Heritage Designation: Coulson Church The subject property is a privately-owned former church located on Lot 1 Concession 6, Oro- Medonte (343 Horseshoe Valley Rd. W.) The building in question sits on the northeast corner of the Walker farm (approximately 80.2 hectares) located along Horseshoe Valley Road West, between Line 5 North and the Sugarbush subdivision. Surrounding land uses consist mostly of woodlots, agricultural uses and residential uses. Description of Building/Structure - Coulson Church Coulson Church, built in 1881, is a one-room, one-storey building that represents the type of rural public building common in late nineteenth century Ontario. The exterior is the original clapboard siding. It has a rectangular plan with three windows on each side and a gable roof with return eaves. On the north end is a small entry porch. There is a second door on the south end which was added in the 1960s. The interior features the original plank floors, a pressed tin ceiling, a small raised platform at the south end and original pews along the walls. The centre pews were stolen during a break-in in the 1980s and have been replaced with new ones to replicate the originals. In 1956 it was in a state of disrepair and a new roof was installed, the interior painted and papered, and the broken windows repaired. It was closed as a place of worship in 1965. In 2010 it became the property of the Walker family who further restored it with painting and repairs to the plaster. Evaluation under Ontario Regulation 9/06 Section 1(2) of O. Reg 9/06 outlines the criteria for determining whether a property is of cultural heritage value or interest. In order for a property to be designated under Section 29 of the Heritage Act, R.S.O., 1990 c. P. 13, the property is required to meet two or more of the criteria. The criterion is separated into three main categories: 1. Historical or Associative Value; 2. Design or Physical Value; and, 3. Contextual Value. Page 17 of 139 5.a) Minutes of Heritage Committee meeting held on Monday, May 12, 2025. Historical or Associative Value In 1831 the area was opened to European settlement. Regular church attendance was important to the settlers and the lack of a dedicated place of worship meant travel over difficult terrain to communities of some distance. In 1880, local residents determined to build a church of their own. John Tudhope Walker was a member of a pioneer family from the 7th line at Coulson. He acquired the farm at Lot 1, Concession 6, Oro in 1879. The following year, he offered a corner of his field for a church and horse shed with the stipulation that it could be used by any Protestant denomination for public worship. Lumber and materials were donated by William Seymour who owned the farm directly east and James Cooke who farmed on the top of the next hill. The church was built by volunteer labour under the supervision of local builders Beard and Buchanan and dedicated in 1881. This team built several significant buildings in early days, including the first Coulson School which previously stood beside the church. On alternate Sundays there was a worship service for the Methodists (served from Warminster) and Presbyterians (served from Jarratt's Corners), with Anglicans meeting occasionally (served from Fairvalley). It was an active church which served the community through various groups. The Methodist congregation consolidated their hold on the population by establishing a Sunday School. Young graduates became involved in various church groups, eventually joining the Methodist Church. As a result, this church entered the newly formed United Church of Canada in 1925 with "Church Union" (a merger of four Protestant denominations). In 1938, due to decreasing attendance and difficulty finding leadership, services were discontinued. For 18 years it sat in a state of gradual deterioration. In 1956 the community moved to restore it. A descendant of one of Coulson's original pioneer families, Dr. Patricia Laing (nee Patterson) of Detroit, donated funds for the church's restoration. Once again, with the help of volunteer labor the church was brought to life. In 1965 the church was closed by the United Church of Canada and kept in repair by the people of the community for special services. In 2010 the Walker family acquired the historic church in order to save it. The centre pews were re-built by Ian Walker and repairs and painting completed. The Walker family is committed to the preservation and restoration of the church as a heritage site. Coulson Church was built and re-built with volunteer labour and materials. In its early days the space was shared by multiple denominations. From its very beginnings it has stood as a symbol of community co-operation and pride. Many of the early buildings that formed the pioneer hamlet of Coulson have disappeared. The church remains an important connection to the heritage of the community. Design or Physical Value Coulson Church is an example of the Classical Revival style which reflects the simple, agricultural life that characterized late nineteenth-century Ontario. These early churches typically featured rectangular plans, a gable roof and clapboard siding. This simple structure tells a story of the past, while highlighting the high degree of craftmanship of local builders, "Beard and Buchanan". This team built several significant buildings in early days, including the first Coulson School which formerly stood beside the church. This is particularly exemplified through the following original components of the building: 1. Clapboard Siding Wooden clapboard siding was a common material for Ontario's early vernacular architecture. The use of clapboard in Canadian construction can be traced to the settlers who brought European building techniques with them. Early clapboards were made of wood and were essential for protecting buildings from our harsh weather conditions. Eaves Returns The building features "eaves returns"— the extension of the eaves around the corner at the gable ends forming a return of the cornice. They are used on the main roof and the roof of the small entry porch. This further suggests the influence of the Classical Revival Style of the time. Eaves returns have both functional and decorative purposes. They help protect the building's exterior from rain and snow by directing water away from the walls and foundation. At the same time, they add to the visual appeal of a building, offering a decorative element. 3. Pressed Tin Ceiling The ceilings of Coulson Church are finished with tinplate with designs pressed into them. A tin ceiling is an architectural element that was very popular in Victorian buildings in North America in the late 19th century. Original plank flooring t. Contextual Value The "little white church" has stood watch on the top of Coulson hill for over 140 years. It is physically, visually and historically linked to its surroundings. The building has welcomed members of the community since its construction in 1881, and promises to serve the surrounding area as a gathering place in the future. Coulson Church is a landmark for the community and a reminder of its past. Evaluation In summary, Coulson Church meets the following criteria: 1. The property has historical value or associative value because it has direct associations with a theme, event, belief, person, activity, organization or institution that is significant to a community. 2. The property has historical value or associative value because it yields, or has the potential to yield, information that contributes to an understanding of a community or culture. 3. The property has historical value or associative value because it demonstrates or reflects the work or ideas of an architect, artist, builder, designer or theorist who is significant to a community. 4. The property has design value or physical value because it is a rare, unique, representative or early example of a style, type, expression, material or construction method. 5. The property has contextual value because it is physically, functionally, visually or historically linked to its surroundings. 6. The property has contextual value because it is a landmark. Statement of Cultural Heritage Value Coulson Church, situated on the northeast corner of the property municipally known as 343 Horseshoe Valley Road W. (Lot 1, Concession 6, former Township of Oro) holds cultural heritage value and interest to the Township of Oro-Medonte. This church stands as a reminder of community cooperation and collaboration which characterized the early days of settlement in rural Ontario. It is one of a few remaining buildings constructed under the supervision of "Beard and Buchanan", local builders of the day. The clapboard siding and eaves returns represent a typical 19th century building technique. The interior tin ceiling is a rare example of this architectural feature. Municipal Naming serves highlight local heritage or natural environmental features, as well as a method of commemorative recognition to honour events and individuals' outstanding achievements, distinctive service or significant community contributions. The Township of Oro-Medonte further recognizes and supports Naming Rights as an alternative revenue generation strategy to offset costs associated with the provision of municipal services. Naming Rights arrangements shall benefit both the Township and the Naming Rights Purchaser with a final goal of generating revenue to enhance the experience of the users of the Township program, event, activity, project or Township asset or to allow for the Township program, event, activity or a project to exist. 1. PURPOSE The purpose of this policy is to: i. Streamline and define the authorizing process and management of Municipal Naming and Naming Rights to ensure a positive municipal image and enhance Township assets, products and services; ii. SCOPE This policy applies to all municipal assets, including but not limited to parks, amenities, facilities, and properties and public spaces within the jurisdiction of the municipality. It governs the processes and criteria for: i. Naming Municipal Assets: Establishing guidelines for naming (or renaming) municipal assets based on their historical, cultural, or social significance to the community. ii. Naming Rights: Outlining the terms and conditions for granting naming rights to municipal assets in exchange for financial or in-kind contributions. This includes ensuring that naming rights agreements align with the municipality's strategic goals, values, and community standards. 3. DEFINITIONS a. "Administration" means the administration of the Township; b. "Advertising" means a contractual arrangement for a defined period of time where a third party provides a financial contribution in return for rights to place a single message on a medium (e.g., billboard, dasher board, fence, etc.) where the content is controlled by the third party and approved by the Township; for certainty, an advertising arrangement does not provide the third party with further substantive rights such as in Naming Rights or Sponsorship arrangements; c. "Asset Steward" means the Director of the Township department (or designate), that is ultimately responsible for the long-term operation and maintenance of the Township asset, and is accountable for the final recommendation regarding Naming of the Township Asset (excluding naming of Communities and/or roadways; the Department responsible for subdivisions as part of the planning and development process is responsible for the final naming recommendation of Communities and/or roadways); d. "Township Asset" means an item, object, thing (including a service, program, event or activity) or real estate property owned by the municipality; e. "Township"/ "the Township" means the Township of Oro-Medonte; f. "Community" means a geographic area comprehensively planned and developed over time; g. "Council" means the municipal Council of the Township of Oro-Medonte; h. "Grant" means a financial award without valuable consideration by public or private foundation, registered charitable organization or other order of government (a `grantor') to the Township that meets the grantor's funding priorities, is for a defined period of time and includes reporting obligations on the Township; k. "Municipal Naming" means naming of Township assets including parks, facilities, properties,and other municipal assets by the Township, without the exchange of goods, services or financial contribution between the Township and Naming Applicant; I. "Naming Rights" means a contractual arrangement for a defined period of time where a third party provides goods, services or financial contribution in return for access to the commercial/marketing potential associated with rights for the inclusion and public display of the third party's name as part of the name of a Township asset; m. "Partner" means an independent organization that has an established relationship with the Township and who collaborates with the Township to deliver positive results to residents (specific conditions of well-being for children, adults, families, communities and businesses in Oro-Medonte; results may include the positive benefits generated by the activities carried out by the Township and Partner during the course of their relationship). For certainty, third parties who enter into market rate agreements with the Township, including leases for Township assets, or hold permits with The Township for activities or events are not considered "Partners", and; n. "Valuation" means a current comprehensive review of a Township asset's overall value as it relates to Naming Rights opportunities or proposals. 4. APPLICABILITY 4.1 Municipal Naming Requirements Applicability: i. Requirements of this policy for Municipal Naming of Township assets (other than Communities and roadways) apply to all Township departments, business units, Partners and naming applicants involved in such naming applications; refer to the policy procedure 5.1 and Schedule 1. Proposal Submission - Community members, organizations, or council members may submit naming proposals for Township assets (other than Communities and roadways) managed by the Township, or by Partners, to the Asset Steward. Each proposal must include the suggested name, rationale, and any supporting documentation. Proposal submissions may be solicited publicly by the Asset Steward. iii. Review and Shortlisting - The Asset Steward shall evaluate the naming proposal against the policy requirements, including requirements outlined in Schedule 1 "Requirements for Naming of Township Assets (Other Than Communities and Roadways)". Naming proposals that comply with the guidelines will be shortlisted for further consideration. iv. Public Consultation - The Asset Steward may circulate the naming proposal to the affected stakeholder groups, as appropriate, for feedback. This may also be completed in accordance with 5.1.ii (Proposal Submission) of this procedure. Where deemed prudent, the shortlisted names may be presented to the public for feedback. The Asset Steward shall prepare the naming report and with asset naming recommendations for consideration by Council. vi. Announcement and Implementation - The chosen name will be officially announced to the public. The Asset Steward shall inform the naming applicant of the acceptance (or rejection if necessary) of the naming proposal and coordinate with the applicantany required post- naming arrangements (e.g., creation and installation of the signage, naming announcements, etc.). 5.2 Procedure for Naming Rights for Township Assets i. The Asset Steward shall notify all other Director(s), or the Senior Management Team, that Naming Rights are being proposed for a municipal asset prior to soliciting or agreeing to a Naming Rights proposal (if applicable). ii. The Asset Steward shall complete a due diligence review to ensure appropriateness of the proposed Naming Rights arrangement. The Asset Steward shall develop Naming Rights agreements in consultation with the Finance department and a legal review by Township solicitors. iv. If the proposed Naming Rights arrangement affects more than one department it shall be endorsed by the CAO and the Township's Chief Financial Officer (or their designates) prior to submission to Council. V. The Asset Steward shall prepare a report and make a recommendation for consideration and final decision by Council. The report shall include the fundamental terms and conditions of the proposed Naming Rights arrangement, and any associated conditions. vi. Upon approval of the fundamental terms and conditions for the proposed Naming Rights arrangement by Council, the Township is authorized to enter into a Naming Rights agreement with the Naming Rights purchaser. Naming Rights agreements shall be executed on behalf of the Township by those authorized as per relevant existing delegation(s) of authority by the CAO. vii. The Asset Steward shall be responsible for stewarding the implementation of the Naming Rights arrangement including sign installations and maintenance. 6. Municipal Naming of Township Assets 1.1 What Township assets can be named 1.1.1 Only Township assets in common use by the public shall be specifically named. 1.1.2 Township-owned facilities used as work areas shall be named according to this policy and as the operational procedure requires. 1.2 How Township assets can be named 1.2.1 The proposed Township asset names should either reflect Oro-Medonte's Heritage or local geographic feature(s), including flora and fauna, and/or further a sense of community. 1.2.2 While the preference is that asset names shall follow article 1.2.1, consideration may be given to naming Township assets after individuals, groups or organizations, with the following guidelines: a. Notable residents, Canadians, international individuals and groups that have displayed exemplary public or community service; b. Former elected representatives of Council, Members of Parliament (Federal), Canadian Senate (Federal) and Members of the Legislative Assembly (Provincial); and C. Individuals, groups or organizations who have provided a donation, including in-kind, to The Township. d. Names should be thoroughly vetted for suitability. 1.3 Other requirements for naming Township assets 1.3.1 Township assets, once named, shall not normally be renamed. Council may consider renaming a Township asset in exceptional circumstances. 1.3.2 When naming Township assets after individuals: a. Names that are otherwise objectively offensive, misleading, or ineffective are also not permitted. 1.3.4 Proposed Township asset names shall be distinct from names used for other Township assets of similar nature elsewhere in Oro-Medonte (e.g., park and cemetery). Similar sounding names shall be avoided due to confusion it may create for citizens or emergency services. Schedule 2 - Requirements for Naming Rights for Township Assets Operated by The Township 1. The Township shall only enter into agreements with Naming Rights purchasers who align to the Township's priorities and policies. 2. All Naming Rights (including Naming Rights components associated with signage, branding, publicity,advertising and naming rights implementation) shall adhere to all applicable Township bylaws and policies and all applicable provincial and federal legislation. 3. The name of a Township asset that can be confused with other Township assets of similar nature shall also include a Community name or geographic indicator. The name shall consider community and/or historical significance and/or advise of the purpose of the Township asset. 4. All costs associated with the implementation of a Naming Rights arrangement shall be covered by the purchaser or by the revenue generated from such sale, and not from the Township's annual operating budget. 5. Proceeds received by the Township for Naming Rights are to be used for capital maintenance, enhancement costs (either operational or capital), or the provision of programs and services as determined by the Asset Steward. 6. Background The purpose of this report is to submit a draft Fees and Charges By-law for the Building and Planning Divisions for Council's consideration and adoption. The commencement of the project was approved by Council in 2024, in an effort to move Building and Planning Division fees closer to cost recovery for services provided by the divisions.Various Township departments and divisions have been working directly with Watson and Associates over the course of 2024 and into 2025 to identify work processes and associated time estimates for each Building and Planning process/application to arrive at updated fees that attempt to move towards a modernized cost recovery model. This work has resulted in the completion of a Development Fee Review Report prepared by Watson and Associates dated February 26, 2025 and the preparation of an updated draft fee By-law for the Building and Planning Divisions (Attachment 1). The recommendations and proposed fees have been available to the public for review since March 12, 2025. A presentation was also provided by Watson and Associates on March 12, 2025, which summarized the process, current financial outlook, key recommendations and projected revenues based on the proposed fees. Notice of a statutory public meeting for Building Fees was circulated on April 1, 2025 directly to stakeholders and builders via email. Standard municipal social media channels (Township website, Facebook etc..)were also utilized to provide broad Township-wide notification. Engagement/Public Meeting A public meeting for Building Division Fees was held on April 23, 2025 as per statutory requirements. There were not any members from the public present at the public meeting and formal comments have not been received regarding the proposed fee increases. Planning Division fees do not require a public meeting, however best practice is to inform known stakeholders and provide the fees for review in advance of fees coming into effect. Calculation of Permit Fees Permit fees shall be calculated based on the formula given below, unless otherwise specified in the schedule. The minimum fee for a permit shall be in accordance with the specified rate for the current year unless specifically stated as a flat rate. Any fee not determined in the following is determined at the discretion of the Chief Building Official. Permit Fee=Service Index(SI)x Total gross floor area (A) Note: Gross floor area (A)calculated in square feet and is measured to the outer face of exterior walls and to the centre of fire walls. 2. Permit Fees Building Classification &Construction Service Index(SI) Table 2.1 $/ftz 3. Refund of Permit Fees 3.1 Pursuant to this by-law, the portion of the total calculated permit fees that may be refunded shall be a percentage of the total fees payable under this by-law, calculated as follows in regard to functions undertaken by the municipality: a) 75% if only administrative functions have been performed; b) 50% if administrative and plans examination functions have been performed; c) 25% if the permit has been issued and no field inspections have been performed subsequent to permit issuance; or d) 0% if any field inspections have been performed subsequent to permit issuance. However, in all cases a minimum permit fee will be retained. 3.2 The permit fee shall be returned to the person named on the fee receipt, unless such person advises the Chief Building Official, in writing and prior to release of the refund, of a change in name, in which case the refund shall be returned to the person then authorized to receive it. When only the minimum fee, or less has been collected/submitted, no refund will be processed. 4. Conditional Permits Conditional permit application requests to be reviewed in accordance with the OBC and the current procedure. 4.1 Securities As requested and issued by the Chief Building Official, to be paid in addition to applicable permit fees in accordance with the fees specified in Table 2.1. The amount deemed shall be the amount of the security deposit required in the form of a letter of credit. Cost Recovery Where an Order is issued under the Building Code Act, the property owner or any other person responsible for the action, shall pay fees in accordance with Table 2.1. Where an Order is issued under the Act and where the named achieved eventual compliance with the Order, the Township may choose not to prosecute the named, if satisfactory settlement is reached. 7. Additional Costs When the Township, or another municipal, provincial, or federal agency/entity on the Township's behalf, takes actions or pays money to rectify failures, by-law infractions or situations created by, or on behalf of a person, including but not limited to non-compliance with the terms of any agreement, or permit, or license, such person shall be responsible for all costs paid or payable by the Township including the cost of staff time, equipment expenses and other expenses incurred by the Township. Payment of Fees, Expenses and Actual Costs 2.1 The total amount payable is payable upon receipt of a completed application form and prior to formal presentation to Council or its advisory bodies. Application fees are non-refundable and are applicable on a per lot basis. 2.2 The applicant is liable for any direct costs incurred by the Township during the processing of planning applications including legal, engineering, and other consultant fees. These costs shall be invoiced to the applicant on a monthly basis. In the event there is a security deposit on file with the Township, these fees shall be dedicated from said deposit and where a minimum balance is required throughout the processing of an application as set out in the Schedule of Planning Fees, the applicant shall be invoiced an amount to maintain the balance required for the security deposit. 2.3 Expenses incurred by staff associated with an application in excess of Planning Act requirements and actual costs incurred for such items as advertising, consulting (Planning, Development Engineering, and other) and legal will be charged directly to the applicant and deducted from the refundable deposit. As expenses and actual costs are incurred on behalf of the application, they will be submitted to the applicant for reimbursement so that the initial refundable deposit will be replenished to enable the Township to pay further costs as they are incurred. In the event that the applicant does not maintain the application fee and applicable deposits with the Finance Department then the application will be considered not complete with respect to the payment of fees under the Planning Act. 2.4 Any person making application to the Ontario Land Tribunal shall pay the applicable fees outlined by the Ontario Land Tribunal and/or the Planning Act, as amended. All fees for such applications are to be paid online through the Ontario Land Tribunal e-file service or by certified cheque/money order to the Minister of Finance, Province of Ontario. 2.5 The applicant shall pay all costs associated with a planning development application including Ontario Land Tribunal Hearings and pre-hearing consultation costs and appeal fees. 2.6 Where a Development Application in respect of a Planning Matter is referred to appeals to the Ontario Land Tribunal and the Township and the applicant jointly support the application either as a decision by Development Services Committee prior to the filing of said appeal, or by way of settlement, the applicant shall be responsible for all costs to the Municipality associated therewith. Such costs shall include legal, expert testimony, and administrative and overhead costs. To secure payment of such costs, the applicant will provide the Township upon notice and/or acknowledgement of an appeal to the Ontario Land Tribunal, with an initial deposit of$ 5,000.00 such amount to be increased by an amount determined by the Township in the event the Township determines the nature of the application indicates that $ 5,000.00 may be inadequate. Where a Development Services Committee decision(s) has been appealed and the Committee does not adopt the position recommended by Township staff, then the following provision shall apply in the event the applicant obtains a summons compelling Township staff to attend the hearing of the Ontario Land Tribunal. Staff shall undertake such preparations as required for the hearing and the costs of such preparation and attendance at the hearing, including any legal costs not otherwise associated with the hearing, shall be paid by the applicant who has obtained the summons. In this instance, the fee is $5,000.00 and shall be paid to the Township not later than the day before the Ontario Land Tribunal hearing. Any costs to the Township in excess of the deposit shall be paid to the Township by the applicant upon submission of an invoice thereof. 2.7 The tariff of fees described in Schedule "E" shall not include the processing of objections to amendments, the attendance of the Municipality at Ontario Land Tribunal hearings, the attendance of the Municipality at any public meetings other than those formally required by the Planning Act, the preparation of Subdivision Agreements or the review and approval of engineering drawings relating to subdivisions by the Municipality. The applicant agrees that, should the above become necessary, the applicant will provide the Township with a deposit which shall be determined by the Treasurer on an individual basis, and the applicant will provide a written agreement to pay further deposits as required, and to reimburse any costs not covered by the deposits. 2.8 Refund of Fees: If an application is withdrawn prior to circulation, 75% of the application fee may be refunded. If an application is withdrawn after circulation but prior to a staff report being prepared, 25% of the application fee may be refunded. Applicants that participated in pre-consultation and pay the fee as per Schedule `E' and apply for applications under the Planning Act shall have the pre-consultation fee deducted from the required application fee(s) needed to facilitate the development proposal. 2.9 Reactivation: Any application which has been withdrawn or which has been inactive for 12 months shall be considered abandoned and a full application fee at the current rate shall be required to activate a new application. 2.10 Consulting Services: Where any application requires the Township to hire a consultant to review supporting technical studies on behalf of the Township, the applicant shall be responsible for all costs, and those costs shall be payable upon submission of an invoice from the Township. Assuming data can be supplied by the Township to Watson & Associates Economists Ltd. in early June, population analysis could be completed by late June early July. 2. Public community engagement, by Watson & Associates Economists Ltd., could be scheduled in early September. 3. The Recommendations report and associated by-law would follow. As noted previously, public community engagement is an important component of Ward Boundary Reviews. While public engagement was undertaken in 2021, regarding Final Option 1; it is important to undertake public engagement again, as all ward boundaries are subject to change, including the number of wards within the Township under Final Option 1 changing from six (6) wards back to five (5) wards and the Deputy Mayor position returning to being elected at large. This will provide a two-way communication for new and long- standing residents with respect to this matter. Consultants will share information and data with residents on the reasons for these proposed changes and an opportunity for constituent's to provide feedback prior to approval of the final ward mapping and by-law. As stated in the previous report, while this time frame represents a tight timeline to allow for the 45-day appeal period and have the By-law passed by December 31, 2025, it is more desirable than conducting public engagement during the summer months. Typically ward boundary reviews are conducted with an 8 to 12 year forecast, therefore conducting this review in 2025 may potentially extend the need for a future ward boundary review to post 2030 election. Financial/Legal Implications/ Risk Management Table 1 below provides the updated proposed fees for Watson & Associates Economists Ltd. to complete this project focusing on Final Option 1 of the July 20, 2021 report to Council. Currently there is an allocation of$7,500 in the 2025 budget. Any expenditure beyond this would be unbudgeted and therefore would require Council approval for the over run. Further should this process result in an appeal, additional financial resources would then be required for representation at the appeal. The division issued a Part I under the Township's Dumping By-law as a result of reactive response to illegal roadside dumping on Line 13 North. Staff went through the debris and located evidence that assisted in finding the individual responsible for the illegal dumping. The individual was located based on the debris and was charged. As of April 30, 2025, the division issued a total of sixty-seven (67) parking infractions for various offences under the Township's Traffic and Parking By-law. The division currently does not have any pending court matters and looks forward to moving forward with the Administrative Monetary Penalty System By-law. The AMP's program is currently up and running, for the months of March and April the division did not issue a penalty notice. The Division will continue to focus on an education first approach. The Division experienced five (5) after-hours calls throughout the month of March, where staff followed up the next business day with all five (5). Four (4) were related to the Canine Control By-law and one (1) concern about wildlife. The Division experienced nine (9) after-hours calls for the month of April. Out of the nine (9) occurrences, three (3) were related to the Canine Control By-law. Staff attended one (1) of the three (3) calls to pick up a dog that was found to be at large. The remaining six (6) calls were followed up on the next business day. Licensing/Permits Another responsibility of the division is the review and issuance of permits/licensing. The Township of Oro- Medonte has retained WAMCO Waterworks and Municipal Products (WAMCO) to complete these necessary water meter installations. The Municipal Disaster Recovery Assistance (MDRA) program is available to help municipalities impacted by natural disasters by reimbursing emergency response and recovery costs on a cost-shared basis. I understand the Township of Oro-Medonte is intending to apply to the MDRA program for assistance with ice storm costs by the deadline of July 28, 2025. Any proposal to be based upon the deal that was reached between the City of St.Thomas and the Municipality of Central Elgin. St.Thomas&Central Elgin Following this meeting,the Mayor of Barrie sought out the details of the agreement between St.Thomas and Municipality of Central Elgin, in order to replicate and offer based on the aforementioned terms.As part of the agreed terms between the two municipalities,St.Thomas is to pay cash in two ways: 1. $10 million in upfront,one-time cash 2. $1 million per annum for five years The total of this proposal was$15 million. Additionally,St.Thomas was to provide 2000 units worth of water/wastewater capacity to convert an area previously used a healthcare centre to residential development. In exchange,St.Thomas received 2000 acres of land for development for the Volkswagen EV Factory.This equates to a ration of 1:1 for acres of land to units of servicing,and a value of$7,500 of cash per acre.Additionally,the Province of Ontario and Volkswagen provided St.Thomas with contributions for their water/wastewater capacity. Refund of Permit Fees 3.1 Pursuant to this by-law, the portion of the total calculated permit fees that may be refunded shall be a percentage of the total fees payable under this by-law, calculated as follows in regard to functions undertaken by the municipality: a) 75% if only administrative functions have been performed; b) 50% if administrative and plans examination functions have been performed; c) 25% if the permit has been issued and no field inspections have been performed subsequent to permit issuance; or d) 0% if any field inspections have been performed subsequent to permit issuance. However, in all cases a minimum permit fee will be retained. 3.2 The permit fee shall be returned to the person named on the fee receipt, unless such person advises the Chief Building Official, in writing and prior to release of the refund, of a change in name, in which case the refund shall be returned to the person then authorized to receive it. When only the minimum fee, or less has been collected/submitted, no refund will be processed. 4. Conditional Permits Conditional permit application requests to be reviewed in accordance with the OBC and the current procedure. 4.1 Securities As requested and issued by the Chief Building Official, to be paid in addition to applicable permit fees in accordance with the fees specified in Table 2.1. The amount deemed shall be the amount of the security deposit required in the form of a letter of credit. Payment of Fees, Expenses and Actual Costs 2.1 The total amount payable is payable upon receipt of a completed application form and prior to formal presentation to Council or its advisory bodies. Application fees are non-refundable and are applicable on a per lot basis. 2.2 The applicant is liable for any direct costs incurred by the Township during the processing of planning applications including legal, engineering, and other consultant fees. These costs shall be invoiced to the applicant on a monthly basis. In the event there is a security deposit on file with the Township, these fees shall be dedicated from said deposit and where a minimum balance is required throughout the processing of an application as set out in the Schedule of Planning Fees, the applicant shall be invoiced an amount to maintain the balance required for the security deposit. 2.3 Expenses incurred by staff associated with an application in excess of Planning Act requirements and actual costs incurred for such items as advertising, consulting (Planning, Development Engineering, and other) and legal will be charged directly to the applicant and deducted from the refundable deposit. As expenses and actual costs are incurred on behalf of the application, they will be submitted to the applicant for reimbursement so that the initial refundable deposit will be replenished to enable the Township to pay further costs as they are incurred. In the event that the applicant does not maintain the application fee and applicable deposits with the Finance Department then the application will be considered not complete with respect to the payment of fees under the Planning Act. 2.4 Any person making application to the Ontario Land Tribunal shall pay the applicable fees outlined by the Ontario Land Tribunal and/or the Planning Act, as amended. All fees for such applications are to be paid online through the Ontario Land Tribunal e-file service or by certified cheque/money order to the Minister of Finance, Province of Ontario. 2.5 The applicant shall pay all costs associated with a planning development application including Ontario Land Tribunal Hearings and pre-hearing consultation costs and appeal fees. 2.6 Where a Development Application in respect of a Planning Matter is referred to appeals to the Ontario Land Tribunal and the Township and the applicant jointly support the application either as a decision by Development Services Committee prior to the filing of said appeal, or by way of settlement, the applicant shall be responsible for all costs to the Municipality associated therewith. Such costs shall include legal, expert testimony, and administrative and overhead costs. Page 17 of 19 Page 136 of 139 17.a) 2025-048: A By-law to Amend By-law 2024-134, "A By-law of The Corp... To secure payment of such costs, the applicant will provide the Township upon notice and/or acknowledgement of an appeal to the Ontario Land Tribunal, with an initial deposit of $ 5,000.00 such amount to be increased by an amount determined by the Township in the event the Township determines the nature of the application indicates that $ 5,000.00 may be inadequate. Where a Development Services Committee decision(s) has been appealed and the Committee does not adopt the position recommended by Township staff, then the following provision shall apply in the event the applicant obtains a summons compelling Township staff to attend the hearing of the Ontario Land Tribunal. Staff shall undertake such preparations as required for the hearing and the costs of such preparation and attendance at the hearing, including any legal costs not otherwise associated with the hearing, shall be paid by the applicant who has obtained the summons. In this instance, the fee is $5,000.00 and shall be paid to the Township not later than the day before the Ontario Land Tribunal hearing. Any costs to the Township in excess of the deposit shall be paid to the Township by the applicant upon submission of an invoice thereof. 2.7 The tariff of fees described in Schedule "E" shall not include the processing of objections to amendments, the attendance of the Municipality at Ontario Land Tribunal hearings, the attendance of the Municipality at any public meetings other than those formally required by the Planning Act, the preparation of Subdivision Agreements or the review and approval of engineering drawings relating to subdivisions by the Municipality. The applicant agrees that, should the above become necessary, the applicant will provide the Township with a deposit which shall be determined by the Treasurer on an individual basis, and the applicant will provide a written agreement to pay further deposits as required, and to reimburse any costs not covered by the deposits. 2.8 Refund of Fees: If an application is withdrawn prior to circulation, 75% of the application fee may be refunded. If an application is withdrawn after circulation but prior to a staff report being prepared, 25% of the application fee may be refunded. Applicants that participated in pre-consultation and pay the fee as per Schedule `E' and apply for applications under the Planning Act shall have the pre-consultation fee deducted from the required application fee(s) needed to facilitate the development proposal. 2.9 Reactivation: Any application which has been withdrawn or which has been inactive for 12 months shall be considered abandoned and a full application fee at the current rate shall be required to activate a new application. 2.10 Consulting Services: Where any application requires the Township to hire a consultant to review supporting technical studies on behalf of the Township, the applicant shall be responsible for all costs, and those costs shall be payable upon submission of an invoice from the Township. In the event the Page 18 of 19 Page 137 of 139 17.a) 2025-048: A By-law to Amend By-law 2024-134, "A By-law of The Corp... invoice is not paid in full, the application will be placed on hold and no further work will be completed until payment is received. 2.11 All applicants, in addition to the fees as set out in Schedule "E" attached hereto and forming part of this By-law, shall also be responsible for all legal expenses that may be incurred by the Municipality in connection with their application and those costs shall be payable upon submission of an invoice from the Township. 2.12 That notwithstanding the tariff of fees prescribed in Schedule "E" attached hereto and forming part of this By-law, the Council of the Corporation of the Township of Oro-Medonte may, by resolution, reduce the amount of or waive the requirements for the payment of the fee in respect of the application where the Council is satisfied that it would be unreasonable to require payment in accordance with the tariff.
