RE: FORMER BUFFALO SPRINGS SUBDMSION AND GEORGIAN NORTH LAND
POTENTIAL ALTERNATIVE, OUR FILE Y327A
On October 13, 2004 I made a presentation to the Committee ofthe Whole and I have been
asked to formalize our verbal request in wr;; ihg.
In 1994 the Ontario Municipal Board granted draft plan approval for a 230 lot residential plan
of subdivision on the "Buffalo Springs" property located in Part lots 2 and 3 Concession 9
(Oro) in the Township of Oro- Medonte.
In 2003, Georgian North Land Ltd. (Georgian) acquired the Buffalo Springs property. Prior
to and following acquisition of the lands, Georgian entered into discussions with
representatives of the Township with the objective of advancing an alternate development
scenario which represented approximately 50% of the original approved residential density.
Formal applications were submitted to the Township and the OMB in early 2004 requesting
the necessary changes to the Zoning By-Law and draft plan of subdivision accordingly.
In bringing forward its applications, Georgian had its consultants prepare updates to the
following reports: servicing, hydrogeology, natural environment, traffic and planning.
Notwithstanding the proposed reduction in density and preparation of revised reports,
Georgian's applications were met with substantial opposition from neighbours and requests
by the Township for extensive additional ecological analysis notwithstanding the fact that the
OMB had approved development of 230 residential lots.
Based on the reaction to its revised development proposal, Georgian then proceeded to do the
following:
1. initiated the process to satisfy the OMB conditions of draft plan approval for the
original 230 lot subdivision; and
2. reviewed its options in terms of alternate development scenarios.
On March 7, 2004 we attended a Planning Advisory Committee meeting and made a
presentation in response to a planning report prepared by Meridian. At that time, Georgian
was encouraged to consider a further development alternative whereby the residential lots
proposed for the west half of the property were shifted to the east half in order to minimize
the number of proposed lots in proximity to the westerly wetlands.
Since that time, Georgian has optioned the Johnston property which is located to the north of
the east portion of the Buffalo Springs property. Georgian has undertaken a design exercise to
investigate whether the suggestion made at the March Committee meeting could be
accommodated. It is this "Johnston Alternative" which was subject of our presentation to
Committee on Oct. 13.
I am attaching the series of handouts which were presented to Committee on Oct. 13:
1. the OMB approved 230 lot subdivision;
2. the "Johnston Alternative" which is labeled as "Concept Plan, Option 3" which illustrates creation of 225
residential lots;
3. a "Comparison Plan" where the OMB approved lots intended to be altered or eliminated are illustrated in red; and
4. a chart comparing key criteria of the OMB approved subdivision and the Johnston Alternative.
Pursuing the Johnston Alternative will require a County of Simcoe Official Plan Amendment and quite likely, some
substantial technical studies. For this reason, Georgian is reluctant to explore this alternative without some indication
from Oro-Medonte that this is an alternative that can be supported in principle subject to meeting the normal
requirements of an application of this nature.
Therefore, the request we made verbally on Oct. 13 which we repeat in writing in this correspondence is that Council
approve the Johnston Alternative in principle subject to completion of technical studies necessary to demonstrate that the
Johnston Alternative is appropriate from a planning point of view.
Provided Georgian obtains approval in principle from Council, it is prepared to make the investment necessary to bring
forward revised applications to implement the Johnston Alternative.
We also wish to advise Council that it is Georgian's intent to proceed with registration ofthe easterly phase of the 0 MB
approved plan of subdivision. Georgian is prepared to put on hold the registration of the westerly lots pending Council's
consideration of formal applications relating to the Johnston Alternative.
As a matter of interest, we met with several of the residents following our presentation to Committee and we were pleased
with the positive reaction received to the Johnston Alternative.

To the Mayor and Council,
I am writing to ask you to revisit the existing noise bylaw, and specifically to address the issues of noise levels to
include an unacceptable decibel level, increasing the scope of noise to include more than essentially dogs and
music/speaker systems, and finally to add some parameters which would limit noise to between the hours of 7:00
am and 11 :00 pm. Could you also consider including Sundays as "no noise" days as is done in some
municipalities as well?
As an example, the current bylaw would allow construction noise to continue all night if that was in the best
interests of the builder. Whereas this is probably not a common occurrence, it is just an example of the kinds of
things which can become frustrating to ratepayers when the bylaw is too specific. As well, the level of noise is
subject to the enforcer's opinion if no noise levels are indicated. The designating of times wherein some level of
noise is acceptable means that ratepayers can at least be assured of getting some sleep at night, not a luxury in
most people's opinions. I realise that some exemptions will have to exist for things such as the airport, highway
and agricultural equipment.

We need your municipality to join other Ontario municipalities who have already joined
PITCH-IN. Municipalities provide financial support to this popular community-based program to
ensure that it can continue. Municipal membership fees are based on your population (benefits and

The 2005 PITCH-IN Week campaign takes place April 18-24. In January all of your schools, your

Most Chapters of TD's Friends of the Environment Foundation in Ontario supported the 2004 PITCH-
IN Program. PITCH-IN is a grassroots environmental action program - the largest in Ontario and
Canada. It is operated on a province-wide basis, taking advantage of the economies of scale
associated with developing and purchasing materials and managing the program, with projects taking
place within, and involving volunteers in, every community in Ontario..
We Did....
PITCH-IN CANADA produced 14,000 free EcoActionPaks. They were sent to every school in
Ontario, all local governments, and thousands of community-based organizations. In partnership with
local governments, 816 local PITCH-IN Eco-Team Coordinators, the media and many others, we
supplied local groups with ideas, free hands-on materials and support to help them undertake
environmental projects in their community. We also recognized groups for their involvement.

1.299.329 volunteers participated in 2,528 projects in 261 communities, with support of 816 local
PITCH-IN CANADA Eco-Team Coordinators.

Participating groups are divided into three categories: school, youth and community-based. They include
schools, colleges, scouts, girl guides, chambers of commerce, naturalists, hiking clubs, old age pensioners,

Expansion of the PITCH-IN Program
The PITCH-IN Program evolves each year as PITCH-IN identifies areas where, and ways by which, volunteers
can make a contribution to enhancing the environment. In 2004 the program introduced two new components
which will be expanded in the years to come.
The ecoActive School Program
108 Ontario Schools applied to PITCH-IN CANADA to be certified as ecoActive Schools, signifying they are
participating in a year-round environmental improvement program. This new program was introduced in
February, 2004.
The National Cell Phone Collection Program
There are millions of discarded cell phones across Canada. Diverting them from the solid waste stream,
recycling their components or, where feasible, re-using them elsewhere is a major focus of this new PITCH-IN
CANADA Program.
123 Ontario organizations have already registered to collect phones since the program's inception in February,
2004. Participating groups, schools, municipalities and others will be removing cell phones from the waste
stream and they will receive $1 for every cell phone collected - funding which many of the participants are
using for other environmental enhancement programs in their community! It's a "win-win" program!

Potential Alternative to Layout of

CKGROUND:
On October 18th, 2004, Mr. Brent Clarkson of MHBC submitted a letter on behalf of Georgian North Lands Ltd.
(Georgian) requesting that the Township give some consideration to a revised development concept on the
subject lands. The October 18th, 2004 letter is also on the Committee of the Whole agenda for receipt.
As Council will recall, the Ontario Municipal Board (OMB) approved the designation and zoning of the subject
lands and draft approved a plan of subdivision that would provide for the development of 230 lots in 1994. In
2003, Georgian purchased the property and in January 2004, an application was submitted to permit the
development of a 117 lot residential plan of subdivision instead. The 117 lots were proposed to replace the
230 lots on lands that were draft approved for development.
In September 2004, Council resolved to ask the County of Simcoe to not make a decision with respect to the
designation and policies applying to the Georgian property in OPA #16. This decision was made since the
proponent indicated in correspondence that Council had in some way reaffirmed the designation of the
property and the suitability of the property for development as part of the OP A #16 process. However, as the
intent of OPA #16 was to develop a comprehensive land use plan for the Oro Moraine that would provide the
basis for considering future development applications, existing development approvals were not reviewed.
In order to deal with concerns about the continued suitability of developing the western portion of the Georgian
property, Georgian has 'optioned' the Johnston property, which is located to the north of the east portion of the
subject property. In their submission, MHBC has included a plan that shows a number of lots being created
on the Johnston property instead of on the western portion of the Georgian property.
Their intent is to transfer the density from the more environmentally sensitive portion of the Georgian property
to the Johnston property, which is not the site of any significant natural heritage features. Approximately 70
lots are proposed to be eliminated from the Georgian property. The 18 lots that were to be accessed by a new
public road from the 8th Line in the northwest corner of the Georgian property is also proposed to be reduced
to 8 lots that are accessed directly from the 8th Line. An additional 71 lots are proposed to be sited on the
Johnston property. The total number of lots that would be created if this option was approved is 225, which is
5 less than what was approved by the OMB in 1994.
NAL YSIS:
In the October 18th, 2004 submission, MHBC requests that "Council approve the Johnston alternative in
principal subject to completion of technical studies necessary to demonstrate that the Johnston alternative is
appropriate from a planning point of view." It is further indicated in the submission that "provided Georgian
obtains approval in principal from Council, it is prepared to make the investment necessary to bring forward
revised applications to implement the Johnston alternative."
It has not been Council's practice to approve a development in principal, prior to receiving and considering the
technical information required to support any application. As a result, it is my opinion that Council should not
approve anything in principal at this point in time. However, Council could formally indicate its willinqness to
consider the Johnston alternative in order to limit the potential impacts of the development on the natural
heritage system and on the Oro Moraine.
It is my opinion that there is some merit in considering the Johnston alternative, particularly because the
alternative will result in no development occurring within the most sensitive portions of the Georgian property.
In addition, the concept of transferring development rights from a property or a portion of a property that is the
site of significant natural heritage features to another area is not new. For example, the Provincial government
recently allowed for the transfer of development rights from portions of the Oak Ridges Moraine in Richmond
Hill to lands owned by the Provincial government in the Town of Pickering (Seaton).
An application to amend the Oro-Medonte Official Plan and Zoning By-law will be required to facilitate the
Johnston alternative. The applicant would be required to submit all technical studies to support the Johnson
alternative for review and consideration by the Township as part of the application process. It should be noted
that the policies of the Official Plan currently do not permit the expansion of any of the development nodes
along the Horseshoe Valley Road corridor unless an Official Plan Review is carried out and it is determined
that there is proper justification for such an expansion. In this case, while an expansion is proposed, there is
also a reduction proposed in the amount of development within the development node. It is my opinion that the
principle of considering such an expansion on this basis can be considered, provided the total number of lots
originally approved is not increased.
It should be noted that the proposed amendments to the Planning Act in Bill 26 may have an impact on the
consideration of the application to expand the Buffalo Springs development node. These provisions, as
currently written (second reading), indicate that a refusal by an approval authority to permit the expansion of
an area of settlement cannot be appealed to the Ontario Municipal Board. While this definition may be
reworded prior to the third reading of the Bill, the definition appears to be a 'catch-all' for any developed area
and includes urban areas, urban policy areas, towns, villages, hamlets, rural clusters, rural settlement areas,
urban systems, rural service centres and future urban use areas.
Notwithstanding the draft provisions of Bill 26, it continues to be my opinion that there is merit in considering
the Johnston alternative.

RECOMMENDATION S:
On the basis of the above, it is recommended that:
. Report PO 2004-61 be received and adopted; and,
. That Council indicate their willingness to consider an application to develop additional lots on the
Johnston property in accordance with correspondence from MHBC Planning dated October 18, 2004.

The purpose of this report is to consider the proposed Zoning By-law Amendment
application submitted by Selri Investments. The subject lands are located in the Rural
Settlement Area of Shanty Bay as designated by the Township's Official Plan. The
property is not currently zoned and this is the basis for the application currently before
the Township to allow for residential use of the subject lands.
The subject property is located in Concession 3, Part of Lot 27 and is located on the
east side of Line 2 South at the northern boundary of the settlement area and directly
south of the existing Township Rail Trail. The property subject to the rezoning is a total
of 0.49 acres size with a lot frontage of 66 feet. The applicant's have applied for a
Zoning By-law Amendment to establish a zone on the subject lands which were
previously owned by the CN Railway and to permit a lot frontage of 20 metres (66 feet)
and not the required 30 metres (98.4 feet).
The intent of the proposed Zoning By-law Amendment is to zone the subject lands in a
Residential Exception (R1*159(H)) Holding Provision Zone. The exception would
recognize the existing lot frontage on the subject property at the 20 metres (66 feet).
The Holding Provision would not be removed from the property until such time as the
landowner entered into a Site Plan Agreement with Council to ensure the appropriate
location of the dwelling and to ensure the appropriate buffering between the Rail Trail
and the subject property.
In September 2004 a report was presented to the Planning Advisory Committee, which
assessed the application and recommended the application proceed to the required
Public Meeting in accordance with the Planning Act. If the attached Zoning By-law
Amendment is considered favorably it would permit the use of the property for
residential use and would permit the construction of a single detached dwelling.
The subject property is designated Rural Settlement Area in the Township's Official
Plan. The objectives of these policies are to maintain attractive communities with
suitable amenities and to ensure that settlement areas are developed in a logical and
cost effective manner. Permitted uses within this designation include low density
residential uses as proposed by this application. The subject property is an existing lot
of record and was sold by the CN Railway privately to create this parcel and in
accordance with the Planning Act did not require the approval of the Committee of
Adjustment.
The Township has required in other areas along the Rail Trail that the applicant provide
the required buffering to the Township Rail Trail and have required fencing inside the
landowner's property line. In order to ensure the appropriate location of the dwelling,
appropriate buffering between the proposed dwelling and the existing Rail Trail, and to
ensure the proposed dwelling maintains the character of this residential area it is
recommended that the property be subject to the provisions of Site Plan Control and
that the property will be subject to a Holding Provision as part of the Zoning By-law to
ensure the approval of a Site Plan Agreement with the Township prior to the issuance
of a building permit.
A copy of the proposed by-law is attached to this report.
A public meeting was held on October 18, 2004 at which time 12 written and 4 verbal
comments were received. Copies of all correspondence are attached for Council's
reference.
The proposed Zoning By-law Amendment would conform with the intent and policies of
the Oro-Medonte Official Plan and the County of Simcoe Official Plan. The imposition
of Site Plan Control will ensure that appropriate buffering occurs between the proposed
dwelling and the existing Rail Trail. On this basis, it is recommended that the attached
Zoning By-law Amendment be given favorable consideration by Council.

It is recommended to Council:
1. THAT Report PD2004-58 re: Selri Investments be received;
2. That the Zoning By-law Amendment for Selri Investments, that would rezone the
lands described as Concession 3, Part of Lot 27, RP 51 R-29332, Part 1 (Oro),
on Schedule A2 of Zoning By-law 97-95, as amended from an un-zoned property
to the Residential One Exception (R1 *159(H)) Holding Provision Zone be
adopted; and
3. That the Clerk bring forward the appropriate by-law for Council's consideration.

I am writing in regards to the proposed Zoning Bylaw Amendment PI 37/02,
concerning the rezoning of lands in the Village of Shanty Bay adjacent to the Rail Trail
and Concession 2.
My family has been resident in Shanty Bay for approximately 12 years. In that
time, the acquisition, retention and establishment of the CN rail line and Rail Trail is one
of the most farsighted acts ofthis Township that I can think of. My family has been
walking on the rail line since the caDcellation of rail service and the resurfacing of the
present trail. I continue to walk my dog past the subject property on a daily basis in all
seasons.
I understand that the subject property is without zoning of any type and is
currently vacant fallow land. For this reason the Township has a one-time chance to
enhance the positive work begun by the establishment of the trail.
This property is ideally suited to provide limited off-road parking as well as
providing education and commemoration of the history of the Township and the Village.
A small trail shelter, park benches, parking and cairn would to my mind be a far better
use of the land than the addition of another dwelling of questionable frontage on an
increasingly busy road.
Obviously, the current landowner is planning to develop and improve this property.
A suggestion made at the public meeting to compensate the landowner with an alternate
property owned by the Township seems to be a possible solution.
Whatever the Township's decision, I will continue to enjoy the Trail in it's present state
but will always consider how it could have been improved and the opportunity lost. . ..

My wife Kathleen, son Brendan and myselflive in the house behind the
property to be discussed at to-nights meeting,our pool is only fifteen feet
from the boundary line.
. We are concerned about what the township will do with the land should
they acquire it.
We understand one of the proposals is to turn it into some kind of parkland
area,if this is the case we feel there could be a problem with individuals
making it a place to hang out and possible vandalism as has been the case in
Barrie.
Apart from the original expenses involved in setting up and maintaining the
area there could be additional expenses in dealing with the effects of misuse
plus a possible problem with inappropriate behaviour,we have ATV's and
dirt bikes using the trail in spite of them being prohibited,my concern is we
may be creating new problems in the future.

The village is going to grow and the township as well- some of us give money to the rail trail each year and I
think the township could use this money to buy this property -as to the future as well as now the property would
be a definite asset to the township- Paul where is the vision in this township anyhow? what about your wind
power, the highspeed internet etc - the list goes on we need to become more progressive and not wait and do
things at the last moment - let us start looking to the future with more vision and definitive action, if not we are
going to see the township will die a quick death .You and your fellow council members need to become more
progressive or this will definitely happen. this is another wakeup call that should not be ignored by our council !_

I believe that the Old Gowan Station Property is an excellent place for a picnic area and a small parking lol The
picnic area could be a grassy area and contain a couple of picnic benches.
Now that Barrie is going to be one of the prime growth areas of Ontario, the township of Oro-Medonte should
concentrate on the following items:
. Preserve our rural heritage and green spaces.
. Put all new development into the designated Rural Settlement Areas.
. Give the Lake Simcoe Region Conservation Authority more funds.
. Get serious about removing the amount of phosphorous flowing into Lake Simcoe.
. Stop the UCCI development proposal between the 4 th.and 5 th.lines
The township should concentrate on improving the quality of life and not the quantity of building permits issued.
Let us not judge the success of Oro-Medonte by the number of building permits issued each year but by things
devoted to improving the quality of life, like, for example, improving the quality of the water in Lake Simcoe and
.obtaining the old Gowan Station property.

We agree the Twp. of Oro-Medonte should purchase the GowanStcltion site at Shanty Bay.
If the present owners are not allowed to build a house on this property the price should be adjusted accordingly.
The market value assessment could be used as a guideline.
The old Shanty Bay station should definitely be recognized at this site along with the Station masters who lived
there.
Also the village of Shanty Bay could be recognized here. The history committee could become involved in this
research.
Ideas for other uses could come later but the important thing right now is for the township to gain ownership of
this property.
We are interested and willing to help financially and with ideas.
Please keep us informed as to what is happening.

old gowan station property
You last e-mail asked for more input re: the Gowan Station Property. A tot lot is a wonderful idea since many
people alreC:cdy park their cars on the edge of the concession and then un load their bicycles, strollers, dogs
etc. A parking lot would certainly be safer, ever more so in the winter when the snow banks are high and it is
almost impossible to park safely on the side of the road. Isn't this what the rail trail is for??? I mean USING BY
PEOPLE? As for maintaining and displaying the heritage of our lovely Township, all the more power to youtll

We heartily endorse the move to have the Gowan Station property become a park. It will be a fitting location for
the Shanty Bay Area Fieldstone Fence project. Please take whatever action you deem appropriate to make this
happen.
Also, our road has benefitted from the recent grading and is much better to drive on. Thanks. Oiling the whole
thing would certainly be worth a try. How expensive is it to do tar covered with crushed stone compared to oil? It
is possible that once the construction phase of the development on the Bidwell Road is complete that the heavy
traffic will be reduced. The newest phase is roughed in, but I don't think the lots are on the market yet The
eventual residents of the last loop may use Line 1 as their access. I doubt they will use Line 2.

THE CORPORATION OF THE MUNICIPALITY OF ORO-MEDONTE
BY-LAW NO. 2004-
Being a By-law to change the zoning on lands within Concession 3, Part of
Lot 27, RP 51 R-29332, Part 1 (Oro) now in the Township of Oro-Medonte
(Selri Investments - Roll # 43-46-010-007-31350-0000).
WHEREAS the Council of the Corporation of the Township of Oro-Medonte is empowered to pass
By-laws to regulate the use of land pursuant to Section 34 of the Planning Act, R.S.O. 1990,
c.P.13.
AND WHEREAS Council deems it appropriate to re-zone the lands to permit the development of
residential uses, in accordance with Section 04 of the Official Plan
NOW THEREFORE the Council of the Corporation of the Township of Oro-Medonte enacts as
follows:
1. Schedule 'A2' to Zoning By-law No. 97-95 as amended, is hereby further amended by
changing the zone symbol applying to the lands located in Concession 3, Part of Lot 27,
RP 51 R-29332, Part 1, in the former geographic Township of Oro, now in the Township of
Oro-Medonte, from a non-zoning to the Residential One Exception One Hundred and
Fifty-nine (A/RU*159 (H)) Holding Provision Zone as shown on Schedule 'A-1' attached
hereto and forming part of this By-law.
2. Section 7.0 to Zoning By-law 97-95, as amended, is hereby further amended by adding
the following new section:
"7.159 *159 - Concession 3, Part of Lot 27, RP 51R-29332, Part 1 (Oro)
Notwithstanding any other provision in this By-law, the minimum lot frontage requirement
applying to the lands denoted by the Symbol *159 on Schedule A2 to this By-law is 20
metres (66 feet)."
3. The Holding Provision shall not be removed until such time as a Site Plan Agreement that
is satisfactory to Council has been entered into and registered on title.
4. This By-law shall come into effect upon the date of passage hereof, subject to the
provisions of the Planning Act, as amended.

BACKGROUND:
The purpose of this report is to consider the request received from residents of the
Bass Lake Estates subdivision (Hepinstall Place, Sunset Crescent, and Orsi Drive) to
close the access from Hepinstall Place to the Bass Lake Side Road East. Copies of all
correspondence received on this matter has been attached for reference purposes,
This residents' request has been prompted by the Planning public meeting held by the
City of Orillia which was to review the Official Plan Amendment, Zoning By-law
Amendment, and Plan of Subdivision applications for Stone Ridge Estates (43T-
03602).
LYSIS:
On September 20,2004 a special meeting of Council was held in the City of Orillia to
review the proposed Official Plan Amendment and Draft Plan of Subdivision for the
Stone Ridge Estates subdivision, Concession 2, Lots 6 & 7 and Part of Lot 8, At that
meeting Official Plan Amendment #4 was adopted by Council which included a re-
alignment of Street D to ensure that it was not offset from Hepinstall Place in the
Township of Oro-Medonte thereby alleviating any safety concerns with the offset. This
road was also re-aligned because of the identification of a woodlot located to the west
of proposed Street D that was to be designated Environmental Protection and required
preservation. The location of this woodlot area constrains the re-Iocation of Street D to
any alternate location. The principle of development of this subdivision was established
in the City of Orillia Official Plan in 1993. The purpose of Official Plan Amendment No.
4 was to introduce additional site specific policies to achieve the planned function of
these lands and to protect features of environmental significance contained within the
proposed community. The draft plan of subdivision with a list of conditions was also
approved by the City of Orillia Council at their September 20, 2004 meeting.
The Township of Oro-Medonte adopted Engineering Standards by By-law in 1997.
These standards were adopted to provide uniform consistency for review plan of
subdivision submissions. All plan of subdivision applications are required to conform
with the Engineering Standards. Section 3.3 (14) of these standards states that "a
minimum of two access/regress roads must be provided for residential developments".
This is intended to ensure that in the case a blockage at one of the access points to the
subdivision, access can continue to be provided to the residential development through
the second access. In the case of the Sass Lake Estates Subdivision, this would be
significant if Highway 12 became blocked and an emergency situation arose on
Hepinstall Place, Orsi Drive or Sunset Crescent. If the access from the Sass Lake Side
Road was not available emergency response could be delayed or impeded,
As can be seen from the Area Map of the Sass Lake Estates subdivision (attached)
there is no direct route through the Sass Lake Estates subdivision from the Bass Lake
Side Road to Highway 12. An individual would be required to meander through a
combination of Hepinstall Place, Orsi Drive and Sunset Crescent in order to gain
access to Highway 12. The more direct access points to Highway 12 would either be
the Harvie Settlement Road or Line 15 North. These would be safer access points to
Highway 12 as traffic signalization already exists at Line 15 North and is planned for the
Harvie Settlement Road.
It is recognized that Hawthorn Place and Old Scotia Place are single access roads to
residential developments in the vicinity of the Sass Lake Estates subdivision; however,
both of these subdivisions were approved by the former Township of Orillia prior to
amalgamation in 1994 and prior to the adoption of the Township of Oro-Medonte
Engineering Standards. As such they would essentially be "legal non-conforming",
meaning that they existed prior to the standards being adopted and do not comply with
the standards.
As indicated previously any new plan of subdivision application is required to comply
with the Engineering Standards. When considering alterations to an existing
subdivision, the subdivision is required to continue to comply with the Engineering
Standards. On this basis, any alteration to the second access into the Sass Lake
Estates subdivision either at Sunset Crescent or Hepinstall Place would not conform
with the Township's Engineering Standards, would not represent good planning, and
would not provide the most efficient method of providing emergency response to this
area,

On the basis of the above, it is recommended that Council not support the request to
close either Hepinstall Place or Sunset Crescent to through traffic.
II RECOMMENDATION (S):
It is recommended to Council:
1. THAT Report PD2004-62 re: Road Access from Stone Ridge Estates be
received and adopted; and
2. That Council not support the request to close Hepinstall Place to through traffic
at Bass Lake Side Road East nor to close Sunset Crescent at Highway 12 to
through traffic,

Dear Council Members:
The City of OriIlia has given its approval in pripciple to the Draft "Plan of
Subdivision which is shown on the schematic map attached herewith as Schedule 2.
While the map shows the proposed lots in the Stone Ridge Subdivision it does not show
the planned apartment buildings which will be included in the development.
We, the residents of what is known as Bass Lake Heights, a neighbourhood of
forty-four residences in Oro-Medonte, are faced with the prospect of a tremeDdous
increase in the traffic through our subdivision during and after the completion of this
subdivision.
At the City ofOrillia Council meeting on September 20th, city planners
acknowledged for the first time that it was intended that Street D, a major artery in the
new subdivision would intersect the Bass Lake Side Road directly opposite the present
entrance of He pins tall Place.
Motorists heading north, and either east or west, along Highway l2, ITom the new
subdivision along Street "D" will have three choices:
East along the Bass Lake Side Road to Fairgrounds Road and north to Highway
12;
West along the Bass Lake Side Road to the Bass Lake Road and north to
Highway 12;
North along Hepinstall Place to Orsi Drive and Sunset Crescent to Highway 12

City of Orillia Council did not entertain our request that Street "D" be diverted
further west to enter on the Harvie Settlement Road. However, when pressed City
Council made no comment as to the dosing of Hepinstall Place, which is the
jurisdiction of the Township of Oro-Medonte.
Working with our Councilor Ralph Hough we prepared and circulated a notice
and petition to all the resideDts of our subdivision which is attached hereto as Schedule 1.
As at October 19, 2004 the results of this petition are as follows:

26 were in favour ofthe Township ofOro-Medonte
requesting that the City of Orillia move the entrance

We think that it is fair to say that the residents do not hold out much hope for the
movement of Street "D" to the east.
We would submit that this is a strong indication as to how our neighbourhood
feels about the potential increase in traffic through our subdivision.

So why are we concerned?
1. When people are considering where they are going to live they take into
account their finances and the lifestyle they are looking for. The residents
of our subdivision found what they were looking for in Bass Lake Heights
and had the ability to pay for the residences for sale. or built what they
wanted and could afford, considering the cost of the lot.
2 What did they get? Large lots, neighbours with substantial houses, no
sidewalks, and very little traffic, because basically no one travels through
our subdivision at the present time. There is no need for sidewalks
because ofthe low volume of traffic. It is also safe to assume that when
the subdivision was constructed the roads were not designed and paved to
accommodate through traffic.
This assumption is not all that out of line because Hawthorne Place and
Old Scotia Place as shown on the map to the west of He pins tall Place
are ''No exit" roads. We have it on good authority that when the
subdivision was first planned Hepinstall Place was not designed to have
an entrance on the Bass Lake Side Road. Note the use of the word
"Place" .
So why are we askin2 the Township of Oro-Medonte to look after our
interests?
We are not asking the Township ofOro-Medonte to block the proposed
subdivision. That is within the jurisdiction of the City ofOrillia. We are asking
the Township to preserve what we thought that we had secured when we
purchased homes in our subdivision - a quiet neighbourhood with the feel of
a small community, little traffic, so that people felt :l:fee to walk the streets that
have no sidewalks, and the security that the value of our investment in our homes
would be protected.
We suspect that the City ofOrillia will show very little enthusiasm for the
movement of Street "D" to the east along the Bass Lake Side Road towards the
Harvie Settlement Road. They are anxious for the development and the
assessment. That development and assessment is going to take place
anyway. Therefore we ask that the Township of Oro-Medonte to close
Hepinstall Place to through traffic at the Bass Lake Side Road or Sunset Crescent
at Highway 12 .
We appreciate the opportunity to attend this Committee of the Whole
meeting and respectfully request Council's support.

Dear Neighbor:
Several of us attended the City ofOrillia Council meeting on September 20,2004.
At that meeting City Council gave approval to the Stone Ridge Subdivision, which is an
extension of the West Ridge Subdivision, south of the Bass Lake Side Road and west of
the southerly extension of Fairgrounds Road, known as the Harvie Settlement Road. This
development will be very positive for the City of OriIlia and the surrounding area.
Unfortunately, it may have negative repercussions for our subdivision with respect to
increased traffic flow.
What we learned was:
City planners acknowledged for the first time that Street "D", a major artery in the
new subdivision, would intersect the Bass Lake Side Road directly opposite the
entrance of He pins tall Place.
Motorists heading north, and either east or west, along Highway 12, from the new
subdivision along Street "D" will have three choices:

W est along the Bass Lake Side Road to Bass Lake Road and north to

(The same will naturally apply to motorists coming south to Street "D")
City Council was polite but declined to take notice of the risk of increased traffic
Fortunately, when pressed, OriIlia City Council declined to oppose a closing
of Hepinstall Place to through traffic, which is the jurisdiction of The
Township of Oro-Medonte.
Enclosed herewith is a schematic map showing our subdivision and the proposed
subdivision. The routes highlighted in yellow are the three routes outlined above.

We hqve met with Ralph Hough, our representative on the Oro-Medonte Council
and he has been most helpful. We understand that the Township ofOro-Medonte also
has traffic concerns. As well as our concerns, the Township is concerned about the
possibility of increased traffic along the Bass Lake Road, especially in the area close to
Highway 12.
Working with Ralph we have come up with the following plan of action:
We will circulate a petiti on to detenTIine the feelings of the residents of
our subdivision
Once we have that position detenl1ined we will arrange a meeting with the
Planning Committee of Oro-Medonte. All residents will be notified of the
time and place of the meeting. (Planning committee meetings are attended
by staff and members of Council and are less fOnTIal than a Council
meeting.
We are enclosing herewith a petition for your consideration. We would ask you
to indicate your preference and return it to either John Ayerst at 14 Hepinstall Place of

Dear Mayor Craig
As residents of the Bass Lake Heights Subdivision, my wife & I would like to express our deep
concern over the impact the proposed Stone Ridge Subdivision may have on our quahty of life. Like
the other residents in the area, we purchased our house with the understanding that our community
of some 34 houses would be free from the kind of vehicular traffic that nonnally besets typical
urbanized subdivisions.
It wowd seem, however, that "Street D" of the plan wowd intersect Bass Lake Side Road directly
opposite the entrance to HepinstalI Place. One implication ofthis plan is obvious: vehicular traffic
might well use Hepinstall Place as a short cut to every-busy Highway 12. Our sub-division never
had sidewalks constructed, simply because heavy "outside" traffic was never anticipated.
We are aware that Ralph Hough, our contact with the Oro-Medonte Council, is working with our
local representatives in an ongoing effort to remedy this potential problem. It is our wish that this
effort will yield satisfactory reswts.

It has been brought to my attention that Oro-Medonte has not signed off on the development of the West
Ridge Subdivision and would like to bring to CouncHs attention that the increased traffic flow through the
subdivision known as Bass Lake Heights would seriously jeopardize the quiet enjoyment of this
community.
At the City ofOriUia Council meeting September 20, 2004 it was proposed by Doug Lewis (retired MPP),
who presently has a law firm in Orillia, that a correction wherely closing offHepinstall were it meets Bass
Lake Road would greatly forestall any excess traffic through Bass Lake Heights. I heartily agree with this
proposal and request that it be granted. Street "D" should definitely not be allowed to continue past the
Bass Lake Sideroad nom the south. The bottom line of this proposal is to force all traffic nom the
proposed extension of the West Ridge Subdivision to use Line 15N or Fairgrounds Road (may be known as
Harvie Settlement road).
Please advise me as to your intentions regarding your acceptance/or not of the West Ridge Subdivision
plans and if there is reason to hope for your assistance with Doug Lewis's proposal.

I am writing to follow up on concerns I originally expressed to you by phone
surrounding the new West Ridge subdivision for the City of Orillia. Concerns which I felt
strongly enough about, to bring to your attention in the hope you might attend with me &
other concerned residents of my subdivision, the City of OrilIia council meeting which
took place on{ JUNE 29} & thus assure representation & support from Oro-Medonte
Township.
Simply stated my concerns, which are similar to the Hon. Doug Lewis, & other
neighbors, are over traffic flow through our neighborhood, & over possible ground water
alterations caused by the aforementioned project.
When challenged by me in front of cameras, the mayor of Orillia was quick to
offer assurances, our wells would be monitored, likely not affected, and that if they were,
the developer would have to make good. In this event, the prospect of weekly trucked in
water, does not impress nor satisfy my concerns at all .At the very least, I need those
same assurances, and in writing, from the township I support & pay my taxes too [ ORO-
MEDONTE] !
Concerning traffic flow, I strongly urge that there be NO STREET D as per. the
plan, allowed as an entrance for the new subdivision, onto Bass Lake Side Road. Failing
that option, other alternatives, & less desirable, would be to block off access to our
neighborhood altogether from Bass Lake Side Road, or to make Hepinstal1/ Orsi one-way
streets only.
In closing, it was made clear to the Mayor of OrilIia, that the City of OriIlia, & the
developer, have not been communicating well, with us, the concerned affected neighbors
of the project. I ask for similar due consideration & evidence of concern & support from
you our elected representative, & from the township ofOro-Medonte.
Will our ORO Mayor go before camera, & make similar assurances, our rights &
concerns will be fully acknowledged, & acted upon?

I have not written in before, but feel now that I must make my feelings know
to the council. The current construction in the area ofOrilIia (West Ridge
area) is a positive growth for the City of Orillia, but it is encroaching on
the land near where I live. I am a resident of the neighborhood comprised
of HepinstaI1 Place, Orsi Drive and Sunset Cres. I moved here 11 years ago
and have watched the developments in the Orillia west end as they steadily
came nearer and nearer. Like I said, I am not opposed to this development,
but I would like to have some thought being added into the growth. I know
it wi111ikely take five or more years for this development to affect me
more directly, and I knew when I bought my home that OriHia was "across the
street". My concern is the layout of the streets proposed by the new
development. I oppose this layout because I know that the layout wi11
encourage travelers to use my quiet, two lane, no sidewalk street to access
the west route out of the new subdivision. This wi11 turn a street
(Hepinstall) into a busy throughway that was in all likelihood not designed
to be a major road. In fact, in the eleven years I have been here, the
streets have started to crack and the shoulders have receded to the point
where maintenance must now be done (and has been done) on Orsi and
HepinstaU. I fear that this will escalate given the new road aUowances
being developed. I moved to this area (residential/agricultural) to escape
the busy roads and associated problems attached to this level of road use.
I walk frequently on the roads in my neighborhood and rarely do I find any
traffic on my road.
This is my concern. I can only make a few observations that could alleviate
the anticipated problems with this new road map. In one case, the section
of road ftom Orsi to Bass Lake side road could be made inaccessible to
westbound traffic out of the new street by making it one way, or by closing
it off. I for one would prefer it be left open as I go to work that way.
If it were one-way, then traffic coming into this subdivision from Bass Lake
Side road would not be pennitted. As far as the residents go, the people
who live in this area could be omitted from the "one-way" provision with a
subsection of the law allowing it. The other thought I had was to make the
roads offset by a number of feet, discouraging through traffic. Either way
you look at it, if something is not done, then this will become a very busy
road with heavy traffic, more fumes, more danger to
pedestrians/pets/children, and it wi11 certainly change the environment of
this nice quiet subdivision for ever.
I am sure that if you lived here, you would feel the same way. I am not a
city planner, but I do know what I see, and I do know what people are like.
I am asking you and the membership of council to look at the situation and
give it another thought. Engineers may have a better solution than mine,
