LSRCA's Environmental Projects Grants - Septic Repairs
Further to OUf letter of June 14th, 2002, regarding the commencement of the Lake Simcoe Water
Quality Improvement Program, we would like to advise you that the Lake Simcoe C!ean Water
Improvement Program can now accommodate applications for fauJty septic system repairs on
residential rural properties, as well as on faml propenies, Grants are also being "grandfathered"
for those projects that previously were not eligible for funding but now meet the criteria and were
completed since March 1 st, 2002.

Dear Council Members;
RE: SEPTIC SYSTEM LOAN PROGRAM
The Council of the Municipality of Bluewater, at their March 4th, 2002 regular
meeting, passedthe following resolution:
"WHEREAS the Ministry of the Environment has imposed regulations in regard to
the operation and maintenance of municipal water systems to ensure the safe quality of water;
AND WHEREAS the Ministry of the Environment has issued Orders on municipal sewage
lagoons in order to prevent the contamination of water sources;
AND WHEREAS malfunctioning septic systems pose a danger of contamination to potable
water sources and to bodies of water used for recreational purposes;
AND WHEREAS many owners of septic systems are unable to repair or replace the
malfunctioning septic system due to the cost;
NOW THEREFORE BE IT RESOL VED THAT the Council of the Municipality of Bluewater
hereby petitions the Ministry of the Environment to provide a program for the repair/replacement
of septic systems based on the tiie drain loan program provided by the Ministry of Agriculture,
Food and Rural Affairs; and further, that the resolution be forwarded to municipalities province
wide and to AMO for their consideration and endorsement."
The tile drain program is administered by the municipality with the loan funds
provided by the Ministry. The loan is at 8% over 10 years for 75% of the cost of the
drain system up to a maximum of $20,000. .
Council would appreciate your endorsement of this resolution and that you
advise the Ministry of the Environment and your local MPP of the endorsement.

A suggestion was made that a report be prepared for Town of Midland Council
stating how much extra funding the Library would require in 2003 to off-set
the Joss of product should the County Library service close.

The wrap-up meeting for the Literary Affair Dinner/Dance Vol. II wiJl be
held May 14, 2002. A final tany wiJl not be available until then,
However, it was a great success again with 170 in attendance.
Mrs. Walker asked for comments and suggestions for next year. A comment
about slowness in bar service to tables led to the suggestion that perhaps baT
tickets could be sold in advance.
The date for the Friend's annua] booksale wiJl be announced soon. It wiJl
likely take place the same Saturday as the Classic Car Show.

9.1.1 New StatTPosition update
After a unanimous request from part-time statTto share the approved
new 2] hours part-time position, Mr. Sainte met with the treasurer
and CAO at the Midland Town Office about relevant concerns regarding
this proposal. After discussion and agreement Mr. Sainte requested
Board approval. The Board supported this plan,

9.2 Correspondence
A mailing advertising a Book Expo conference was brought to the Board's

K. Stewart drew the Board's attention to the recent hiring of an "Early
Literacy Specialist" for the Simcoe County Early Years Centers. This
is an initiative to enhance children's early language and pre-reading
experiences to foster readiness to learn. Perhaps the Library could
partner around some events and initiatives.
Mr. Playter has conducted a performance appraisal of the Chief Librarian
and will soon meet with Town of Mid land CAO, Mr. Flood and
Mr. Sainte to finalize the matter.
Mr. Sainte wi]] speak to Bryan Peter about moving the Library's
bicycle rack to a more accessible spot.

An Invitation to Uemember
On September] ]th, 200], the world witnessed an act of aggression unlike any other. The world
as a whole grieved for the families oftl1ose affected and steps were initiated to stop those who
had been responsible, The community of Orillia and area shared in this grief and showed support
as local churches opened their doors for services; the community reached out to its southern
neighbor and a book of remembrance was signed by hundreds ofOrillia families. The Simcoe
Funeral Home Orillia Chapel was privileged to furnish the book for this purpose.
Wednesday September] ]th of this year will be the anniversary of this devastating event in world
hislory. For the many whose lives were directly affected, this will not be an easy time, It is a
time to remember.
In dedication of those lives that were innocently lost and in dedication of those who have toiled
or fought for the freedom that we all still enjoy, the Simcoe Funeral Home is presenting a
"Service of Dedication and Remembrance". The service will be held on our front lawn at which
time we will be remembering, celebrating and honoring, A monument will be dedicated and a
new Canadian flag ensemble will be raised on our grounds to mark this date in history, We

Four Ministry of Natural Resources Stewardship Networks, in partnership with the Ontario Forestry Association (OFA) , are
hosting this second annual two-day event. Woodlands Expo 2002 offers two days of presentations, exhibits, demonstrations!

The Simcoe County Historical Association is pleased to announce that the Mnjikaning
Fish Fence Circle (MFFC) will be this year's host for our 3rd Annual Fall Barbecue. The
event will be held on Saturday, September 21 sf at the Stephen Leacock Museum in
OriJIia, rrom 10:00 am to 5:00 pm.
We were very excited to learn recently that The Hon. James K. Bartleman will be in
attendance. By way of this letter, we are extending an invitation to yourself and members
of Council to join us for all, or a portion, of the day.
The MFFC plans to showcase the Mnjikaning Fish Weirs National Historic Site with the
introduction of a new video "Journey to the Weirs" and guided shuttle bus tours to the
Narrows. There wiJI bc entertainment by the Women's Drum Group, native art and crafts,
as well as displays by the SCHA and others. The MFFC display will include a number of
preserved weir stakes, on loan rrom Parks Canada. A program outlining the day's
activities will be available latcr this summer and will be forwarded to your office for
distribution.
Entrance to the grounds and all activities in Swarunore Hall are rree of charge. Tickets
are being pre-sold for the barbecue and will also be available for purchase on-site. Please
conftrm your attendance with Janet Turner, Organizing Committee Chair, at 835-9331.

BACKGROUND:
Since restructuring in 1994, the Administration Centre and Roads Yards have been closed between
Christmas and New Years. This holiday season, Christmas Day falls on a Wednesday, Boxing Day on
Thursday and New Year's Day will be celebrated on a Wednesday as well. In the past the office has been
closed for the entire time between Christmas and New Years.
Article 18 subsection 18.01 states "the Corporation recognizes the following as paid holiday for per-
manent employees: '12 day before Christmas Day and '12 day before New Year's Day." It is recom-
mended that employees draw three days of their holidays to provide for Y2 day on December 24th, and a Y2
day on December 31, one day on December 27 and one day on December 30, 2002.
The office would be closed on Monday, December 30, 2002 however certain Treasury staff will be working
that day in order to process payroll. The Public Work's department crew's would be on standby for the shut
down period; and in the event of a snowstorm the public works crew would be called upon to clear the
snow.
The holiday shutdown would commence at 4:30pm on Monday, December 23, 2002 to 8:30am Thursday,
January 2, 2003.
RECOMMENDATION:
1) It is recommended that the holiday shutdown commence at 4:30pm on Monday, December 23,2002 to
8:30am Thursday, January 2, 2003.
2) That the Administration Centre and the Roads Yards be posted accordingly.
3) That this report be received and adopted.

1.1 The Developer agrees to assume all risk in commencing installation of Township
services on the Subdivision Lands, prior to the execution of a Subdivision
Agreement with the Township, and the registration of Ihe Plan of Subdivision.
The Developer hereby releases the Township, its agents, servants and
employees from and against all actions, suits, claims and demands whatsoever,
which may arise either directly or indirectly as a result of the installation of
Township services by the Developer.
1.2 The Developer acknowledges and agrees that, in the event that a Subdivision
Agreement with the Township is not finalized for any reason and the Plan of
Subdivision is nol registered as a result, pre-servicing of the Subdivision Lands
shall cease immediately.
1,3 The Developer acknowledges and agrees that engineering design plans and
specification for the Township services 10 be installed by the Developer, as
submitted to the Township, in accordance with the terms of this Agreement, may
require further amendment as a result of requirements imposed by the Township
under the terms of the Subdivision Agreement to be entered into for the
Subdivision Lands. The Developer covenants and agrees to assume all risk and
responsibility for the cost of required revisions to the engineering design
drawings and specifications for the Township services, together with the costs of
modifying, reconstructing, removing andlor replacing the Township services
installed by the Developer, pursuant to the terms of this Agreement, in order to
satisfy the requirements finally imposed by the Township at the time that the
Subdivision Agreement is entered into.
1.4 The Developer acknowledges and agrees Ihis approval relates only to the
installation of the following Township services:
1. Earth Works
2. Storm Drainage
3. Road Construction to Base Course Asphalt
1.5 The Developer acknowledges and agrees that no work shall be carried out on
any existing Township right-of-way, and that there shall be no connection to
services on any Township right-of-way.

1,6 The Developer acknowledges and ag,ees that no work shall be carried out on
lands not owned by the Developer, without the written consent of the owner to be
filed with and approved by the Township.
1,7 The Developer acknowledges and agrees that all Servicing Plans must comply
with Federal, Provincial and Township provisions.
2. REQUIREMENTS PRIOR TO THE COMMENCEMENT OF WORK
2.1 The Developer agrees to submit the following to the Township, in a form
satisfaclory to the Township, prior to the commencement of the installation of
Township services on the Subdivision Lands:
a) A letter from a qualified Engineer experienced in the field of Township
services confirming:
1. Retainer - That thei, firm has been relained by the Developers to act as
Consulting Engineers for Terra Ridge Developments Inc.
2. Terms of Retainer - The terms of their retainer with the Developer as
follows:
a) Plans and Specifications - P,epare plans and specifications for
the construclion of Township services;
b) Cost Estimates - Prepare cost estimates for the Township
services to be constructed from the drawings;
c) Approvals - Obtain all necessary approvals to construct;
d) Co-ordination - Co-ordinate the installation of Township services
to avoid conflicts wilh regards to telephone. cable T.V. and
Township services;
e) On,Site Inspections - Ensure that all on-site inspections of
Township service installations are conducted by the Developer's
Consulting Engineers at all times during construction;
f) As-Conslructed Drawings - Submit certified "as-constructed"
drawings after acceptance of the Township services;
g) Chanqe in Retainer - If at any time during the project:
i) The te,ms of their relainer are changed by the Developer. or;
ii) If they become aware that they will noI be able to provide
"as-constructed" drawings, they will notify the Township
within twenty-four (24) hours;
h) Erosion and Siltation Control - Ensure all necessary precautions
are taken to prevent erosion and sedimentation of sewers,
ditches, culverts, slopes, etc., both within the subdivision and
downstream, prior to and during construction.
b) Confirmation letters are to be filed with the Township Clerk, confirming the
following:
1) The Township Engineer has no objection to the pre-servicing;
2) The Planning Department has no objection to the pre-servicing;
3) The Township Solicitors have no legal objections to the pre-servicing.

c) Payment of cash or certified cheque required to cover the cost of the
Township's lawyer and Planner for all costs involved in processing the Pre-
Servicing Agreement, and for all the Township's Engineers for checking of
plans, specifications and inspection on behalf of the Township forthe sum of
Five Thousand Dollars ($5,000.00). As accounts are received from the
Township Planner, lawyer, and Engineer, they will be paid by the Township
and then submitted to the Developer for reimbursement within thirty (30) days,
In the event that the deposit is drawn down to a level of $Two Thousand,
Five Hundred Dollars ($2,500,00), or less, and the Developer does not pay
the accounts within thirty (30) days, it is hereby understood and agreed that
the Developer is in default of this Agreement and all work must cease;
d) A Letter of Credit, as per Schedule "C", in the amount set out in Schedule "6",
attached, as security to ensure the due completion of the Township services
to be constructed by the Developer, and as security to be held by the
Township for the warranly periods to be more particularly described in the
Subdivision AgreemenI tor Ihe Subdivision Lands. The said Letter of Credit
shall provide that if in the sole opinion of the Township, default under the
terms of this Agreement has taken place, the said Letter of Credit may
thereupon be drawn upon in whole or in part;
e) A certified copy of an insurance policy, or a certificate of insurance, confirming
comprehensive general liability in the amount of Five Million Dollars
($5,000,000.00), naming the Township as co-insured, and containing the
following additional provisions or endorsements:
1) Products/Completed Operations provisions;
2) Cross-liability clause;
3) Blasting included, only if done by an independent contractor;
4) Notice of Cancellation - a provision that the insurance company agrees
to notify the Township within fifteen (15) days, in advance, of any
cancellation or expiry of the said insurance policy.
f) All servicing plans shall be submitted to and accepted by the Township
Engineer;
g) The Ministry of the Environment and Energy has given technical approval
to the servicing plans.
3. INSPECTION BY THE TOWNSHtP
3.1 The Developer agrees to permit unrestricted access to the Subdivision Lands to
the Township and its agents for the purpose of inspection of the Township
services to be installed by the Developer. Notwithstanding that inspections may
be conducted by the Township or its agents, the Developer shall bear sole
responsibility for the soundness of the engineering design of the Township
services, and for ensuring that the Township services to be installed will function,
as intended, and will be compatible with the final Plan of Subdivision when and if
such Plan of Subdivision is approved.
3.2 If, in Ihe opinion of the Township, there is an emergency situation as a resulI of
any work undertaken by the Developer or its servants, or agents, which requires
immediate attention to avoid damage to private or public property or services
owned by the Township or to eliminate a potential hazard 10 persons, such work
may be done immediately by the Township at the expense of the Developer, but
notice shall be given to the Developer at the earliest possible time,

4.
APPLICATION OF SECURITY
4.1
In the evenI of default by the Developer under the terms of this Agreement, or if
the Township is required to enter onto the Subdivision Lands or the abutting
Township lands to conduct any work on the Township services or the connection
of the Township services to facilities due to an emergency, the Township shall be
entitled to draw upon the security posted by the Developer pursuant to the terms
of this Agreement, in whole or in part, to cover the costs incurred by the
Township in remedying the default on the part of the Developer, or in addressing
the emergency situation.
5.
NO REDUCTION OF SECURITY
5.1
The Developer acknowledges and agrees that no reduction in the amount of
security filed by the Developer with the Township, in accordance with the terms
of this Agreement, shall be permitted until such time as the Developer has
entered into the Subdivision Agreement for the Subdivision Lands with the
Township. Thereafter, any reductions in the security posted by the Developer
shall be completed in accordance with Ihe terms of the said Subdivision
Agreement.
6.
NO ASSUMPTION OF TOWNSHIP SERVICES
6.1
The Developer acknowledges and agrees Ihal Ihe Township shall not be required
to assume the Township services to be constructed by the Developer, pursuant
to the terms of this Agreement, until such time as the Developer has entered into
a Subdivision Agreement with the Township for the Subdivision Lands, and Ihe
Township services have been compieted, inspected, and approved.
7.
NOTICE
7.1
Any notice required to be given pursuant to this Agreement may be given by
prepaid registered post to the Developer at the following address:

Backqround:
Councillor Ruth Fountain attended a workshop on May 28, 2002 hosted by the Ministry of Citizenship with
respect to municipalities' roles in improving opportunities for people with disabilities in our Province.
The Ontarians with Disabilities Act, 2001 legislates that municipalities with a population of 10,000+ must form
an Accessibility Advisory Committee to provide the municipality with an inventory of current accessibility
initiatives in the community, as well as suggesting new plans and initiatives.
The Province encourages municipalities to contact service groups and organizations in the community (i.e.
CNIB, Easter Seals Association, Ontario Mental Health Association, Canadian Hearing Society, etc.) to assist
in locating people to sit on the Committee who have expertise and credibility in disability issues. The
Committee will also be encouraged to call on these organizations to share their thoughts, ideas and
experience.
Attached for Council's consideration are Councillor Fountain's notes on the background regarding the
formation of an Accessibility Advisory Committee (Attachment # 1), as well as suggested Mission Statements,
Goals and Objectives, and Terms of Reference for an Accessibility Advisory Committee (Attachment # 2).
RecommendationCs):
1. That this report be received and adopted;
2. That an Accessibility Advisory Committee be created, consisting of one Council member (Chair), three
members of the public, one support staff, and the Mayor (ex-officio);
3, That the Accessibility Advisory Committee meet on a quarterly basis;
4. That staff advertise for members of the Committee;
5. That the Clerk bring forward the appropriate by-law to appoint the members to the Accessibility Advisory

Disability Advisory Committee:
Bill 125 - received Royal Assent on December 14, 2001.
The purpose of this Bill is to improve opportunities for persons with disabilities and to provide for their
involvement in the identification, removal and prevention of barriers to their full participation in the life
of the Province.
The right of persons with disabilities to equal treatment without discrimination in accordance with the
Human Rights Code is addressed in a number of Ontario statues and regulations. Some of these
are:
The Blind Persons' Rights Act
The Building Code Act, 1992
The Education Act
The Ontario Disability Support Program Act, 1992
The Workplace Safety and Insurance Act, 1997
The Canadian Charter of Rights and Freedoms
Municipal Requirements:
Every municipality with a population of more than 10,000 must set up an Accessibility Advisory
Committee.
This Committee can have any number of members as set by Council, but the majority of the
members shall include persons with disabilities.
Each year, the Council shall prepare an accessibility plan.
The Accessibility plan shall include:
1. a report on the measures the municipality has taken to identify, remove and prevent barriers to
persons with disabilities;
2. the measures in place to ensure that the municipality assesses its proposals for by-laws, policies,
programs, practices and services to determine their effect on accessibility for persons with
disabilities;
3. a list of the by-laws, policies, programs, practices and services that the municipality will review in
the coming year in order to identify barriers to persons with disabilities; and
4. all other information that the regulations prescribe for the purpose of the plan.
Level of Accessibility:
The guidelines shall ensure that the level of accessibility for persons with disabilities is equal to or
exceeds the level of accessibility by the Building Code Act, 1992 and the regulations made under it.

MISSION STATEMENT:
The Township of Oro-Medonte Accessibility Advisory Committee for persons with disabilities is dedicated to
promoting equal opportunity and access for all persons regardless of needs, to participate as fully as possible
in all aspects of community life.
GOALS AND OBJECTIVES:
The goals of the Accessibility Advisory Committee are to encourage and facilitate accessibility on behalf of all
challenged persons by:
1. promoting public awareness and sensitivity;
2. encouraging co-operation among all services and interest groups to ensure a better community for all
persons;
3. identifying and documenting relevant issues and concerns;
4. improving access to housing, transportation, education, recreation and employment, which are the
qualities of a five star community;
5. improving communications among all levels of 90vernment and service agencies to make
recommendations re: policy and legislation;
6. recognizing that the needs of all persons are constantly changing.
TERMS OF REFERENCE:
TERMS:
To assist Council by advising, reviewing and making comments and recommendations on Federal and
Provincial legislations and Municipal by-laws of the Township of Oro-Medonte in the interest of people with
disabilities throughout the Township.
Within the framework of the Goals and Objectives, to deal with community issues relevant to disabled persons.
PROCEDURES:
1. The Committee will hold regular quarterly meetings, the minutes of which will contain recommendations of
the Committee to Council.
2. The Committee will liaise with the Council through the Council representative and by forwarding the
minutes and relevant documentation to the Clerk for submission to Council.
3. The Committee will consist of one Council member (Chair), three members of the public, one support staff,

In December, 2001, Report #PWS2001-26 was presented to Council addressing concerns from
Bryan and Bernice Kennedy that their driveway pipe and end walls located at 130 Tudhope Boulevard
were improperly installed during construction of the storm sewer, which was completed in mid-
September, 2001. After site inspections were completed, it was recommended to Council that the
Kennedy culvert and end walls remain as previously installed and additional topsoil be placed to
assist in blending the end walls into the back slope of the ditch.
Mr. Kennedy, being dissatisfied, contacted Jennifer Zieleniewski, Chief Administrative Officer, on July
23,2002, to arrange another site visit with the Mayor, Public Works Superintendent and herself to
address the following concerns:
. Remove, replace and extend both end walls into the ditch back slope;
. Realign the east end wall; and
. Realign the driveway pipe.
The cost to complete this one-day repair would be approximately $1,100.00.
On July 26, 2002, another site visit was conducted by the Chief Administrative Officer and the Public
Works Superintendent to measure and take photos of the driveways that were installed by Georgian
Aggregates in the Fall of 2000. Of all driveways that were measured, there was a range of two to
seven inches in which the end walls were not parallel. In discussions with the Manager of
Operations, Mr. Brian Roubos, who has overseen this project, he advised that run-off water flows
down the Kennedy driveway to the end walls and washes into the ditch, which creates erosion to the
driveway.

.s not to set a precedent with the existing driveways on Tudhope Boulevard, it is recommended that
~r. Kennedy reshape his driveway, create swales on both sides of the lane to eliminate further
:rosion, and landscape at the backside of the end walls to enhance his driveway and property, a
,rocess which has been done by a majority of the residents in the area.
I. THAT Council receives and adopts this report.
2. THAT the Kennedy culvert and end walls remain as previously installed.
3. THAT the Public Works Superintendent advises Mr. and Mrs. Kennedy accordingly.

On January 1, 2000, the Region of Waterloo passed one of the most comprehensive no smoking
bylaws in the province of Ontario. This bylaw was ground breaking for the Province of Ontario
since it required all eating establishments, bars, bingo halls, places of amusement etc. to be 100%
smoke free. No other municipality at the time had such a restrictive and comprehensive bylaw.
No provisions for designated smoking rooms were provided in the bylaw.
Under the Municipal Act Section 213, authority is granted to municipalities to pass bylaws
regulating the smoking oftobacco in public places and workplaces within the municipality. Our
process started before the revisions to the Municipal Act as the Cornmunity Health Department
recognized the growing health implications on health and tobacco. A report to Regional Council
in 1993 outlined the health concern and the section under the Mandatory Health Programs and
Services Guidelines that stated, "The Board of Health support and encourage municipal policy
development, including the consideration of appropriate bylaws and their enforcement to reduce .
smoking in public places and workplaces". This was the impetuses for Regional Council to direct
staff to investigate the possibility of smoking bylaws. In 1994 when the Municipal Act was
amended allowing upper tier municipalities to pass bylaws the focus changed from separate area
municipal bylaws to a regional bylaw. The argument was simple; tobacco is a health hazard. As a
Public Health Department and Regional Council as a board of health and it made sense to peruse
a bylaw as an effective health policy to protect the residents of the Region of Waterloo from the
hannful effects of second hand smoke.
After significant public consultation, a phased in bylaw was passed in September 1997, with a
partial implementation on November 1, 1996, and full implementation on January 1, 2000.
Throughout the process and upon the full implementation of the non smoking bylaw, arguments
for and against have been passionate, hostile and cOnITontational.
The health effects of tobacco products and second had smoke are well documented. I don't think
there is another product that the evidence is so overwhelming on the hannfu1 effects that it is
beyond comprehension that there are some who still think the documented proof and peer
reviewed work of scientists and the testimony of physicians are considered a government
conspiracy or fiction.
The effects of tobacco are devastating and the evidence to implement smoking bylaws is
compelling. Tobacco use has been considered the single most significant cause of preventable
morbidity and mortality in Canada, and most other developed countries. "Within Ontario, 1994- .

owners/companies sued the Region of Waterloo for 106 million dollars for economic loss as a
direct result of the bylaw. In the Superior Court proceedings not one establishment could or .
would provide any information to substantiate any economic hardship. In fact, the only evidence
that was provided at the trial was at the request of the lawyers representing the Region of
Waterloo. A financial statement from one of the appellants was requested and when the financial
statement was submitted as evidence, the financial statement indicated a loss in the first three
months of 1999 when the premise was not affected by the bylaw and a significant profit in the
first three months in 2000 when the bylaw was in effect. The Superior Court Judge stated "Just
because a claim ofloss is made is not necessarily true unless it is proven." Not one operator
could prove an economic loss as a result of the bylaw. As one operator indicated to me, operators
will IDlderstate their profits and overstate their losses. Weare aware of many establishments that
have stated to our staff that business has remained the same or improved. They indicate tables
turn over faster, there are lower cleaning costs, less damage due to cigarette burns and happier
employees working in a smoke-free environment as benefits. Many operators are commenting
they were IDlaware of the conditions they worked in when smoking was permitted and stated
they would never go back to a smoking environment. They are becoming our greatest advocates
for smoke-free bylaws.
Smoking Bylaws Hurts Tourism
Many of you may know, the Region of Waterloo is host to one of the largest festivities called
Oktoberfest. More than 600,000 visitors come to the area to enjoy old fashion Bavarian
hospitality. For Oktoberfest 2000, officials stated ticket sales exceeded 1999 sales and to the
credit and assistance of Oktoberfest Inc., the event was smoke free. Can you image more than
3,000 people in a fest hall and no one smoking? We heard from some tour operators that if they .
knew Oktoberfest was truly non smoking, they would have been able to fill additional tour buses
to come to Waterloo Region. In 2001 ticket sales were at a record pace IDltil the tragic events of
September 11. A repeated cornment to our staff about Oktoberfest was it was a pleasure to enjoy
the festivities in a smoke-free environment.
Smokers Rights:
There is no such legal statute that enshrines smokers' rights. Governments will never provide
legal authority for voluntary or involuntary exposure to a toxic substance. Just as the public
would not accept contaminated food or water we as a society should not accept toxic substances
in the air we breathe. There is appropriate legislation to protect food and water sources and we
are just beginning to legislate protection of the air in public places with non smoking bylaws.
With smDkers this is passionate issue. They feel maligned as a second class citizen, discriminated
against and feel their right to use a legal product has been taken away. A non smoking bylaw is
not a smoker's bylaw but a non smoking bylaw. A non smoking bylaw only dictates where you
cannot smoke similar to the Liquor License Act that legislates where you can and cannot
consume alcohol and the conditions in which you can and cannot consume the product.
Where Are We At In the Region of Waterloo?
Since the implementation of the smoking bylaw on January 1, 2000, we have had our ups and
downs. The tremendous courage and support of our Regional COIDlcil is primarily reason for its
success. Without the continued support of council, the residents of the Region of Waterloo would
not have been able to benefit from one of the most progressive pieces oflegislation in municipal .

smoke and possibly municipalities will be sued for not exercising their authority in implementing
non smoking bylaws to protect the citizens in their communities.
In conclusion, a non smoking bylaw is a good public health policy in protecting citizens from the
hannful effects of second hand smoke. I would encourage those municipalities who have not
started the process of a non smoking bylaw to do so. There are excellent examples of successful
implementation of such bylaws and these municipalities would be more than willing to assist you
in this endeavor.

What The Act Says About
Remuneration And Expense Allowance
Expense allowance (Extract from
Municipal Act, RSO 1990):
255. (1) Despite this Act or any other
general or special Act, where an elected
member of a council of a municipality or
a local board, as defined in the Municipal
Affairs Act, is, under a by-law or
resolution of the councilor such local
board, paid a salary, indemnity,
allowance or other remuneration, one-
third of such amount shall be deemed to
be for expenses incident to the discharge
of his or her duties as a member of the
council or such local board. R.S.O. 1990,
c. MA5, s. 255.
Section 255 of the Act was amended
by Bill 111, by adding the following
subsection, which came into effect
upon Royal Assent (December 12,
2001):
Resolution in 2002
(2) Subsection (1) ceases to apply to
elected members of the council of a
municipality or its local boards on
January 1, 2003 unless the municipality
passes a resolution before January 1,
2003 stating its intention that one third of
the remuneration paid to the elected
members of the council and its local
boards shall continue as expenses
incident to the discharge of their duties
as members of the councilor local board.
Section 283 of Bill 111 , which comes
into effect January 1 2003:
Remuneration and expenses
283. (1) A municipality may pay any part
of the remuneration and expenses of the
members of any local board of the
municipality and of the officers and
employees of the local board.
That would be incurred.
Limitation
(2) Despite any Act, a municipality may only pay the
expenses of the members of its councilor of a local
board of the municipality and of the officers and
employees of the municipality or local board if the
expenses are of those persons in their capacity as
members, officers or employees and if, (a) the
expenses are actually incurred; or (b) the expenses
are, in lieu of the expenses actually incurred, a
reasonable estimate, in the opinion of the council or
local board, of the actual expenses
Local boards
(3) A local board of a municipality may pay
remuneration to and the expenses incurred by
its members, officers and employees to the
extent that the municipality is able to do so
under this Act.
Limitation
(4) No part of the remuneration of a member of a
councilor local board paid under this section is
deemed to be for expenses incidental to his or her
duties as a member and a municipality or local
board shall not provide that any part of the
remuneration is for such deemed expenses.
Former by-law
(5) Despite subsection (4), if a resolution of a
municipality under subsection 255 (2) of the old Act
is not revoked before January 1, 2003, the
resolution shall be deemed to be a by-law of the
municipality and one-third of the remuneration paid
to the elected members of the council and its local
boards is deemed as expenses incident to the
discharge of their duties as members of the council
or local board.
Repeal
(6) A council may repeal a by-law under subsection
5) and the repealing by-law shall be effective on
January 1 of the year after the year in which it is
passed.
Review
(7) A council shall review a by-law under subsection
5) at a public meeting at least once during the
three-year period corresponding to the term of
office of its members after a regular election.

West Nile Virus Update

This health fax is to update all municipalities in Simcoe County on the West Nile Virus.
West Nile Virus fYVNV) has been detected throughout Ontario, as well as Quebec,
Manitoba, and Saskatchewan. There have been no confirmed human cases in Canada,
however, preliminary tests indicate that there are three probable human cases in Peel and
Halton Region. West Nile Virus has been detected in crows as far north as Thunder Bay
and as far south as Windsor-Essex.
To date, WNV surveillance efforts in Simcoe County have included 287 dead crow
sightings and the collection of 74 dead crows, Of the crows submitted for testing, four
have been tested WNV positive. As a result, dead crow pick up has been suspended in
the following municipalities: City of Barrie, Township of Oro-Medonte, Town of
Collingwood, and in the neighbouring municipalities of Springwater Township, Clearview
Township, Innisfil Township, and Essa Township.
While the health unit is no longer picking up dead crows in specified municipalities, the
sightings of dead crows from these areas are important for further risk assessment.
Therefore, the health unit advises that the staff of all municipalities direct calls regarding
dead crows to the Simcoe County District Health Unit, Health Connection Une.
While the risk of transmission of the virus to humans is very low, the health unit advises
residents to continue personal protection methods and to eliminate areas of standing water
where mosquitoes may breed.

Hello Everyone,
This past Sunday I receive a call from Dr. George Pasut, Medical Officer of Health advising that Monday August 19th, his
office would be releasing a news release regarding two dead crows found in the Shanty Bay area of Oro-Medonte and the
City of Barrie, sent for testing on August 6, are presumed posilive for West Nile Virus. Further testing by the National
Microbiology Laboratory - health Canada is needed to confirm the finding.
On Sunday George explained that presumed positive means "first testing confirmed positive", he is confident that
Health Canada will confirm. West Nile Virus has been found in birds in almost every health unit in Ontario this year,
including all those neighbouring Simcoe County. It has also been detected in Manitoba and in Quebec.
Dr. Pasut emphasize that the risk to humans is exceedingly low and that the virus us very rarely transmitted to people. "To
date no human cases have detected in Canada".
The health unit is continuing its dead bird and mosquito surveillance programs and asks that people keep reporting
sightings of dead crows. To date, there have been 238 sightings of dead crows. Of those, 68 crows have been submitted
for testing, with about 20 test results still pending.
Dr. Pasut also advise that Infections from the virus are extremely rare and those affected usually experience only mild
symptoms such as fever or headaches, inflammation of the brain (encephalitis) may occur in a small number of cases.
In addition to monitoring for sick and dead birds, people can practice prevention by reducing mosquito breeding grounds
and reducing the risk of getting bitten by:
. Eliminating of draining standing water in birdbaths, tire swings, flower pots, wheel barrows, children's wading pools
and the top pf pool covers.
. Cutting back thick bushes and shrubbery and keeping grass short, clearing leaves and twigs from eaves troughs, and
immediately throwing away lawn cuttings and raked leaves.
. Sealing holes and putting screens on all windows and doors.
. Using insect repellant on exposed skin, wearing light-coiored, long-sleeved shirts and long pants when you are
outdoors.
People are asked to report sightings of dead or ill crows to the health unite by calling the Health Connection line at 721-
7520 or 1-877-721-7520. As with any dead animal, it's important that people do not handle or touch the bird with bare
hands.
I have invited Dr. George Pasut to make a presentation to Council at their first Committe of the Whole in September.

Dear Mayor Craig and all Councils Members:
I am writing this letter as I would like to sever the back portion of my property which fronts
on to the Warminster sideroad, property being the south east part Lot 6, Concession 9, Medonte
Township. (Now known as Oro-Medonte Township.)
We have approximately 21 acres, previously ovmed by my parents since 1954, and my
husband and I purchased it from them in 1971. We built our home on the property in 1973 and have
resided on the property since then, with our entrance being on Concession 9, north of the creek and
railway.
The property is a corner property, fronting on the 9th concession and the Warminster
sideroad. We have a creek running right through the property, being called the "Avon River" or to
some "Moonstone Creek."
My husband passed away July 3 of this year. My present home area is too large for me, as
well as the existing lawn area and laneway is too long and is a major servicing chore.
I would like to be able to still live on the property, building a smaller home which is being
designed by an Architect, possibly somewhere in the vicinity of 1200 sq.ft. with an attached garage.
The laneway would be much shorter and the lawn area considerably smaller.
I propose to build this home on the back portion of the property, at the extreme west end,
well off the intersection with my driveway off the Warminster sideroad.
All environmental considerations would be given with regard to the home being situated a
maximum distance from the stream. There are major pines in the area where I would be building
and they wiJI not be cut down. There is a natural flat area that is ideal for the home, with the
removal of some hawthorn, wild apple and ]j]ac bushes. We would also be erecting a proper fence

to enhance the property. The frontage of the proposed severed property which is being considered
wou1d be approximateJy 423 ft. by a depth northerly to the Booth! Adamson fence line. The property
wou1d be properJy surveyed, as weB as the existing residence property surveyed.
Would you p1ease consider changing your policy to allow me this severance from my original
property and allow me to bui1d my home. This wou1d allow me to continue to be a resident of this
township, where I have lived fOT the past 48 years.
I have attached a drawing showing the approximate area of the property I would like to build
on and the area of the entire property in question. As you can see, this property is not conducive to
fanning and is mostly bush.

RE: Assumption of Main Access Road at tbe Lake Simcoe Regional Airport
Mayor, Members of Council and CAO:
Qri, June 10, 2002, the three municipal partners executed the Lake Simcoe Regional Airport
Agreement. Of particular benefit to the Township of Oro-Medonte was the concession made by the
other partners that Oro-Medonte would no longer forfeit the local portion of property taxes on leased
commercial properties at the Lake Simcoe Regional Airport.
As you will recall, the Lake Simcoe Regional Airport Agreement also provided for the sale of
commercial Development Lots for the construction of airport hangars. The Township would also
retain the local portion of the property taxes assessed on these hangars. During the negotiations, the
subject of the Township of Oro-Medonte assuming the Airport Tenninal Road was discussed
infonnally, and no objections were raised.
Two distinct advantages of the Township assuming the road in question are as follows:
i) A potential access to the 6th line.
ii) A potential access to a service road along Highway II.
On November 7, 2001, the Township ofOro-Medonte Council ratified the following resolution: "It is
recommended that the correspondence form the Lake Simcoe Regional Airport re: assumption of the
main access road at the Lake Simcoe Regional Airport be received and that staff be authorized to
begin the process of assumption, by the Township of Oro-Medonte of the main airport access road
leading past the Airport Tenninal Building, from the 7th line to the Southwest Commercial
Devclopment Area and hence northerly along the frontage of the five (5) lots in the Southwest
Commercial Development Area, as a public right-of-way, all in order to facilitate the establishment of
hangars in the Southwest Commercial Development Area."
An offer to purchase and build hangars on two of the airport's commercial development lots has been
accepted with a closing date of September 5, 2002. A condition of the sale and development of these
two lots was the provision of access to a public highway. To comply with this condition, an easement
IOC-if.
over the Main Access Road was provided. As more development occurs, the logistics of providing
easements becomes more complicated.
A road assumption agreement of the Main Access Road with the Township of Oro-Medonte is an
essential markeling too] for attracting further commercial development opportunities to the Lake
Simcoe Regional Airport and the Township ofOro-Medonte. Consequently, I am requesting that this
agreement be finalized as soon as possible.
I would suggest that the timing of the assumption be upon the issuance of two additional occupancy
penn its for hangars located in Ihe Southwest Commercial Development Area, Phase I, (3 of 5
potentia] hangars). A land survey of the proposed road allowance has been completed and registered,
which was also a requirement of the land sale initiatives. The road wj]] be brought to a standard
satisfactory to the Township of Oro-Medonte Roads Superintendent. Should the Township so desire,
the same contractor whom provides snow removal services to the airport, can facilitate winter
maintenance for fee.
In closing, the Lake Simcoe Regional Airport Commission requests involvement for the naming of the
road in question.

as follows:
TERM AND APPLICABLE LAWS
The Licensee shall operate the Concession from September 16, 2002 to April 16, 2003, and
from September 16, 2003 to April 16, 2004, The term of this agreement maybe amended by
the Recreation Co-ordinator.
The Licensee shall comply with all applicable Federal, Provincial and municipal laws and
regulations in the operation of the Concession.
PAYMENTS
1. The Licensee shali pay the Township the amount bid of Nine Thousand Dollars
( $ g,OOO) in the following manner by means of post-dated cheques:
(a) 10% ( $ 900,OO) on or before the date of this Agreement;
(b) 20% ($ 1,800,00) on or before the 1st day of November, 2002
(c) 20% ($ 1,800,00) on or before the 1 st day of December, 2002
(d) 20% ($ 1,800,00) on or before the 1st day of March, 2003
(e) 20% ($ 1,800.00) on or before the 1st day of November, 2003
(f) 10% ($ 900.00) on or before the 1st day of March, 2004

HOURS OF OPERATION
2. The Licensee shall keep the Concession Boolh open for business for the minimum time
periods set out below;
( a) During the months of September to April inclusive, during this Agreement,
between the following times on the following days;

(b) After a period of 30 days from the date the operation commences if the above
time and dates, in the opinion of the Licensee are not profitable, a request in
writing to Ihe Recreation Co-ordinalor to delete certain times would be
considered. A decision 10 delete or change times shall be at the discretion of the
Recreation Co-ordinator.
OPERATION OF THE CONCESSION BOOTH
3. The Licensee agrees to opera Ie the Concession Booth in accordance with the
following provisions:
(a)
to provide an adequate number of competent employees to prevent undue
delay in service to patrons;
(b)
(c)
tQ have employees wear suitable attire wnen on duty;
to maintain maximum slandards of cleanliness and hygiene for the
premises and employees;
(d)
to comply with any directions of and to permit inspections by Ihe Simcoe
County District Health Unit and any other Health regulatory agencies;
(e)
to provide courteous, honest and timely service to patrons of the
Concession Booth;
(f)
(g)
10 provide goods and services of good quality and at fair market value;
to terminate the employment of any employee for good cause, always in
compliance with the Employment Standards Act and applicable laws, upon
written request by the Corporation of the Township of Oro-Medonte;
(h)

not to sell or allow the sale of any bottled refreshments;
not to sell any alcoholic beverages;
not to sell any prohibited or restricted goods or any goods which would
reasonably constitute a danger or hazard to patrons of the Arena;
(k)
to sell "Pepsi" products in accordance with an existing agreement.

GENERAL COVENANTS OF THE LICENSEE
4. The Licensee, having inspected the Concession Booth and satisfied themselves
as to any equipment located therein, agrees to;
(a) use and maintain such equipment and fixtures in good condition at
their own expense including repairs where necessary, and upon the
termination of this Agreement, the Licensee shall deliver such
equipment and fixlures to the Township in good and substantial repair
and condition, and shall replace in whole or in part of them which has
been lost, damaged or destroyed; or
(b) to supply and maintain all necessary concession booth equipment
(c) well and sufficiently repair and maintain the portion of building
occupied under this Agreement, when, where and as often as need by
- (reasonable wear and tear and damaged by fire, lightning or tempest
only excepted).
(d) surrender and yield up to the Township, the said Township Concession
Boolh and equipment in good and substantial repair an condition, at
the expiration or earlier termination of this Agreement - (reasonable
wear and tear and damage by fire, lightning or tempest only excepted)
ALTERATIONS AND REPAIRS
5. The Licensee shall not make any alterations or repairs without written
aulhorization of the Township and without having obtained all proper building
permits therefore.
DAMAGE DEPOSIT
6. The damage deposit of $350,00 shall ,emain with the township for the duration of
this Agreement as the deposit for the Agreement and will be refunded upon
termination of the Agreement, subject to any deduction for repairs to the building
or equipment necessitated by Ihe actions or operations of the Licensee.
GENERAL PROVISIONS
7. The Licensee acknowledges that this Agreement is for the right to operate a
Concession Booth and equipment only.
8. (a) The Township may, in the case of damage by fire, lightning or tempest,
which makes repair of such damage within thirty (30) days impossible
(substantial damage), terminate this Agreement and the Township shall refund to
the Licensee that portion of the sum payable by the Licensee to the Township
which would be attributable to that ~ortion of the year from the date of such
terminalion to and including the 16' day of April, 2004 and each party shall be
released from further obligation hereunder.

(b) Notwithstanding paragraph 9 (a), the Licensee shall be relieved from any
obligations pursuant to paragraph 2 and 3 of this Agreement in case of
substantial damage.
9. The Township shall be under no liability whatsoever to any person, firm or
Corporation for any damages or injury, including death, to any person or persons
caused by or resulting from the operation of the Concession Booth by the
Licensee, his servants or agenls, and Licensee shall, from time to time, and at all
times hereafter, protect, indemnify and forever save and keep harmless the
Township, and I or its officers, agents and servants, against any damage,
penalty, fire claim, judgment, coSls, expense or charge suffered, imposed,
assessed or incurred for any violation or breach of any law occasioned by any
act, neglect or omission of the Licensee or his servants or agents.
10. Prior to execution of this Agreement by Ihe Township, the Licensee shall provide
proof of liability insurance covering personal liability and property damage in a
minimum amount to Two Million Dollars ( $2,000,000.00). The said insurance
must be with an insurer satisfactory to the Township, and the policy shall show
loss payable to the Corporation of the Township of Oro-Medonte and Licensee
jointly.
11. The Licensee agrees to obtain and pay for all necessary licenses and permits
prior to commencing the operation of the Concession Booth.
12, The Agreement between the parties being a personal agreement, this Agreement
shall not be assigned or subcontracted. In the event of the death or bankruptcy of
the Licensee prior to the expiration of the term of this Agreement, this Agreement
shall become null and void and all lands and premises shall be delivered up to
the Township and any amount paid or payable by the Licensee shall be
apportioned to the date of death or bankruptcy.
13. The Township shall be responsible for all ulilities used in connection with the
operation of the Concession Booth.
14. The Licensee may, until notified otherwise by the Township, sell first aid supplies
from the Concession Booth. Whether such items may continue to be sold by the
Licensee from the Concession Booth is at the sole discretion of the Township.
15. The Recreation and Co-ordinator and any other authorized agent or servant of
the Township shall have the right at any reasonable time to enter and inspect the
lands and premises occupied under this Agreement.
16. The Licensee and its employees shall promptly deliver all articles found in the
Oro-Medonte Township Community Arena to Ihe Recreational Facilities
Manager.
17. All notices and orders given to the Licensee may be served by mailing the same
to the Licensee at the address hereinafter set out, or by delivering a copy to the
Licensee personally or by leaving it at his place of business in the Oro Township
Community Arena, or by posting the same in a conspicuous place upon the
outside of the building occupied by the Licensee under this Agreement. If such
notice were served by mailing the service is deemed effective two (2) days
following said mailing.
18. Any breach or violation of the lerms and conditions herein set forth by the
Licensee shall entitle the Township to terminate this Agreement forthwith without
notice. Upon termination of this Agreement, the Licensee shall remove from the
Concession Booth all of his supplies and equipment.

19. The Township hereby undertakes and agrees not to grant any other
organizations or individual the right to operate a concession selling similar lines
of goods excepting:
(a) A function not related to "on ice" (arena floor) activities:
(b) A functi"n in any other part of the Oro-Medonte Township Arena, in
conjunction with an .. on ice" activity will require the consent of the
licensee. Where consent is not forthcoming, the Township
reserves the right to a final decision in which the Licensee and
other parties inv"lved will be duty notified;
(c) Vending machines may be installed by the Township. Such costs I
profits on the machines will be assumed by the Township
20. This Agreement shall terminale April 16th, 2004, unless amended by the
Recreation Co-ordinator. The licensee shall rem"ve all goods and equipment
owned by them from the Concession Booth by the 16th day of April 2004 and
shall leave the said Booth in a condition as set out in paragraph 1 B hereof. It is
understood Ihat if all such goods and equipment are not removed by such time,
that the licensee shall pay a storage charge determined by the Township of the
goods and equipment not removed and shall be liable for all expenses incurred in
the later removal of them.
21. If, in the absolute discretion of Ihe Township, the Licensee is not operating the
Concession Booth in the best interests of the public or complying with the laws,
Statutes, By-laws, or Regulalions applicable to them, or with the provisions of
this Agreement, the Township may terminate this Agreement without notice as
specified in paragraph 1 B of this Agreement and the remaining applicable
provisions of this Agreement shall apply.
22. The Licensee shall be responsible for the installation and renloval of any poone
services required at the Licensee's expense.

Being a By-law to Authorize the Execution of a Pre.Service Agreement
Between the Township of Oro.Medonte and Terra Ridge Developments Inc.
WHEREAS Section 51, Subsection (26) of the Planning Act, R.S.O. 1990, Chapter
P.13, as amended, provides that municipalities may enter into agreements imposed as
a condition to the approval of a plan of subdivision and such agreements may be
registered against the land to which the subdivision plan applies;
AND WHREAS, this subdivision received Draft Plan Approval in November, 1991 (43T-
90051);
AND WHEREAS, pursuant to By-law #97-86 of the Township of Oro-Medonte, it is
deemed desirable for the Township 10 enter into a Pre-Service Agreement with the
Owner (Terra Ridge Developments Inc.) for the development being:

1. That the Mayor and Clerk are hereby authorized to execute, on behalf of the

atlached hereto and forms part of this By-law as Schedule 'A'.
2. That the Municipality shall be entitled to enforce the provisions of the Pre-
Service Agreement against the owners.
3. That this By-Law shall come into force and take effect on the final passing

PRE-SERVICING AGREEMENT
THIS AGREEMENT MADE BETWEEN:
THE CORPORATION OF THE TOWNSHIP
OF ORO-MEDONTE
(hereinafter called the "Township")

TERRA RIDGE DEVELOPMENTS INC.
(hereinafter called the "Developer")
WHEREAS the Developer is the registered owner of the lands described in Schedule
"A" attached (the "Subdivision Lands');
AND WHEREAS the Developer desires to commence installing municipal services with
Ihe Subdivision Lands, prior to the registration of the Plan of Subdivision and the
execution of the Subdivision Agreement with the Township:
NOW THEREFORE THE PARTIES HERETO AGREE AS FOLLOWS:
1. ASSUMPTION OF RISK BY DEVELOPER
1.1 The Developer agrees to assume all risk in commencing installation of Township
services on the Subdivision Lands, prior to the execulion of a Subdivision
Agreement with the Township, and the registration of the Plan of Subdivision.
The Developer hereby releases the Township, its agents, servants and
employees from and against all actions, suits, claims and demands whatsoever,
which may arise either directly or indirectly as a resu~ of the installation of
Township services by the Developer.
1.2 The Developer acknowledges and agrees that, in the event that a Subdivision
Agreement with the Township is not finalized for any reason and the Plan of
Subdivision is not registered as a result, pre-servicing of the Subdivision Lands
shall cease immediately.
1,3 The Developer acknowledges and ag,ees that engineering design plans and
specification for the Township services to be installed by the Developer, as
submitted to the Township, in accordance with the terms of this Agreement, may
require further amendment as a resu~ of requirements Imposed by the Township
under the terms of the Subdivision Agreement to be entered into for the
Subdivision Lands. The Developer covenants and agrees to assume all risk and
responsibility for the cost of required revisions to the engineering design
drawings and specifications for the Township services, together with the costs of
modifying, reconstructing, removing andlor replacing the Township services
installed by the Developer, pursuant to the terms of this Agreement, in order to
satisfy the requirements finally imposed by Ihe Township at the time that the
Subdivision Agreement is entered into.
1.4 The Developer acknowledges and agrees this approval relates only to the
installation of the following Township services:
1. Earth Works
2. Storm Drainage
3. Road Construction 10 Base Course Asphalt
1,5 The Developer acknowledges and agrees that no work shall be carried out on
any existing Township right-of-way, and that Ihere shall be no connection to
services on any Township right-of-way.

1,6 The Developer acknowledges and agrees that no work shall be carried out on
lands not owned by the Developer, without the written consent of the owner to be
filed with and approved by the Township.

1.7 The Developer acknowledges and agrees that all Servicing Plans must comply
with Federal, Provincial and Township provisions.
2. REQUIREMENTS PRIOR TO THE COMMENCEMENT OF WORK
2.1 The Developer agrees to submit the following to the Township, in a form
satisfactory to the Township, prior to the commencement of the installation of
Township services on the Subdivision Lands:
a) A ietter from a qualified Engineer experienced In Ihe field of Township
services confirming:
1. Retainer - That their firm has been retained by the Developers to act as
Consulting Engineers for Terra Ridge Developments Inc.
2. Terms of Retainer - The terms of their retainer with the Deveioper as
follows:
a) Plans and Specifications - Prepare plans and specifications for
the construction of Township services;
b) Cost Estimates - Prepare cost estimates for the Township
services to be constructed from the drawings;
c) Approvals - Obtain all necessary approvals to construct;
d) Co-ordination - Co-ordinate the installation of Township services
to avoid conflicts with regards to telephone, cable T.V. and
Township services;
e) On-Site Inspections - Ensur~ that aU on-site inspections of
Township service installations are conducted by the Developer's
Consulting Engineers at all times during construction;
f) As-Constructed Drawings - Submit certified "as-constructed"
drawings after acceptance of the Township services;
g) Change In Retainer - If at any time during the project
i) The terms of their relainer are changed by the Developer, or;
ii) If they become aware that they will not be able 10 provide
"as-constructed" drawings, they will nolify the Township
within twenty-four (24) hours;
h) Erosion and Siltation Control - Ensure all necessary precautions
are taken to prevent erosion and sedimentation of sewers,
ditches, culverts, slopes, etc., both within the subdivision and
downstream, prior to and during construction.
b) Confirmation letters are to be filed with the Township Clerk, confirming the
following:
1) The Township Engineer nas no objection to the pre-servicing;
2) The Planning Department has no objeclion to the pre-servicing;
3) The Township Solicitors have no legal objections 10 the pre-servicing.

c) Payment of cash or certified cheque required to cover the cost of the
Township's lawyer and Planner for all costs involved in processing the Pre-
Servicing Agreement, and for all the Township's Engineers for checking of
plans, specifications and inspection on behalf of the Township for the sum of
Five Thousand Dollars ($5,000.00). As accounts are received from the
Township Planner, lawyer, and Engineer, they will be paid by the Township
and then submitted to the Developer for reimbursement within thirty (30) days.
In the event that the deposit is drawn down to a level of $Two Thousand,
Five Hundred Dollars ($2,500.00), or less, and the Developer does not pay
the accounts within thirty (30) days, it is hereby understood and agreed that
the Developer is in default of this Agreement and all work must cease;
d) A letter of Credit, as per Schedule "C", in the amount set out in Schedule "B",
attached, as security to ensure the due completion of the Township services
to be constructed by the Developer, and as security to be held by the
Township for the warranly periods to be more particularty described in the
Subdivision Agreement for the Subdivision lands. The said letter of CrediI
shall provide that if in the sole opinion of the Township, default under the
terms of this Agreement has taken place, Ihe said letter of Credit may
thereupon be drawn upon in whole or in part;
e) A certified copy of an insurance policy, or a certificate of insurance, confirming
comprehensive general liability in Ihe amount of Five Million Dollars
($5,000,000.00), naming the Township as co-insured, and containing the
fOllowing additional provisions or endorsements;
1) Products/Completed Operations provisions;
2) Cross-liability clause;
3) Blasting included, only if done by an independent contractor;
4) Notice of Cancellation - a provision thaI the insurance company agrees
to notify the Township within fifteen (15) days, in advance, of any
cancellation or expiry of the said insurance policy.
f) All servicing plans shall be submitted 10 and accepted by the Township
Engineer;
g) The Ministry of Ihe EnvilOnn.ent and Energy has given technical approval
to the servicing plans.
3. INSPECTION BY THE TOWNSHIP
3.1 The Developer agrees to permit unrestricted access 10 the Subdivision lands to
the Township and its agents for Ihe purpose of inspection of the Township
services to be installed by the Developer. Notwithstanding that inspections may
be conducted by the Township or its agents, the Developer shall bear sole
responsibility for the soundness of the engineering design of the Township
services, and for ensuring that the Township services to be installed will function,
as intended, and will be compatible with the final Plan of Subdivision when and If
such Plan of Subdivision is approved.
3.2 If, in the opinion of Ihe Township, there is an emergency situation as a result of
any work undertaken by the Developer or its servants, or agents, which requires
immediate attention to avoid damage 10 private or public property or services
owned by the Township or to eliminate a potential hazard to persons, such work
may be done immediately by the Township at the expense of the Developer, but
notice shall be given 10 the Developer at the earliest possible time.

4.
APPLICATION OF SECURITY

4.1 In the event of default by the Developer under the terms of this Agreement, or if
the Township is required to enter onlo the Subdivision Lands or the abutting
Township lands to conduct any work on the Township services or the conneclion
of the Township services to facilities due to an emergency, the Township shall be
entitled to draw upon the security posted by the Developer pursuant to the terms
of this Agreement, in whole or in part, to cover the costs incurred by the
Township in remedying the default on the part of the Developer, or in addressing
Ihe emergency situation.
5. NO REDUCTION OF SECURITY
5.1 The Developer acknowledges and agrees thaI no reduction in the amount of
security filed by the Developer with the Township, in accordance with the terms
of this Agreement, shall be permitted until such time as the Developer has
enlered inlo the Subdivision Agreement for the Subdivision Lands with the
Township. Thereafter, any reductions in the security posted by the Developer
shall be completed in accordance with the terms of the said Subdivision
Agreement.
6. NO ASSUMPTION OF TOWNSHIP SERVICES
6.1 The Developer acknowledges and agrees that the Township shall noI be required
10 assume the Township services \0 be constructed by the Developer, pursuant
to the terms of this AgreemenI, ontil such time as the Developer has entered into
a Subdivision AgreemenI with the Township for the Subdivision Lands, and the
Township services have been compleled, inspected, and approved.
7. NOTICE
7.1 Any notice required to be given pursuant to this Agreement may be given by
prepaid registered post to Ihe Developer at the following address:

8. NO ASSIGNMENT
8.1 The Developer shall not assign or otherwise transfer the benefit of this

WHEREAS The Corporation of the Township of Oro-Medonte has registered on the 25th
day of April 2002 a tax arrears certificate against the land described in Schedule "A"
attached hereto and forming part of this By-Law.
AND WHEREAS Section 8 of the Municipal Tax Sales Act R.S.O., 1990, Chapter M.60 as
amended provides that a municipality may by By-law authorize an agreement with the owner
of such land to extend the period of time, which the cancellation price payable on the land is
to be paid.
NOW THEREFORE the Council of fhe Corporation of the Township of Ora-Medon!e hereby
enacts as follows:
1. THAT an agreement be entered into by the Corporation with Cynthia Lorraine
Mariano the owner of the land described in Schedule "An to extend the time period in
which the cancellation price payable on this land is to be paid beyond April 25~ 2003.
2. THAT the agreement be substantially the same form and contain the same terms
and conditions as set out in Schedule "B" attached herelo and forming part of this
by-law.
3. THAT Ihe Mayor and Clerk be authorized to enter into the agreement on behalf of
the Corporation.
THAT this By-law shall have effect immediately upon final passing.

THIS AGREEMENT made in triplicate the Wh day of Mar, 2002.
BETWEEN
THE CORPORATION OF THE TOWNSHIP OF ORO.MEDONTE
Hereinafter called the "Corporation"
~and Cynthia Lorraine Mariano
Hereinafter called the "Owner"
WHEREAS the Owner is the owner oflhe land in the Township ofOro-Medonte
described in Schedule "A" attached hereto and forming part of this agreement.
AND WHEREAS the Owner's land is in arrears of taxes on the 3rd day of May, 2002
in the amount of $5,700.57 and a tax arrears certifICate was registered in the Registry
Office on the 25~ day of April, 2002 in respect of the Owner's land.
AND WHEREAS under Section 8 01 the Municipal Tax Sales Act, R.S.O. 1990
Chapter M.60 as amended a municipality may by By-law, authorize an extension agreement
be entered into by the Corporation with an Owner to extend the period of time in which the
cancellation price in respect to the Owner's land is to be paid.
NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the
premises and of the covenants and obligations hereinafter contained. it is hereby agreed as
follows:
1. The Owner agrees to pay to the Corporation the sum of $600.00 (six hundred)
dollars monthly] payable on the 1st day of each and every month commencing on the
1" day of June, 2002, 10 and including the 1" day of June, 2005.
2. In addition to paying the amounts provided for in Clause 1] the Owner agrees to pay
all taxes levied on the land as they become due during the tenor of this Agreement.
3. Notwithstanding any of the provisions of this Agreement, the Municipal Act] R.S.O.
1990, Chapter MA5, as amended, shall continue to apply to the collection and
enforcement of all tax arrears and aU taxes except that the Treasurer and the
collector of taxes of the Corporation, without waiving the statutory rights and powers
of the municipality or of the Treasurer] shall not enforce collections of such tax
payments, except as set out in Clauses 1 and 2, during the time the Agreement is in
force so long as the Owner is not in default hereunder.
4. In the event the Owner defaults in any payments required by this Agreement, this
Agreement upon notice being given to the Owner by the Corporation, shall be
terminated and the Owner shall be placed in the position he or she was before this
Agreement was entered into. In the event of a default, this Agreement shall cease to
be considered a subsisting agreement on the day that the notice of termination is
sent to the Owner.
5. Immediately upon the Owner making all the payments required under paragraphs 1
and 2, this Agreement shall be lerminated and, the Treasurer shall forthwith regisler
a tax arrears cancellation certificate in respect of the said land.
6. Notwithstanding the provisions of paragraphs 1 and 2, the Owner and any other
person may at any time pay the balance of the cancellation price and upon receipt of
the aforesaid payment by the Corporation, this Agreement shall terminate and the
Treasurer shall forthwith register a tax arrears cancellation certificate.
7. This Agreement shall extend to and be binding upon an ensure to the benefit olthe
Parties and to their respective heirs, successors and assigns.

8. If any paragraph or part of paragraphs in this Agreement be illegal or unenforceable,
it or they shall be considered separate and severable from the Agreement and the
remaining provisions of the Agreement shall remain in force and effect and shall be
binding upon the Parties hereto as though the said paragraph or paragraphs or part
or parts of paragraphs had never been included.
9. Any notice required to be given to the Owner hereunder shall be sufficiently given if
sent by registered post to the Owner at the following address:

A By-law to convey Parts of O'Brien Street, being Parts 1 and 2, Plan SlR-
30184, and Parts 3, 4 and 5, Plan 51R-28368, being Part of PIN#58554-
0051(Lt), (geographic Township of Oro) Township of Oro-Medonte, County of
Simcoe.
WHEREAS pursuant to Section 297 of the Municipal Act, R.5.0. 1990, c.M.4S, as
amended, Council is empowered to stop up and close any part of a highway;
AND WHEREAS pursuant to Section 31S of the Municipal Act, R.S.O. 1990, c.M.4S, as
amended, Council is empowered to sell any part of a highway which is legally stopped
up and closed;
AND WHEREAS Part of O'Brien Street, more particularly described as Parts 1 and 2,
Plan SIR.30184, and Parts 3, 4 and S, Plan SlR-28368, (geographic Township of Oro),
Township of Oro-Medonte, County of Simcoe, more particularly described In Schedule
"A" attached hereto and forming part of this By-law, has been stopped up and closed by
By-law 2000-84, passed by the Township of Oro-Medonte on October 18, 2000;
AND WHEREAS the Municipal Act, R.S.O. 1990, c.M.4S, sections 191 and 193, as
amended, authorize a Council of a municipality to dispose of surplus real property In
accordance with the provisions of a by-law passed by the Council, establishing
procedures governing the sale of such property;
AND WHEREAS Council passed By-law No. 1996-3S on the 17'" day of April, 1996,
being a By-law to establish procedures to provide for the disposal of real property
within the Township of Oro-Medonte, pursuant to Section 193(2) of the Municipal Act,
R.5.0. 1990, c.M.4S, as amended;
AND WHEREAS Council has determined that the said road is not required for
municipal purposes, and has by resolution declared parts of O'Brien Street, more
particularly described as Parts 1 and 2, Plan SlR-30184, and Parts 3, 4 and S, Plan SIR.
28368, (ge09raphic Township of Oro), Township of Oro-Medonte, County of Simcoe,
more particularly described in Schedule "A" attached hereto and forming part of this By-
law, to be surplus to the municipality;
NOW THEREFORE the Council of the Township of Oro-Medonte hereby enacts as
follows:
1. Authorization of Sale - Council does hereby authorize the sale of Part of O'Brien
Street, more particularly described as Parts 1 and 2, Plan SIR-30184, and Parts 3, 4
and S, Plan SlR-28368, (geographic Township of Oro), Township of Oro-MedDnte,
County of Simcoe, more particularly described in Schedule "B" attached hereto and
forming part of this By-law, to the registered owner from time to time of the
abutting lands described as Lots, 7, 8 and 9, Plan lS61, and Parts 7 and 14, SIR-
28161, more particularly described in Schedule "B" attached hereto and forming part
of this By-law.
2. Sale Price - In accordance with Section 31S of the said Municipal Act, Council
hereby sets the sale price for Parts 1 and 2, Plan SIR-30184, and Parts 3, 4 and S,
Plan SlR-28368, (geographic Township of Oro), Township of Oro-Medonte, County
of Simcoe, more particularly described in Schedule "B" attached hereto and forming
part of this By-law, at a consideration of amounts as set out In Schedule "B"
attached hereto and forming part of this By-law.

BEING A BY-LAW TO CONFIRM THE PROCEEDINGS OF THE COUNCIL
MEETING HELD ON WEDNESDAY, SEPTEMBER 4, 2002.
THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE
HEREBY ENACTS AS FOLLOWS:
1. THAT the action of the Council at its Council Meeting held on Wednesday,
September 4,2002, and in respect to each Motion, Resolution and other actions
passed and taken by the Council at its said Meeting is, except where prior
approval of the Onlario Municipal Board is required, hereby adopted, ratified and
confirm.
2. THAT the Mayor and the proper Officials of the Township are hereby authorized
and directed to do all things necessary to give effect to the said action or to obtain
approvals where required and to execute all documents as may be necessary on
behalf of the Council of the Corporation of the Township of Oro-Medonte. And,
the Clerk is hereby authorized and directed to affix the corporate seal to all said
documents.
