03 16 1987 Public Minutes THE CORPORATIOO OF THE TCW:\lSHIP OF ORO SPECIAL PUBLIC MEETING MONDAY, MARCH 16, 1987 @ 7:00 P.M. - COUNCIL CHAMBERS FIFTIETH MEETING 1985-88 COUNCIL The following Members of Council were present: Reeve Robert E. Drury Deputy Reeve Thelma Halfacre Councillor David Burton Councillor David Caldwell Councillor Robert Swerdon Reeve Robert E. Drury chaired the Meeting. Also present were: Mr. Paul Kitchen, Ms. Holly Spacek, Mr. Harold Brain, Mr. Lloyd Vanderberg, Mr. & Mrs. Alan Wrigley, Mrs. Mary Shedd, Mr. Stewart Wcx:>drCM, Mr. Stephen Wcx:>drCM, Miss LYnne E. Reeve Robert E. Drury opened the Meeting by explaining to those present, that the purpose of the Meeting was to introduce a Proposed By-law Amendment to the Township of Oro's Zoning By-law under Section 34 (12) of The Planning Act. I I I I I I I II II II il , II II II II i The Proposed Zoning Amendment is for Part of the West One Half of Lot 21, Concession 14 in the Township of Oro. The Proposed Rezoning would change the Zone Designation of the Lands within the effected Area frcm the Holding (H) Zone to the Country Residential Exception (æ-5) Zone. The Proposed Rezoning would permit the Development of a 21 Lot - Single Family Residential Development by Registered Plan of Subdivision. Notice of the Public Meeting was circulated to the Area effected and to all Land Owners within 120 metres of the Area effected on January 30, 1987, in accordance with the Ontario Regulations. The Reeve then stated: "That all Persons present would be afforded the opportuni ty of asking questions with respect to the Proposed Zoning Amendment". He also stated that Persons asking questions, please give their name prior to stating their question, so that it could be properly recorded in the Minutes. The Reeve then asked the Clerk, if any correspondence had been received concerning the Proposal. ( a) (b) ( c) The Reeve then turned the Meeting over to Mr. Paul Kitchen, the Proponent for the Proposal who will explain the purpose and effect of the Proposed Zoning Amendment; Mr. Kitchen then proceeded with the following explanation: "I will start with some of the background material on the Property, and what is going on with it, the Property consists of 28 Acres located on Concession 14, Part of the West One Half of Lot 21. The Property that is being developed, the North Half Portion is an abandoned gravel pit, which is starting to regenerate, the South Half is a Hardwood bush, which have soils of gravel, to most extent; the layers thin out as you move towards the South. The Subdivision is proposed to have two entrance Roads, one off the Concession Road, and the second entrance off the 20 - 21 Side Road. This entrance is approximately 300 feet frcm the SPECIAL PUBLIC MEETING PAGE 2 corner of the Intersection. The Subdivision will be developed with 21 Lots, the Lots vary in Area frcm 3,900 square metres (which is just under an Acre) to 7,800 square metres (which is about One 3/4 Acres). Three of the Lots face onto the Concession Road, &ll the rest of the Lots face internally onto the internal network. The Subdivision will be developed with paved Roads, under- ground electrical services, and Street Lights. The Property is generally flat, and drops off gradually towards the South. We will be providing the Township with a strip of Land along the Concession and the Covered Road, there will also be a One foot reserve, which will also be given to the TCMnShip to provide access control to the Develop:nent. The Property presently in the Official Plan for the TCMnship of Oro is zoned or designated as Country Residential, under Amendment No. l2 to the Official Plan of the TCMnShip of Ora, which was prepared in the late 1970' s. This Property hasn't been developed nCM. We propose to change the Holding Zone, that it's in, to the appropriate Country Residential for Development. The Plan actually shCMs the layout of the Subdivision, and it is shown on the Plan, where the Houses will be put on the individual Lots, and also where the Tile Beds will be placed. There has been extensive Studies done on the Soils on the Developnent, along with the water availability within the Development. The existing gravel pit that is here, part of it will be regraded, as there are a few holes that have to be taken out, for more usual uses. The intention with the Development is that trees will be left there, with the Lots there are long lists of protective covenants that protect the environment in the Subdivision, and are very restrictive for the People that live here. Primarily, we are concerned about maintaining the appeal of the Area, the fact that it has a nice Hardwood bush, and in this protective covenants, the People can not cut any trees that are unnecessary, but otherwise that are required to build their House on their Lot. There are also restrictions on the House size, the Architectural Style, things as far as no Trailers, no Gas Tanks, no Trucks; we are trying to develop a high class Development, we are not interested in having these things laying around. People that live there, will have to live up to these protective covenants in their Deeds. There is alot of concern about the Covered Road, there is no intention that this Road will be touched at all, there is no Development being done on this Road. We will be providing an entrance off this Road, about 300 feet frcm the corner of the Intersection, as already mentioned. It will not be touched. The appeal is to have the trees there." Questions Mr. Lloyd Vanderburg - Regarding the drainage, on Lot 25, is it just a pipe? Q. A. Mr. Paul Kitchen - There isn't a pipe, there will just be a swail, all on Lot 25. There is a six (6) metre easement down that Property. Q. Mr. Lloyd Vanderburg - Do the back of those Lots meet to the back of my Lot, which is Lot 24? A. Mr. Paul Kitchen Q. Mr. Harold Brain A. Mrs. McCulloch - Yes, the Subdivision Lots do run along the back of your Lots. - What is supplying the Subdivision with water? - Everyone will have their own personal well, Reports have been done on availability of water in the Subdi vision, and there is no problem as far as losing your water supply. - The culvert that is down there with the drainage, did you take into consideration the over flCM effect? - This drainage along with the gravel nature will not produce an over flow effect, because most of the water is absorbed into the ground, there is not much run off. All the water that runs into the drainage ditch nCM, we are channelizing it. The ditches are flowing quite well. - How much of a Buffer Zone are you allowing along that Road, between your Property Line into the Development Property? I Q. A. Mr. Paul Kitchen Q. Mr. Paul Kitchen SPECIAL PUBLIC MEETING PAGE 3 - We are transferring an easement to the Municipality here of three (3) metres of widening Area, which incorporates the bank which is there, beyond that there is a . 3 metre reserve. - Will the trees be taken down, if the Road becemes paved? - There is a strip of Road Allowance on that Road of 66 feet wide, which extends 33 feet on either side of that is the Road AllCMance, which is owned by the Municipality. This Zone is zoned ResidentiaL - Can you tell me what my Property across the Road frcm the Subdivision is zoned as? - It is zoned RuraL Q. Mr. Walter Richardson - What are the two Roads wi thin the Subdivision classified as? A. Mr. Paul Kitchen - The Roads wi thin the Subdivision are Public Roads, and they will be maintained by the Township. Mr. Lloyd Vanderburg - will this Subdivision look at all like the Bass Lake Wcx:>dlands Subdivision? A. Mr. Paul Kitchen Q. Mr. Harold Brain A. Mr. Paul Kitchen - This Subdivison will be very similar, bigger Lots, bigger Houses, and lots of trees. - With the Subdivision going in there, it will create a bigger traffic load in the Area, is the TCMnship taking into consideration doing scmething like upgrading this Road, possibility putting up Speed Signs, and upgrading? - Yes, the Township is taking this into consideration, and will see to putting up more Signs, with more traffic flCM. Q. Mrs. Margo Sheppard, - Can you tell me what sort of course will be taken, if People are cutting down trees? A. Mr. Paul Kitchen - When People buy the Property, they buy it on the condition that they must conform to these covenants and there is a list of three pages of covenants, which are attached to the Deeds, that are registered in the Registry Office, and they layout basically what you can not do. Q. Mrs. Margo Sheppard - Who enforces the By-laws, as far as tree cutting? A. Reeve Robert Drury Q. Mr. Alan Wrigley A. Reeve Robert Drury - The By-laws are enforced by the By-law Enforcement Officer, and its' the Publics responsibility to report and let the By-law Enforcement Officer knCM is going on in the Township. - As far as the Covered Road is concerned, will the TCMnShip do any repairs or maintainance on this Road? - There are no immediate plans for this Road at this time, if you do wish this Road upgraded, we are going to have to take sane trees down in order to ditch it, that's the main canponent for the Roads, to have proper drainage, to keep the Road dry, then we can keep it in good condition. Right now, there are no plans to spend the money on that Road. We eventually hope to go into a complete ditching program within the Township, which at that time will be just ditching. SPECIAL PUBLIC MEETING PAGE 4 Q. Mr. Bob Stevenson - What about the lake access to the People that will own sane of these Lots, across the Road where the drainage system is? A. Mr. Paul Kitchen - The access is known as Public access. The Reeve then accepted frcm Mrs. E.E. McCulloch a list of names frcm Property Owners in the Area, who wish Council to know their desires on preserving the trees boarding the Road connecting Oro Concession 13 and the Oro/Orillia Township Line. The Reeve then thanked on behalf of Council all those in attendance for their participation and advised those present that Council will consider all of the matters brought forward at this Meeting, before reaching a decision. He also advised the Members of the Public, who wished to receive notification of passing of the By-law, should leave their name and address with the Clerk.
