SPECIAL PUBLIC MEETING
MONDAY OCTOBER 30, 1989 @ 7:00 P.M. - COUNCIL CHAMBERS
FIFTY NINTH MEETING 1988-1991 COUNCIL
The following members of Council were present:
Reeve Robert E. Drury
Deputy-Reeve David Caldwell
Councillor David Burton

Reeve Robert E. Drury chaired the meeting.
Reeve Robert E. Drury opened the meeting by explaining to those
present that this public meeting has been called pursuant to
Section 34 (12) of the Planning Act, to obtain public comments
with respect to the proposed application. The applicant has
applied to rezone lands described as Lot 11, Plan 1242,
Concession 13, in the Township of Oro.
To date, the Council of the Corporation of the Township of Oro
has not made a decision on this application other than
proceeding to a public meeting. Only after comments are
received from the Public, Township Staff and requested agencies
within an appropriate time period will Council make a decision
on this application.
Notice of the public meeting was mailed out on September 27,
1989, to all property owners within 400 feet of the subject
lands. Notice of the public meeting was also placed in both
the Barrie Examiner and Orillia Packet and Times on September
27, 1989.
The Reeve then asked the Clerk if there had been any
correspondence received on this matter. The Clerk responded by
indicating that no correspondence had been received.
The Reeve then stated that those persons present would be
afforded the opportunity of asking questions with respect to
the proposed Zoning By-Law Amendment.
Reeve Robert E. Drury then turned the meeting over to the
Township Planner, Ms. Beverly Nicolson, to explain the purpose
and effect of the proposed Zoning By-Law Amendment.
Beverly Nicolson:
The applicants are proposing to rezone
a parcel of land from the Shoreline
Residential Zone to the Genera
Residential Zone. Lands described as
Lot II, Plan 1242, Concession 13.
The purpose of the rezoning is to
allow the parcel to be developed for
year round use.
The effect of the rezoning would be to
permit the owners to convert an
existing seasonal dwelling and reside
in a permanent single family detached
dwelling unit on a year round basis.

To further explain this request, I
will briefly review the historical
development of the policies which
pertain to the application.
In 1979 a study was undertaken of the
Waterfront area which addressed the
following concerns:
1. the ability of the soils to accept
the effluent from septic tank
development;
2. the concern of the possible
deterioration of Lake Simcoe as a
result of poor soils and inadequate
septic systems;
3. the conversion of seasonal
dwellings to permanent dwelling on
substandard lots with substandard
septic systems;
4. the Provincial approach to
prohibiting conversions to occur in
Shoreline areas.
The results of the study recognized
that if a person wished to use the
dwellings on a permanent basis or was
already using the home on a permanent
basis the most important/critical
factor was septic tank suitability.
Therefore, the Township adopted a
"conversion approach" which allows
properties within the Shoreline Area
to be converted subject to:

obtaining a rezoning;
obtaining a certificate of
conversion;
meeting the requirements of the
SCDHU for a Class 4 or the
Ministry of Environment for a
Class 6 sewage disposal system.

In order to obtain a rezoning the lot
must have 15m of lot frontage 1,850
square meters of lot area (20,000
square meters). If there is a minimum
of 15 meters of lot frontage the area
could be further reduced to 1,100
square meters (11,840 square feet) and
further if the lands are suitable and
an appropriate year round system can
be installed with Health Unit approval
then the lot area could be further
reduced by obtaining a minor variance
from the Committee of Adjustment.
In keeping with these policies we have
the application before us tonight,
requesting a rezoning from Shoreline
Residential (Seasonal use) to General
Residential (Permanent use) for a lot
having 30 meters of frontage, 1,830
square meters lot area (19,698 square
feet). A copy of a certificate of
approval from the Health Unit was
submitted with the application.

As there was no one present at this Public Meeting, no
questions were asked.
The Reeve in closing the meeting, thanked those in attendance
for their participation and advised Council would consider all
matters before reaching a decision. He also advised those
present that if they wished to be notified of the passing of
the proposed by-law, they should leave their name and address
with the Clerk.
