07 15 1991 Sp Council Minutes THE CORPORATION OF THE 'IOWNSHIP OF MEOONTE Minutes of a Special Meeting of Council of the Township of Medonte under Section 34 of the Planning Act, held on July 15, 1991 at 7:00 P.M. in Council Chambers, Moonstone. - Present - Reeve - 1. Amos Deputy Reeve - H. Vasey Councillors - J. Patterson - C. Hall - N. Dalziel Also Present - Mr. A. McNair Mr. R. Mills 35 Ratepayers Reeve Amos called the meeting to order 7: 00 P.M. and welcamed those in attendance. - The Clerk advised those in attendance that the Public Meeting was being held under Section 34 of the Planning Act to consider an application for rezoning a Parcel of Land, Pt Lot 17, Con 9 fram Rural (RU) to Rural Exception (RU-12) and Low Environmental Sensitivity (ES2) to permit the use of the existing residence and a contractors shop for the milling of wood and fabrication of structures such as docks, small wood frame buildings etc. including an office and studio and the outside storage of lumber and finished products. He advised that notice was given in accordance with the regulations by placing a notice in the June 25/91 issue of the Orillia Packet and Times and in the Township office and by mailing the notice on June 21/91 to the Ministry of Agriculture & Food, Ministry of Natural Resources, Ministry of Environment, Simcoe County Clerk, Simcoe County Health Unit, Two School Boards and to 8 ratepayers owning lands within 400 feet of the subject property. He advised that prior to the meeting 11 letters of objection had been received and copies given to Council. He advised that the property owner would give a presentation and that Council would then have a question and answer session. He advised that Council would not make a decision until all remarks had been reviewed and requested people to suhnit written corrments. t Mr. Ron Mills then gave a presentation outlining a history of his ownership of the property and a description of the proposal. He noted that a one hectare parcel would be rezoned and then severed to allow the proposed owners of the property to operate a business. He explained that the proposed purchasers both presently worked as teachers and would be operating part time and mostly in the sumner. He advised that they did not expect to have any additional employee's in the beginning. Reeve Amos then opened the floor for questions. t Mr. Paul Devillers, Solicitor, advised he had been retained by the Tremblay's and the Bembens. He filed a petition with over 20 names fram neighbours in the area objecting to the proposal. He also presented a Doctor's letter on behalf of Mrs. Bemben outlining the affects that increased noise could have on her health. Mr. Devillers listed the main concerns of the neighbours as noise, traffic and affects on Environment. He questioned as to whether the existing road was in a condition to handle increased truck traffic. He also noted that there had been two previous severances fram the property and no further severances should be allowed. He also expressed environmental concerns over the disposal of sawdust and the possible burning of treated lumber. He pointed out that under Section 5.5.3 of the Official Plan Council could request an environmental review. He also advised that Section 5.16.4 of the Township Official Plan outlined that the developnent should occur as infilling only and that a severance would contravene the Township Official Plan. He summarized that all the neighbours were against the proposal and asked Council not approve the rezoning. . Mr. McNair explained that other lands on the entire holding were to be zoned Environmental because a survey of the property was now available and the boundaries of the Environmental Zone could now be determined. t Mr. Patcheson, the proposed purchaser gave an explanation of his plans. He advised that the building would be 40' x 60' and that all building would take place inside. He stated he understood the concerns over noise. He said he was a small business and would only expect one delivery truck per week. He advised he was not looking to create a lumber yard. He noted there would be no burning on the property. He advised the sawdust would be sold and that he did not use pressure treated lumber. Ms. Tremblay expressed her concern over the noise fram the operation. Mr. Bemben advised there were 28 names on the petition against the proposal. They were very concerned over noise and traffic on the road. The residents all want the area to remain rural and noise free. Another ratepayer expressed concern as to what might happen on the property after the rezoning went through. Mr. R. Smith also expressed concern over the extra traffic and noise that might occur. He questioned as to whether other lands might be available and whether site plan control would be involved. Mr. McNair advised that the property would be subject to site plan control. Mr. Mills advised that the business would be a small operation, operated only on a part time basis. He also advised that the zoning was site specific and any expansion would require a further rezoning. Reeve Amos advised that no decision would be made until all information was reviewed.
