IBACKGROUND: MW
The purpose of this report is to consider the proposed Zoning By-law Amendment application
submitted by Laurel View Homes Inc. and Horseshoe Valley Lands Ltd. The subject lands are
located in the Horseshoe Valley Low Density Residential Area in the Horseshoe Development
Node as designated by the Township's Official Plan. The property is currently zoned
Residential One Exception (111*140) in the Township's Zoning By-law 97-95, as amended.
The subject properties are located in Concession 4, Part of Lots 3 and 4, and Plan M-741, Lots
1-66 (Oro) and are located on the east side of Line 3 North and south of Highland Drive. The
property subject to the rezoning is a total of approximately 96 acres and includes Phase 1 of the
Laurel View subdivision registered as Plan M-741 and the remaining lands which have draft
plan approval owned by both Laurel View Homes Inc. and Horseshoe Valley Lands Ltd.

The applicant's have applied for a Zoning By -law Amendment to amend the current Residential
One Exception (R1 *140) zone to permit a revised rear yard setback specifically for decks with a
4.5 metre requirement for lots that back onto the golf course /recreational trails and a 5.0 metres
requirement for lots that back onto other residential lots.
ANALYSIS:
In September 2004 a report was presented to the Planning Advisory Committee, which
assessed the application and recommended the application proceed to the required Public
Meeting in accordance with the Planning Act.
A public meeting was held on October 18, 2004 at which time 2 written and 8 verbal comments
were_ceceived._ The two_written comments were received from the School Board and the
C ounty of Sim
comments received two raised concerns regarding safety with the reduced setback and six
were supportive of the reduced setback.
The subject property is designated Horseshoe Valley Low Density Residential in the Township's
Official Plan. The objectives of these policies are to promote the consolidation of residential
development in existing development nodes and to ensure that all new development is sensitive
to the natural heritage system and rural character of the area. Permitted uses within this
designation include an Adult Lifestyle Community which would include low density residential
and golf courses. The proposed amendment would provide setbacks for decks accessory to
the single detached dwelling that are contemplated by the Official Plan and as such the
proposal would not offend the policies of the Official Plan.
The application proposed two additional exceptions to the current Exception 140. The first
would allow for a required rear yard setback for a deck of 5.0 metres for lots which do not back
onto either the golf course or recreational trail but would back onto other lots within this
subdivision. This would apply to 283 of the lots representing 50.2% of the plan. As these lots
only back onto other lots within the same subdivision and this area is already recognized as
being a unique residential community with full services and smaller lot sizes; the proposed
reduction is considered appropriate.
The second would allow for a required rear yard setback of 4.5 metres for lots which back onto
either the golf course or recreational trail. This would apply to 280 of the lots representing
49.8% of the plan. Of these, 236 of the lots would back onto the golf course and 44 would back
onto the recreational trails.
It was previously indicated that a potential safety concern to the individual land owners might
exist by permitting decks to be built closer to the golf course. The applicant was requested to
provide additional technical information that would indicate the probable range of play did not
include the rear yard of the residential lots. The applicant's architect has provided written
confirmation that all the residential lots, except Lots 1 -4 in proposed Phase 2, are located
outside of the probable range of play. With respect to Lots 1 -4 it is recommended that these
lots be zoned with a Holding Provision that is not removed until such time as the
recommendation in the Spray Analysis Report dated November 12, 2004 by Shawn P Wafters
& Associates, which includes the planting of 11 screening evergreens, is completed.

While this report from the applicant provided the technical basis to proceed with the zoning by-
law amendment, the question was also previously raised at the September meeting regarding
Township liability in permitting the amendment to be approved. This matter was reviewed by
the Township Solicitor who has indicated that there is no liability matter by permitting the Zoning
By-law Amendment and that the municipality has been diligent in the requirement of the
technical work completed by the applicant.
A copy of the proposed by-law is attached to this report. The map schedule in only required for
the identification of the lots subject to the Holding Provision, as Exception 140 already exists on
Schedule A15 of Zoning By-law 97-95. If the attached Zoning By-law Amendment is considered
favorably it Would permit the construction of a deck at the rear of a single detached dwelling.
The proposed Zoning By-law Amendment would conform with the intent and policies of the Oro-
Medonte Official Plan and the County of Simcoe Official Plan. On this basis, it is recommended

RECOMMENDATION
1 THAT this report be received and adopted; and
2. That the Planning Advisory Committee recommend to Council that Zoning By-law
Amendment for Laurel View Homes Inc. and Horseshoe Valley
Lands Ltd., Concession 4, Part of Lots 3 and 4, and Plan M-741, Lots 1-66 (Oro),
that permits reduced rear yard setbacks for decks be adopted.

THE CORPORATION OF THE MUNICIPALITY OF ORO- MEDONTE
BY -LAW NO. 2004-
Being a By -law to amend the zoning on lands within Concession 4, Part of
Lots 3 & 4, and Plan M -741, Lots 1 -66 (Oro) now in the Township of Oro -
Medonte (Laurel View Homes Inc, and Horseshoe Valley Lands Ltd. — Roll #
43 -46- 010- 002 - 15900 -0000 and 43 -46- 010- 002 - 15901- 0000).
WHEREAS the Council of the Corporation of the Township of Oro - Medonte is empowered to pass
By -laws to regulate the use of land pursuant to Section 34 of the Planning Act, R.S.O. 1990,
c.P.13.
AND WHEREAS Council deems it appropriate to re -zone the lands to permit the development of
decks s ssociated with the residential uses, in accordance with Section E2.5 of the Official Plan
AND WHEREAS Council deems it appropriate to place the subject land in a zone with yard
requirements that are better suited for the subject lots;
NOW THEREFORE the Council of the Corporation of the Township of Oro - Medonte enacts as
follows:
Section 7.140 Exceptions of By -law 97 -95, as amended, is hereby further amended by
adding a new subsection "k" to the "Regulations for single detached dwellings" after
subsection "j" as follows:
"Minimum required rear yard for a deck is:
(a) for those lots abutting a golf course or recreational trail 4.5 metres
(b) for all other lots 5.0 metres"
2. That the Holding Provision applying to the lands not be removed until the
recommendations contained in the Shawn P. Walters & Associates Spray Analysis
Report dated November 12, 2004 are completed to Council's satisfaction. The Holding
Provision as shown on Schedule 'A -1' attached hereto and forming part of this By -law.
3. This By -law shall come into effect upon the date of passage hereof, subject to the
provisions of the Planning Act, as amended.
