Mr. Ron Kolbe, C.B.O. and Ms. Beverly Nicolson, Township Planner were present to discuss with the Committee a Building By-Law Infraction. Mr. R. E. Young from the Ministry of Environment was present to discuss the Ministry of Environment Regulations with regards to burning at the landfill site: he also discussed the possibility of the municipality looking at another site to dispose of stumps. Mr. Henry Sander, Treasurer, was present to discuss Kathy Hummel's Maternity Leave as well as the Confidential Report concerning the Staff in the Treasury Department. Mr. Brian Shellswell, Mr. Ron Kolbe, C.B.O. and Ms. Beverly Nicolson were present to discuss a Building Infraction on the East Part of Lot 16, Concession 14. MOTION NO.1 Moved by Crawford, seconded by Burton It is recommended that the Administrator/Clerk request an opinion from Township Solicitor, D. White and R. Watkin, Township Planning Consultant with regards to rezoning Lot 44, Plan 875. Carried. MOTION NO.2 Moved by Caldwell, seconded by Johnson It is recommended that the Confidential Correspondence from Win full Properties Inc. dated September 25, 1989, concerning Win full Properties and Oro Township Development Agreement be received and further the Administrator/Clerk advise Winfull Properties Inc. of the following: (a) the then current rate of Lot Levies for Residential Lots be inserted in the Agreement; (b) that option No.2 outlined in the correspondence dated September 25, 1989, for cash-in-lieu of Parkland, be accepted by the Township and; (c) that Clause 52 remain with the same wording. Carried. - 4 - MOTION NO.5 Moved by Crawford, seconded by Burton It is recommended that the Confidential Correspondence from Donald R. Nixon, M.D. with regards to the Road Allowance between Concessions 1 and 2, South of the Ridge Road, be received and referred to a future meeting. Carried. MOTION NO.6 Moved by Burton, seconded by Crawford It is recommended that the correspondence from the Niagara South Board of Education, with regards to the request for information of the Township of Oro as well as twenty (20) Township lapel pins, be referred to the Township Planner for a reply and further the request for twenty Township lapel pins be granted. Carried. MOTION NO.7 Moved by Burton, seconded by Crawford It is recommended that the Administrator/Clerk, Robert w. Small, be granted permission to attend the Canadian Bar Association Seminar entitled "Recent Developments in Municipal Law", to be held in Toronto on Monday, October 2, 1989. Carried. MOTION NO.8 Moved by Caldwell, seconded by Johnson It is recommended that the Administrator/Clerk, Robert W. Small, be granted permission to attend the A.M.T.C. Seminar entitled "Freedom of Information", to be held on October 5, 1989, in Toronto. Carried. MOTION NO.9 Moved by Burton, seconded by Crawford It is recommended that the memo from Kathy Hummel, with regards to her Maternity Leave be received and further the Municipality will assume Mrs. Hummel's benefits for the time period of February 27, to July 01, 1990. Carried. - 5 - MOTION NO. 11 Moved by Crawford, seconded by Burton It is recommended that the Administrator/Clerk direct the Township Solicitor to correspond with Mrs. Sier and indicate to her that the Municipalities position has not changed from the Council Meeting held on Monday, May 15, 1989, and further the Municipality has obtained a verbal opinion from its appraiser that the easement retained by the Township would not effect the appraised value of Block 26, and further the Municipality will not entertain the sale of this particular Block at a price below the appraised value. Robinson and Associates Limited with regards to the 7th Line ReconstructionEngineering Costs, be received and further the Administrator/Clerk is hereby directed to advise Mr. R. G. Robinson, he is to direct the Ontario Land Surveyors to proceed with the legal survey work from Highway #ll North to County Road #22. Carried. MOTION NO. 15 Moved by Burton, seconded by Crawford It is recommended that the correspondence from Mr. and Mrs. MacLeod with regards to the Promenade, Plan 626, be received and referred to the Township Planner and Animal Control/By-Law Enforcement Officer, for a review and a report back to Council. Carried. - 6 - REPORT NO. 16 Moved by Burton, seconded by Crawford It is recommended that the correpondence from Rotert and Jacquie Bessie with regards to Official Plan Amendment #36, with regards to Lot IS, Concession 2, be received until a draft modification is received from Ron Watkin, Township Planning Consultant. MOTION NO. 17 Moved by Johnson, seconded by Caldwell It is recommended that the correspondence from the Corporation of the Township of Medonte with regards to :he proposed Buffalo Springs Development, Lots 2 & 3, Concession 9, be received and further the Administrator/ Clerk is hereby directed to correspond with the Township of Medonte indicating that the Municipality will consider their comments outlined in their correspondence, before ,reaching a decision on the proposed development. 'MOTION NO. 18 Moved by Crawford, seconded by Burton ,It is,recommended that the correspondence from Doug Beatt1e, with regards to the Development proposal for ,and Official Plan and Zoning By-Law Amendment for Part of the West Half Lot 22, Concession 12, Plan of Subdivision, John Johnson Construction be received and further the Administrator/Clerk is hereby directed to correspond with Mr. Beattie indicating that his concerns will be taken into consideration, prior to the municipality making a decision on this proposed subdivision. Carried. MOTION NO. 19 Moved by Johnson, seconded by Caldwell It is recon~ended that the correspondence from Mr. D. J. Fitzgerald, Mr. James Tanner and Mr. J. Leigh, concerning a recent Committee of Adjustment Application B-13,14 and IS/89 (Newton), be received and referred to the Ontario Municipal Board. Carried. MOTION NO. 20 Moved by Burton, seconded by Crawford It is recommended that the report from Animal Control/ By-Law Enforcement Officer, Robert James, for the month of August, 1989, be received. Carried. MOTION NO. 21 Moved by Johnson, seconded by Caldwell It is recommended that the Administrator/Clerk be authorized to advertise for an assistant to the Building Inspector, as outlined in the sample ad submitted to Council on this date and further this Salary Range and Job Description be reviewed prior to the Advertisement being placed. Carried. : - 7 - MOTION NO. 22 Moved by Burton, seconded by Crawford It is recommended that the 1989-90 Arena Ice Time Rental Fee of $32.50 per hour, be charged to all groups using non prime time hours, including Simcoe County Board of Education Schools as well as any other Provincial Government Agency. Carried. MOTION NO. 23 Moved by Burton, seconded by Crawford It is recommended that the report from Robert W. Small, Administrator/Clerk, with regards to the Oro Arena Concession Booth Tender, be received and adopted. Carried. MOTION NO. 24 Moved by Johnson, seconded by Caldwell It is recommended that the correspondence from Mr. and Mrs. John Buckley, received by the Corporation of the Township of Oro on September 21, 1989, concerning the condition of the Oro Memorial Park House, be received with thanks. Carried. MOTION NO. 25 Moved by Johnson, seconded by Caldwell It is recommended that the replacement Committee Member for the Oro Planning Advisory Committee be made in the following manner: Ad be placed in both local papers for appointment of members for 1990. Carried. MOTION NO. 26 Moved by Caldwell, seconded by Johnson It is recommended that Treasurer, calculate interest on all outstanding Accounts Receivable from thirty (30) days after accounts were mailed and send out updated statements showing outstanding interest at 2% per month. MOTION NO. 29 Moved by Burton, seconded by Caldwell It is recommended that the Administrator/Clerk obtain an Injunction if Mr. Brian Shellswell proceeds with any further construction at his site on Concession 14 and Highway #11, without receiving the proper approvals.
