and which we charge books stores and service clubs (when I give talks to them on the Church). Over half of the books are sold at the retail price of $] 5. If we printed fewer books, our cost per unit would go up into the $12 to $ J 4 range. The Director continued to attend Rotary meetings over the summer as a guest and was inducted as a member of Rotary July 2S"'. . 2. The Director attended the meeting ofCEOs of Large Public Libraries of Ontario (CELPLO) June 7"'. The meeting included a tour of the new London downtown central library with a presentation by the CEO, Derrel Skidmore, on the number of partnerships developed to make the facility a reality. At the July 14"' meeting, CELPLO drafted a preliminary position statement on the Ontario Public Library's Building Value Together. In essence, CELPLO sees the priorities for an Ontario Public Library to be marketing, advocacy, research and purchasing. To facilitate a framework for collaborative action, CELPLO will invite other libraries to develop a first stage response to Building Value Together. 3. Joanne Com per attended a workshop on Performance Measurement and Benchmarking for Municipalities in Collingwood. . 4. In June, Lynn Hougham was hired as a relief Library Assistant in Circulation Services and in August was hired on a one-year contract while Evelyn Sherk is on maternity leave. S. Pages Peter DeCourcy (4 years) and Angela Jekums (I.S years) left the library to attend university. Kathryn Burgess, Kristyn Fetter, Sarah Petrie and Andy Rabas were hired as pages and trained during August. 6. June 8'" the Director, Jane Salmon and Ann Andrusyszyn participated with the City of Barrie and other community organization in the Hydro One orientation. Approximately 300 employees will eventually move to Barrie as . part of that organization's restructuring. A second session held on June 22nd was attended by Jane and Ann. . 7. Ann Andrusyszyn attended the Association ofFundraising Professionals audio conference on strategic timelines for capital campaigns as well as the seminar on funding success in the corporate and foundation grant world. 8. Ann also attended the biannual meeting of the Ontario Public Library Fund- Raising Group (OPLfrg) and completed the fundraising audit on behalf of the . Library, . ;/\, ~ 25 ,-" \. ,'""\ , . \JC i~? , / 9. Nancy Woods, fonnerIy a Relief staff, joined the Children's Department as . the new Library assistant. 10. Cathy Bodle participated in a survey and report conducted by the Simcoe County United Way Steering Committee. The Committee is guiding the development of a Feasibility Study and Implementation Plan to bring the abbreviated dialing code, 211, to Simcoe County. The intent is to provide citizens with access to community, social, health and government infonnation . and referral outside the current heavily used 911 service. The study is looking at the current infrastructure with a view to identifying a "lead" agency to implement a countywide call centre and service. It is also looking at other social organizations including public libraries and the Infonnation Providers Coalition of Simcoe County (lPe), of which Infonnation Barrie is a member, as secondary community infonnation providers. The creation of a 211 Champions Funding Task Group has been recommended to develop multi- sector funding partners. Start up costs is estimated to be $628,000 with annual operational expenses of $126,000. II. June 17'h, Shalyn Milligan was hired for the Birth Marriages and Deaths Index project. 12. Kristina Roudiy, a co-op student from Paris, France was welcomed to the library in July. Kristina helped with the Readopoly Program and learned . about other library systems and perspectives while in Canada. Kristina also provided us with an unique perspective of the Barrie Public Library. 13. The Director attended the Canadian Library Association (CLA) National Annual Conference in Halifax June 19'h to 22"'- The Director also attended the Canadian Association of Large Urban Public Libraries (CALUPL) meeting in Halifax. 14, The Director attended the United Way Open House at 136 Bayfield Street on July 18'h IS. July] 5'\ Joy Martin, Manager Infonnation Services, returned to work after being on maternity leave. Jane Salmon returned to her position as Head of Children's and Youth Services and Jeannie Tilson completed her contract position as Head of Children's and Youth Services on July] 9'h, 2002. ]6. July 25th, Aileen Carroll, Member ofParIiament for Barrie-Simcoe-Bradford used the library to make a number ofliteracy grant announcements. The fonner Chair of the Barrie Public Library Capital Campaign, Aileen Carroll, mentioned the role of the Barrie Public Library in supporting literacy and literacy groups. . 26 5c)~ 17. On July 30t\ two new employees, Katherine Kraft and Pauline Landry joined the Barrie Public Library. Katherine will assist in Information Services and Pauline will work with the Infonnation Barrie database. 18. The Director and Heather Betz, Business Officer, attended the Communities in Bloom at City Hall July 31 ". 19. In August, Cindy Pomeroy was married to Keith White. Cindy is now known as Cindy Pomeroy-White. . 20. August 7t\ Cathy Bodle, in her elected capacity as Trustee for CUPE 2380, attended a meeting of Trustees. 21. August 19th and 20th, Brenda Jarvis, Kym McOuat and Yvonne Wilson attended a Mother Goose Workshop with Sandra Carpenter Davis. The program focused on the use of rhymes, music and fingerplays as weJ] as oral storytelling without the use of props such as puppets. The training was free due to an arrangement made with the new Early Years Centre. The library makes a monthly visit to the Centre to present a puppet show, storytime or other preschool program to promote the Barrie Public Library. 22. The Director attended the Chamber of Commerce meeting August 21". . 23. Shonna Froebel attended the grand opening of the Greater Barrie Business Enterprise Centre. 24. August 25th, the Director, Ann Andrusyszyn and Sue Gifford volunteered with Great White North for the Dragon Boat Racing Event at Ontario Place to learn, first hand, some of the aspect of the race that must be managed using volunteers. 11 INFORMATION SERVICES l. Alya Demiray, Cindy Pomeroy-White, Linda Beazley and Sue Gifford were . appointed to a special DVD Committee to develop strategies to reduce the theft of this collection. Certain identification changes were implemented immediately. Joanne Com per continues to work with the pawnshops in . Barrie. Alternative security devices are being investigated. 2. During the summer, Shalyn Milligan indexed the Barrie Examiner for 1946. As the library was not successful in getting a grant this year, the library and the Genealogical Society of Simcoe County shared the cost of 2 I 6 hours for this project. . 27 L,-// \~-f "-'~) --I 3. Patricia Roebuck's procedures for new material in other languages has resulted in a commitment to the Southern Ontario Multilingual Pool (SOMP) . for materials that will increase and rejuvenate our multilingual collection. 4. Janet Graham is pursuing a number of avenues to expand our talking book collection. 5. Shonna Froebel continues to develop the library's new business program. A lengthy environmental scan has been conducted and a number of focus group . interviews (with the assistance of a local company) will be conducted to provide direction for relevant future services. In the meantime, Shonna has worked with Ann Andrusyszyn to prepare a business brochure. 6. Shonna Froebel, Janet Graham and Robin Zuck provided 6 weekly orientations for the public to the library's new Internet Public Access Catalogue (IP AC). 7. In response to patron demand, Janet Graham has developed a fiction Book Club that will be self-run by its members and meet monthly. 8. Internet Programs for beginners, beyond basics, e-mail, seniors and drop-in have been developed for the fall. Two special subject-focused programs in health and Christmas activities have been developed as well. Staff continue . to work to expand this high demand area of adult programming. 9. Mary McAlpine has continued to work on improving fiction reader advisory services, updating the Recommended Reading Lists and adding a new list for Adventure/Thrillers. Mary has also worked on the Library's Readers'Couch Webpage. 10. Janet Graham has been asked to create a bibliography for Catholic Family Life Counseling Centre to use as part of the package for their workshop for seniors Sept 27'h. She has also sent a list of our programs to Kate Ellis at Parkview Centre for Seniors for inclusion in their fall newsletter. I I. Jane Salmon has been actively participating in Early Years committees as it is an excellent networking opport\ll1ity to collaborate with others who work with children. 2. Anne Dorsey has updated the Teen Services Web Page and prepared a young Adult Reader's Advisory Book Lists. . 3. Yvonne Wilson has completed the four new Library Story Kits that will be made available to people whom work with children. . 4. The following programs for children were offered over the summer: I Can Picture It Now.. .Fun With Photography for Kids-Lucy Purdy, a freelance photojournalist, once again ran a 6-week course May 25'h - June 29th for children ages 10- I 4 years. Nine children signed up for this course and an exhibition of their photos graced the library for the summer. . 29 /'\ ,.::5 C- ) .~ 'l ,/ Celebrate Barrie-Library staff spoke to approximately 600 people, most of them Barrie . residents, about the Library. Most of the questions were about children's services. The board, made by Brenda Jarvis of2 Medieval people with the face cut out so that children could become a knight or a lady, was a big hit. Readopoly-Readopoly was a huge success this year, with a total of I 313 children playing. The theme, this year, of the Toronto Dominion Summer Reading Program was Read Around the World. This year was the first time children ages 3 and 4 could play. The inclusion of preschoolers was a big hit with parents. The wrap-up event on August 22"d . featured Animals for the Arts. This organization brought several animals, including a 6- month-old chimpanzee that was the favorite of the crowd. We received many donated prizes from various sponsors, including swim passes from the City of Barrie, movie passes from Stinson, free video rentals for everyone from Bandito, mini-golf passes from Putting Edge, passes to Round Ranch com maze and T-shirts from Animals for the Arts. Library on the Loose! - Outreach Park Visits-Outreach in the parks may be more effort than it is worth although those with a view from the road or a summer camp close by were better attended. We saw a total of 137 children come to try out Readopoly on our portable gameboard at the five parks we visited. The parks were Ho]]y Community, A]]andale, Painswick, Cundles West and Eastview. Wednesday Morning Summer Storytime-these drop-in Story times continue to be . extremely popular. Over 7 weeks, stories were told to 505 children and adults, an average of 72 at each weekly storytime. Community Storyte]]jng-the Barrie Storyte]]ers thri]]ed an audience of 45 with stories from around the world on July I 6th. This evening program was held on the roof garden. Share the Music, Tap the Drum with Janet Jephcott-the "Share the Music, Tap the Drum" program on July 25th was a huge hit with the 22 parents and children ages 10 and up. Dance, Dance, Wherever You May Be-Kathy Kraft led the Dance program. This was we]] attended. Bedtime Tales-Bedtime Tales program was not as we]] attended as last summer.Jhere were a total of 45 in attendance over 4 evenings. This program continues to be popular in the early spring and autumn. Puppet Show-July 18th, Brenda Jarvis and Jeannie Tilson presented 2 puppet show performances. Working with the Readopoly theme of "Read Around the World", the puppet play was based on a Japanese folk-tale. Jeannie wrote the script and Brenda created the stick puppet characters and props. The morning performance had 3 8 in the audience. The afternoon had 54 in attendance. . 30 /' " \ /0 6C)-,' /} IV CIRCULATION SERVICES ~ I. Joanne Comper, Mary Urry, Sue Gifford, Lilli Papais, Evelyn Sherk, Cathy Truax and Elisabeth Maynard delivered a very successful interactive Page Training and Orientation Workshop on August 8'h. 2. The Self-Checkout Station continues to show an increase when compared to the library's total circulation count. Circulation Statistics: . Laurie Wright has been successful in setting up a statistics-gathering program on the OP AC stations. ~ 2. Laurie has created Web pages to work off the Library's Web Site in the event the library's IP AC software or server is offline. 3. Work has been done to explore software for the handicapped OP AC. 4. Laurie worked with epixtech support staff this summer on security and graphical issues related to the implementation ofIP AC. As well, Laurie worked with City staff to address a number of network connectivity and Internet problems that seemed to plague the library all summer. 5. This summer, the library completed the configuration ofIPAC and rolled it out for the public. , 6. Horizon 7 upgrade was tested and its installation authorized. The upgrade went smoothly but a number of post-upgrade issues are still outstanding. This - includes the functionality recently gained with enriched BlSAC. However, Z39.50 protocol, that allows other libraries to access Barrie Public Library regardless of what system is being used is now operational. Southern Ontario Library Services staff report that it is now being used for Interlibrary Loan. 7. Concern exists over the after hour response times from the City help desk. . This will be discussed with the City. '. /\ 31 ~C)"I( VI COMMUNITY DEVELOPMENT . 1. The Library's summer newsletter was delivered to all elementary schools in Barrie. The summer newsletter is of special interest to parents and teachers because it contains the library's summer reading programs and schedule. Targeting families with this newsletter created an opportunity to make adults more aware of the other services offered by the library. . 2. The library participated in the Barrie Jazz and Blues Festival in June by being a host venue. Ann then met with Robin Munro of the Barrie Jazz and Blues Festival to debrief and discuss strategies for 2003 3. Ann Andrusyzyn attended the monthly meeting of Planned Giving Counsel of Simcoe County. 4. Ann continues to work on fundraising by making some preliminary enquires about a float for the Santa Claus Parade and by contacting the City and Canoe Club in Barrie to get infonnation about a Dragon Boat Racing site on the Bay. Ann has also explored the possibility of a major sponsorship for such an event Ann has visited a St. Catharine's organizational meeting with the Great White North for infonnation on operating such an event . 5. New artists from the Barrie Art Club are now on display in the Library's boutique. 6. Ann assisted in manning the Ontario Public Library Association (OPL) booth at the annual Association of Municipalities of Ontario (AMO) Conference. 7. The Library launched its newsletter in two formats, PDF and Screen reader accessible, from its Web Site. Print impaired individuals can now download the library newsletter off the Internet in a format that enables the blind to use voice software that can read the newsletter. 8. Ann met with Cathy Bodle and Bill Blak to look at the possibility of preparing and publishing a hardcopy community directory based on the Infonnation Barrie database. 9. Ann also met with Bob Cassels and the Library Director to develop an outline and parameters for questions to survey the residents of Barrie with respect to a possible satellite library located in South Barrie. 10. Details were finalized with the Barrie folk society. Ticket sales for the Maria . Dunn and Valdy concert were a success, The Library received many 32 $C)~/;r comments from the public even days after the Valdy concert expressing appreciation for and compliments on the roof garden venue. VII VOLUNTEER PROGRAM J. In June, Julie Ross attended a Professional Administrators of Volunteer Resources of Ontario (P A VRO) workshop, "Vicarious Liability-a resource workshop on liability and legal issues for the volunteer sector". Julie attended the Barrie Association of V olunteer Administrators (BA V A) . 2. meeting in June. 3. Julie conducted the Library Transit Sample Survey using volunteers during the first week of July. 4. The library has nominated one of the library's volunteers, GeoffTey Sullivan, for a Young Adult Initiative Award. Judging by the United Way will take place this fall. 5. All volunteer job descriptions were revised to include goals, screening measures and training. . 6. Volunteers were provided to assist with summer programs such as the Readopoly kick-off and \'-'Tap-parties, Read in the Park, puppet shows, workshops and to assist with tickets at the two folk concerts held at the library this summer. 7. During June, July and August, a total of four new cafe volunteers were hired, two for the boutique, five for collection maintenance and one for the reading circle. The leak around the roof garden windows has been repaired and evestrough will be installed on the dome room over the reading garden to eliminate snow and water build-up. 3. Heather Betz attended the Proponet's meeting for the review of the Request for Proposal for Audit Services for the City of Barrie. 4. Health and Safety inspections have been conducted and requisite meetings held. A fire drill was held June 7th. 5. New office furniture has been delivered and the Director's, Head ofInfoffi1ation Services and Business Office now meet ergonomic standards. A request for Infoffi1ation Barrie office furniture has been made. . 6. City representatives and Judges have infonned the library that the roof garden was one of the areas included in the Communities in Bloom contest judging. LOL 2XO Re: Mail delivery in Hawkestone on 1 5 2002 ORO-MEDONTE Dear Mayor Craig and Members of Council: TOWNSHIP You may be aware that residents of the ViIJage of Hawkes tone have begun receiving notices ITom Canada Post that they must instaIJ a mailbox outside their home at the street. Although I understand the Municipality is in no way connected to this decision, I wanted to point out some areas of concern that I believe should also be the concern of CounciL The mail boxes that have already been erected must be close to the street as the mail will be deHvered by car. There are no shoulders, on the roads in Hawkestone, and few sidewalks. The placement of these mail boxes will undoubtedly cause problems for snow plowing. Either people will lose their boxes every winter or the street will become much narrower for traffic and pedestrians alike. Mail deHvery, by car, in a built up area is ridiculous, A car starting and stopping every few yards which wi]] be partly out on to the road is also dangerous. Finally, and no less important, is the fact that mailboxes give the Village a cluttered look and take away some of its beauty and charm, It is interesting to note, that Canada Post has also not advised people of an address change, Currently we use Compartment numbers but these are no longer relevant. Many people in Hawkestone share my concerns and we are currently trying to find out how such a decision got made without any knowledge about the population density in Hawkestone. Ifwe are no longer able to use the Community Mail Boxes then delivery should be by hand and people should be able to install a mailbox on their house. In regards to the safety issues and other impact on local residents, I hope Council may see fit to investigate this situation further. As a result of our participation and advocating for a province wide resolve to this issue, we have scrutinized the effects of our members being two-hatters to a degree not witnessed before. . This research has illustrated the various consequences on our members on many fronts. Notwithstanding, the obvious and flagrant constitution violation, there are significant health and safety, worker's compensation, collective agreement and benefit entitlement issues. All of these concerns have a negative impact on all of us. Despite our attempts to work with the various stakeholders including the Ontario Association of Fire Chiefs (OAFC), Fire Fighters Association of Ontario (FFAO- volunteers), Association of Municipalities of Ontario (AMO) and the Ontario Fire Marshal's office, there does not appear to be a willingness to continue the consultation process. Accompanying us in our opposition to Bill 30 is the OAFC. They described many concerns that will result from this Bill's passage in their August 1st position paper. However, the FFAO and AMO have continued their despicable campaign distorting the facts and maligning the OPFFA and the IAFF instead of attempting to resolve this issue. Given the combination of the aforementioned I am officially lifting the OPFFA's requested moratorium for charges on members who are two-hatters. This will leave all members with the unfettered freedom to exercise and enforce their rights under our constitution. , This decision does not come easily but the time has come to reassess our approach to this issue. Dear Mayor Craig and Council Members : It was suggested at the last Council meeting we attended, that the Legion conduct a Survey of our Members to ask them what their position was in regards to a "No Smoking By-law" for Branch 619. The Poll was conducted by Treasurer Bonnie Johnstone, over a period of two days. She contacted a total of 74 Members out of 78. All those contacted were well aware ofthe dilemma facing both Council and the Legion. The Question asked was. Are you in favour of a No Smoking By-law for Branch 619 ? 58 Members were not in favour of the proposed By-law, some very adamtly. 16 Members thought it was a good thing, and thought it should be implemented. Draft copies of Members polled are enclosed. The con census at our General Meeting on October 21st., was that the whole issue is certainly not based on a level playing field. The decisions of the Municipalities around us are a prime example. We realize that a decision on a "No smoking Bylaw" is inevitable in Simcoe County. As you are aware, the Town is to be posting signs regarding the leashing of dogs & poop and scoop at all our parks. It would appear the only place this has been done has been the trail. I spoke with Pam in public works on Sept 24 and after checking she advised they should be installed within the next two weeks. Today I again spoke with Pam and after she spoke with another individual,( I do not know who), she advised that they will be done but couldn't say when. She did advise that some had already been posted at some parks already, I asked if she could tell me those locations, she was unable to do so. It would be appreciated if the three entrances to the Harbourwood Park, be signed. Yesterday morning at the school bus stop , two mothers brought up the issue of dogs running at large, one was, that morning frighten by a large white dog running loose in her back yard, the other complained of black dog frequently roaming on her property being a general nuisance and at times growling at members of her family. Both these women own dogs themselves. I informed them of the recent by-law, of which they were unaware of and told them to contact the Town. Last week while walking on Shelswell I was pursued by a dog ,a car being driven by a woman pulled up and advised she knew the owner and shortly there after the owner came out from his home placed the dog under control and indicated the dog was usually leashed but he had just decided to let her go for a run. Today my husband on his daily bicycle run was chased by two dogs on the Lakeshore from the 8th line to the 9th. Two weeks ago my walking partners and I were shadowed and occasionally nipped at by two hound dogs which followed us from the 8th line to the 7th on Lakeshore. A gentleman on his bike, stopped and tried to offer his assistance in getting the dogs away from us by encouraging them to follow him, however that failed. It was a great relief when they left us at the 7th. This Monday our garbage which we put out at 8.30 a.m. was tom to pieces by a roaming dog. We were busy cleaning up the mess when the garbage man came, seeing the mess he advised once everything was collected to place on the other side, which we were grateful. I would like to poinl out that IT APPEARS NO ONE SEEMS TO BE AWARE OF THE LEASH AND POOP & SCOOP BY-LAW. IT IS POINTLESS TO HAVE A LAW THAT NO ONE IS MADE AWARE OF ,Please advise what has the Township done to Inform the public? Has there been notices published in the various media circulated in the Township? Has it been posted on the web site in an OBVIOUS MANNER. All 36 cast items will be polished gold plated pewter with enamel added to the logos as required. The 24 pewter name bars will have black brass engraving plates, After a great deal of consideration, it was deemed only appropriate that the logos for each of the five townships that make-up the amalgamated Township of Ora- Medonte be used and mounted on the ten gold plated pewter maple leaves, arranged in alphabetical order of the Township and in the reverse order on the other side of the chain, Each Township's logo will be in coloured enamel the same as their respective municipal Township pin, The maple leaf at the middle of the very back of the Chain of Office is blank in order to keep everything symmetrical. The engraving plates will be black brass and engraved with the year of commencing office to the last year in office followed by the respective Mayors' name. There is an additional cost of approximately 10 cents per letter for engraving. The scrolling on the outer edge of the black engraving plate will be gold in colour. The Committee did not arrive at a decision with regard to the engraving for the name bars or placement of engraving on the Chain of Office at this time. An approximate time frame for receiving the Chain of Office is six to eight weeks depending on when the order is placed and what their production orders are at that time. The Committee recommended that the order for the Chain of Office be placed with Coyle and Greer Awards Canada Ltd. as their quotation was lower and the company appeared to be more professional. Pennycook, Clerk DATE: October 23, 2002 SUBJECT: Regulation of Smoking in Public Places Township of Oro-Medonte IBACKGROUND I At the Committee of the Whole Meeting of July 17, 2002, it was recommended that staff bring forward a draft by-law to make public places 100% smoke-free; and that such by-law be presented at a public meeting to invite comment from the residents of Oro-Medonte; and that enforcement and educational campaigns with respect to such a by-law be provided by the Simcoe County District Health Unit at no cost to the municipality. Subsequently, a draft by-law was presented at the Committee of the Whole Meeting of September 11,2002 for the Committee's input and comment. At that meeting it was recommended that the draft By-law be circulated to stakeholders and the general public for comment by September 26, 2002, prior to the Public Meeting to be held on October 2,2002. (Attachment #1). The draft by-law was posted on the Township web site. Notice of Council's intention to hold a public meeting on October 2, 2002, as well as a request that any comments be forwarded to the Township, was given in three area newspapers. A copy of the notice of meeting and the draft by-law was also circulated to business owners within the Township. Attachment #1 of Report ADM2002-35, "Next Steps in Consideration of Regulating Smoking in Public Places and Workplaces" outlined Council's process to ensure that residents of the Township and business owners were given an opportunity to give input to the premise of regulating smoking in public places. This process also ensured that interest groups, such as the Simcoe District Health Unit, the Lung Association, etc. were given a venue to present information on the subject to Council in a public forum. The process is now at the final stage, consideration by Council of public input and a decision on the passage of the by-law. (Attachment #2) //' ~, .~\ ~ ) J / / I'll -"" /'} .~ ~~.: ~ IANALYSIS ~ The response to circulation of the draft by-law, whether by mail, bye-mail or by telephone was minimal. Two private citizens telephoned in support of the by-law and three letters of support were received. Of the 72 business owners circulated, two owners telephoned to advise that both premises had been 100% smoke-free for at least two years. The public meeting held on October 2, 2002, generated approximately 20 participants and 12 speakers. Of the 12 speakers, the majority were in favour of the draft by-law which would regulate smoking in public places. One person was opposed to the regulations outlined in the by-law, and one person commented that the enforcement of such regulations should be the responsibility of a higher level of government. · The Simcoe District Health Unit suggested that Council give consideration to regulation of smoking in the workplace. · A business owner advised that his premises relied on the Provincial "Smoking in the Workplace" Act to regulate smoking on the premises. · A representative of a branch of The Royal Canadian Legion presented a position for exemption for the Legion as a private club. A transcript of the meeting is available in the Clerk's office for review. The draft by-law has also been referred to the Township Solicitor for comment and advice on "enforceability" of the by-law. Generally, the Solicitor found that "the use of a functional approach for the definition of "public place" applies the "common sense" test used in many court decisions and ensures that the average citizen would be able to discern where and when the by-law would apply." Two amendments to the draft were suggested: 1. Definition l(i): Public Portion: means the area of any building to which the public has access; Amend to: Public Portion: means the indoor area of any building to which the public has access; 2. Offences Section 7.2 Any person who hinders or obstructs a person lawfully carrying out the enforcement of this by-law is guilty of an offence. Amend to: Any person who hinders or obstructs an inspector lawfully carrying out the enforcement of this by-law is guilty of an offence. 3. For ease of enforcement: Insert: 13. This by-law may be cited as the "Public Places By-law". . /1. Staff received the correspondence by Mr. Kurtz at the Committee ofthe Hole on October 9, 2002, Upon reviewing the correspondence staff notified Mr. Kurtz that unfortunately the Banquet Hall was previously booked, and Mr. Kurtz was asked to provided another recommended date, Mr Kurtz verbally replied back to staff with the request for the use of the Hall on Saturday March 29'\ 2003. A letter has not yet been submitted, but staff has temporally booked the Banquet Hall. The Oro District Lions Club is asking Council to waive the rental fee for the use of the Banquet Hall in the amount of$267.00. . The Oro District Lions Club has informed Township staff that they will be expecting around 150 to 200 . . participants that evening. The event will attract present and former members and spouses, invited guests, and friends, The Oro District Lions Club has agreed that they will supply the necessary bartenders that are trained with "Safe Serve". The Club feels that the Banquet Hall is centrally located, easy for visitors to find, provides sufficient parking, and is wheel chair accessible. The Banquet Hall will be able to accommodate the estimated guests sufficiently, rather than the Clubs monthly dinner-meeting facility, the Hawkestone Community Hall. , It would be my recommendation that Council waive the rental fee of$267.00 in recognition of the Club long time services. . \ ^ O!/d The Ora District Lions Club is also requesting pennission to operate their bar under a "General Liqu6l vi License". Carried. 7:20 p.m. Ucci Consolidated Companies P- 115/01 Concession 5, Part of Lots 26 to 28 (Oro) Proposed Official Plan and Zoning Bylaw Amendment In Attendance: Cheryl Shindruk, Applicant's Consultant, John Lackey, Applicant's Engineer, and Bryan Davidson, Applicant's Agent Ms. Leigh updated the Committee in regards to the progress of this application as it related to the technical comments received from R.G. Robinson and Lake Simcoe Region Conservation Authority. Ms. Shindruk explained that the County application had been submitted and that a site visit had been conducted with the County to review the proposal. Ms. Shindruk explained that the one matter which had arisen during the discussions with the Township Engineering Consultant was the calculations required for the servicing reports and design. She explained that the Township was requiring a calculation using 3.5 persons per unit while a standard for most adult lifestyle communities would be 2.5 persons per unit and she was requesting the Committee to consider a reduction in this amount. The Committee discussed this and determined that the current standard appeared to continue to be appropriate. Carried. 7:30 p.m. Horseshoe Resort P- 135/02 Concession 4, Part of Lot 1 (Oro) Proposed Zoning Bylaw Amendment In Attendance: Martin Kimble, Applicant Ms. Leigh explained the current Official Plan policies and the requirements of the Comprehensive Development Plan. She explained the previous work completed in regard to the Traffic Study for the entire Settlement Area and that the applicant would be required to enter into an agreement with the County and post securities with the County for the traffic improvement works required as they relate to the current application. Ms. Leigh turther explained the requirement for two formal Public Meetings on any applications, one to review the conceptual plan a second one once all comments of the Comprehensive Development Plan were completed. Mr. Kimble reviewed the conceptual plan with the Committee and provided an overview of the technical work completed to date. He explained the need for the expansion to the hotel and the requirements for adequate conference facilities and the concept of a condo-hotel to the Committee. ML Lucas reviewed the various permissions being requested with this rezoning application and the need for these permissions as indicated in his planning report. The Committee required clarification in regard to the site walk and the line now proposed as the Environmental Protection Boundary/top of bank. The Committee expressed environmental concerns with the new request to permit sanitary facilities in the boathouse and did not believe the need was there for such a request. Ms. Leigh explained that the proposed haul route on Line 12 North through the Settlement Area of Rugby was a consideration that could not be satisfied in accordance with the Official Plan policy requirements and therefore the request for a zoning by-law amendment must be denied. In 1997 when the new Zoning By-law was completed for Oro-Medonte Lot 18 was inadvertently rezoned to the Private Recreational zone and no longer permits a single detached dwelling to be built ; on the lot. She explained the proposed rezoning would correct this situation.
