03 07 1988 Public Minutes 7:15 1 THE CORPORATION OF THE TOWNSHIP OF ORO MONDAY, MARCH 7, 1988 @ 7:15 P.M. - COUNCIL CHAMBERS SPECIAL PUBLIC MEETING NINETY-SIXTH MEETING 1985-88 COUNCIL The following members of Council were Reeve Robert E. Drury Deputy Reeve Thelma Halfacre Counclllor David Burton Councillor David Caldwell Councillor Robert Swerdon presen t: Reeve Robert E. Drury chaired the meeting. Also present were: Ms. Holly Spacek, Mr. Ron Watkin, Lloyd Fletcher, Robin Spooner, Ross Cotton, Donald P. Hanney, John Borysiak, Phil Gormaly, Rocco Fuda, Shirley Woodrow, Peter G. Smith, Stephen Woodrow, Marilyn Swerdon, Bud Arbour, Doug Colquhoun, S. Koole, Henry Neufeld, Judy Alderdice, Roy R. Hastings, Alf Alderdice, Carol Alderdice, Betty Schnurr< Jerry Schnurr, Fran Hanney, Martha G. Bllles, Don Kilbourne Reeve Robert E. Drury opened the meeting by explaining to those present that the purpose of the public meeting was to introduce a proposed zoning by-law amendment under Sectlon 34, sub (12) of the Planning Act. The proposed zoning amendment is to rezone those lands situated on part of Lot 28, Concession 4, from the Natural Area "NA" zone to the Natural Area Exception "NA-1" Zone. The purpose of this rezoning is to permit the development of a boxing school and training centre in the existing barn located on the subject property. The subject property has a frontage of 59.34 metres (194.69 reet) and an area of 3.29 hectares (8.15 acres). Notice of this public meeting was circulated to the areas affected and to all land owners within 120 metres on January 26, 1988 as well as the Barrie Examiner and the Orillia Packet and Times, in accordance with Ontario Regulations. In addition, notices were sent to agencies considered to have an interest in the matter. 8 The Reeve then asked the Clerk if there had been any correspondence received on this matter. The Clerk responded that he had received two pieces of correspondence, one from Mr. K. Ainsworth of the Mlnistry of Transportation indicating that he had no concerns with the proposed rezoning amendment and did not wish to be notified of the passing of the by-law. The other piece of correspondence was from Ms. Martha G. Billes of Calgary, Alberta who had sent a letter dated February 5, 1988 which the Clerk read to those present indicating that she had a lot of questions concerning this proposal as well as some concerns. The Reeve then stated that all persons present would be afforded the opportunity of asking questlons with respect to the proposed amendment. Reeve Robert E. Drury then turned the meeting over to Township Planning Consultant Mr. Ron Watkin of Ainley and Associates, who explained the purpose and effect of the proposed amendment. The Reeve then asked those present if they had any questions or concerns with regard to the proposal: Don Kilbourne: 8 Ron H3tkin: What is the potential of what is being proposed in this By-law? Anything which is in addition to what is asked for would have to come back before Council. Martha Billes: I am from Calgary Alberta and my summer home is here ln Oro and that property has been in the family since the 1930's being 32 acres of waterfront adjacent to the McArthur property. Are there not any existing industrial/commercial properties already in the Township where the boxing school could go? Why is the Township considering such a proposal in a rural residential area? I am not opposed to the ñctivities for boys and girls or Mr. l1cArthur' s good in ten t ions, I am just concerned about the impact this will have on the surrounding area and there is just too much at stake to permit a blanket rezoning. The club house, school - 2 " Martha Billes: (Cont'd. ) and people not from the area does concern me and therefore I see no other course of action but to oppose the rezoning application. My nelghbours, Muriel Jean Collton and James A. Coliton have sent a letter with me, shall I read it for the records? Reeve Drury: Martha Billes: Sure 8 Robert W. Small, Administrator. Dear Sir, We are unable to attend tonights meeting to vote against the Amendment to the By-law, asked for by the Owners of the property shown on the attached map, and designated as NA-1. This lot is the second lot east of ours so you can really understand a boxing school in this location will not only reduce the value of our property, but change the quiet rural atmosphere of this area. We are strongly opposed to any change in the existing by-law. Muriel Jean Coliton and James A. Coliton. Reeve Drury: Maybe we will have our Planning Consultant Ron Watkin answer some of the concerns. Ron Watkin: The concerns and issues you have brought up here tonight are very similar to the questions and concerns Council and the Planning Advisory Committee raised when this proposal was first presented by the McArthurs. This public meeting is part of the planning process which the proposa are presented to Planning Advisory Committee, then to Council, and then to this public meeting for which notices were sent out. Martha Billes: Will this zoning go on title or will it end when ownership changes? Ron Watkin: The exception is there for posterity. The only thing this by-law will provide is the use of the barn only for the boxing school. Martha Billes: How many students will be attending the school and is there a maximum? Ron Watkin: The Township can't regulate that. Martha Billes: What will the hours of operation be and will they be open on Sundays? Ron Watkin: A Zoning By-law cannot regulate hours or days of operation. 8 Robert Small: Mr. Reeve, Sunday Openings are being debated by the Provincial Government at the present time. Reeve Drury: Perhaps Mr. McArthur could answer some of your concerns. Ed McArthur: I can understand some of your concerns. Our membership runs between 20 - 25. Reeve Drury: Perhaps Mrs. Billes later on in the evening you could talk to our Planner and Mr. and maybe some of the problems can be resolved. If there are any further quest .. ~ 8 . " - 3 - Rocco Fuda: I live in Oro in the fine Community of Shanty Bay and my concerns are basically the same, we are living in a residential area and I would like it to stay residential. We do have an area for industrial/commercial development and I am sure there is space there for a great low economical cost? How many square feet do you have there for the boxing school? Ed McArthur: 3,600 square feet. Rocco Fuda: There are locations that are designated commercial space but to open a door in the area of boxing you are going to start losing a lot of controls here. In five years time, this is going to probably grow and it will be more than just a few cars coming in. I am not objecting to the principal of the boxing school but as a land owner right adjacent to their location, I will object very strongly. Reeve Drury: Are there any further questions? If not I would like to thank you for your participation. There were no further questions from those present. The Reeve in closing the meeting thanked those in attendance for their participation and advised that Council would consider all matters before reaching a decision. The Reeve also advised those present that if they wished to be notified of the passing of the proposed by-law, that they should leave their name and address with the Clerk.
