COUNCIL CHAMBERS - NOVEMBER 8, 1983 SPECIAL COMMITTEE OF COUNCIL MEETING A Special Committee of Council meeting at the call of the Reeve upon request of the Council Building Committee, was called for this evening for 6:30 p.m. All members of Council were notifeid by telephone and written notice to con- firm same. Present for the Committee of Council meeting were: Reeve Deputy Reeve Councillors: S. Davie J. McEwen R. Drury T. Halfacre A. Johnson Planning & Zoning Admin. Chief Bldg. Official G. Roberts J. Shellswell Meeting opened at 6:40 p.m. . Purpose of the meeting was to consider Council's options with respect to Build- ing Permit Nos. 111/83 and 140/83 issued for a Residence and Garage respectively on W~ Lot 8, Conc. 5. Property owned by Gordon Bidwell, Agent for the Permits M, Keyes. In accordance with resolution of Council passed at a meeting of Council held on October 31, 1983, the Planning & Zoning Administrator and Chief Building Official were to meet with Township Solicitor in order to obtain a legal opinion on the matter. The Planning & Zoning Administrator and Chief Building Official met with White, Q.C. on Monday, November 7, 1983. Verbal opinion was indicated to Roberts & Mr. Shellswell, who related same to Committee of Council along information on which the permit for the residence was issued as follows: D.S. Mr. with Councillor Halfacre suggested that to consider the matter, Council first hear from Mr. George Roberts regarding the issuance of the Building Permits, then from Jim Shellswell, the Chief Building Official and then together. George Roberts explained the procedure of completing of the Zoning portion of the Building Permit and answered questions of Council regarding the issu- ance. And presented a typed memo to Council as result of his attendance with Mr. D.S. White, Q.C. - Solicitor along with Jim Shellswell as requested by Council. W~ Lot 8, Conc. 5 The caption matter was reported to Council by the writer in Committee of the Whole on October 31, 1983. After being brought to the attention by the chairman of the Committee of Adjustment on October 18, 1983. Further to Council's direction by resolution of Octobe¿ 31, 1983, the writer and Chief Building Official, Jim She1lswell met with the Township Solicitor on November 7, 1983. The following was presented to the Township's Solicitor, David White, Q.C. for his consideration. Copies of Building Permit Application Nos. 111/83 & 140/83 including the "plot plans". Confirmation that the permits had in fact been issued on August 25, 1983 and September 22, 1983, respectively. Information pertaining to the ownership of the lands in question and the adjacent lands by Gordon Bidwell. Information in regard to buildings in existance on the property. The relationship of M. Keys to G. Bidwell. Official Plan and Zoning designations applying to the land. Committee of Adjustment file information indicating the means of acquisition of the subject lands by G. Bidwell from Mr. & Mrs. R. McMaster. Mr. White Was of the opinion that the building permit applications were improperly filled out and were faulty and incomplete with regard to the information shown. Mr. White indicated that he would write to the owner, Mr. Bidwell, informing him that the Township's Zoning By-Law had been contravened, and that Mr. Bidwell should immediately apply to the Committee of Adjustment to obtain a severance of the west part of Lot 8, from the east part. Although the McMasters retained approximately 1.2 acres of the west part of the lot, about 98.8 acres or 40 hectares remained, which, if convyed, would still comply with the By-Laws requirement for a 40 Ha. minimum parcel size. Resultant1y, there would remain one dwelling on each parcel after severance. Mr. White indicated he would set his recommendations out in writing to Council at the first opportunity. t - - 4
