06 03 1986 Sp Council Min 7:00 THE COHPOHATION OF THE 'I'OWNSHIP OF aHa SPECIALMEErING TUESDAY 1986 - 7: 00 P.M. COUNCIL CHAMBERS The following members of Council were present: Heeve Robert E. Drury Deputy Reeve Thelma Halfacre Councillor David Burton Councillor David Caldwell Councillor Robert Swerdon Reeve Robert E. Drury chaired the meeting. Also present were: Ron Watkin, Ainley & Associates; Holly Spacek, Township Planner; Charles T. Whillans; Eric W. Money; Ron Kempling; Dennis Aiken; Orval Hutchinson; Ken Cunningham; Brian Money; Don Hubbert; Murray Ross; David Hill; Paul Elliott; David Williams; Bruce Hicks; Bessie Crawford; Ann & Tom McIntyre; Alan McNair; James Winter; Jim Somerville; M. Beckett, Mr. & Mrs. Harrmond, Don Forbes. Reeve Drury opened the meeting by explaining to those present that this is a Special Meeting held under Section 34 (12) of the Plaru1ing Act to consider a Temporary Use By-law to allow an Automotive Flea Market to be located on part of Lots 21 and 22, Concession 8, on June 5th to 8th inclusive. The Reeve then stated all persons present would be afforded the opportunity of rnaking comnents in respect of the proposed By-law. He also noted that proper notice had been given through the Barrie and Orillia papers. The Reeve then turned the meeting over to Ron Watkin of Ainley & Associates who explained the purpose and effect of the proposed By-law. The Administrator/Clerk stated the following pieces of correspondence had been received by the Township following the published notice of this meeting: (a) Bessie Crawford - Oro Station (b) Mary Ellen Bokesch - Barrie (c) Grah~n, Wilson and Green - Barrie (d) Simcoe County District Health unit re: servicing fall event The meeting was then opened for corrments from those present: Q. A. Q. A. Q. A. e S. Mrs. McIntyre - hours of operation of the Flea Market Ron Watkin - By-law stipulates termination at 7:00 p.m. Mrs. Hammond - is their a by-law governing noise? Ron Watkin - Township has a Noise By-law in effect. David Williams - does this By-law only effect this one time occasion? Ron Watkin - Yes, and beyond this event their is an Official Plan and Zoning By-law which will be before the O.M.B. to determine future use of the land. Doug Little - on behalf of Huronia Tourist Assoc. declaring support of the Flea Market event and the spring and fall events bring in approximately one million dollars into the County. Q. Alan McNair - explanation as to the procedure in calling a public meeting at this time and passing of the By-law only 3 days before the event? A. Ron Watkin - Council chose to hold a public meeting to provide the public the opportunity to make their concerns known and have acted on the application within the tenns of the Planning Act. Council will be making no decision at this meeting. - 2 - Q. Mrs. Mclnt.rye - concerned that a.'1y t.ype of event. could request. a Temporary Use By-law and that the Public Meetings would be held just a few days before the event and feels it is unfair. A. Ron Watkin - with resf.1ect: to the Flea Market, decision will be made by the O.M.B. on its futu.rE~. A Public Meeting is not part of an approval pror.=ess any m;:my do result in non-approvals. Q. Alan McNair - What criteria is being used for the Temporary Use policy relevant to this specific application? A. Ron Watkin - Council 'dill be assessing each issue contained within the Official Plan Policy. Q. Mrs. Hanmond - had problerns last year getting out driveway when Vendors were moving in. A. Eric Money - signs have been posted stating no parking in certain areas, educated their manpa;ver with respect to traffic control, and will be utilizing an entrance closer to the highway. Q. Mr. McIntrye - When will Council be making their decision? A. Hon Watkin - Council will be dealing with the By-law within the next day or two, and will be meeting with the Flea Market Association later on this evening. In all probability, a decision will be made by Thursday. Q. Mr. IVJ.cIntrye - has in the past submitted concerns to Council dating back to 1984 and will Council be taking this into consideration? A. Ron Watkin - All concerns and policies within the Official Plan will be considered prior to a decision being made as well as meeting with the Flea Market Association for their input.. S. Bessie Crawford - Gates were so well guarded that when I was to perform my duties at the main gate, I had to wait for approval from Flea Market Representatives before she coulq start. Q. Mrs. McIntrye - will alcohol be sold on the property? A. Eric Money - An alcohol licence has been applied for and decision on the licence is pending on the decision of Council. Q. Mr. Hammond - Are the gates going to be open all night for campers? A. Eric Money - The gates will be closed and the carnpground road will not be used this year. Q. Alan McNair - Has their been a site plan submitted by the Flea Market to the Township to show how they are planrling to use the property and are their activities going to be confined to the b'O relatively small areas sham on the By-law schedule? A. Ron Watkin - The areas shown on the Schedule refer to zoning and the Site Plan will be finalized and fully in place prior to the O.M.B. Hearing. e Q. Mr. Somerville - It was my impression that the purpose of the meeting was to pass the By-law. A. Ron ~'Jatkin - No, the purpose of this meeting was hear corrments frem those in support and those vvho oppose the By-law. The Council are hear to listen to your comments. S. Mr. Somerville - It is a gc)()d idea and as long as it is controlled there shouldn't be any problems. S. Alan McNair - Just Wa!1t to advise Council that if this By-law is passed that his clients ",rill be objecting to it on the basis that if it is passed prior to the event. that there isn't any opportunity to object under the precess of the Planning Act. If the Council is meeting later on this evening that the meeting be public. A. Reeve Drury - it will start out as a Public Meeting but Council may choose to go into Committee of the WholE~ to discuss the matter. S. Murray Ross - I live within quarter mile of the site and it certainly does not create any noise that interrupts my sleep, and I think its a great thing for the corrmtmity and business people. Reeve Drury stated that at this time ]'vir. Watkin has to leave the meeting and Township Planner Holly Spacek may be able to answer any inquiries. - 3 - S. Jim Winter - I'm from Oro Camping just down the road from the site and we get gJite a few campers in as a result of the event ffi1d its the easiest business we Cill1 have because their is no noise. S. Ron Kempling - I represent the Knights of Columbus one of the service chills which are given the ()pportunity to participate in the Flea Market. In years passed we have operated the Beer Garden which is the only alcoholic beverage sold on the site. We have applied for a pennit to operate a beer garden for this upcoming event assuming that this Coul1cil pass the By-law. There were some minor problems last year noted by local residents not necessarily arising from the consumption of beer in the beer gardenl but people who had drank tc'O much and we have no idea where they came from. We have met with inspectors of the LLBO and the OPP and made provision to hire police officers to patrol the beer garden and control entry and exit from the beer garden on Saturday and Sunday. Therefore we would like to support the Flea Market in any way we can and includes seeing Council pass -the Temporary Use By-law. S. Sandra Simon - I am from Dutchies Restaurant and last year we did not have any problems and we that t:he Flea Market creates more business for everyone and creates jobs for young people and cannot see anything wrong with it. Q. ivIr. Harrmond - It's fine for these people to say they can control the beer tent, but whose going to control the vendors where a lot of the drinking is going on and they are the ones that are doing all the hooting and hollering all night long until 3: 00 0' clock in the morning. A. Mr. Honey -. We have upgraded our control and use military from Base Borden on the gates. We have regulations set up in our terms and conditions of the Vendors which they have to abide to. Q. Mrs. McIntyre - My alcohol concern was not just with the beer garden but also the person who stopped at the end of our driveway and relieved himself and how are you going to control that? A. Mr. Money - I might add that we vlere not the only function on Concession 8 which was operating a beer garden last year. S. Robert Small - 'I'he Township has a By-law Enforcement Officer who will be on the site periodically throughout the weekend. Q. Buffi yvoronka - With respect to liability, what happens if there is an alcohol related accident? A. Robert Small - the onus would be on the person who caused the accident. Q. Ala.!1 McNair - Is the Township or the Flea Market carrying liability insurance against that sort of event and if so, how much? A. f>'!r. Money - We have a two million dollar liability and we insist that all the food vendors and the K.C. I S selling beer have similar policies before we negotiate with them for their services. A. Reeve Drury - Th~ Township has seven million dollar liability per occurance. e S. Don Forbes -- On behalf of the Lion's ClwJ, the Flea Market has been an excellent source of incon~ for us and the CaTIITlunity. S. Nick Nikolouzos - I support the Flea Market and it is good for the Township. S. Rocco Calautti - I own a restaurant in Oro Township and I feel the same way as Nick and thir~ it is one of the best things that have come to Oro 1'ownship. S. David Hill - I have just st''8nt the last six days making hotel reservations for people from as far away as London. I run for it since I am in the old car business which also brings me business which means I can pay my taxes and support my wife and kids. - 4 - S. John Crawford - I am with the 1st Ora Boy Scouts and would like to express my support of the Flea Market. Last spring we were afforded the opportunity to clean up the garbage at the Flea Market site and because of the gc:x:x1 job that we did, we were allowed to do the same at the fall event. With the proceeds we were allowed to purchase all brand new equipment. S. Mr. McIntyre - I can appreciate the support expressed here this evening and cannot dispute that, but I think my point in this whole thing is the invasion of privacy and a few of us are unfortunate enough to live in this area whEre the event is taking place. S. Eric Money - We have heard a lot of discussion hear this evening relating to alcohol related problems. First it is true, that we did sell alcohol last year and we feel that the best control is by operating a beverage stand than people opening their trunk of their car. As far as the alcohol related offences, I am not totally convinced that they are related to our event. As I stated, there was another event on the same Concession with an alcohol licence. S. Lynda Crawford - I have worked at the Flea Market and I have really enjoyed working with the Vendors and those associated with the Flea Market and have not run into any problems with anyone. I also was up and down amongst the sites and there was the odd site where they were drinking alcohol but I feel it is their site and their privilege as long as they keep themselves contained their is no problem. Everyone in the area gets the benefit of money coming in to the area and I have had a lot more noise at our place on a Saturday night from the events next dCX)r that we ever have had from the Flea Market.
