COUNCIL CHAMBERS - OCTOBER 4, 1982
. NINETEENTH MEETING
Council met pursuant to adjournment at 9:30 a.m. with the following members

Reeve R.S. Arbour in the chair opened the meeting at 9:30 a.m. with prayer.
The minutes of the last regular meeting of September 20, 1982 were on motion
of Vo~sden and Halfacre, confirmed as printed and received with a correction
on page 530, paragraph 2 and resolution corrected to read:

On motion of Vousden and Halfacre that as recommended by Committee
of Council, Oro Council would be prepared to permit, by exception, the
use of Prime and Double Surface Treatment, MTC Spec. No. 303, in place
of 2" Asphalt on the Road of the Draft Approved Plan of Subdivision, part
Lots 5 & 6, Concession 14, File 43T-81011, subject to M.T.C. Specifications
and approval and subject to verification, on title of each lot, that the
Township will not in the future be held responsible to place asphalt on
the said road. Also that the placing of. entrance culverts be the responsibil-
ity of the owner and user of each lot according to M.T.C. Standards and
installed under the direction of the Township Road Superintendent.

On motion of Halfacre and Johnson, copies of letters as presented and for-
warded, be placed on file for reference.
Presented letter from Head Traffic Section, Ministry of Transportation and
Communications advising that the Planning and Design Branch had advised that
the tapers of acceleration and deceleration have not caused any problems
and that the O.P.P. after having been requested to investigate and check
the matter, have indicated that this section of roadway is operating quite
satisfactorily.
On motion of Halfacre and Davie, letter be received and Mr. Eldon Greer,
who had expressed concern to Council in this regard be forwarded copies of
letters from Head Traffic Section and Planning and Design Section, Ministry
of Transportation and Communications, which indicate that the section of
Roadways in question appear to be operating quite satisfactorily as well
as report from O.P.P. which indicates the same.
Presented letter from Community Programs Consultant, Ministry of Tourism
and Recreation advising that the application for Wintario Non-Capital Grant
for the Oro Township Community Arena has been assigned file No. BAR-82-580061
and advising that it takes approximately two months to complete the process
to provide notification of the decision from time all documents are forwarded.
Also further letter advising that additional information and documentation
is required.
On motion of Vousden and Halfacre, letter be received and filed until further
advised after process of the application has been completed.
Presented letter from Central Data Processing in reply to Township letter
of September 21, 1982 advising, formally offering services to prepare and
submit additional rebates for Retail Sales Tax on a commission basis. And,
that if no money is recovered, the Township will not incur any expense.
On motion of Davie and Johnson, Oro Council would request Central Data Pro-
cessing to prepare a Retail Sales Tax Rebate Claim of Ontario Retail Sales
Tax paid and not claimed for years prior to date for which claims have been
processed and/or received. And, further, that the Percentage Commission be
on the same basis as previous preparation.
Presented letter from Account Manager, Bank of Montreal, advising that the
Irrevocable Letter of Credit No. 4443783S for Norshell Devleopments Ltd.,
will be renewed for a period of one year in the amount of $18,000.00, by
an amended copy of the Original. And, further, that should the Letter of
Credit not be received by September 30, 1982, the letter be accepted as an
undertaking as substitution pending receipt of the formal Letter of Credit
documents. And, presented amended Letter of Credit issued September 24, 1982
(IMPLC/444/31783S) for an amount of $18,000.00. Expiry date of September
30, 1983. Letter includes paragraph requested by the Township.

On motion of Davie and Halfacre, letter advising of renewal and Letter of
Credit (IMPLC/444/31783S) as amended with additional conditions as requested
by the Township for a total amount of $18,000.00 for Phase I of Plan M-118
with expiry date of September 30, 1982 be accepted and filed for all neces-
sary reference for purposes required.
Mrs. Loreen Lucas was present with respect to Ramp at Town Hall and after
request, Council agreed to receive her report on the matter of the Ramp and
the estimated costs.
On motion of Davie and Halfacre, that Oro Council authorize the Mitchell
Square Women's Institute to proceed with the installation of a concrete ramp
at the south east entrance of the Town HaIl and the necessary alteration
of the stair rail to allow the proper width for a wheelchair. And, further
that the Township of Oro are prepared to share the cost of the quotation
received from Scott Silo Construction Limited for a total of $1,000.00.
Presented letter from Ministry of Tourism and Recreation advising that the
Application for Ontario Regulation 200, 1982 Recreation Grant has been recom-
mended for an amount of $2,144.00 and is SUbject to final approval by the
Minister.
On motion of Vousden and Halfacre. letter be received and Oro Township Arena
Committee be advised accordingly.
Presented letter from Ministry of Natural Resources granting temporary par-
tial relief from compliance from Section 14(1) of the Regulations which is
granted under Section 9(2) of the Pits & Quarries Control Act. Relief being
to locate stockpile of materials within 100 feet of the south boundry of
the licensed property. Clerk advised that the Road Supt. had received a copy
of same.
On motion of Davie and Vousden, letter be received and filed for necessary
reference.
Committee of Council Recommendations - meeting of September 30, 1982
1. Regarding trailer placed on Lot 1, Plan M-118, without permission and
conditions of same. The report of By-Law Enforcement Officer and presenta-
tion by D. McKee of Hitch House Limited were further considered by Council.
On motion of Halfacre and Davie, that Oro Council grant permission to the
use of a trailer on Lot 1, Plan M-118 during the construction of a residence.
The permission may be granted subject to Simcoe County District Health Unit
approving occupancy of same on a temporary basis and that the permission
may only be granted once a Building Permit has been issued and further that
permission for use of the trailer is for a period of 6 months from date of
issuance of the Building Permit, during which time a monthly fee in lieu
of taxes of $30.00 per month is to be paid in advance for each month. And,
further that the trailer is to be removed before occupancy of the residence
is to take place, at no time may both trailer and residence be concurrently
resided in or otherwise occupied for residential use.

. 2. The matter of the Surplus property Lot 21, Concession 11, Hawkestone
Restoration Centre and letter from Ministry of Government Services, Realty
Branch with respect to same, regarding Municipalities possible interest for
a future service road, was further discussed by Council with the following
action taken:
On motion of Davie and Vousden, that the Ministry of Government Services
be advised that the Council of the Township of Oro are still mainly interested
in the property for a service road and are not prepared to recommend to the
1983-85 Council to consider purchase of the entire property at the appraised
value.
3. At Committee of Council meeting the matter of Agreement/Affadavit for
Raynold R. Schiele, as signed by his Agent Ray M. Schiele, to occupy the
existing residence during the construction of a new residence, it was recom-
mended that Council authorize the Agreement. After further review the following
action was taken.

On motion of Davie and Vousden, that Raynold Robert Schiele be permitted
to use the existing dwelling during the construction of the new dwelling
on part of Broken Lot 28, as shown on Part 1 of Plan 51R-I0726, until the
new dwelling has been constructed and occupancy permit has been issued for
the new dwelling. The time for use of the existing dwelling is for a period
of one year or until the new dwelling is completed, whichever is lessor.
Chief Building Official is to keep Council informed of the progress and sta-
tus of the new dwelling and demolition of the old dwelling according to the
Agreement/Affadavit.
4. The matter of drain or ditch referred to in letter from Mr. K.M. Gilbert,
Lot 20, Plan 1151, previously referred to by Council for discussion at the
Committee of Council meeting held on September 30, 1982 was further consid-
ered and recommendation of Committee of Council was accepted and the follow-
ing action was taken.
On motion of Davie and Vousden, that Mr. K.M. Gilbert, Lot 20, Plan 1151
be advised that according to any Agreements on title as result of search
at the Registry Office would indicate that any such Agreements registered
in no way appear to implicate or mention the Township of Oro. Accordingly
the Township of Oro apparently are not responsible for any repair, mainten-
ance or construction of the drain or ditch as set out in instrument No.
63713 and subsequent instruments of transfer of the lands in question.
5. The request of Mr. R. Sparrow for permission to clean up wood already
cut and to cut high stumps as well as clearing brush as discussed at Com-
mittee of Council was further considered with the following action taken:
On motion of Johnson and Halfacre, Mr. R. Sparrow be advised that Oro Council
are not prepared to change any conditions of wood cutting other than what
was agreed to by Council at a Committee of Council meeting held on September
15, 1982 and resolution of Council at a meeting held on September 20, 1982.

6. Request of Robert Barber with respect to sale of Ice Cream Machine at
Oro Memorial Park was further considered with the following action taken:
On motion of Halfacre and Johnson, that Mr. Robert S. Barber be advised that
as previously arranged, he could purchase the Soft Ice Cream Machine from
the Township for the price the Township paid for same.

7. Letter from B.S. Onyschuk, Q.C. re: Cedarbrook Estates, Quadrant Develop-
ments Limited, Plan M-157 with respect to payment to contractors and reduction
of Letter of Credit and recommendation of Committee of Council, was further
considered with the following action taken:
On motion of Johnson and Davie, that B.S. Onyschuk, Q.C. be advised that
Oro Council would be prepared to schedule an appointment for the meeting
of October 18, 1982 as requested.
On motion of Vousden and Johnson, that Council go into Committee of the Whole
to consider several matters prior to taking action on same.
On motion of Davie and Vousden, that Council come out of Committee of the
Whole.
Letters to Township Solicitor and correspondence from Solicitor for owner
of Part E~ Lot 9, Concession 6.
On motion of Davie and Vousden that the correspondence to the Township Solici-
tor and from Solicitor for Client be filed until documents requested are
completed.
Letter from Robert Holmes requesting his letter of application previously
forwarded for the position of Caretaker be considered when applications are
accepted for the 1983 season.
On motion of Halfacre and Johnson, letter be received and filed and that
the Township advertise for a Caretaker at Oro Memorial Park for 1983 and
that the notice be placed in both the Barrie Examiner and Orillia Packet.
Applications to be received up to November 12, 1982.
The matter of fence at the easterly boundry of Shelswell Park which had been
considered as result of letter of complaint regarding proposed erection of
a cedar rail fence was further considered following review of same at Com-
mittee of Council with action as follows:
On motion of Halfacre and Johnson that Dr. R. Shoichet and Mrs. Margaret
E. Shoichet, Lot 50, Plan 755 be advised that Oro Council are prepared to
proceed with erecting a standard 9 strand wire fence, according to Township
standards for a boundry fence along the easterly boundry of Shelswell Park
and Lot 50, Plan 755 and that the work will be completed as soon as possible.
By-Law Enforcement Officer, William Ormerod was present without scheduled
appointment to give a report on entertainment activities witnessed at River
Gardens, now known as Country Roadhouse, operated by Vid Gustain. He advised
that he and Deputy-Reeve Davie and Councillor Allan Johnson attended the
establishment following complaints about performance by exotic dancers.
Deputy Reeve Davie read his report on the type of entertainment witnessed
by the presence of exotic dancers. Oro Township Ratepayers do not want or
need this type of entertainment in their community. Also a chance this could
effect the memories of many tourists visiting the area. He added that this
disturbed him and a By-Law to prohibit this type of entertainment should
be drafted and passed.

. After further discussion the following action was taken:
On motion of Davie and Johnson that the By-Law Enforcement Officer be re-
quested to contact the Ontario Provincial Police and the LLBO in this regard
and obtain their comments.
On motion of Davie and Johnson that a draft By-Law with respect to control
of performances at Commercial establishments other than those permitted
under present Township By-Law, be prepared.
The Planning Administrator was present at 11:40 a.m. to review planning and
development matters.
Council were advised that the Holmberg draft subdivision had been reviewed
with Solicitor W.D. Russell, and correspondence has been forwarded to the
Developer's Solicitor. On receipt of a revised Agreement, together with the
required deposit for legal fees, capital lot levies and cash in lieu of park-
lands, the Agreement would appear satisfactory for execution..
Council were also advised that Mr. Holmberg has requested a special meeting
of Planning Board with regard to his making a proposal to develop the "top"
portion of his lands being part of Lot 27, Concession 6, comprised of approxi-
mately 140 acres on lands designated 'natural area' in the Official PIan
of the Oro Planning Area. Mr. Holmberg is aware of the costs of a special
meeting and has requested the same as soon as possible.

Council were further advised that conversion re-zoning certificates had been
issued on 13 Lakeshore area properties and that 6 were pending finalization
with the Health Unit, subject to Restricted Area By-Laws 1266/82 - 1271/82
inclusive, and that one property affected by By-Law 1272/82 would likely
be subject of an O.M.B. Hearing on the matter. Approximately 20 additional
applications are presently being prepared for conversion re-zoning By-Law
consideration.
On motion of Halfacre and Johnson, correspondence as related by Planning
Administrator be received as satisfactory and same be filed.
On motion of Halfacre and Johnson, that the cash in lieu of Parklands and
legal fees be paid upon signing of the Subdividers Agreement and that the
lot levies be secured by letter of credit and be paid within 6 months after
registration of Plan of Subdivision.

On motion of Johnson and Halfacre, Treasurer's Report showing receipts for
the month of September to a total of 1,066,373.56 accepted as satisfactory.
Road Superintendent, Fred Haughton, was present at 1:05 p.m. to give his
report for work done during the month of September along with Vouchers 9
and 9 A to cover same.
On motion of Vousden and Davie, report of Road Superintendent be accepted
as satisfactory and Treasurer authorized to issue cheques in payment of same
to a total of $36,253.65 according to Vouchers 9 and 9A.
Road Superintendent presented a letter from Ivan Spears, County Weed Inspec-
tor requesting attendance of Road Supt. and member of Road Committee to
attend on October 8, 1982.
Road Superintendent related contents of letter from S. Russell being a com-
plaint of condition of landscapping in front of his place on the Lakeshore
Road and advised that he would respond to the letter.

On motion of Vousden and Davie, that tenders for additional snow removal
equipment for Routes Band C be re-tendered, should contractors that have
previously carried out the snow removal for Routes B & C, after having been
contacted, not be interested.

On motion of Johnson and Vousden, correspondence, communications, etc be received
and filed.
Presented letter from Ministry of Municipal Affairs and Housing along with
print-out of 1982 resource equalization and support grant entitlements in ac-
cordance with the Ontario Unconditional Grants Act. Total amount receivable
being $120,804 and same has been received.
On motion of Vousden and Halfacre, print-out and letter be received and filed
for reference.
Presented letter from Ministry of the Solicitor General, Office of the Fire
Marshall as memorandum regarding 1982 Fire Prevention Week October 3-9th and
Proclamation for same. Letter requests that Municipality support same and
urge its residents to carry out a program of care, clean-up and common sense
caution, not only for this week, but for all times.
On motion of Halfacre and Johnson, letter and Proclamation of "Fire Prevention
Week" be received and filed.

Presented letter from Clerk, County of Simcoe, forwarding copy of report NO.
16 of the Agriculture, Planning and Development Committee, which had been
presented to County Council on September 17, 1982.
On motion of Johnson and Vousden, report be received and filed for reference.
Presented letter form Ontario Good Roads Association with respect to 1983
Convention to be held February 21st to February 23rd, 1983 at the Royal York
Hotel, and Hotel Reservation Form. Letter further advises if names are not
available same to be forwarded by January 21, 1983 to the Hotel for which
Reservation has been confirmed.
On motion of Vousden and Halfacre, that the Hotel Reservation form be completed
for 3 names and returned.
Presented letter from Ministry of the Environment with respect to Ministy's
position regarding dog breeding and boarding kennels and applicability of the
Agricultural Code of Practice in reply to enquiry with respect to verbal pro-
posed applications for same.
On motion of Halfacre and Johnson, that the letter be filed until a written
application has been presented to Council for approval.

Presented Inspection and Completion Certificate Form 8, as completed by Tile
Drainage Inspector, Delno Jermey, for drainage constructed on part of Lot 19,
Concession 5, by Carl Cumming at the same time as the previous work was done
for which a Debenture has been issued for a total of $660.00. The application
for Tile Drainage was approved by Council at a meeting held on June 21, 1982,
for a total sum of $1,500.00. Works having been completed with no apparent
defects for a total cost of $3,200.00.

. On motion of Davie and Vousden, that the Inspection and Completion Certificate
of the Tile Drainage Inspector be accepted as satisfactory and Treasurer au-
thorized to issue cheques in the amount of $1,500.00 being the Loan less the
inspector's fee of $50.00 to Carl Cumming, when the Debenture has been pur-
chased by the Province.
Drainage work have been satisfactorily performed and Form 8 completed and re-
ceived, a By-Law to impose Special Annual Drainage Rates upon the land in res-
pect of which money is borrowed under Tile Drainage Act, R.S.O. 1980, c. 500,
to construct sub-surface drainage works on such lands and whereas Council
has upon application agreed to lend the owner a total of $1,500.00, being the
pro rated costs of the works as shown on Form 8, to be repaid with interest,
at the rate of 10% by means of a rate hereinafter imposed by a Rating By-Law
as perscribed in Form 11, as presented, be on motion of Halfacre and Vousden,
introduced and numbered as By-Law No. 1284/82 and read a first time.
On motion of Vousden and Davie, that By-Law 1284/82 read a first time, be read
a second time.
On motion of Davie and Johnson, that By-Law NO. 1284/82 read a second time,
be read a third time.

On motion of Johnson and Halfacre, that By-Law No. 1284/82 read a third time,
do pass, be engrossed by the Clerk, signed and sealed by the Reeve and Clerk
to complete and forward Schedule "A" of the By-Law which sets out annual rates,
Offer to Sell Form 9 and Debenture, Form 4, No. 82-8 in the amount of $1,500.00
which are hereby authorized to be executed by the Reeve and Clerk on behalf
of the Corporation of the Township of Oro, along with Form 8 to the Ontario
Ministry of Agriculture and Food, Food Land Developments Branch, Drainage
Section, Queen's Park.
