Disclosure of pecuniary Interest and the General Nature
Thereof - In Accordance with The Act
Dave Knox declared a conflict with Item 8(a) being that he
is a member of the Rugby Hall Board and discussion would
occur with regard to funding. Mr. Knox did not participate
in the discussion nor did he vote on the motion.

Council:
No questions as a result of a review of the dispositions.

Deputations:
7:05. p.m.
Mr. Graham Connelly attended to discuss plans
for the building of a 4 sheet Curling Club.
Negotiations for the land have been completed
for property behind the Arena. A ten year
agreement is in place with plans to turn the
facility over to the Township of Severn when
payments on the building are complete. Funds
are being raised through various means with
$130,000.00 currently available and
$115,000.00 in pledges. An estimate of less
than $600,000.00 to build the facility was
given and there are plans to approach the
Province for a grant. The profitability of
various arenas (curling clubs) has been
investigated by the group and the Township of
Severn is reviewing the possibility of
waiving property taxes on the facility. The
club will be run by a Board of Management
with representatives from the participating
municipalities to sit on the Board. The
Coldwater Curling Club is requesting a grant
from the Township of Oro-Medonte in the
amount of $20,000.00.

Correspondence:

Horseshoe Valley O.M.R.A. Conference:
The Parks and Recreation Manager indicated that the
correspondance identified the room rates which will be
discussed at the Sub-Committee meeting established for
May 30th.

Parks & Recreation Manager Monthly Report:
a)
Day Camp Staff Program 1994:
After interviews, the Parks and Recreation Manager
proposes the following be hired as staff for Day Camp:
Pauline Henderson, Jennifer Williams, Shawna Laffin,
Rebecca Partridge, Jeff McKenzie, and Bob Leigh.

It is recommended to Council that Pauline Henderson,
Jennifer williams, Shawna Laffin, Rebecca partridge, Jeff
McKenzie, and Bob Leigh be hired as Day Camp Staff as
proposed by the Parks and Recreation Manager.

b)
Alcohol Risk Management Committee Report:
The Alcohol Risk Management Committee Report was
distributed to the Committee for review and discussion
at the June meeting. Discussion occurred with regard
to provisions pertaining to liability and additional
insurance to be provided by the user.
c)
Warden's picnic Report:

The Warden's picnic Report was presented in the form of
a tentative schedule of activities for adults and
children.
d)
Ball Diamond Schedule:
The Ball Diamond Schedule was presented to the
Committee for their information. The Craighurst
diamond is to be used for hardball only. Through
discussion, the suggestion was brought forth that the
Ball Diamond Allocation Policy be amended to reflect a
specific date by which requests for diamond time must
be submitted.

It is recommended to Council that the Ball Diamond
Allocation policy be amended to reflect that final requests
for diamond time be submitted before the Ball Diamond User
Group meeting is held in order to assure fair allotment of
diamond time.

Parks - Playground Report:
Suggestions are made within the report to be discussed
during the Budget process. An amount of $15,000 has
been suggested for utilization with regard to safety
concerns and safety items. The estimated cost to
complete all the recommendations within the report is
$2,500.00. Volunteer groups will be encouraged to
contact the Township to obtain safety specifications
for equipment to be placed on municipally owned
property.

Committee Chairman's Report:
a)
O.M.C.H.B. Association Report of April 25, 1994:
The Association appears to be working in a co-operative
manner with a Gigantic Garage Sale to be held at the
Arena which is being sponsored by the Oro-Medonte
Community Hall Board Association. The next meeting of
the Association is scheduled for May 30th @ 7:00 p.m.
at the Craighurst Hall.
b)
Book-keeping Procedure:
The Medonte Halls are agreeable to coming into the
municipal accounting system although concern has been
expressed about some of the older people having to
travel to the Administration Centre with large amounts
of cash. This problem to be discussed with the
Treasury Department.

Dave Knox did not participate in the discussion or vote on
the motion.

Hall Board Information:
The 1993 Financial Picture with regard to Community
Halls was presented and reviewed by the Committee.
Apparently all of the Township owned halls lose money.

It is recommended to Council that all the halls located in
the municipality be incorporated into a system whereby every
hall is treated in a fair and equitable manner in that the
privately owned halls being Oro station, Rugby Hall, and
Shanty Bay Community Centre each receive a grant of
$1,000.00 per year.

b)
Correspondance received from The Simcoe County Board of
Education regarding the Community Use of Facilities was
distributed with discussion taking place. The
Committee will review the material and provide
individual comments to Council members.

ALCOHOL RISK MANAGEMENT POLICY
PREAMBLE
The Township of Oro-Medonte owns and manages facilities where
alcohol consumption is not permitted, and other facilities where
alcohol consumption is permitted under the authority of a Special
Occasion Permit. The Township of Oro-medonte has developed an
alcohol risk management policy in order to prevent alcohol related
problems that arise from alcohol consumption within its facilities
and to promote a safe, enjoyable environment for those who use
these facilities.
A range of problems can arise from alcohol consumption. These
problems can affect not only the drinkers but other people who use
the facilities. These problems include:
vandalism and destruction of Township property
police being called to municipal property
injuries to drinkers or other individuals
liability action arising from alcohol related injuries or
deaths
increased insurance rates as a result of alcohol related
incidents
loss of insurability should the insurer' s risk assessment
escalate
charges laid against the Township or the special Occasion
Permit holders under the Liquor Licence Act
suspension or loss of alcohol permit privileges by the Liquor
Licence Board of ontario
loss of enjoYment by non-drinkers and moderate drinkers
complaints lodged by offended parties
withdrawal from use of facilities by people concerned about
alcohol consumption
loss of revenue due to reduced participation
increased public concern about alcohol consumption.
PURPOSE OF THE POLICY
The alcohol risk management policy consists of a range of measures
designed to prevent alcohol related problems such as:
a) drinking to intoxication;
b) drinking and driving;
c) underage drinking; and
d) drinking in prohibited areas
and also to increase the enjoYment of those who use the facilities.
By reducing the potential for alcohol related problems, the
Township of Oro-Medonte concurrently reduces its risk of liability
actions. This policy introduces barriers to impede the targeted
drinking practices.

The policy is divided into four sections:
1. Designation of facilities where alcohol use is prohibited;
2. Designation of facilities where alcohol use is permitted;
3. Specification of conditions under which alcohol use is
permitted;
4. Enforcement Procedures for violations of the policy.
SECTION 1.
AREAS DESIGNATED WHERE ALCOHOL USE IS PROHIBITED
The consumption of alcoholic beverages is prohibited in the
majority of parks, gardens, sports facilities and service
facilities in the Township of Oro-Medonte. The Township of Oro-
Medonte Council may change the designation of any site at its
discretion. A complete list of these areas can be obtained from
the Parks and Recreation Department. Users who seek permission to
use these facilities will be asked to sign a form agreeing that
people included in the activity or event will not consume alcohol
(see Appendix A).
SECTION 2.
AREAS DESIGNATED FOR CONDITIONAL USE OF ALCOHOL
The following facilities and areas are currently designated for
alcohol use under the authority of a special occasion permit.
Township of Oro-Medonte Township Council may change the designation
of any site at its discretion at any time.

SECTION 3.
CONDITIONS FOR SPECIAL OCCASION PERMITS
Anyone who wishes to serve alcohol at a designated site must
complete an agreement form that stipulates the conditions under
which alcohol may be served (see Appendix B). In addition, the
responsible person must obtain a Special Occasion Permit from the
Liquor License Board of ontario. The Special Occasion Permit
holder must ensure that all the conditions of the Liquor Licence
Act and the Township of Oro-Medonte are adhered to at the event.
The Township of Oro-Medonte reserves the right to refuse an
applicant permission to run a licensed event on its property.

All special Occasion Permit holders are required to adhere to the
following conditions.
3.1
Cateqorv:
Control
3.1.1
The permit holder will accept only an Age of Majority
card, a photo drivers licence, or a passport as
identification for alcohol purchase or consumption.
3.1.2
The permit holder will provide the Township with a list
of the bartenders, servers and all appropriate personnel,
two weeks prior to the event, and ensure that only those
listed will serve alcohol.
3.1.3
The permit holder will ensure that the bartenders and
servers do not serve alcohol to underage, intoxicated,
rowdy or unauthorized people at the event.
3.1.4
The permit holder will provide the Township with a list
of the monitors, aged 19 or over, two weeks prior to the
event. There will be at least 1 monitor for 100
participants and 1 monitor for each entrance and exit at
the facility or area. Monitors will supervise the event,
encourage legal and moderate drinking behaviour and
ensure that any problems that arise are dealt with
appropriately.
3.1.5
The monitors, bartenders and servers will not consume
alcohol during the event, nor will they be under the
influence of any alcohol consumed before the event.
3.1.6
The permit holder will be responsible for recognizing the
need for assistance during the event, and make sure that
proper assistance is available.
RATIONALE:
The Special Occasion Permit holder and the facility owner need to be alerted to the potential liability
and attendant responsibility to prevent participants from becoming intoxicated and protect them from
foreseeable harm.
In order to provide a safe environment and control behaviour, event organizers must supervise entrances
and exits. By controlling entry, underage, intoxicated, rowdy or unauthorized people can be prevented
from entering an event. This will considerably reduce the likelihood of a problem occurring.
By providing the facility owner with a list of bartenders, servers and monitors. those who previously
have over served, served minors. and served intoxicated patrons can be asked not to participate in the
event.

3.2.
Category:
Sale of Alcohol
3.2.1
When tickets are sold for alcoholic beverages, there will
be a limit of 4 per person at one time. Discounts will
not be offered for the volume purchase of tickets.
3.2.2
When tickets are not sold, each person will be limited to
a purchase of 4 drinks at a time. Discounts will not be
offered for the volume purchase of alcoholic beverages.
3.2.3
A sign will be posted at the bar and at the ticket
counter stating the law on serving to intoxication.
RATIONALE:
By limiting the number of tickets or drinks participants can purchase at one time, the ticket sellers,
monitors, bartenders, and servers are provided with more opportunities to observe participants for signs
of intoxication. Table consumption can be moderated by not selling rounds of large numbers of tickets--
a strip of twenty, for example.
3.3
Cateqory:
Low Alcohol and Non-Alcoholic Options
3.3.1
The permit holder will ensure that low alcohol options
are available (i.e. low alcohol beer, light wine, and low
alcohol spirits). Non-alcoholic beverages will be
available at a lower cost than any alcoholic beverage.
3.3.2
A sign will be posted identifying the low alcohol and
non-alcoholic beverages available at the event.
RATIONALE:
Low alcohol beverages help prevent intoxication by permitting responsible consumers with an opportunity
to consume less alcohol and avoid becoming intoxicated and will provide servers with a substitute drink
for those nearing intoxication. A patron consuming a regular beer (at 5% alcohol) could drink two
"extra light" beers (at 2.5% alcohol) to ingest the same amount of alcohol. Similarly, "l ight" beer
(at 4% alcohol) represents a 20% reduction in alcohol intake.
3.4
Category:
Accountability
3.4.1
The permit holder will post a sign, approved by the
Township of Oro-Medonte, stating the name of the Special
Occasion Permit holder and the telephone numbers for the
Township owners and the Liquor Licence Board of ontario.

3.4.2
The permit holder will obtain a minimum of one million
dollars liability insurance, name the Township of Oro-
Medonte as an additional insured, at least two weeks
prior to the event. The permit holder will indemnify and
save the Township of Oro-Medonte harmless from all claims
RATIONALE:
While the local authorities and liquor licence Inspectors are informed of the date and place of the
special occasion function, they do not always have an opportunity to drop in and check on the operation
of the event. The signs serve notice to the permit holder that whi le enforcement personnel may not be
present the entire time, concerned participants will know where to lodge a complaint. This can
facilitate early correction of potentially risky situations.
If an individual is injured, and if the Township of Oro-Medonte were to be found "jointly and severally"
liable, the Township of Oro-Medonte could end up paying the total judgement should the Special Occasion
Permit holder be uninsured or inadequately insured. In addition to costing the municipality to settle
the award, a municipality might have difficulty obtaining continued insurance coverage.
3.5
Safe Transportation
Cateqory:
3.5.1
The permit holder will be responsible for promoting safe
transportation options for all the drinking participants.
Examples of safe transportation options are:
a)

a designated driver selected from non-drinking
participants at the event;
a designated driver provided by the sponsoring
group; or
a taxi paid either by the sponsoring group or the
participant.

RATIONALE:
The risk of liability is high when an impaired driver leaves an alcohol related event. Event organizers
must assume responsibility for promoting safe transportation for all drinking participants. Safe
transportation options are essential since the only way to sober up an impaired person is with time.
Coffee provided at the end of the evening only turns a sleepy drunk into a wide-aware drunk and still
unable to drive.

ENFORCEMENT PROCEDURES FOR POLICY VIOLATION

Areas Where Alcohol is Prohibited
A violation of this policy occurs when individuals
consume alcohol in a municipal facility or area where
alcohol consumption is prohibited. Intervention can be
initiated by a member of the group using the facility or
area (if it is a group activity), by a staff member of
the Township or a Council-appointed volunteer, or by a
member of the ontario Provincial Police.
A group member may intervene by informing the offending
individual (s) that municipal policy prohibits alcohol
consumption and asking that it stop. Group members
should feel encouraged to intervene in this way because
intervention at other levels could result in a loss of
privileges.
A staff member of Township of Oro-Medonte will intervene
whenever he or she encounters a violation of the policy.
Staff members can ask that the consumption of alcohol
stop, or they can ask the individual or organized group
to leave the facility or area, depending on the
circumstances and the nature of the violation (especially
the potential for harm, for loss of enjoYment by non-
drinkers, or for complaints). Should the individuals or
group members fail to comply, the staff member can call
the police for enforcement.
Where a member(s) or organized group(s) have violated the
municipal policy, and have been confronted by Township
staff, the group will be sent a registered letter
advising of the violation, and indicating that no further
violations will be tolerated.
Should members of an organized group violate the policy
within one year of receiving notice of their first.
violation, the group will be suspended from organized use
of any Township facility or area for a period of one
year. A registered letter will be sent to the contact

person advising of the suspension. A copy of the
suspension letter will be provided to Township Council.
A member of the Ontario Provincial Police may intervene
in a violation of this policy on his or her initiative or
in response to a request either from a member of the
Township staff or a member of the general public. The
police officer may ask that the alcohol consumption stop,
or can order the individuals or organized group to leave
the facility or area. In addition, the officer may, at
his or her discretion, lay charges against the offending
individuals under the Liquor Licence Act of ontario or
any other relevant legislation.
Areas Where Alcohol is Permitted

Occasion Permit holders fail to comply with the
conditions of the Liquor Licence Act of ontario or the
Municipal Alcohol Policy. Intervention can be initiated
by a participant at the event, a Township staff member,
a member of the ontario Provincial Police, or an
Inspector of the Liquor Licence Board of Ontario.
A member of the organizing group or the designated
monitor may intervene by informing the offending
individual(s) of the policy violation and ask that it
stop. Group members and monitors should feel encouraged
to intervene in this way because intervention at other
levels could result in a loss of privileges and legal
charges.
A Township staff member will intervene whenever he or she
encounters a violation of the policy. Depending upon the
severity of the policy infraction, Township staff may ask
the organizers of the event to stop the violation or they
may close down the event. Should the organizers fail to

Township staff member, the group will be sent a

PLAYGROUND SAFETY REPORT
In December of 1993, a review was conducted by myself on the former
Medonte playgrounds to assess the level of safety. The assessment
was based on the Canadian Standards Association for Plavstructures.
June, 1991.
Playgrounds built after 1991 must meet the standards as outlined in
their manual. Playgrounds built before 1991 should be brought up
to reasonable level of standard or disassembled. All the Township-
owned playgrounds in the former Medonte Township were built before
1991.
The following recommendations are attempts to bring each playground
up to a reasonable level of safety.
Attached is a playground inspection record which will be given to
the people responsible for the playgrounds. It is recommended that
these playgrounds be inspected on a weekly basis and the inspection
records be kept on file at each location. Any necessary work on
the playground should be performed by the people responsible for
the playground (e.g. the volunteer park boards).

Education approved in principle a revised policy with respect
to the community use of school board facilities. A copy of
this policy is enclosed.

Backqround
At a number of meetings during the past two years, the
Property Committee and the Business and Finance Committee
have considered revisions to the current Policy 2340 - Use
of School Facilities by outside Organizations.
The committees' review has covered discussion of the
agreements for use of school facilities by various community
groups as well as the use by permit by all other users.
Discussion of rate schedules included comparisons with two
other large ontario school boards.
2.
Draft Policy and Rate Schedule
The Business and Finance Committee at its meeting of
Aprill2, 1994 requested Administration to draft a revised
policy and rate schedule to incorporate decisions made by the
Committee in its discussions. This draft policy is attached
as APPENDIX A.
The guidelines set out in the draft policy document establish
the conditions under which various user groups will be able
to use school facilities and the Education Centre. The Rate
Schedules appended to the policy document as Schedule A
proposes rates to be assessed for use by the various groups.
In order to begin a new school year, and therefore a new
season for permit use of schools, with a revised rate
schedule, the Committee recommends approval of this policy
document in principle. Approval in principle would allow
distribution of the document to schools and current users for
consultation during the May/June period of this year. Final
approval at the end of June would give time for
implementation of new rates for new permits in September.

Indication of Ma;or Chanqes
The draft policy guidelines, when compared with the current
Policy 2340 and the administrative procedures which support
it, incorporate a number of significant changes which
include:
(a) the need for custodial service in attendance for all
community group use of schools, except summer recreation
programs;
(b)
increased rates for college and university use;
(c) discontinuation of use by special agreement by church
groups for weekly services;
( d)
introduction of fees for permit use of outdoor school
facilities;
(e) introduction of fees for activities beyond the school
program organized by student/parent groups;
(f)
introduction of fees for use by community groups for
activities organized primarily for adults;
(g)
introduction of a flat administrative fee for processing
all permits exclusive of school activity permits.

That The Simcoe County Board of Education approve in principle
Policy 2340, Community Use of Facilities, as set out in Report
No. B-2-e dated April 27, 1994.

Rationale
The Simcoe County Board of Education recognizes the
desirability of full use of its facilities by the educational
system and the sharing of its facilities with community groups
provided that there is no additional cost incurred by the
board's ratepayers as a result of this sharing of facilities.
2.
Policy
It is the policy of The Simcoe County Board of Education that
its facilities will be made available for community use in
accordance with the guidelines that follow.

The first priority for the use of school facilities will
be for school activities as approved by the principal and
the Superintentendent of Schools.
The second priority for the use of school facilities will
be for board-sponsored activities.
School buildings and outdoor facilities will be made
available to community groups ~t times which do not
conflict with the use of such facilities for school
activities.
School facilities will not be rented for purely
commercial purposes unless there are no suitable
facilities available within the community.
School facilities will not be made available for use by
community groups without custodial staff in attendance,
except for summer programs maintained and supervised by
municipal recreation departments by agreement.
School facilities may be rented in accordance with the
current facilities rate schedule to colleges and
universities to operate credit programs and training
programs.
Elementary school facilities may be rented in accordance
with the current facilities rate schedule to church
groups for weekly worship services.
Indoor elementary school facilities may be used by permit
by programs under the supervision of municipal recreation
departments and such programs will be assessed fees in
accordance with the current facilities rate schedule.

Indoor elementary school facilities may be used for
summer programs under the supervision of municipal parks
and recreation departments by special agreement provided
proof of additional insurance and adequate security
measures are given by the municipality.
3.10
Outdoor facilities may be used by community groups by
permit; however, priority for use will be given to
recreation programs operated by municipalities which
enter into reciprocal use agreements which cover joint
facility planning and maintenance.
3.11
Activities outside the school program which are organized
by student groups or parent groups may be held in school
facilities with the approval of the principal and will be
assessed fees in accordance with the current facilities
rate schedule.
3.12
Community groups organized to provide activities for
school-aged children may use school facilities during the
after school and early evening period when regularly
scheduled custodial service is in attendance upon payment
of a fixed administrative fee.

3.13 Non-profit community groups organized to provide
activities primarily for adults may use available school
facilities and will be assessed fees in accordance with
the current facilities rate schedule.
3.14 The Education Centre may be used by community groups at
times which do not conflict with the normal operations of
the building and the requirements for its use by various
system groups.
3.15 The facilities rate schedule to be used in conjunction
with Administrative Procedures for assessing fees is
attached to this policy as Schedule A.
3.15.1
The facilities rate schedule will be altered
immediately by Adminisrati ve Council to
reflect changes in wages and benefits or
utilities charges.
3.15.2
The facilities rate schedule will be confirmed
annually by the Board.

Administrative Procedures

administrative procedures necessary to implement this policy.
