The intent of this application is to recognize a single detached dwelling that was constructed on the subject property. The application applies to lands legally described as Concession 8, East Part of Lots 12 and 13, RP 51 R- 14221, Parts 1 and 2, and RP 51 R- 31772, Part 1 (Medonte) now in the Township of Oro - Medonte. The intent of the proposed Zoning By -law Amendment is to rezone a portion of the subject lands from the Environmental Protection (EP) Zone to the Agricultural /Rural (A/RU) Zone. ANALYSIS: In September 2004 a report was presented to the Planning Advisory Committee, which assessed the application. If the attached Zoning By -law Amendment is considered favorably it would permit the use G(�, -Z As noted in the September report a Build Permit application for a Change of Use is still required to be submitted by the applicant. The engineer's assessment that was required to supplement this application has been received and reviewed. The proposed Zoning By -law Amendment has been circulated to staff and the appropriate agencies and no comments have been received that do not support the proposed Zoning By -law Amendment. The proposed Zoning By -law Amendment would conform with the intent and policies of the Oro - Medonte Official Plan and the County of Simcoe Official Plan. On this basis, it is recommended that the attached Zoning By -law Amendment be given favorable consideration by the Committee and recommended for adoption by Council 1. This property is designated Rural and Agricultural as well as Greenlands and is subjecf, & the Rural and Greenlands policies of the Simcoe County Official Plan. County planning have no objection to this application in principle, however, it should be recognized that a portion of the subject lands are designated Greenlands and the entire property has been mapped as deer wintering by the Ministry of Natural ,Resources. As such, according to Sections 3.3.5 and 3.7.5 of the County Official Plan, any, development and site alteration on the subject lands is subject to an EIS which can demonstrate that there will be no negative impact on the natural features and ecological functions for which the property is identified. According to the Simcoe County Official Plan, development means the creation of a new lot, a change in land use, or the construction of buildings and structures, but does not include activities that create or maintain infrastructure. Site alteration means activities, such as fill, grading and excavation that would change the landform and natural vegetative characteristics of the site. In accordance with Section 4.11 of the County of Simcoe Official Plan, this application is also subject to all other applicable Provincial, County and Local planning policies and by -laws. File No. Date: D14 012140 BACKGROUND: The purpose of this report is to assess an application submitted by Markus and Sonja Schneider. The subject property is located in Concession 7, East Part of Lot 1 and is located at the south east corner of the intersection of the Horseshoe Valley Road and Line 7 North in Coulson. The applicant's property is a total of approximately 11.56 acres with approximately 2.0 acres being proposed to be re -zoned as part of this application. The intent of the application is to rezone a portion of the subject property to permit outdoor storage, restoration of motor vehicles, and the sale of former government military equipment and related parts. The proposed rezoning would rezone the lands from the Agricultural /Rural (A/RU) Zone to a Site Specific Zone to permit the intended use. A portion of the property is zoned Environmental Protection (EP) along the western boundary (part of the West Coulson Swamp Complex) which would not be rezoned through this process. This report will assess the application and provide a recommendation to the Planning Advisory Committee on how to proceed with the application. A copy of the survey that identifies the location of all structures and the area subject to the re- zoning submitted by the applicant is attached for the Committee's reference. 66 -z ANALYSIS: Conformity with Oro - Medonte Official Plan This section of the report is intended to assess the policies of the Official Plan as they apply to this proposal. The subject property is designated Rural and Environmental Protection One in the Township's Official Plan. The Environmental Protection One designation is contained within the rear of the property and identifies the area as a portion of the West Coulson Swamp - Class 3 wetland area. This area of the property cannot be utilized for any form of development and is not the area subject to the application before the Committee. Section D3A indicates the objectives of the Rural designation are: - to preserve and promote the rural character of the Township and the maintenance of the open countryside - to prevent the intrusion of land uses which are incompatible with the rural character and /or resource activities of the area Permitted uses in this designation include single detached dwellings, home occupations, and home industries. A range of small -scale industrial uses such as salvaging, recycling and storage of goods and raw materials are also permitted. The proposed use is compatible with the existing rural character of the area and the existing environmental area on the neighbouring property to the west would be maintained as this is not the area subject to the re- zoning. Specifically any application for rezoning for a commercial/industrial use is subject to the policies contained in Section D3.3.2. The development policies indicate that new uses may be subject to site plan control. In order to maintain land use compatibility and protect the rural character of this area, the site plan control process would be appropriate for the subject property given the type of use proposed which is intended to include outdoor storage. The policies of Section D3.3.2 indicate that Council shall be satisfied that the proposed use: a) is compatible with the rural character of the area; The proposed rezoning would permit an outdoor storage and repair and sales business to be located on the lands that also contain the applicant's residence. The applicant needs to identify on their sketch the location of the outdoor storage and also clarify the business that will be contained within the existing or proposed buildings on the property. It should be confirmed the specific type of restoration that would occur on the vehicles and whether there would be paint spraying of the vehicle. b) can be designed and sited to blend in with the rural surroundings; The subject property is located at the intersection of the Horseshoe Valley Road and Line 7 North. Land uses within this vicinity include a retail convenience store, residential and agricultural uses. The property abuts a County road and Township road on two sides of the property. As discussed above the application would be subject to site plan approval to ensure that the use blends in with the surrounding uses and to ensure the outdoor storage is minimized. C) is located where it would have little or no impact on agricultural operations; 0 CDC _�' The agricultural operations within this area would be located on the north side of the Horseshoe Valley Road and would not appear to be impacted by the proposed use. )-- - - -ce-m be- serviced- with-- an- appty- opriate water supply- and - means -o# - sewage - -- - - - - -- - -- disposal; The property is currently serviced by an individual well and septic system for the existing dwelling. The Committee should determine if the applicant requires water and sanitary facilities in the accessory building and if so how these will be provided. e) is to be accessed by municipal roads that can accommodate the increased traffic generated by the proposed use; The access into the subject property is located on Line 7 North and the Township Roads Department has indicated that they have no concerns with the application. f) will not cause a traffic hazard as a result of its location on a curve or a hill; and, As stated above, there is an existing entrance and no roads department concerns have been raised in regard to the proposed rezoning. g) can be appropriately buffered from adjacent residential uses. Subsection (b) above indicates that there are already a variety of land use activities including residential uses located in the vicinity of the subject property. The site plan control process is intended to ensure appropriate buffering for these existing residential uses. In addition, prior to considering an application to develop a new industrial, institutional or commercial use, Council shall be satisfied that the proposed use cannot be reasonably sited in a nearby settlement area or on lands in the vicinity that are designated Industrial or Commercial. Although the subject property is located in Coulson this is not identified in the Official Plan as a settlement area. The nearest settlement areas would be Horseshoe Valley and Sugarbush and no lands are currently available or appropriate for the intended use. There are also no lands designated Commercial or Industrial in the vicinity of this property. Conformitv with Countv of Simcoe Official Plan The subject property is designated Rural and Agricultural and Greenlands in the County of Simcoe Official Plan. The objective of the Rural and Agricultural designation is to provide for rural uses such a resource activity, recreation and residential while protecting the rural character and the viability of existing agricultural operations. The purpose of the Greenland designation is to ensure that the scale, form, and location of development is such that the features and functions of the natural heritage system are sustained for the future. Permitted uses within the Rural and Agricultural designation include highway commercial, home occupations, and home industries. The proposed Zoning By -law Amendment would permit a highway commercial /home industry type usage of the property and would therefore conform to the policies of the County of Simcoe Official Plan. 6 i 4 Summary CJn the basis {f the analysis provided above, itiGmy opinion that the proposed amendment conforms to the-intent-and -polic-les-of4he-Ofe-Medonte-Offic�� the County of-Simcoe Official Plan an.
