2004-147 To Assume and Establish Highways and Roads within the Township of Oro-MedonteTHE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 2004-147 A By-law to Assume and Establish Highways and Roads within The Township of Oro-Medonte WHEREAS Section 11 (2) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that municipalities may pass by-laws with respect to jurisdiction over highways; AND WHEREAS Section 31 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that municipalities may by by-law establish a highway; AND WHEREAS Section 26 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, defines what constitutes a highway; AND WHEREAS pursuant to Section 48 of the former County of Simcoe Act, 1993, S.O. 1993, c.33, the ownership of lands within the jurisdiction of the former Township of Oro and Township of Medonte were vested in the Township of Oro-Medonte as of January 1, 1994; AND WHEREAS Council of the Township of Oro-Medonte deems it necessary to assume and establish for use all highways within the boundaries of the Township of Oro-Medonte with the exception of those highways and roads listed on Schedule 'A' attached hereto; NOW THEREFORE the Council of the Township of Oro-Medonte hereby enacts as follows: THAT all highways and roads within the boundaries of the Township of Oro- Medonte are hereby assumed and established for use as a public highway with the exception of those highways and roads listed in Schedule 'A' of this by-law; 2. THAT the attached Schedule 'A' shall for part of this By-law; 3. THAT this by-law shall come into force and take effect on its final passing thereof. Neil Craig Clerk, Marily Pennycoo� TOWNSHIP OF ORO-MEDONTE SCHEDULE `A' to BY-LAW NO. 2004-147 Excepted Highways and Roads within the Township of Oro-Medonte: 1) All Highways under the jurisdiction of the Province of Ontario. 2) All Highways under the jurisdiction of the County of Simcoe. 3) All portions of Boundary Roads not particularly under the jurisdiction of or maintained by The Township of Oro-Medonte except as provided for in an agreement with another municipality (Boundary roads being those roads within the joint jurisdiction of the Township of Oro-Medonte and another municipality) 4) All Private Roads (roads or highways not under ownership of The Township of Oro-Medonte as of December 1, 2004). 5) All untravelled, unopened portions of original road allowances which are under the jurisdiction of The Township of Oro-Medonte and are not maintained or open for vehicular use. 6) All Highways which are signed "No Winter Maintenance". 7) All Highways within a registered Plan of Subdivision unless particularly assumed for maintenance purposes by specific by-law of the Township of Oro-Medonte. 8) All Highways which have been closed by by-law.
