2005 Ontario Family Fishing Weekend
As you know, the Province of Ontario, in partnership with many nongovernment
organizations like the Ontario Federation of Anglers and Hunters, declares one
summer weekend (Friday, July 8 through Sunday, July 10, 2005) a licence-free
fishing weekend.
This special weekend, now run in conjunction with National Fishing Week,
includes fish festivals, clinics, or conservation and educational activities that may
be held in your area.
Would you please help us publicize the 2005 Ontario Family Fishing Weekend in
any calendar of summer events you may participate in or publish. In addition,
please consider "declaring" this date as Ontario Family Fishing Weekend.

Intergovernmental action plan for south Simcoe County
Thank you for joining me on December 7,2004, to discuss our proposed intergovernmental
action plan for south Simcoe County. It was a great pleasure for me to meet with so many of
you.
In addition to the answers I provided at the meeting, I would like to clarify the matter of the
Province's funding commitment for this initiative. As part of the government's commitment to
source water protection planning, my colleague, the Honourable Leona Dombrowsky, Minister
of the Environment, announced on October 14, 2004, that the Province will fully fund the
assimilative capacity studies of the Nottawasaga River and Lake Simcoe watershed. The
Province will provide 100 per cent of the $1.5 million to fund these studies, which will benefit
all the municipalities in these watersheds, including those in the Counties of Dufferin and Grey,
and the Regions of Durham and York, which are outside the scope of the proposed action plan.
Accordingly, I am seeking a 50:50 cost sharing arrangement for the balance of the action plan,
which includes the Environmental Scan as well as Phases 2 through 4. This is estimated to be
$1.5 million. Furthermore, as I promised at the meeting, any costs in excess of $1.5 million will
be borne by the Province.
As you can appreciate, before we can all determine the actual cost of this project, we will need to
finalize the scope of work for the action plan and seek competitive bids.

In order to advance this plan, I suggest a two-stage process. First, I would like to have your
support in principle for scoping the work plan and seeking competitive bids within the next 30
days. Second, I would like to have a formal commitment to participate in this plan.
I propose the following resolution, which you may wish to bring before your council:
THAT the (name of municipality) supports in principle the proposed
Inter-governmental Action Plan for south Simcoe County as put forward by
Minister of Municipal Affairs and Housing John Gerretsen on December 7, 2004 in
Barrie.
AND FURTHER
THAT the (name of municipality) agrees to the scope of work proposed, and
to participate financially, subject to knowing the firm cost of involvement.

KGROUND:
Since the implementation of current value assessment in 1998, the Province has passed various
pieces of legislation to mitigate the impact on taxes for properties in the commercial, industrial and
multi-residential classes. Please find attached a chart summarizing the said legislation. The intent in
1998 was to move towards CV A for properties in the said classes. The refunds issued to properties
over the capped limit would be financed by withholding decreases (claw backs) that properties with
CVA less than prior year's taxes would have received. The problem, however, is that with ongoing re-
assessments, CV A is a moving target.
In 2004, the result of the capping program for each class was as follows:

For properties with CV A taxes less than prior year's taxes, the percentage of the decrease they could
receive that they actually retain is:

I respectfully suggest that after seven years of capping, the percentage of decrease retained for the
commercial and industrial class should be much closer to 100% than those detailed above. Those
property owners whose taxes should be decreasing are growing increasingly frustrated with the slow
pace in achieving CV A taxes.
Bill 83 provides municipalities with options to accelerate the move to CV A taxes. These options are
summarized on the said attached chart.
ANAL YSIS:
Please find attached analysis of the impacts of various options for each of the classes in the capping
program. Please find below commentary on the impact of each of the options.
Increase annual limit of tax increase to 5% of prior years' CVA tax:
This option would be most effectively used in combination with the other options and could accelerate
the move to CV A for properties with 2004 adjusted taxes less than 50% of CV A. The problem is that
it would further complicate the calculation of taxes and add to the confusion of the taxpayer. As such,
I would not recommend implementation of this option.
Increase annual limit of tax increase to a maximum of 10% of prior year's taxes:
As indicated on the attached analysis, this option would result in a greater number of properties
moving towards full CV A. 10 commercial properties and 6 properties would experience increases
above status quo of more than $500. The amount required to be clawed back would decrease by
$22,829.32 for the commercial class and $10,061.05 for the industrial class. While the impact of a

10% annual limit may be onerous for some property owners, I believe this is outweighed by the need
to move to full CV A taxes and increase the percentage to be retained by those experiencing claw
backs.
Impose minimum tax increase of $250:
This option would result in more properties attaining full CV A and not be exceedingly onerous. As
such, this option should be implemented.
Impose minimum claw back of $250:
This option would result in more properties attaining full CVA and should be implemented. In 2004,
32 commercial properties and 2 industrial properties experienced claw backs less than $250. One
drawback to this option is that a property with a claw back of $249.99 would have the claw back
reduced to nil while a property with a claw back of $250.01 would not experience any reduction in the
claw back.
Introduction of "floor" on tax levels for comparable properties:
As stated above, the intent of capping legislation was to mitigate the effect of the change to CV A in
1998. I have never understood why properties with new buildings constructed after 1997 were
provided protection from the impact of CVA. As such, I support any option that will accelerate the
taxation of new buildings to full CV A.
COMMENDATION S : .
1. THAT Report No. TR2004-32 be received.
2. THAT the Township of Oro-Medonte supports implementation of the following capping options by
the County of Simcoe:
- capping limit of 10% over previous year's capped tax
- establishment of minimum increase of $250
- establishment of minimum claw back of $250
introduction of "floor" on tax levels for comparable properties

THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE
BY -LAW NO. 2004-
A By-law to Assume and Establish Highways and Roads
within The Township of Oro-Medonte
WHEREAS Section 11(2) of the Municipal Act, 2001, S.D. 2001, c.25, as amended,
provides that municipalities may pass by-laws with respect to jurisdiction over highways;
AND WHEREAS Section 31 of the Municipal Act, 2001, S.D. 2001, c.25, as amended,
provides that municipalities may by by-law establish a highway;
AND WHEREAS Section 26 of the Municipal Act, 2001, S.D. 2001, c.25, as amended,
defines what constitutes a highway;
AND WHEREAS pursuant to Section 48 of the former County of Simcoe Act, 1993,
S.D. 1993, c.33, the ownership of lands within the jurisdiction of the former Township of
Oro and Township of Medonte were vested in the Township of Oro-Medonte as of
January 1, 1994;
AND WHEREAS Council of the Township of Oro-Medonte deems it necessary to
assume and establish for use all highways within the boundaries of the Township of
Oro-Medonte with the exception of those highways and roads listed on Schedule 'A'
attached hereto;
NOW THEREFORE the Council of the Township of Oro-Medonte hereby enacts as
follows:
1. THAT all highways and roads within the boundaries of the Township of Ora-
Medonte are hereby assumed and established for use as a public highway with
the exception of those highways and roads listed in Schedule 'A' of this by-law;

II BACKGROUND:
I
In June of 2004, the Public Works Department rented a John Deere 450H Trim Dozer from United
Rentals to assist with all of the capital road construction projects, as well as to be utilized for ditching,
culvert installations and ball diamond maintenance. This dozer has become a very versatile piece of
equipment for capital and maintenance projects, as it was in operation, each day, from June to mid-
November.
For a number of years now, the Public Works Department has rented a dozer for use on construction
projects and as the demand to upgrade roads has increased, so has the need for a trim dozer. As
well, the rental dozer has become an essential piece of equipment within the Parks and Recreation
Department for preparing all of the ball diamonds for summer usage. In turn, as usage has
increased each year, so has the monthly rental charge; this year, the rental rate for the dozer totaled
$20,434.07.
In September of 2004, United Rentals approached the Public Works Department with the option to
purchase this dozer at the net selling price of $69,900.00, minus the five month's rental rate of
$14,500.00. This would reduce the net selling price to $55,400.00. It is apparently customary for this
rental contractor to sell off their construction equipment, such as bulldozers and backhoes, every two
years in order for new equipment to be rented the following year.
As this dozer was in excellent shape for rental equipment and the fact that over 80% of this year's
rental would be deducted from the net selling price, it would be cost effective to pursue this purchase
option, as a new dozer of this size would cost approximately $110,000.00.
The following is a cost benefit analysis prepared over a 10-year period:

r II ANALYSIS: II
As the purchase of this dozer was not a 2004 capital equipment budget item, the Treasury
Department was asked to provide a projected year-end equipment reserve total. During 2004, our
vehicle replacement budget totaled $401,835.00, which comprises of two tandem plow truck
replacements and a one-ton crew cab replacement.
Once the tenders for these vehicles were awarded, there was a surplus of approximately $58,000.00,
plus an additional $7,000.00 from vehicle trade-ins, giving a total of $65,000.00. Considering the
rental ($17,475.00) that is paid and the amount of work the dozer completes in a year, it would be
beneficial to purchase the bulldozer, compared to a yearly rental, which would total the purchase
price in approximately four years.
Thus, it is recommended that the trim dozer from United Rentals be purchased, including the 12
month power train warranty.
II RECOMMENDATION(S):

1. THAT Report No. PW2004-10 be received and adopted.
2. AND THAT the Public Works Superintendent be authorized to purchase the John Deere 450H
Trim Dozer from United Rentals at a total cost of $66,603.86.

GROUND:
The purpose of this report is to consider the proposed Zoning By-law Amendment application submitted
by Allan Shelswell. The intent of this application was to rezone a parcel of land that was severed by the
Committee of Adjustment for residential purposes in July 2004.
The application applies to lands legally described as Concession 13, West Part of Lot 18, more
specifically described as RP 51 R-331 02, Part 1 in the Township of Oro-Medonte (formerly Oro). The
intent of the proposed Zoning By-law Amendment is to rezone the subject lands from the
Agricultural/Rural (AlRU) Zone to the Rural Residential Two (RUR2) Zone.
AL YSIS:
In July 2004, the Committee of Adjustment granted a consent application for a new lot of approximately
0.4 hectares (0.98 acres) in total land area which was intended to be utilized for residential purposes.
As the parcel was currently zoned Agricultural/Rural (AlRU), the Committee of Adjustment included a
condition in their decision that required the severed lot to be rezoned to a residential zone to reflect the
intended usage.
The applicant submitted the application for rezoning and a public meeting as required by the Planning
Act was held on December 13, 2004. No concerns were received at the public meeting and written
comments were received from Simcoe County District School Board and the County of Simcoe
indicating that they had no objection to the approval of the proposed re-zoning.
The proposed Zoning By-law Amendment would conform with the intent and policies of the Oro-Medonte
Official Plan and the County of Simcoe Official Plan. On this basis, it is recommended that a Zoning By-
law Amendment be given favorable consideration by Council.
COMMENDATION (S):
1. THAT this report be received and adopted; and
2. That a zoning by-law amendment for Allan Shelswell, that would rezone the lands described as

The applicant submitted the application for rezoning and a public meeting as required by the Planning
Act was held on December 13, 2004. Verbal comments were received from the neighbouring landowner
regarding the Official Plan policies for consents in the Agricultural designation; however as indicated
above the Committee of Adjustment approved the application in accordance with the Official Plan and
this decision was not appealed. Written comments were received from Lake Simcoe Region
Conservation Authority, Simcoe County District School Board and the County of Simcoe indicating that
they had no objection to the approval of the proposed re-zoning.
The proposed Zoning By-law Amendment would conform with the intent and policies of the Oro-Medonte
Official Plan and the County of Simcoe Official Plan. On this basis, it is recommended that a Zoning By-
law Amendment be given favorable consideration by Council.
ECOMMENDATION (S):

On April 5, 2001 the above noted subdivision was given draft plan approval by the Township (as the
approval authority) for 595 residential lots and 32 blocks for services and open space/golf course
subject to a number of conditions being fulfilled before registration of the plan. This approval was
obtained by Horseshoe Resort Corporation; however they have now sold Phases 1 and 2 to Laurel
View Homes. Laurel View Homes has submitted a request and plan for a proposed redline revision
and this request is attached for Council's review.
A redline revision refers to a plan which proposes amendments to an existing draft approved plan
and requires favorable consideration from the approval authority. A copy of the original draft
approved plan and the proposed red line revision are attached for Council's review. The revised
redline plan was circulated to Department Heads and no concerns were identified.
The red lined plan proposes two items:
1. To reduce the number of lots from 69 lots to 56 lots in Phase 2 to increase size of the smaller lots;
2. To increase the lot frontage from 15 metres to between the 18 to 23 metres
The applicants are reducing the number of lots and thereby improving the approval previously
granted. There is no legal situation in this regard and notification of the changes, if approved by
Council, will proceed in accordance with the requirements of the Planning Act. As indicated above,
Laurel View Homes are the owners of Phases 1 and 2, which would include the 56 lots in Phase 2.
The developer is requesting favorable support from Council to proceed with the redline revisions. On
the basis of the comments above, it is recommended that the proposed redline revision be supported
~
by Council. As Council is the approval authority, the adoption of this report will direct th~ Senior
Planner to proceed with the notification of the amended draft plan conditions in accordance with the
requirements of the Planning Act.

1. Report PD 2004-64 be received and adopted;
2. That Council approve the redline revision to the draft approved plan (43_0M-20001) which has
the effect of:

1. to request an extension to the Draft Plan associated with the above noted property which
expires on March 17th, 2005 and,
2. to request a red-line revision for Phase 2W of the plan.
The first request is being made in order to permit the Owner's to continue to satisfy their
conditions of Draft Plan Approval and continue to market and sell the lots in the plan; additional
time is required in order to undertake these matters.
The red-line revision is proposed to provide for lots with a larger lot frontage on the lots within
the phase. If granted, this red-line revision will result in the following within the phase:
. a reduction in the number of lots in the phase from 69.5 to 56
. an increase in the typical lot frontage from 15 metres to between 18 and 23 metres
. and a change in the average lot frontage from 15 metres to approximately 20 metres
The boundaries of the subdivision will not change nor will the approved block locations. The
extension of Tanglewood Crescent from Oakmount Avenue to Landscape Drive has been closed
as the road connection was deemed superfluous. It is understood that this was presented at the last
red-line request for the plan.

BACKGROUND:
On April 5, 2001 the above noted properties received draft plan approval from the Township (as the approval
authority) for 595 residential lots and 32 blocks for services and open space/golf course. This approval was
subject to twenty seven conditions and ten notes (Attachment #1) which were required to be satisfied prior to
the registration of the plan. The applicant's have submitted a request in accordance with the notes to the draft
plan approval requesting an extension to the draft plan approval (Attachment #2). The request for the
extension is the subject of this report.
IS:
The Township of Oro-Medonte was delegated the approval authority for plans of subdivision/condominium
from the County of Simcoe in June 2000 in accordance with the requirements of the Planning Act and a
Memorandum of Understanding with the County. Since that time, the Township has draft plan approved three
plans of subdivision/condominium. The above noted property was one of those approvals granted by the
Township on April 5, 2001 subject to the conditions requested by both Township staff and requested agencies.
In order to receive final approval from the Township and proceed to registration of the plan of subdivision the
applicant is required to clear all conditions imposed by the approval authority and provide the appropriate
clearance letters from the required agencies.
The applicants did proceed with the clearance of the draft plan conditions on the subject property; however,
this was only completed for the first phase comprised of a total of 66 residential lots (Redlined from original
draft plan of 71 lots). Condition #7 of the draft plan did permit the phasing of this proposed subdivision and on
April 1 ,2003 Phase 1 of this plan was given final approval by the Township and registered as a subdivision on
April 10, 2003 (Plan M-741). To date, the applicants have been completing the construction of Phase 1 and
have not been proceeding with the clearing of conditions for the remainder of the draft approved subdivision.
At this time building permits have been issued for a total of 38 of the 66 lots in Phase 1. The applicants have
applied for a redline revision on Phase 2 to reduce the number of lots and thereby increase the lot frontage
and area requirements within this phase, this redline revision is the subject of a separate report to the
Committee.
The subject property is designated Horseshoe Valley Low Density residential in the Township's Official Plan.
This designation permits the form of development that was approved on the subject property and permits a
density of up to 7.0 units per hectare. The draft plan of subdivision approved by the Municipality was 5.65
units per hectares, a lower density than permitted by the Official Plan. It is the goal and objective of both the
County and Township Official Plan to direct new residential development to existing settlement areas and to
require these developments to be serviced by full municipal services. In order to implement this, policies are
established in the Horseshoe Valley Road area of the Township's Official Plan, which permit the development
of a variety of residential uses on full water and sewar services. As the proposed residential development was
approved on the basis that it was contained within an existing settlement area, was to be serviced by full water
and sewar services, the continued approval of this draft plan approval is deemed appropriate and in conformity
with the Official Plan.
On the basis of the above it is recommended that an additional extension of 1 year from the lapsing date of
March 17, 2005 be granted to the applicant to allow for the registration of the remainder of the subdivision.
No additional conditions are recommended as these were revised in early 2004 and continue to be
appropriate. Once Council approves the extension of the draft plan conditions, notice of decision would be
sent to the applicant and required agencies in accordance with the provisions of the Planning Act.
ATIONS:
It is recommended to Council that:
1. Report PO 2004-65 be received and adopted;
2. That Council approve the extension to the draft plan approval for Laurel View Homes Inc. and Horseshoe
Valley Lands Ltd. Concession 4, Part of Lots 3 and 4 (Oro), File 43-0M-20001 for a period of one year;
and
3. That the applicants be advised of Council's decision.

Subsection 51(37) of the Plannint! Act
Extension of Approval and Amended Conditions of Draft Plan of Subdivision to the application in respect of the subject
lands noted above, is proposed to be given by the Township of Oro-Medonte. A copy of the decision is attached.
When and How to File an Appeal
Notice to appeal the decision to the Ontario Municipal
Board must be filed with the Township of Oro-Medonte
no later than 20 dates from the date of this notice as
shown above as the last date of appeal.
The notice of appeal should be sent to the attention of the
Senior Planner, at the address shown below and it must,
(1) set out the reasons for the appeal, and
(2) be accompanied by the fee prescribed under the
Ontario Municipal Board Act in the amount of
$125.00, payable by certified cheque to the Minister
of Finance, Province of Ontario.
Who Can File an Appeal
Only individuals, corporations or public bodies may
appeal the decision of the Township of Oro-Medonte to
the Ontario Municipal Board. An appeal may not be filed
by an unincorporated association or group. However, a
notice of appeal may be filed in the name of an individual
who is a member of the association or group.
Right of Applicant or Public Body to Appeal
Conditions
The applicant or any public body may, at any time before
the final plan of subdivision is approved, appeal any of
the conditions imposed by the Township of Oro-Medonte
to the Ontario Municipal Board by filing with the
Township, a notice of appeal.
How to receive Notice of Changed Conditions
The conditions of an approval of draft plan of subdivision
may be changed at any time before the final approval is
given.
You will be entitled to receive notice of an changes to the
conditions of approval of draft plan of subdivision if you
have either,
(1) made a written request to be notified ofthe decision
to give or refuse to give approval of draft plan of
subdivision, or
(2) make a written request to be notified of changes to
the conditions of approval of the draft plan of
subdivision.

The Township's conditions and amendments to final plaD approval for registration of this
subdivision are as follows:

1 . That this draft plan approval applies to the draft plan 43-0M-20001 prepared by Shawn P.
Watters & Associates, P.K. Menzies Planning and Development, The LaDdplaD Collaborative
Ltd., and Dino R.S. Astri, dated June 30 2000, showing 595 lots aDd 32 blocks on Part of North
Half and South Half of Lot 3 and Part of Lot 4, Concession 4 in the former Township of Oro
(now Township of Oro-Medonte) and amended by the draft M-plan prepared by Dino Astri for
Phase 1 dated JaDuary 15,02.
2. That the road allowaDces included within this draft plan of subdivision shall be dedicated as a
public highway without monetary consideration and free of all encumbraDces.
3. That the 0.3 metre reserves included within this draft plan of subdivision shall be conveyed to
the Township of Oro-Medonte without monetary consideration aDd free of all encumbrances.
4. That the road allowances within this draft plan of subdivision shall be named to the satisfaction
of the Township of Oro- Medonte.
5. That prior to final approval the appropriate zoning shall be in effect for this subdivision, in
accordaDce with the provisions of the Planning Act.
6. That the owner shall enter into a subdivision agreement with the Township of Oro-Medonte,
agreeing to satisfy all conditions, financial and otherwise, of the Township of Oro-Medonte.
7. That the subdivision agreement between the owner and the Township contain phasing
arrangements to the satisfaction of the Township.
8. That such easements as may be required for utility or drainage purposes shall be graDted to the
appropriate authority.
9. That the owner agrees in the Subdivision Agreement to contribute financially towards the
preparation of a 3D modeVmonitoring program for the Coldwater River watershed.
10. That prior to final approval, an amended Certificate of Approval from the Ministry of
Environment be obtained with respect to ownership and operation of the waste treatment facility.
That the owner is required to advise all prospective purchasers that the waste treatment facility is
privately owned aDd operated and not under the control of the Township.
11. That prior to final approval, aD amended Certificate of Approval from the Ministry of
Environment be obtained with respect to ownership aDd operation of the storm water facilities.

12. That prior to final approval, an amended Certificate of Approval from the Ministry of
Environment be obtained with respect to ownership and operation of the water works facilities.
13. That the Ministry of Environment receive a fully executed copy of the subdivision agreement to
ensure that conditions are being fulfilled.
14. That the owner enter into a Responsibility Agreement with the Township of Oro-Medonte and
the private operator (A WS) in regards to the ownership, financing, construction, operation,
maintenance, and repair of certain sewer and waste treatment facilities.
15. That prior to final approval, a plan or plans shall be prepared to the satisfaction of the Township
Engineer showing:
a) drainage control measures,
b) general lot grading including existing and proposed elevations,
c) building envelopes
d) erosion control measures
e) location and type of drinking water supply.
These approved planes) will form part of the Subdivision Agreement with the Township.
The consultant may be required to check the elevations of the building footings, prior to further
construction, to ensure conformity with the approved plans noted above.
The consultant may be required, prior to the issuance of a Final Inspection Report, to certify in
writing that the installed works have been carried out in accordance with the approved plans.
16. That the Subdivision Agreement shall contain a clause to the effect that any major works
required in the approved plans noted in Condition 14 will be carried out by the developer.
17. That prior to any site alteration, the following shall be prepared to the satisfaction of the
Nottawasaga Valley Conservation Authority and the Township of Oro-Medonte:
A detailed Storm Water Management Report;
An Erosion Control Plan; and,
A detailed Grading Plan.
18. That the owner shall agree in the Subdivision Agreement, in wording acceptable to the
Nottawasaga Valley Conservation Authority, to carry out or cause to be carried out the
recommendations and measures contained within the plans and reports set out above.
19. That the owner shall agree in the Subdivision Agreement, in wording acceptable to the
Nottawasaga Valley Conservation Authority, to ensure that all storm water management facilities
and sediment and erosion control measures will be in place prior to any site alteration.

20. That the owner shall agree in the Subdivision Agreement to engage a qualified
professional to certify in writing that the works were constructed in accordance with
the plans, reports and specifications, as approved by the conservation authority.
21. That the owner shall agree in the Subdivision Agreement, in wording acceptable to the
Nottawasaga Valley Conservation Authority, to maintain the storm water management facilities
(ponds) and their function, in accordance with the approved storm water management report.
22. That the Subdivision Agreement contain the following clause to the satisfaction of
the Simcoe Muskoka Catholic District School Board:
"The owner shall include in all offers of purchase and sale a clause advising prospective
purchasers that pupils from this development attending educational facilities operated by the
Simcoe Muskoka Catholic District School Board may, be transported to/accommodated in
temporary facilities out of the neighbourhood school's area. "
23. That the Subdivision Agreement contain the following clause to the satisfaction of the Simcoe
County District School Board:
" Purchasers, renters, lessees are warned that there are no schools planned within this subdivision,
or within walking distance of it and that pupils may be accommodated in temporary facilities and or
be directed to facilities outside of the area. "
24. That prior to final approval a Traffic Impact Study be submitted to the County
Engineer for approval. Completion of the study may require the applicant to enter
into agreements with the County for road Improvements, including implementation,
intersection design, and signalization. Any road improvements that are attributable
and benefiting the proposed development( s) would be the financial responsibility of
the proponent.
24. That prior to the final approval of this plan, the Township is advised in writing by the Simcoe
County District School Board how condition 23 has been satisfied.
25. That prior to the final approval of this plan, the Township is advised in writing by the Simcoe
Muskoka Catholic Separate School Board how condition 22 has been satisfied.
26. That prior to the final approval of this plan, the Township is advised in writing by the
Nottawasaga Valley Conservation Authority how conditions 17 through 21 have been satisfied.
27. That prior to the final approval of this plan, the Township is advised in writing by
the County of Simcoe how condition 24 has been satisfied.

NOTES TO DRAFT APPROVAL
1 . It is the applicant's responsibility to fulfil the conditions of Council's approval and to ensure that
the required clearance letters are forwarded by the appropriate agencies to the Township of Oro-
Medonte, Planning Department, Administration Centre, 148 Line 7 South, Box 100, Oro, ON
, LOL 2XO, quoting Township file number 43-0M-2oo01.
2. The Land Titles Act requires all new plans be registered in a Land Titles system if the land is
situated in a land titles division and there are certain exceptions.
3. The Township of Oro-Medonte uses a 0.3 metre reserve to notify the public that access to the
Municipal highway will not be granted across the reserve. It should be shown as a block on the
final plan outside the road allowance. Deeds in triplicate conveying this reserve to the
Corporation of the Township of Oro-Medonte together with the proposed final plan should be
sent to the Municipal Clerk.
4. Inauguration, or extension of a piped water supply, a sewage system, or a storm drainage system,
is subject to the approval of the Ministry of Environment under sections 23 and 24 of the Ontario
Water Resources Act, R.S.O. 1980.
5. Hydro One wishes to advise the developer of the following:
(a) the costs of any relocations or revisions to Hydro One facilities which are necessary to
accommodate this subdivision will be borne by the developer
(b) any easement rights of Hydro One are to be respected
(c) the developer should contact the local Hydro One Area Office to verify if any low
voltage distribution lines may be affected by the proposal
6. The final plan approved by the Township must be registered within 30 days or the
Township may withdraw the approval under Section 51(59) of the Planning
Act, R.S.O. 1990
7. All measurements in the subdivision final plan must be presented in metric units.

If the agency conditions concern conditions in the subdivision agreement, a copy of the relevant section
of the agreement should be sent to them. This will expedite clearance of the final plan.
9. If final approval is not given to this plan within one year of the draft approval date, and no
extension has been granted, draft approval shall lapse under subsection 51(32) of the
Planning Act, R.S.O. 1990, as amended. If the owner wishes to request an extension to
draft approval. a written explanation, must be received by the Township of Oro-Medonte
sixty (60) days prior to the lapsing date.
Please note that an updated review of the plan, and revisions to the conditions of approval,
may be necessary if an extension is to be granted.
10. When the Zoning By-law is being prepared, reference to this subdivision application OM-file
number should be included in the explanatory note. This will expedite the Township's and other
agencies' consideration of the by-law.
Subject to the conditions set forth above, this Draft Plan is approved under Section 51 of the
Planning Act RS.O. 1990, Chapter 13, as amended.

Dear Ms Leigh,
The purpose of this letter is two fold:
1. to request an extension to the Draft Plan associated with the above noted property which
expires on March 17th, 2005 and,
2. to request a red-line revision for Phase 2W of the plan.
The first request is being made in order to pennit the Owner's to continue to satisfY their
conditions of Draft Plan Approval and continue to market and seH the lots in the plan; additional
time is required in order to undertake these matters.
The red-line revision is proposed to provide for lots with a larger lot frontage on the lots within
the phase. If granted, this red-line revision will result in the foHowing within the phase:
. a reduction in the number of lots in the phase from 69.5 to 56
. an increase in the typical lot frontage from 15 metres to between 18 and 23 metres
. and a change in the average lot frontage from 15 metres to approximately 20 metres
The boundaries of the subdivision will not change nor will the approved block locations. The
extension of Tanglewood Crescent from Oakmount Avenue to Landscape Drive has been closed
as-the road connection was deemed superfluous. It is understood that this was presented at the last
red-line request for the plan.
