Committee of the Whole on Wednesday, February 9. 2005.
At issue is the road known as Line 15 North bounded by Bass Lake Side to the south and Hwy. 12 West to the north.
Our concerns are as follows:
a) speeds of vehicular traffic
b) use of the road by trucks where prohibited

DEPUTATION
Good Morning your worship and members of this committee. My name is Roberta
Johnson and I reside at 1201 Line 15 North. I am here today along with several of my
neighbours to present and discuss a serious problem and danger that exists on our road.
The road referred to in this deputation is the section of Line 15 North bounded northerly
by Highway 12 West and Bass Lake Side Road to the South. For those members who are
not familiar with Line 15 North as described above; this a 1.5 km. narrow residential
beach road with signage stating the speed limit is 40km. In the winter it is narrowed even
further due to the fact that the ploughs have limited area in which to push the snow unlike
Line 15 North south of Bass Lake Side Rd., where there are no homes directly on the
road.
In June 2004, the township repaved our road, which was desperately needed and greatly
appreciated. You also passed a bylaw and posted signage restricting truck traffic, which
was also welcomed by the residents along this road. Unfortunately these improvements
have created a problem with vehicles speeding, increased usage by vehicles and trucks
refusing to obey the bylaw. Prior to the road being repaved, our road was in such a
deteriorated condition that is was a danger to even go for a walk for fear of twisting an
ankle in a pothole. Most motorists were aware of this and were forced to limit their speed
for fear of "bottoming out". When the Bass Lake Side Road entrance onto Highway 12
West was closed to accommodate the new subdivision, Line 15 North became a major
access route to Highway 12, thus increasing vehicular traffic immensely. Due to this
ongoing problem we are currently being held captive in our own homes and we expect it
will only worsen with the impending development slated for the Bass Lake Side Road
area, which will ultimately border on Line 15 North. An even greater concern is the
construction equipment that will be used in this new development using our road without
heeding the signs - as was witnessed this last Fall during the commercial construction in
the West Ridge Mall.
Some examples of the incidents that have occurred are as follows:
One of the residents of our road, who is in attendance today, was out jogging one day and
was stopped by an O.P.P. officer who suggested that she return home because the road
was too dangerous for her to be performing this type of exercise. If this is the opinion of
the police then one would have to question just how safe is it for this same person's son
to be walking up the road every weekday morning and afternoon to board the school bus
and return home after school.
Halloween night of 2004, a family with two young children who reside on this road,
were forced to return to their home due to vehicles recklessly speeding along the road and
endangering their lives. How unfortunate that these two young children were denied this
simple pleasure. The general consensus among the families with children is that they will
"take their children to town" next year where it is safer.

In September of 2004, I was having my driveway paved. The company had all their
equipment, several dump trucks, paver, roller, etc. lining the side of the road. Normally
this would give cause for drivers to decrease their speed and take extra precaution. One of
the workmen grabbed my arm and pulled me out of the way of a speeding motorist and I
wasn't even standing on the road. I was beside my neighbour's mailbox conversing with
her and several ofthe workmen.
Another incident occurred when my neighbour who is also in attendance today exited the
Provincial Park in her car and drove cautiously northbound. Suddenly a small car sped
up behind her with the driver honking her horn in an effort to make my neighbour speed
up. As my neighbour slowed down approaching her driveway with her signal on, the
vehicle shot into the southbound lane to pass and forced a southbound car off the road.
The driver of the small northbound car stuck her finger in the air and proceeded on her
way without regard to the motorist whom she forced off the road. This is not an isolated
incident and has happened to other residents of our road.
Apart from the problems and risks experienced by the residents along this road on an
ongoing basis throughout the year, the issues are magnified in the summer when visitors
are using the public beach and the traffic also consists of recreational vehicles on their
way to the Provincial Park. Some days this entire road is lined with vehicles belonging to
people using the beach area. They park two abreast thus impeding the sight line of
oncoming traffic for anyone wanting to cross the road.
The Barrie detachment of the O.P.P. has been sympathetic to our plight but do not patrol
the area on a regular basis. One of our residents has been diligent in contacting the
O.P.P. regularly requesting police presence on our road. She has informed them of the
most problematic periods, which are southbound in the momings,(6:30 - 8:30 A.M)
northbound in the afternoons; (4:00 - 6:00 P.M.) and weekends in the summer due to the
usage of the public beach. The fonner Unit Commander advised her that our road is
posted on the Detachment's Board as a "problem area." Although the police presence has
increased due to the neighbours' complaints, they have rarely been present in the early
evenings and never on weekends. The police have a "one-man" traffic unit for all of Oro-
Medonte whose shift ends at 6:00 P.M. Other officers have been in attendance if they are
available and if the weather is favourable. The former Unit Commander told one of our
residents, who is in attendance today, that they are too busy in other areas such as the
Highway 400/11 corridor. When the officers have been present, we have witnessed a
great number of vehicles being stopped and violations being issued. This would indicate
that there is a problem and a need for something to be done. The O.P.P. do not have the
manpower nor the time to deal with the situation effectively. They themselves are
frustrated and have had several inter-departmental meetings regarding this problem, yet it
still exists.
As an addendum to the above, when the O.P.P. were asked by Council and Roads
Superintendent Jerry Ball for a report on our road back in October, there was a flurry of
presence on our road, sometimes as much as three or four times weekly. This has not
been the case now in months.

Your worship and members of this committee, we have come to you requesting your
advice and assistance in dealing with this problem. Our road has become "an accident
waiting to happen". The problem exists 24 hours per dayl7 days per week. We do not
want to wait until someone is seriously injured or killed in order for action to be taken.
After much discussion and frustration, a notice was sent to all the residents of this road.
Copies have been attached to this Deputation for your perusal. In short, and as a result,
the permanent residents of this section of Line 15 North, request this committee to
consider the following:
The installation of Speed Bumps. We are proposing the temporary type that is currently
used in the City of Orillia. They are in use in the parking lots of Zehrs and A&P. They
can be installed in early April and removed in November so as not to interfere with the
removal of the snow from the road. Given the length of the road, that being 1.5 km., we
are of the opinion that 4 or 5 speed bumps would be ideal but no less that three would be
effective.
These units are much more cost effective than having the O.P.P. attend on the road and
would hopefully result in the consistent decrease of speed. We are also of the mind that
these speed bumps will eliminate the trucks that continue to use the road, something that
neither the O.P.P. nor the Township bylaw and signage have been able to accomplish.
In addition, we respectfully request the Township to declare the aforementioned section
of road a "Community Safe Zone". Given that this option still requires the presence of
the police in order to enforce it, we do not feel this will have the desired effect but could
possibly be somewhat of a deterrent for those that repeatedly violate the law.
The combination of the speed bumps for the period as above specified and a Bylaw
declaring our road a Community Safe Zone should give us the year round protection that
we need and deserve.
In closing, I understand the O.P.P. will be submitting the earlier requested statistics to
Council this month with regards to our road. We firmly believe that this information
coupled with the comments attached hereto by the residents will enable this Committee to
clearly understand the danger our road has become to residents and visitors.
Your consideration of our issues and proposed solutions is greatly appreciated. All the
residents of this road and the families and individuals that use the public beach area
would like to have the freedom to walk along the road again, safely and without fear.

realities that face the members of Barrie OPP.

criminal calls, including sexual assaults, assaults, domestics, break and enters, robberies
extortions and homicides. You can Imagine many of these criminal Investigations are very time
consuming and require a great deal of resources.
The officers at Barrie Detachment are kept extremely busy. I can assure you that your complaint
is as important to me as all the rest, however as a Detachment Commander It Is my
responsibility to work with the shift Sergeants to prioritize our calls for service assigning Barrie
Detachment resources to best meet those priorities. I have, and will continue to have officers
address traffic Issues on the 15'h line at the times that you have Indicated are the most

about due to our constant complaints. I will forward a copy of this report to any
resident who is interested in receiving it.

In order to address Council aU you have to do is contact our clerk, Marilyn Pennycook. at 487-2171 and ask
to be put on a Council agenda to make a deputation. You can do this at either our regular Council meetings,
which are held at 700.pm. on the first and third Wednesday or at our Committee of the Whole meeting,
which are held at 9:00.am. on the second and fourth Wednesday Deputations are limited to approximately
10 minutes with an opportunity for questions and answers afterwards.
If you could attend a day time meeting it may be better in your case as our department heads, including
Jerry Ball, are usuaUy at these meetings. Jerry does not favour speed bumps as they interfere with snow
removal. I understand also that we have to suhmit an environmental impact study to the MOB for any
speed bump we want to put in place. Due to the beach etc, this may be a good location for us to consider a

INTRODUCTION
Barrie Detachment is responsible for both the municipal policing of Oro-Medonte
Twp and Provincial responsibilities for Hwy's 400, 11 and 12.
Communities Covered & Population:
Township of Oro-Medonte: Approx. 19,000 residents covering 61,000 hectares.
Provincial Hiqhways covered:
Hwy 400 - 85 Km's
Hwy 12 - 16 Km's
Hwy 11 - 24 km's
Barrie Detachment members work a 12 hour shift on 4 platoons on a rotating
basis.
The Detachment operates 24 hours per day, 7 days per week.
Minimum compliments of 4 officers for day and night shifts during the week and 5
officers for weekend night shifts. If there are insufficient members to cover,
overtime is utilized to augment for officer safety.

The Orillia District Chamber of Commerce will be presenting their Annual Business Achievement
Awards to area businesses on Thursday, FEBRUARY 24, 2005 at 7:00 p.m. at the Highwayman Inn.
Registration begins at 6:30 p.m. Once again we are incorporating the Annual General Meeting.
Mayor Craig and Council, we encourage you to attend to congratulate award recipients. Time will be

] am a resident of OrolMedonte and live on the second line just north of Shanty bay golf
course. WhiJewatching my son's hockey practices many parents have been gathering to
discuss the IOpic of concern. The topic that has the most residents extremely frustrated is
subdivision plan 709. (Waterfront)
This is what I have learned:
. Many residents thought counciJ had already deaJt with this issue and are very
surprised to find the township has not cJosed this malter.
. The amount of our tax money spent on legal fees is beJieved to be in excess of
$J50,000. This is outrageous!
. The previous council under the Jeadership of Mayor Ian Beard had already voted on
this malter. Made Oct 18 2000

. This council has adopted a resolution to se]] the shoreline lands.!! There have been
severaJ deJays and additional expenses. How could this happen and for so long?!!
. ] am a contractor who has worked on one of the properties along this lakefront. The
Jot was owned by the Halfords. Since J 984 I have worked on and off on the property
and I can assure there is no beach and safe waterfront for parkJand. ]t and the
adjoining properties have a very steep rocky shoreline. It simply is not parkland or
"beach front ". The township shouJd compJete the authorized saJe.!!!
Council shouJd recover our public money from this malter by seJJjng the waterfront land.
If that had been done in the first place aJ] of the money could have gone IOwards other
public park projects.

Myself and others in the township have no interest in Council owning "public parkland"
of this rocky nature, which cannot be safely used. Township liability for public safety on
this land should be avoided. The cost 10 make it a safe place {O take our chjJdren is not
worth while.
Additional waterfront land is not needed. Just around the corner from plan 709 are the
ShelsweJJ Park and Oro MemoriaJ which are not used 10 capacity.
] am very concerned that a decision by the previous council was aBowed to get out of
control and resuJt in huge legal costs. Jt is very frustrating to see our tax doBars wasted on
an issue that should have been resolved years ago.
If I have been misinformed on the facts please teB me.

COlT\ml..U1ities., The Orillia Fish and game Conservation Club, has over the years,
recei\l~d the highest congratulatory recognition's for their work in Conservation,
fromtl'!<:1 Prime Minister of Canada aswoli rrom a number of the Premiers of the
Province of Ontario. The Ontario Federation of Anglers and Hunters. have over
the years, awarded the Orlllla Fish and Game Conservation Club with the
prestigious "Most Active Conservation Club Award In The Province Of Ontario".
It would,be hard fora person born a couple of centuries ago, to visualize what
their natural world of that era, looks like today. The natura' world of that era has
beenfilJed in, mowed and cut down, as well as gobbled up and been replaced
with anifacts beneficia! to what has been recognized as a modern society In
essence, it is an unimaginable disaster of incomprehensible magnitude
Back in the mid 1800, fewer thana biliion people inhabited this planet A
genet<iltion that was basically agricultural, where 3 acres could provide the needs
ora family. This was an era of unspoiled rivers, of great forests and clean air. In
essence, the world was unspoiled,
The grealexplorers were followed by the colonists who were all guided by
prayer.'May we take possession of this land that God has provided and let it
drink milk a honey into our mouths, forever'. Unfortunately the forever. has been
short lived in the name of progress
Six billiqn people now inhabit this planet with a greater majority liying below the
poverty HOe and close to a billion teeter on the edge of starvation They strive to
live andreturn to a healthy clean environment but unfortunately, mest will fail with

Included in the "unfortunate", are the surviving remnants of our natural world.

Many species of plants and animal life have and conlinue to disappear a hundred
or more times faster than ever before to so called coming of a modern society.
Half of the words tropical forests have already been cleared. Should the powers
to be, the political structure of our times, this and other POlitical bodies, allow this
to continue, approximately one half may be gone by the end of this century?
The good book in Revelations 16 tells uS of the final conflict of nations and of a
final cosmic war and of a fiery collapse of the planet. All to take place as we
approach the 3rd millennium. One wonders if this might also mean the wreckage
of the planet by an exuberantly plentiful and Ingenuous humanity

j I We ask that you look around and see the encroachment Of the lands surrounding
I. our lakes and rivers, the cutting of trees, clearing of lands all in the name of a
modern society that is living for today and not for future generations.
We have drank from the botlie of plenty and all that is left is in the bottle neck of
an overpopulated consumptive consumer. It Is not too late to win this race
against time. The human race, along with the wildlife and environment still has a
chance to survive but only if the poiltical will power is there. The political will,
must be ttlere to understand that not only for today, but also for the future life.
Good environmental political stewardShip will be the final line if a healthy planet
survives or not.

The ORILLlA Fish and Game Conservation Club are asking the Governments at
the Federa;, Provincial and Municipal levels to declare the week cf May 15th to
21 sf as 'Conservation Week' We. as a Conservation Club, will ask all other like
organizations in Simcoe North, to undertake their major conservation,
environmental projects during this week or at least throughout the month
Further
Firstly we would ask the City of Orillia to fly the official flag of The Orillia Fish and
Game Conservation Club during the above mentioned week to commemorate
Conservation Week
Secondly, we ask the local councils to declare the week of May 15 through \0
May 21 as clean up week Our club will again encourage all other organisations
to get involved in cleaning up the highways and by ways of rubbish during that
week With the co-operation from your council we will help ensure a healthier
and c;Ieaner environment for the true owners of all thiS, a generation yet to be
born,

The Treasurer was directed to request proposals for real estate appraisal services. Request for
proposals were invited from the seven firms detailed in the attached listing. The firms were selected
by reviewing the Ontario Association of the Appraisal Institute of Canada's membership list available
on their website for appraisers with the A.C.C.I. designation in the vicinity of Oro-Medonte.
Proposals were received from the following three firms:
Consolidated Appraisal Services Ltd.
Indicom Appraisal Associates
Andrew, Thompson & Associates Ltd.
II ANALYSIS:

The Request for Proposal advised that the selection of the successful firm would be based on the
following criteria, but not limited to:

qualifications and experience of the firm and staff

Proponents were requested to provide a summary of fees to be charged and detail any out of pocket
expenses that will be charged. Please find below a summary of fees and charges.
Consolidated Appraisal Services:
Fees are $80 per hour. For a typical residential lot fees would be $300 and for a typical commercial
lot $600. Mileage is $.38/kilometer and all other expenses are at cost.
Indicom Appraisal Associates:
Each appraisal is based upon a fee of $800 per day.

QUALIFICATIONS AND EXPERIENCE OF FIRM AND STAFF
Consolidated Appraisal Services has been active in the appraisal business for more than 20 years
and at present has 15 appraisers of which 5 are accredited.
Indicom Appraisal Associates was formed as an independent appraisal firm in 1975 with offices both
in Toronto and Barrie. Staff includes 2 AACI, 9 CRA and 14 candidates.
Andrew, Thompson and Associates were founded in 1975 by Gordon Andrew. In 1974, Steve
Thompson became a partner in the firm. Staff consists of 2 MCI, a CRA and technical staff.
Mr. Thompson was previously employed by Indicom from 1986-1994.
REFERENCES
Consolidated Appraisal Services provided representatives of various banks as references.
Indicom Appraisal associates provided representatives from the Townships of Oro-Medonte, Innisfil,
Tiny and Essa as well as the Ministry of Transportation and Natural Resources as references.
Andrew, Thompson and Associates provided representatives from the City of Barrie, the Town of
Innisfil and the Simcoe County Board of Education and solicitor Marshall Green as references.
As we are familiar with all these firms, it was deemed unnecessary to contact any of the references.
FIRM'S ABILITY TO MEET DEADLINES
All three firms have a number of appraisers on staff that should allow them to meet deadlines.

The various manner fees were quoted did not facilitate comparison.
Consolidated Appraisal Services Ltd. was contacted for clarification of the fees quoted for a "typical"
lot. We were advised that the fees quoted would be for a form or short narrative report. A review of
fees previously invoiced to us indicates that they charge $650 for a narrative report.
A review of fees invoiced by Indicom Appraisal Associates Inc. in 2004 indicates that the fee for a
narrative report for a residential lot is $600 and a commercial lot $1200.
As such, we can conclude that the fees charged by Indicom are preferable to those charged by the
other two firms.
The municipality has utilized Indicom Appraisal Associates Inc. for the past two years. Staff is
satisfied with the quality of their work and the meeting of even the most stringent deadlines. As such,
we would recommend that Indicom Appraisal Associates Inc. be appointed as appraiser of record for
the Township of Oro-Medonte.

C.T. Strongman Surveying Limited was incorporated in 1992. The firm consists of 2 OlS, 1 senior
project manager, four two person work crews, 3 draft persons and one secretary. Mr. Strongman was
commissioned as OlS in 1976.
Mac Donald Surveying is a recently established firm. Mr. Mac Donald has been involved in surveying
since 1984 and was commissioned as OlS in 2000.
Mc Neice Harvey D'amico Surveyors Ltd. has been in business since 1949.John D'Amico has 23
years of experience.
Eplett & Worobec Surveying Ltd. has been located in Simcoe County for over 20 years. They have a
staff of 16 people.
Rudy Mak Surveying Ltd. has been in operation since 1986. Mr. Mak was commissioned in 1982.
They have a staff of about 20.
Raikes Surveying Ltd. have served Central Ontario since 1972. Mr. Raikes has 20 years of
experience.
Bowers & Jones surveying Ltd. was incorporated in 1997. Mr. Bowers was commissioned in 1984.
Roy C. Mayo has been a licenced surveyor since 1994 and is the manager of Surveying Services for
the Jones Consulting Group Ltd. Staff is composed of 4 two person field crews, 2 calculations and
CAD operators and an OlS.
OVERVIEW
Upon review of the comparison of fees and charges, we have determined that the following firms
have preferable rates:

appointed Community Emergency Management Coordinator reviewed by Emergency Management
Ontario for compliance.

The intent is to bring forward for Council consideration at their Committee of the Whole meeting
dated Mar 9, 2005 the draft Emergency Response Plan for receipt and adoption. The Plan will be

- is responsible for contingency planning, memorandums of understanding,
mutual aid agreements and the implementation ofthe Township of Oro-Medonte
Emergency Plan, when required.
Thc Emergency Plan is designed to ensure that all agencies who may become
involved in an emergency are fully aware of their respective roles and
responsibilities (tasks are assigned in preparing for, responding to and recovering
from the effects of an emergency). Additionally, the Plan makes provisions to
ensure: thc earliest possible response to an emergency; the co-ordination of alJ
actions of agencies involved in an emergency to ensure an efficient response; the
manpower and resource capabilities of the Township and that
additional expertise and resources can be caned upon Plan

II BACKGROUND: II
Thc Ontario Society for the Prevention of Cruelty to Animals (OSPCA) submitted a proposed 2 year contract to the
Township ofOro-Medonte for Council consideration.
The OSPCA proposed contract (Attachment #3) contaius the fol1owing:
I. An additional proposed service for Cat Care Cost for $9550.00 dol1ars annual1y for cat impoundment and care.
2. The OSPCA wil1 not col1ect deceased wildlife on road ways in the Township ofOro-Medonte contrary to
previous contracts.
3. The OSPCA wil1 continue to pick- up deceased cats and dogs on roadways as per pass contracts.
4. The OSPCA requires a 3% increase in the current OSPCA contract of $43,297.00 for 2005.
5. The OSCP A requires a 5% increase for 2006.
6. The OSCPS requires that the Township ofOro-Medonte include provisions in the contract for a prosecutor for
Dog Owners Liability Act charges on a full time basis (under the POA Partners Service Agreement with the City
of Barrie this service is presently being provided).
7. The OSPCA requires the Township of Oro-Medonte provide a prosecutor for al1 Township of Oro-Medonte
animal control By-law related charges.
8. The OSPCA is asking the Township of Oro-Medonte to consider passing a By-law provision to provide
protection to animals. Similar By-law exists in numerous larger cities ego Orangeville, Stratford, Richmond Hil1,
Vaughan, Toronto, Markham, Aurora, Ottawa and Mississauga.
Note: the OSPCA will be requested to present to Council at a later date for Council consideration the
proposed by-law for Protection to Animals, in conjunction with comments relating to the "DRAFT" Pit Bull
Legislation currently before the Province.
The Animal Control Bylaw in effect at this time is as fol1ows;.
I. The OSPCA was awarded the Animal Control Contract at the fol1owing rates:
~ 2001 at a cost of$3468.00 /month or $41,616.00/year (2 year contract)
~ 2002 at a cost of $3,537.33/month or $42,448.00/year
y 2003 at a cost of $3,60S.0S/month or $43,297.00/year (No formal contract)
y 2004 at a cost of $3,60S.0S/month or $43,297.00/year (No formal contract)
2. The OSPCA has since 1999 amalgamated Oro-Medonte Township services to one location in City of
Orillia. The OSPCA has provided adequate service to the Township of Oro-Medonte for many years.
This included after hours emergency service and nuisance complaint responses as requested by the Oro-
Medonte Township Bylaw Department. (See Attachment #1).
3. The OSPCA in 2002, 2003 & 2004 received approximately 400 nuisance calls per year.
After 9pm calls reflect approximately 5% of the total calls or 15 - 20 per year.
4. The OSPCA impounded the following;
y 2002 - 64 dogs/59 cats.
y 2003 - 75 dogs/65 cats.
y 2004 - 75 dogsl100 cats.
5. The OSPCA received
y 2002 - $S50.00
y 2003 - $760.00
y 2004 - $SOO.OO
In addition to the contract respectively to assist with cats impounded (Attachment #2).
Financial impact of the proposed contract:

Staff have reviewed and analyzed options and are listed for Council consideration. The analysis includes several
methods in which the municipality can supply animal control service;
Option #1 - Accept OSPCA contract proposal as submitted.
? 2005 - $54,145.87
? 2006 - $57,299.13
Options #2 - Accept OSPCA contract proposal as submitted less cat fees + prosecution
? 2005 - $43,297.91+ 1,000.00 = $ 44,298.00
? 2006 - $44,595.91+ 1,000.00 = $ 45,596.00
Option #3 - Accept OSPCA contract proposal as submitted revised with cat surcharge limited to $1000.00
per year based on the previous charges that were paid out, in addition to the annual contract.
? 2005 $43,298.00 + $1000.00 (cat surcharge) + 1,000.00 (estimate for prosecution services) = $45,298.00
? 2006 $44.596.00 + $1000.00 (cat surcharge) + 1,000.00 (estimate for prosecution services) = $46,596.00
Option #4 -Is that the Township ofOro-Medonte enforce the Township Animal Control Bylaw
necessitating the hiring of one full time staff to perfonn bylaw functions. In addition the analysis included
Township staff to provide the after hours, weekend services and pound services as noted below
(Attachment#2). Note: this option is similar to City of Barrie animal control services.
? Requirement - manpower - one full-time staff and one staff or part-time or contract staff for after hours
and weekends.

32,760.00 + 40% benefits = $46,000.00
? After hours services provided by Township staff ($ 1 8.00/hr.X 20 hrs/week ($] 8,720.00)
? Weekend services provided by Township staff ($]8.00/hr X ]4 hours X 26 weekends ($8,000.00).
? Pound Services payable to OSPCA of $29,000.00 per year.
? Cost $46,000.00 + $]8,720.00 + $8,000.00 + $29,000.00 = $10],720.00
? Less: the cost of summer staff employed for by-law services $12.20 X 35 hours X 33 weeks =
$14,091.00.
? No Cat and Care impoundment included.
? Total $87.629.00 + cost of Township vehicle $25.000.00 over 5 vears.
Option #5 -Is that the Township ofOro-Medonte enforce the Township Animal Control Bylaw

~ Cost $46,000.00 + $5,200.00 + $7,000.00 +$29,000.00 = $87,200.00
~ No Cat and Care impoundment included.
~ Less: the cost of summer staff employed for by-law services $12.20 x 35 hours x 33 weeks =$14,901.00
~ Total $ 72.299.00 + cost of Township vehicle $ 25.000.00 over 5 vears.
Note #1: The full time proposed Animal Control person in this capacity could be used as back up to the
building department inspection services for decks & sheds only or the sewage re-inspection program resulting
in further savings.
Note#2: Due to the requirements of the new Building Regulation #305/03 a percentage of the financial
implications would be directly attributed to the Building Department.
II RECOMMENDATION(S):

It is recommended that:
1. THAT Report No. BD2005-02 be received and adopted.
2. THAT staff be authorized to prepare a BY-Law to enter into a two year agreement with the
OSPCA has outlined in Option #3.
3. AND THAT the OSPCA be requested to present to Council for their consideration
their proposed Animal Care Bylaw and comments with respect to the "DRAFT" Pit Bull Legislation.

Dear Mr. Kolbe and Mr.Yife
The Orillie branch of the Ontario S.P.C.A. provides 24 hour
emergency Btan~-by service to the residencea of Oro Hedonte. An
emergency is classified as follows;
I)Injured animal
2)Bitc incident
3)Threat to public safety as result of an animal
4)Priority Bylaw infraction
5)Priority CreulLY to Animals
The officer on emergency stand by after communication with the residen
will decide wheLberthe occurcncc requires immediate attention or verb
assiatencc.
A routine call such as a dOB runninR at large, at times requires an
officera presence on the scene due to circumstances, and prevention
of a more severe nature. At other times the officer is able to rectify
8 situation and prevent any further occurence by verbal advice.
Every call we receive, contact is made to the calle~ the priority
callers immediately,and the non emergency as soon as possible.

Dear Mr. Kolbe
As you are aware, it is coming time again for the Animal Control Contract renewal, !
with Ora-Medonte and the Ontario SPCA Grillia Branch.
The Contract expires on December 31 st of 2004 and we felt now would be an
opportune time for our proposal.
Cat Care Costs
The Ontario SPCA does request the Twp. ofOro-Medonte contribute to the costs of
caring for the stray cats admitted to the OSPCA shelter ITom within the Twp.of Ora-
Medonte boundaries.
We are also aware you have contributed $5.00/cat in previous years and we thank
you for that, but the cat population is ever increasing and cost of housing increasing
as well.
The OSPCA is proposing a yearly contract increase in the amount of$9,550.00 for
cat impoundment and care. This would cover the care for a period offive days
including the day of impoundment, further costs relating to adoption would be paid
for by the Ontario SPCA.
Cats unclaimed ITom the Ont. SPCA will be adopted or humanely destroyed and
disposed of in a proper manner.
The OSPCA shelter has taken in 93 cats in 2004 up to November 1 st within the limits
of the Twp. ofOro-Medonte.

Deceased Wildlife on Roadways
The Ontario SPCA has been collecting dead wildlife on roadways for a number of
years in the Twp. ofOro-Medonte as a courtesy to the municipality and public.
The Ont. SPCA can no longer offer this service as it deters our Animal Control
Officers from performing their duty, which is bylaw enforcement.
We wiJl however continue to pickup dogs and cats that are unfortunately killed on the
roadways.
Contract Proposal
The Ontario SPCA has had a long term partnership with the Township ofOro
Medonte enforcing the animal control bylaws and dealing with a multitude of other
animal related incidences.
As we are both aware the cost to carry out these tasks unfortunately go up every year.
Therefore the Ontario SPCA request an increase with the Animal Control Contract
of 3% 2005 and 5% 2006.
The Ontario SPCA further requests to retain 100% of the impound fee collected
from owners claiming their dogs.
Providing a Prosecutor
The Ontario SPCA request the Township ofOro-Medonte provide a prosecutor for
any Animal Control bylaw or Dog Owners Liability act issues which may go to court.
Animal Care Bylaw
The Ontario SPCA is asking the Township of Oro-Medonte to consider passing a
bylaw provision to provide protection to animals. Similar bylaws exist in numerous
municipalities across Ontario including Orangeville, Stratford, Innisville, Richmond
Hill, Vaughan, Toronto, Markham, Aurora, Ottawa, Mississauga and the Twp. of
Mono.
The Care of Animals contain provisions relating to:
}o< Proper shelter and sanitary conditions
)> Proper food, water, veterinary care and attention

)- Securing or fastening of animals
)- Proper ventilation ( i.e. leaving an animal in a hot vehicle)
)- Illegal slaughtering of animals
)- Teasing and tormenting animals
This will enable OSPCA enforcement staff to more effectively deal with animal care
related complaints in Oro-Medonte such as; animals housed without shelter,
unsanitary conditions in yards, slaughtering of animals in residential areas and
leaving animals in hot vehicles during the summer season. Many of these scenarios
are not criminal in nature; therefore there are currently no penalties for this type of
behavior. With the enactment of a municipal bylaw, the OSPCA can effectively
respond to complaints regarding irresponsible animal ownership.
This new section of the bylaw, if passed, would be enforced at no additional cost to
the municipality, as this is part of the OSPCA's mission.
