Arbour opened the meeting with prayer at 9:30 a.m. The minutes of the last regular meeting of October 18, 1982 were on motion of Halfacre and Vousden, confirmed as printed and received. Reeve advised that he had visited Mr. & Mrs. P. Bonney at the home of Charles & Lena Simpson to present Township Certificate to recognize their 60th Wed- ding Anniversary and for the 90th Birthday of Mr. Perry Bonney. Presented copies of letters forwarded as instructed as follows: -Oro Sand & Stone Ltd - advising his tender to Supply, Screen, Haul and Stockpile winter sand had been accepted for tender Contract 82-09 accord- ing to tender as submitted on Township Tender Form for a total of $13,342.00. And letters to Russell H. Stewart Construction Co. Ltd., Cliff Varcoe Ltd and Keith Smith Contracting Limited advising of tender accepted for contract 82-09 and returning their tender cheques. -Bryan Paallo , B& B Auctioneers advising that his Tender for Snow Removal Equipment for Route "B" had been accepted subject to equipment meeting all specifications under Township Tender Contract 82-10. -Jim Kenny advising that his tender for Snow Removal Equipment for Route "C" had been accepted, being part 3 of Tender Contract 82-10. -Oro Septic Services forwarding cheque to cover 4 Portable Units at Oro Memorial Park, 1982 Season (Paid out of Park Land Account) -Crown Garden Centre forwarding cheque in payment for supplying and planting of trees and shrubs at Oro Memorial Park (paid out of Park Land Account) -Gibson/Flood & Associates forwarding cheque in payment of work completed September 29th, being 55% of work completed on Municipal Housing Statement according to Agreement for same. -Skelton, Brumwell & Associates Ltd., recommending extension of Draft Ap- proval 'Hastings Draft Plan' file 43T-25103 with copy of letter to Community Planning Review Branch, Ministry of Municipal Affairs & Housing. -Paul Kitchen, O.L.S. resolution of Council re: Subdividers Agreement re- quirements for 'Randsalu Draft Plan' setting out cash-in-lieu of Parklands Dedication and standard lot levy. -B.S. Onyschuk, Solicitor for Cedarbrook Estates, Quadrant Developments, Plan M-157 with respect to reduction of Letter of Credit, adivsing that Council is prepared to reduce same to $55,000.00. Russell, Q.C. requesting review of draft By-Law with respect to opinion as to sufficiency of By-Law for Encroachment on Road Allowance of Buildings on part lot 27, Concession 3 according to Plan of Survey by R.C. Kirkpatrick, O.L.S. dated October 13, 1982. -Oro Sand & Stone Ltd., re: increase of material extraction from Gravel Pit, Lots 9 & 10, Concession 13, from 200,000 tons to 400,000 tonne. -Chief Administrative Officer, County of Simcoe re: Provisional Draft By- Law to provide for four installments of County Levy in 1983. -Trustees Hawkestone Police Village re: Road dedicated on Plan M-20 and servicing lots on Plan 217 (Allen Street) -William Ormerod, By-Law Enforcement Officer advising that Oro Council will continue to retain him as part time By-Law Enforcement Officer on basis according to resolution of Council passed on June 23, 1982. -Leonard Crawford - advising that he repair ceiling tile and door as per quotation received. Clerk advised that the work has been completed. On motion of Vousden and Halfacre, copies of letters as presented and forwarded accepted as satisfactory and same be placed on file for reference as required. Presented letter from Leighton E. Clark, P. Eng. Secretary, Barrie Suburban Road Commission in reply to Township letter of September 21, 1982 with res- pect to consideration of exchange of portion of County Road No. 20, west from County Road No. 27 to Hawkestone, thence to No. 11 Highway, for an equivalent distance of another road or alternatively as set out in resolu- tion of Council passed at a meeting held on September 20, 1982. Letter ad- vises of resolution of Barrie Suburban Road Commission as follows: "That Oro Council be advised that in accordance with the Public Transporta- tion and Highway Improvement Act the Barrie Suburban Roads Commission does not have the authority to assume local roads as Suburban roads or to revert Suburban Roads to local jurisdiction." On motion of Halfacre and Johnson, letter forwarding resolution of Barrie Suburban Roads Commission as presented be received and a copy of same be forwarded to Oro Station Ratepayers Association. And, further that copies of Township letter to Barrie Suburban Road Commission and letter from the said Road Commission in reply, be forwarded to the Hon. James Snow, Minister of M.T.C. and to local M.P.P. Allan K. McLean, Simcoe East, with request for a reply regarding the matter of concern. ' Presented memorandum from Ministry of Transportation & Communications re- commending payment of Interim Subsidy in the amount of $110,484.68 and that same has been forwarded to General Accountant for payment of Subsidy. on motion of Vousden and Davie, approval of Interim Subsidy payment in amount of $110,484.68 accepted as satisfactory. Presented letter from Hitch House Limited forwarding cheque for $600.00 to cover rental fee for 6 months for Harbour East Sales Office on Plan M-118, situated on Park lot. Letter further requests that since the Sales Office will not be used until the end of April 1983, requesting a reduced rate of $33.00 per month, rather than moving the unit until April 30, 1983. Pg. 561 TWENTY-FIRST MEETING - NOVEMBER 1, 1982 . On motion of Davie and Johnson that receipt of payment of rental fee of $600.00 be acknowledged and Hitch House Limited be advised that the Sales Office situated on the Park Land of Plan M-118 may be left on the site until April 30, 1982, for a reduced fee of $33.00 per month and that ar- rangements for same to be left on the site after that time be at the dis- cretion of the 1983-85 Council. The matter of advertising for a Caretaker of Oro Memorial Park for the 1983 season was again presented, further to resolution of Council of October 5, 1982. On motion of Halfacre and Johnson, that a notice be placed in the Barrie Examiner and Orillia Packet calling for applications for persons to carry out the duties of Caretaker of Oro Memorial Park for the 1983 Season and that the notice be placed in two issues of the paper. Applications to be received by November 12, 1982. On motion of Johnson and Vousden, Council go into Committee of the Whole at 9:55 a.m. On motion of Vousden and Halfacre, Council come out of Committee of the Whole at 10:05 a.m. Presented letter from Township Solicitor in reply to Council's request for . opinion on proposal to option property described as part E~ Lot 9, Ccon. 6. On motion of Davie and Vousden, that letter from David S. White, Solicitor, be received and he be advised that the entire matter be held in abeyance for consideration by the 1983-85 Council. Presented letter from Stuart N. Keyes & Associates Ltd., and letter from Stran-Steel Building Systems with respect to Oro Township Arena structure being the report following inspection of the said building be received and Clerk to forward copy of same to Mr. R. Carstens, Ministry of Labour as previously requested. And, Mr. Stuart N. Keyes, Township Engineer be instruc- ted to have the Steel X bracing adjusted and corrected without any delay. And, that a copy of this correspondence be forwarded to the Township Arena Committee. Presented letter from W.D. Russell, Solicitor for Township of Oro for the review of proposed draft By-Law to allow encroachment of buildings on Lot 27, Conc. 3, encroaching on Line 2, north of Shanty Bay Road, along with recommended revisions to By-Law, and a copy of draft By-Law reviewed accor- dingly which had been forwarded to Solicitor for purchaser of the said pt. lot 27, Conc. 3. And reply from Solicitor advising that the Continental Bank are prepared to pay Township Solicitors costs for review and prepara- tion of Amendments to the By-Law. Also account from Solicitor for the re- view of the proposed draft By-Law was presented showing a total cost of $71.95. . . . . ~ TWENTY-FIRST MEETING - NOVEMBER 1, 1982 On motion of Davie and Johnson, letter from Township Solicitor and draft By-Law revised as recommended be received and Draft By-Law be presented for passing later in the day under By-Laws and copy of same once having received three readings and signed, be returned to Solicitor for purchase along with account from Township Solicitor for review of said draft By-Law. Presented Correspondence, Communications, etc. -Copy of letter to 6 applicants for position of Working Foreman advising them of appointment for interview. -Copy of letter to all other applicants who applied for the position advi- sing them that six persons had been selected for interview and expressing appreciation for interest. -Ron Johnston Insurance advising of accident involving Township Vehicle and forwarding Road Supt's report of same. -Ontario Hydro - copy of letter to O.M.B. advising that settlement had been reached in respect to the proper levels of valuation pursuant to Section 46 of the Power Corporation Act for the property which was subject to appeal. -Secretary-Treasurer, Oro Agricultural Society expressing appreciation for the erection of new flag pole at the fair grounds and new brick gate posts both of which greatly adds to the appearance. -Letter from Norman Emms expressing thanks to Council for the co-operation and support in bringing about the completion of the new flag pole and its dedication at the 130th Oro World's Fair. -Associations of Municipalities of Ontario advising of meeting of AMO Board of Directors to be held November 25th and 26th and Clerk's reply advising that as a Director he will be attending. Pg. 564 TWENTY-FIRST MEETING - NOVEMBER 1, 1982 Dr. R. Shoichet was present at 11:00 a.m. as scheduled according to resolu- tion of Council passed at a meeting held on October 18th and as advised by letter under date of Ocotber 20, 1982. Reeve welcomed Dr. R. Shoichet and asked him to make his presentation for discussion. Dr. Shoichet and advised that he had spoken to a contractor about erection of a fence, who had indicated he would erect a sturdy cedar rail type of fence. This matter was discussed at some length. Councillor Halfacre expressed her opinion and indicated that a 9 strand wire fence is a standard fence for Municipal property. Councillor Johnson concurred with the opinion of Councillor Halfacre. Deputy Reeve Davie commented that he was of the opinion a wire fence should be erected and that the decorative cedar rail type fence could be placed inside the boundry line fence on lot 50, Plan 755 if the owner so desired. Dr. Shoichet advised that in his view and from examination of the present fences a proposed cedar fence would be comparative for persons climbing over same. Dr. R. Shoichet indicated that he would be prepared to pay for the cost of erecting a cedar rail type fence. It was left that the members of Council who so desired, to again inspect the present park fence on the rema1n1ng sides of the Park and the matter be then dealt with later this afternoon. Chief Building Official, James Shellswell was present at 11:25 a.m. to pre- sent his report for the month of October. The following was presented. Committee of Adjustment, Notices of Hearing, Submissions B16/82 Wright; B17/82 Richard; B18/82 and A4/82 Randsalu; B19/82 St. Thomas Anglican Church and B20/82 Bateman. On motion of Halfacre and Vousden, the report of the Planning Administrator be received. Road Superintendent, Fred Haughton was present at 1:05 p.m. to present his report for work done during the month of Ocotber and Voucher 10 to cover same. On motion of Vousden and Davie, report of Road Supt. as presented for work done and expenditures for same, during the month of October be accepted as satisfactory and Treasurer authorized to issue cheques in payment of same to a total of $89,230.03. Road Superintendent reported on progress of work, gravel crushing, ditching and proposal by Bell Canada to install a new cable along the Lakeshore Road, which was discussed by Council and Road Supt. It was suggested that a meet- ing be arranged with Bell Canada to review such proposals with Road Committee. Presented letter from D.A. Webb, Senior Municipal Advisor, Owen Sound Dis- trict, Ministry of Transportation & Communications, confirming telephone conversation and giving formal notice of upcoming meeting concerning the Ministry's proposed new funding arrangements for 1983 and in future years, and that this meeting is to be held on Tuesday, November 2, 1982 in the Orillia Township Office, commencing at 9:30 a.m. It is anticipated that the meeting will be of 2 to 3 hour duration. It is hoped that the Township of On motion of Davie and Johnson, that Chairman of the Road Committee, Road Superintendent and Clerk-Treasurer attend the meeting. Mr. John Vanderwaardt was present at 1:25 p.m. on behalf of Jo-Con Develop- ments with respect to proposed paving of Steel Street, Plan M-66. Jo-Con Developments would like to know by what amount the Letter of Credit would be reduced should approximently 500 feet, namely Steel Street from Gowan Road to William Street be paved. Also would building permits then be released for Phase II of PIan M-66. On motion of Davie and Vousden, that Jo-Con Developments Ltd., be encouraged to proceed with the completion of services on Steel Street, Plan M-66, inclu- is leted to the satisfaction of the Township Engineer and Township Road Supt., and a written request re tion of Letter of Credit is received from Jo-Con Developments Ltd., along with an Engineer's breakdown of all costs to complete the remainder of the services on Plan M-66, according to the Subdividers Agreement, consideration for reduction of Letter of Credit will be given. .. . . . """lIlIIII Pg. 566 TWENTY-FIRST MEETING - NOVEMBER 1, 1982 Trustees, Hawkestone Police Village, were pres~nt at 2:00 p.m. with respect to road on Plan M-20 and other matters. Trustees present were Ralph Leigh, and Mrs. Robyn Fallon. Mr. Leigh advised that as owner of Plan M-20 he had no intention of expend- ing further funds on the road. The base of the road had been contracted to M.T.C. standards at the time the property was sold to Hawkestone Homes Ltd. On motion of Davie and Halfacre, that the Road Committee, Trustees, H.P.V. and representative from M.T.C. meet to consider a solution for to bring the said road up to minimum standards and obtain approval from M.T.C. to accept the said road into the Township Road System as a gravel road rather than a paved road at this time. Mr. Jeff Ginn was present at 2:15 p.m. with respect to severance of a wood lot from Lot 6, Concession 7, property owned by Mrs. Haidle. After discussion of the matter, Mr. Ginn was advised that he make applica- tion to Oro Planning Board for an Amendment to the Official Plan and Zoning By-Law to permit a severance as proposed for an Estate Lot or alternatively make application to Committee of Adjustment for a severance that qualifies under the present policies of the Official Plan. Mr. Garnet Pattenden was present at 2:30 p.m. with regard to property owned by Orton Newton and consideration for a severance of portion along line 11 (County Road No. 20) between Ministry of Public Works lands and last house in Village of Hawkestone on west side of the said Road presently shown in Holding Zone for Phase II of Development of Hawkestone Police Village. Mr. Garnet Pattendent was advised that he should approach Oro Planning Board for an appointment to make his presentation for an amendment to the Official Plan and Zoning By-Law before any application for such a severance could be entertained by the Committee of Adjustment. Presented letter from Ministry of Transportation and Communications advising that pursuant to subsection 29(4) of The Public Transportation and Highway Improvement Act and by virtue of an Order in Council # OC-2652/82, approved Oc tober 7, 1982. The portions of Highway under the jurisdiction and control of the Ministry and shown as Part 5 on Ministry Plan P-1726-108; Part 6 on Ministry Plan P-1726-109; and Part 4 on Ministry PIan P-1726-110, copies attached, have been transferred to the Township of Oro being the Municipality in which they are situate, on and after the day on which the Order was approved. Locations being portions of Road Allowances between Concession 8 & 9 (lot 21) Concession 13 & 14 (Lot 17) and 12 & 13 (Lot 19). Letter further advises that any control signs required are the responsibility of the Municipality. On motion of Vousden and Halfacre, letter and Order in Council and Ministry Plan Nos. 1726-108; 1726-109 and 1726-110, as presented be received and filed for reference for Road purposes and necessary control and signing if required. Presented letter from Robert and Susanne Tatton requesting consideration to permit the placing of a house trailer on their lot for their Mother, so that they would be able to look after her since she has been a life long resident and does not wish to move out of the Township. On motion of Vousden and Halfacre, letter be received and Mr. Robert and Mrs. Susanne Tatton be advised, that although Council of the Township of Oro recognize the good intention, the Township By-Laws with respect to a second residence do not permit Council to make an exception. Presented letter from Ministry of Tourism and Recreation, Community Programs advising of Workshop on "for the Older Adult" and setting out dates for same, ~ to be held in January and February 1983. On motion of Vousden and Johnson, letter and supporting material for Workshop be received and tabled for consideration at a later date. Presented letter from County of Simcoe forwarding report of County Property and Protection Services Committee requesting that each Municipality adopt a uniform marking of wolves killed or destroyed for bounty, which is to consist of the tip of both ears being clipped off approximately one inch and that the 10cal Municipality's By-Law be amended to made the wolf bounty payable on condition that the person claiming the bounty do the clipping of both ears in the presence of the Clerk or designate. Also enclosing supply of forms submitting applications for Wolf Bounty. On motion of Halfacre and Vousden, that the report be received along with forms to submit application for Wolf Bounty and Clerk-Treasurer to use the said forms when submitting application for persons making Wolf Bounty Claim. White be received and filed for reference on the matter referred to. Presented letter from Mr. Lloyd George with respect to passing of By-Law to License and Regulate Adult Entertainment, which had received two readings at a meeting of Council held on October 18, 1982. Letter strongly suggests that Council give final reading to the said By-Law. On motion of Davie and Halfacre, that the letter from Lloyd George as pre- sented, be received and filed. Pg. 569 TWENTY-FIRST MEETING - NOVEMBER 1, 1982 .. Presented Draft By-Law to authorize an Encroachment on the Road Allowance between Range 2 and Concession 3 in the Township of Oro of a two storey brick building (formerly a store) concrete shed and frame shed which had been erec- ted on the East Side of the said Road Allowance and have existed for a number of years. Township Solicitor having reviewed the original draft By-Law and as recommended Amendments have been incorporated to paragraphs 2,3,4,5 & 6. After further consideration, the Amended Draft By-Law to authorize the .encroach- ment on the Road Allowance between Range 2 and Concession 3 on part lot 27, Concession 3, more fully described on Survey by R.C. Kirkpatrick, O.L.S. dated October 13, 1982, attached to the By-Law and forming part of Schedule "A", was on motion of Halfacre and Vousden, introduced as By-Law No. 1286/82 and read a first time. On motion of Vousden and Davie, By-Law No. 1286/82 read a first time, be read a second time. On motion of Davie and Johnson, By-Law No. 1286/82 read a second time, be read a third time. On motion of Johnson and Halfacre, By-Law No. 1286/82 now read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve and Clerk to forward Original and duplicate original By-Law to J.D.D. Graham, Solicitor for the purchaser, to have same registered on Title and request Duplicate Original, after registration, be returned to the Township for files and records. . The matter of further consideration of By-Law 1285/82, being a By-Law to License and Regulate Adult Entertainment, which had received the first and second reading at a meeting of Oro Council held on October 18, 1982 was pre- sented to Council. After review and further discussion, the Reeve called for a motion on the matter. It was moved by Councillor Johnson and Seconded by Deputy Reeve Davie that By-Law No. 1285/82 having been read the second time be read a third time. On motion of Halfacre and Davie, By-Law no. 1285/82 now read a third time, do pass, be engrossed by the Clerk, and signed and sealed by the Reeve. Pg. 571 TWENTY-FIRST MEETING NOVEMBER 1, 1982 Fire Accounts 2417.23 On motion of Vousden and Halfacre accounts as presented be accepted and ap- proved for payment and Treasurer authorized to issue cheques in payment of same. The matter of the boundry fence between the easterly boundry of Shelswell Park and property owned by Dr. R. Shoichet and M.A. Shoichet was again considered further to the discussion by Dr. Shoichet with Council earlier today. Prior to consideration three letters of support from adjacent property owners were presented and read. Deputy Reeve Davie, advised that he had attended at the site of the Boundry Fence and related his findings. After further discussion the following action was taken. On motion of Halfacre and Johnson, that Dr. R. and Mrs. M. Shoichet be advised that should they choose to erect a cedar rail type fence on their own property, inside the boundry line at their expense, Council would have no objection to same provided that the fence erected meets with requirements of a fence in a residential area. And, further that should a Council of the Township of Oro in the future, propose to erect a standard type of fence along the boundry on Township Park Property, it would appear, in Council's wisdom, that it would be within Council's jurisdiction to do so without further discussion with the owners of lot 50, Plan 755.
