THE CORPORATION OF THE TOWNSHIP OF MEDONTE
Minutes of a Regular Meeting of Council of the 'Township of Medonte held on March
23, 1992 at 7:00 p.m. in Council Chambers, Moonstone.

Reeve Beard called the meeting to order at 7:00 p.m.
ADOPTION OF MINUTES
Resolution 92-78 was passed as follows:
" That the minutes of a Regular Meeting of Council held on March 9, 1992 and the
minutes of a Special Meeting of Council held on March 13, 1992 be adopted as
printed and circulated".
Council then dealt with the development charges study and By-law.
Resolution 92-79 was passed as follows:
" WHEREAS the Development Charges Act, R.S.O. 1990, c.D.9 enables the Council of
a IVlunicipality to pass by-laws for the imposition of a development charge
against land located in the Municipality where the development of the land
would increase the need for municipal services.
AND WHEREAS Council has reviewed the Township of Medonte Development Charges
Act Study prepared by Reid and Associates Limited and dated December, 1991, and
the Addendum thereto dated the 3rd day of March, 1992.
AND WHEREAS Council held a public meeting in accordance with Section 4 of the
Development Charges Act in order to permit the public to make representations
with respect to the Township's Development Charges proposal.
NOW THEREFORE BE IT RESOLVED THAT:
1 . The Township of Medonte Development Charges Act Study prepared by Reid and
Associates Limited, and dated December, 1991 be amended by the Addendum to
the Study prepared by Reid and Associates Limited and dated March 3, 1992;
2. The Growth Projections set out in Charts 2 and 3 of the said Study be
approved;
3. The Capital Expenditures Plan set out in Charts 4, 5 and 6 of the said
Study be approved;
4. The Service Standards set out Charts 4, 5 and 6 of the said Study be
approved;
5. The remaining policies and recorrmendations set out in the said Study be
approved" .

Resoltuion 92-80 was passed as follows:
" That a By-law with respect to Development Charges as amended bE? considered read
a third time and passed this 23rd day of March, 1992 and numbered By-law 1992-
16" .
Resolution 92-81 was passed as follows:
" WHEREAS the Development Charges Act, R.S.O. 1990, c.D.9 enables the Council of
a Municipality to pass by-laws for the imposition of a development charge

AND WHEREAS Council passed By-law 92-1 6 on March 23, 1992, pursuant to the
Development Charges Act;
AND WHEREAS subsection 14 ( 1) of the Development Charges Act provides that,
where charges related to development have been paid prior to the enactment of a
Development Charge By-law, a Municipality shall give a credit for the amount of
the charge paid against the development charges payable under the Development
Charge By-law;

AND WHEREAS Subsection 3( 3) of the Development Charges Act permits Council to
designate the areas within which a development charge will be imposed;
NOW THEREFORE BE IT RESOLVED THAT:

1. Council does hereby confirm and ratify the Residential Development Charge
Exemption Policy hereto annexed and marked as Schedule "A" to this
Resolution" .

SCHEDULE "A"
RESIDENTIAL DEVEIDPMENT CHARGE EXEMPTION POLICY
1. Upon the development of any vacant lot of record, and in respect of which no
further act as set out in Section 3( 1) (a) to (g) of the Development Charges
Act, R.S.O. 1990, c.D.9 is required, save and except for the issuance of a
Building Permit, no development charge shall be payable under By-law 92-
16 upon the issuance of a Building Permit for the construction of the first
dwelling unit constructed on such lot, provided that the owner of the lot as
of the date the application for building permit is made was the owner of that
lot on the date that By-law 92-16 was passed.
2. Section 1 shall not apply in the event of the redevelopment of any vacant lot
of record.
3. For the purposes of this policy, the term "vacant lot of record" means a
parcel of land with frontage on an assumed street or road upon which no
dwelling unit has been constructed, and that is:

(a) Not less than a whole lot on a Registered Plan of subdivision, but a
Registered Plan of subdivision for the purposes of this paragraph does
not include a Registered Plan of Subdivision which has been deemed not to
be a Registered Plan of Subdivision under a By-law passed pursuant to
Section 50 of the Planning Act, R.S.O. 1990, c.P.13, or
(b) Not less than a parcel of land that carplies with the provisions of the
Planning Act, where such land is subject to part lot control and is
wi thin a Registered Plan of subdivision, or
-
( c) Not less than a whole lot, the description of which is the same as in the
deed which has been given consent pursuant to Section 53 of the Planning
Act, or
(d) Not less than the whole remnant remalnlng to an owner or owners after a
conveyance made with consent pursuant to Section 53 of the Planning Act,
or
(e) Not less than the whole of a legally separate parcel of land, where the
owner of such parcel of land does not retain the fee or the equity of
redemption in, or a power or right to grant, assign or exercise a power
of appointment in respect of any land abutting the said parcel of land,
and

(f) Existing on the date of enactment of By-law 92-16.
4. This policy shall remain in effect from the date of passage of By-law 92-
16 to and including the 31st day of December, 1992.
Council reviewed the proposed 1992 Roads Budget.
Resolution 92-82 was passed as follows:
" That Council petitions the Ministry of Transportation for Subsidy on their 1992
Program of Expenditures in the amount of $965,400.00".
DELEGATIONS
1 ) Mr. Paul Sheppard, pt Lot 13 and 14 Con 1 0 approached Council about developing
his lands for a golf course. He explained he has 260 acres, about 60 acres
wooded with the Coldwater River running through the property. He noted that
the lands were agricultural but that they would make an excellent golf course.
He advised that he has had preliminary discussions with the Ministry of
Natural Resources and the Ministry of Environment. Council expressed concern
over taking good agricultural lands out of production and deferred any
decision until the Clerk had contacted the Ministry of Agriculture & Food.
2) Council met with a delegation of members from the fire department. Councillor
Martin advised that the City of Brampton has a 1984 1050 Pumper with a new
body coming available in 5 to 6 weeks at a cost of $70,000.00. He advised
that the Fire Department requires a Pumper and Tanker now and that this was an
excellent opportunity to purchase a good used pumper. He requested Council
borrow the funds to be paid back over the term of Council. Deputy Reeve
Dalziel and Councillor Dickie expressed their concern over the Township Budget
and suggested the matter should be deferred. Chief Eakley advised the Truck
would not be available and that Council had to provide the Fire Department
with the equipment to do the job.
Resolution 92-83 was passed as follows.:
" That Council adopts the minutes of a Protection to Persons and Property
Committee meeting held March 9/92".
Resolution 92-84 was passed by recorded vote as follows:
" That Council proceed with the purchase of a used Fire Department 1984
Pumper at an estimated cost of $70,000.00 and that the purchase be funded
by a loan from the Township bank to be repaid in three installments over
the term of this Council".

PASSING OF BY -LAWS
Resolution 92-85 was passed as follows:
" That a By-law to amend By-law 1991-09 be considered read a first and second
time, read a third time and passed this 23rd day of March, 1992 and number By-
law 1992-17".

BUSINESS
1) Resolution 92-86 was defeated as follows:
" That Council approves of a payment in the amount of $458. 55 to the Township
of Oro being the Township cost towards legal services regarding
restructuring".

2) Resolution 92-87 was passed as follows:
" That Council approves of a payment in the amount of $32.10 to the Township
of Oro, being 50% of the cost of a copy of the County of Oxford Official
Plan" .

3) Council reviewed a request from MacKell Development Consultants on behalf of
Mr. & Mrs. Larkins pt Lot 19 Con 3 for an Official Plan Amendment to allow for
a severance in the Agricultural District. Council directed the Clerk advise
that as Council is amending their Official Plan and their serverance policy
they are not wanting to deal with site specific amendments at this time.
4) Council approved of Reeve Beard meeting with Seeley & Arnill to discuss their
development proposal in Oro Township.
5) Resolution 92-88 was passed as follows:
" That Council approves of proceeding to a Public Meeting for a rezoning pt
Lot 66 Con 1, from Recreational Residential (R4) to Shoreline Residential
(R5)".
6) Resolution 92-89 was passed as follows:
" That Council of the Township of Medonte endorses resolution 108/92 of the
Township of Flos and requests the Province of Ontario exempt agricultural
buildings from the requirement of using graded lumber".
7) Resolution 92-90 was passed as follows:
" That Mr. James Shellswell be authorized to attend the Georgian Bay
Waterworks Conference to be held in Thornbury on April 22/92".
8) Resolution 92-91 was passed as follows:
" That the minutes of a meeting of the Planning Advisory Carmittee held on
March 16/92 and the recorrmendations contained there in be adopted".

9) Resolution 92-92 was defeated as follows:
" That Gerry Ball be authorized to attend the C.S. Anderson Road School to be
held May 3 to 6 in Guelph, Ontario".
10) Resolution 92-93 was defeated as follows:
" That Gary Cunnington be authorized to attend the Association of Clerks and
Treasurers Convention to be held June 21 to 24/92 in Toronto".

11) Resolution 92-94 was passed as follows:
" That Council of the Township of Medonte requests that the Ministry of
Transportation provide a turning lane for West Bound Traffic on Highway 12
at its intersection with the Mount St. Louis Road and Condor Drive & County
Road 19.
Various other reports and pieces of correspondence were presented, discussed and
filed as information.

Resolution 92-95 was passed as follows:
