06 21 1982 Council Minutes COUNCIL CHAMBERS - JUNE 21, 1982 TWELFTH MEETING . Council met pursuant to adjournment for the second regular meeting of June. . . Present were: Reeve - Deputy-Reeve - Councillor - Councillor - Councillor - R.S. Arbour S. Davie T. Halfacre S. Vousden A. Johnson Reeve R.S. Arbour opened the meeting at 9:30 a.m. with prayer. Minutes The minutes of the last regular meeting of June 7th were on motion of Johnson and Halfacre, confirmed as printed and received with corrections as noted in spelling. Copies of letters forwarded - as instructed at meeting of June 7th, as follows: - Law Construction Ltd. - advising of tenders received for re-construction of Lakeshore Road and that his tender had been accepted for a total price of $43,500.00 (Tender Contract 82-08); - Morris Shelswell Excavating advising that tender of Law Construction had been accepted; - M.T.C. advising of tenders received and that Tender Contract 82-08 from Law Construction had been accepted for Lakeshore Road re-construction; - Ontario Hydro forwarded resolution of Council with respect to re-Iocation of lines in Lot 26, Concessions 6 and 7 and that the Township are prepared to pay 50% of the cost for same, estimated as $2,150.00 for the Township share and forwarding cheque for same; - A.M.O. forwarding names of voting delegates for the Township of Oro and reservation for accommodation as well as cheque for pre-registration of delegates; - Barrie Examiner and Orillia Packet - advertisement for applications for part-time By-law Enforcement Officer; - Ron Johnson Insurance - forwarding letter from Solicitor for Paul Wright of damage to boat at Hawkestone dock; - Simcoe County Board of Education forwarding resolution of Oro Council passed on June 7, 1982 with respect to maintenance cost of Ecole Secondaire Le-Caron in Penetanguishene, with copies to Hon. Bette Stephenson, Minister, Ministry of Education; Allan K. McLean, M.P.P. Simcoe East, Simcoe County Council and Dr. T. Garry, Reeve, Township of Mara; - Community Hall Committees and Arena Committee forwarding letter from Ministry of Municipal Affairs and Housing re: Ontario Employment Incentive Program 1982-83, requesting Council be advised of any projects that the Committees may wish to propose for such a program; - Central Data Processing advising of their services to prepare an updated Sales Tax Rebate for the Township of Oro for a proposed fee of 20% of rebate payable when rebate is received by the Township; - Letter to Standor Business Consultants advising that services of Central Data Processing had been accepted; . . . Pg. 455 TWELFTH MEETING - JUNE 21, 1982 - Lands/Water Administrator, Huronia District, Ministry of Natural Resources forwarding resolution of Council with respect to proposed Water Lot in front of part Lots 26 and 27, Concession 7, and that the Township of Oro supports the program to legalize all commercial structures occupying Crown Lands covered with water (property concerned being that owned by Pamela McKee as shown on Plan 51R-10450); - Secretary, Oro Township Library Board re: Provincial Grants to Libraries for fiscal year 1982/83, requesting comments with respect to questionnaire in letter from Ministry of Citizenship and Culture; - Barrie Public Library Board re: farewell gift for Ron McKenzie; - Mr. & Mrs. Ron Palmer re: Township Lot 8, Plan 1222, Concession 14, adjacent to their lot 9, advising Township is not prepared to consider sale of same at this time; - County of Simcoe Recreation Department advising that the Township of Oro would be prepared to have the County Recreation Department sponsor a Leadership Program for one week from August 23rd to August 27th, 1982, and confirmation that same will be scheduled; - George Tran advising that Township Solicitor has not been able to arrange a meeting with his Solicitor re: conveyance of Road Allowance as shown on Plan 51R-I0064 (Parts 3 and 5); - Mrs. Florence Richmond re: Lots 1 to 60, Plan 807 regarding materials deposited on Elizabeth Street at Lake Simcoe; - Edgar General Store re: designation of Commercial Property under Heritage Act for application under B.R.r.C. Program; - Shanty Bay Ratepayers Association requesting a name be submitted to act as Wharfmaster for Shanty Bay dock. On motion of Halfacre and Vousden, copies of letters as presented and forwarded, accepted and be placed on file for reference. Presented letter from M. H. Seeley, Head Traffic Section, Ministry of Transportation and Communications in reply to Township letter of May 18, 1982 requesting the Ministry to professionally assess the intersection of County Road No. 20 & 27. Letter advises that the location is completely under the jurisdiction of the Barrie Suburban Road Commission, therefore the Ministry has no authority to become involved in a matter of this nature. Clerk advised that the County Engineer had advised that a copy of the above noted letter had been received. On motion of Davie and Halfacre, letter be received and filed for reference and a copy be forwarded to Mr. D. Williams of the Oro Ratepayers Association. Re-presented job estimates to replace underground fuel tank at the Township Office or replacement of furnace with propane fuel. This matter had been left over for further consideration, again referred to Committee of Council. Presented letter from Central Data Processing in reply to Township letter of June 9, 1982 acknowledging same and advising of corrections: (1) That C.E. Tomlins is resident of Township, not D. Leatherdale. (2) That Mr. Tomlins will be working with Mr. Leatherdale to carry out the computing of Retail Sales Tax Rebate for the Municipality. (3) That it is their intention to commence the work during the first week of July. ~ Pg. 456 TWELFTH MEETING - JUNE 21, 1982 . On motion of Halfacre and Johnson that the resolution passed at a meeting of Council held on June 7, 1982 be corrected to read that Central Data Processing Accounting Services be requffitedto compile and prepare an updated Sales Tax Rebate for the Township of Oro for the proposed fee of 20% of the rebate, payable when the rebate is received by the Municipality, and further that Mr. C.E. Tomlins, a resident of the Township of Oro work with Mr. D. Leatherdale associated with the firm, who is experienced and familiar with the Ontario Sales Tax Act, having worked with the Branch. As instructed by Council the draft Agreement between Township of Oro, Simcoe County Board of Education and East Oro Parents-In-Action presented at the last regular meeting was reviewed and a draft revised copy was presented for Council's consideration. On motion of Davie and Vousden, copy of draft Agreement be forwarded to Simcoe County Board of Education for review and comments, as well as to East Oro Parents-ln-Action and the Principal, East Oro Public School, and the Township of Oro Recreation Committee. Presented from Canadian Books in Print a form with respect to Township publications requesting same be completed. On motion of Vousden and Halfacre, Clerk to complete form showing no change of listing, except for price of Story of Oro, and return same. Committee of Council Recommendations 4It Re: Drainage problem Foch Avenue, Concession 14 at property of Mrs. V. Harrison On motion of Davie and Johnson that Mrs. V. Harrison be advised that work to improve the drainage problem will be programmed for 1983 with some engineering, taking of levels, etc., to take place in 1982 in preparation for the work. Students for Road Dept. On motion of Vousden and Halfacre that as recommended by Committee of Council the Road Supt. be authorized to hire up to~two more students, on a part-time basis, as required during the summer months. Presented letter from Hitch House Ltd. (Home Division) with respect to clearing of Shelswell Park as per agreement with Council. On motion of Halfacre and Johnson that Reeve Arbour, Councillors Johnson and Halfacre make an inspection of the Shelswell park lands along with Mr. D. McKee prior to payment of the account. Presented letter from Housing Analyst, Surveys & Statistical Analysis, Corporate Planning & Evaluation Branch, Ministry of Municipal Affairs and Housing forwarding comments on proposal. . On motion of Johnson and Halfacre that letter from M.A.H. (Corporate Planning & Evaluation Branch) be received and be filed until comments are received from circulation of same. . . . ~ Pg. 457 TWELFTH MEETING - JUNE 21, 1982 Interim Report for Park Study Committee On motion of Halfacre and Johnson that the Clerk to reply to the four questions in Summary of Interim Report, dated June 2, 1982. Building Chief Building Official was present at 11:30 a.m. with respect to several items: 1. Re: Kenneth Crawford contravention of By-law - garage attached to house; Building Permit issued for detached garage. 2. Horseshoe Valley with respect to complying with all matters of the Ontario Building Code - regarding fire doors on open stairway and that he had asked them to go to Building Code Commissioner for decision. 3. Gordon Keith - second residence on property. On motion of Johnson and Halfacre report of the Chief Building Official be accepted and letter requiring action be withheld until a By-law Enforcement Officer has been appointed for the Township. Planning & Development The Planning Administrator was present at 11:35 a.m. to review planning and development matters. The following was presented: Committee of Adjustment, Notices of Hearing re: Submissions BI0/82 Magee, B11/82 McMaster, B12/82 Leigh and B25/81 McDougall adjourned from November 24, 1981. Ministry of Municipal Affairs & Housing, advising of approval of new Official Plan approval, Medonte Planning Area. On motion of Vousden and Halfacre, that correspondence as presented be placed on file. Presented correspondence from A.P. McNair & Associates and Ainley & Associates regarding a request for correction to Zoning By-law No. 1031 on behalf of Mr. N. Graves, owner of the W~ Lot 16, R.P. No.1. On motion of Davie and Halfacre, that the Planning Administrator be requested to prepare the necessary Zoning By-law Amendment to correct the text citation for W~ Lot 16, Registered Plan No.1. Report on status of the Quadrant Developments Subdivision, Pt. Lot 22, Cone. 11, Plan M-157, with regard to expiry date of Letter of Credit, Agreement provisions and remaining works. On motion of Halfacre and Vousden, that Council authorize the Township Engineer to carry out an inspection of the works undertaken to date on Plan M-157 and report back to Council in writing prior to July 5, 1982, with regard to the items of work remaining to be completed pursuant to the provisions of the Subdivider's Agreement. Any consultants' estimates to complete works to be comparable with the above mentioned report and to be verified by the Township Engineer as being reasonable and accurate with respect to current costs. . . . ~ Pg. 458 TWELFTH MEETING - JUNE 21, 1982 Advised that the 55-65 Broadway (Ucci) Subdivision has been registered as Plan M-187 and that the consultants advise that road works are being proposed for this season, and that the Timothy Acres Subdivision proposal has had road works tendered for and that a draft Subdividers Agreement is to be submitted in the near future. Presented letter from Gibson/Flood & Associates with respect to preparation of a proposed Municipal Housing Statement in light of correspondence recently received from the Ministry of Municipal Affairs and Housing regarding reduction amount of funding available due to overlap with the Ministry's grant funding of the North Oro Study. On motion of Davie and Halfacre, that the Planning Administrator forward a registered letter to Gibson/Flood & Associates and request that the firm advise in writing within 10 days, whether the necessary procedure of preparing a Municipal Housing Statement, according to resolution of Council retaining their services for this purpose, can still be accomplished as result of Ministrys' comments. Roads Road Supt. Fred Haughton was present at 1:20 p.m. with respect to road matters. 1. Job Evaluation - proposal appeared satisfactory to the employees. Length of service does not appear to be considered in proposal. 2. Lakeshore Road - construction progressing well taking into consideration the weather. 3. 15/16 Sideroad - Engineering work almost completed - some survey work still left. 4. Maintenance of roads slow because of weather. On motion of Vousden and Davie, verbal report of Road Supt. be accepted and noted. Correspondence, Communications, etc. - Workmen's Compensation Board - Statement of Medical Aid for Garnet Pattenden - Hawkestone Fire Dept. - Oro Township Horticulural Society expressing appreciation for the use of the Township Machine Shed for the spring plant sale and especially thank the Road Supt. who provided the space. - Memorandum from Subsidies Branch (Municipal Programs) enclosing brochures describing the assistance available to individuals under the Disaster Relief Assistance and Shoreline Property Assistance Programs. - Don Booth, owner of Lot 20 and 21, Plan 728 re: school tax on resort property - Letter with regard to C.O.R.T.S. Agreement signed by the Minister of Natural Resources and Minister of the Environment Canada for unique plan for co-ordinated environmental and recreational management in the 680 km Corridor of the Rideau and Trent-Severn Waterways System and copy of the C.O.R.T.S. policies. . . . On motion of Johnson and Vousden, corresondence, communications as presented be received and filed. Presented Challenge 2000 Statement by the Hon. Claude F. Bennett, Minister M. A. & H. which is partly program and partly attitude. It is a combination of incentive funding and inventive leadership. It is a program of education, and a focal point for Housing actions. Along with Minister':s Statement is a complete package and program guide as well as application form for loan under Ontario Renter - Buy Program. On motion of Johnson and Halfacre, be received and filed for reference. Presented application for loan under the Tile Drainage Act from Carl. L. Cumming for a tile drainage system of approximately 10 hectares on the EPT Lots 19 and 20, Concession 5. Total amount of the cost of the work estimated at $3,250.00. On motion of Vousden and Johnson that the application be received and Mr. Carl L. Cumming be advised that his loan has received approval of Council on the pro-rated basis of 60% of estimated cost of $3,200.00 = $2,020.00. The amount of loan on $2,020.00 at 75% being $1,500.00. And further, that the loan will be processed as soon as funds are available either by increase of allocation or unless one applicant presently apportioned for 1982 does not carry out the drainage work. Otherwise, the loan will be processed under 1983 allocation. ""'l1lI Pg. 460 TWELFTH MEETING - JUNE 21, 1982 . Presented from Delno Jermey, Tile Drainage Inspector, Form 8, being the Inspection and Completion Certificates for drainage constructed on part of Lot 19, Concession 5 owned by Carl Cumming for which application for a Tile Drainage Loan was made August 13, 1981 and approved by Council on a pro-rated basis on August 17, 1981 for a loan amount of $600.00, and for drainage constructed on part of Lot 16, Concession 9 owned by Sheridan Nurseries for which application was made September 29, 1981 and approved October 19, 1981 revised May 10, 1982 and subsequently approved by Council on May 17, 1982 for a pro-rated revised amount of $1,800.00. Works having now been completed with no apparent defects. On motion of Halfacre and Vousden that the Inspection and Completion Certificates of the Tile Drainage Inspector be accepted as satisfactory and Treasurer authorized to issue and forward cheques in the amount of $550.00 being the loan amount less Inspectors fee of $50.00 to Carl Cumming and $1,750.00 being the loan amount less Inspectors fee of $50.00 to Sheridan Nurseries when the Debentures have been purchased by the Province. Drainage works having been satisfactorily performed and Form 8 received completed, a By-law to impose Special Annual Drainage Rates upon the land in respect of which money is borrowed under the Tile Drainage Act, R.S.O. 1980, c. 500, to construct sub-surface drainage works on such lands and whereas Council has upon application agreed to lend the owners a total of $600.00 and $1800.00 respectively, being 75% of the pro-rated costs of the works as shown on Forms 8, to be repaid with interest, at the rate of 10% by means of a rate hereinafter imposed by a Rating By-law as prescribed in Form 11, as presented, be on motion of Halfacre and Vousden, introduced and numbered 4It as By-law No. 1273/82 and read a first time. On motion of Vousden and Davie, that By-law No. 1273/82 read a first time, be read a second time. On motion of Davie and Johnson, that By-law No. 1273/82 read a second time, be read a third time. On motion of Johnson and Halfacre, that By-law No. 1273/82 read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve and Clerk to complete and forward By-law, together with Schedule "A" which sets the annual rates, Offers to Sell in Form 9 and Debenture No. 82-7 in the amounts of $600.00 and $1800.00 respectively, which are hereby authorized to be executed by the Reeve and Clerk on behalf of the Corporation of the Township of Oro, along with Forms 8 to the Ontario Ministry of Agriculture and Food, Food Land Development Branch, Drainage Section, Queen's Park. Presented letter from Morgan Lemen, Registrar, Huronia Cycling Club advising of compiling of maps for tour through Barrie and the surrounding areas. These maps will be available atttavel information centres, Chambers of Commerce, and other local information centres. Letter indicates that any questions concerning these maps should be directed to the writer. . On motion of Halfacre and Johnson letter be received and Clerk to forward letter requesting copy of the map in order to ascertain the affect of the tours through the Township of Oro~ should the tours include any part of the roads in the Township of Oro. ~ . . . ~ Pg. 461 TWELFTH MEETING - JUNE 21, 1982 Presented informal letter from President, A.M.O. regarding the 1982 Ontario Budget and impact on Municipalities by imposing of 7% sales tax on Township Budgetary Items such as building materials, steel, concrete, gravel, asphalt, and other items, after Municipalities have established their 1982 budgets. Letter requests Council consider the Budget impact and: 1. Determine the financial impact of new provisions; 2. Contact member of the Legislature to present Councils' actions; 3. Contact local public agencies within the Municipality and advise of Councils' actions; 4. Meet with local media to transmit Council's position. On motion of Johnson and Halfacre, letter from A.M.O. President be received and filed for reference - should Council wish to take any action later. Presented letter from Shanty Bay Festival Committee requesting permission from Council to serve beer and wine at the Shanty Bay Community School Centre on the day of the Shanty Bay Festival to be held August 14, 1982. On motion of Davie and Halfacre, that Oro Council would have no objection to the Shanty Bay Community Festival Committee serving beer and wine at the Shanty Bay Community and School Centre and grounds fenced off, but that any permission for such use of the grounds must be obtained from Simcoe County Board of Education, prior to any application for a licence from L.L.C.B.O. for such occasion. Present as previously requested and arranged for, and rescheduled at last regular meeting for 2:45 p.m. today were: Douglas Skelton - Skelton Brumwell & Associates Ltd. Robert Young - Ministry of the Environment D. Morrow - Simcoe County District Health Unit D.S. White - Township Solicitor Norman Shelswell David McKee - of Hitch House Ltd. arrived later during discussion of the proposal for development of Phase II and status of Phase I Purpose of the appointment being at the request of Skelton, Brumwell & Associates Ltd. to further present proposals for Phase I and II of Norshell Developments Ltd. with all agencies involved being present along with Township Solicitor. Mr. Skelton summarized the purpose of the meeting and matters to be considered: 1. Commencement of Phase II of the Development would appear to have been resolved. 2. Council and Ministry of Environment had agreed that securities for septic system and lot grading not be required in Phase II as in Phase I. 3. What happens to security on Phase I presently held by the Township, for lots already developed on Phase I? Would request security for each lot developed on Phase I be returned. Response by Mr. D.S. White, Township Solicitor - 1. Under present Agreement, securities held until each lot has had fill placed and septic system installed at which time same should be returned for the developed lot. Pg. 462 TWELFTH MEETING - JUNE 21, 1982 . 2. Present Agreement includes Ministry's condition assurance for this work. Mr. Skelton advised Ministry of the Environment is not requesting same for Phase II - Township not responsible for septic system, this is responsibility of M.O.E. Mr. Robert Young advised that he had now had an opportunity to review Mr. White's letter regarding this matter and Subdividers Agreement. Sewage system had been considered as a service and that had been the reason for the requirement of securities as protection for work to be completed. However, agreement had no provision to authorize Municipality to complete the system or enter on private property to do so. Would appear not appropriate to have security for this purpose - no mechanism for Township to administer securities for sewage system. Ministry, as result of discussion, to be prepared to recommend that the Township release the $3500.00 per lot for the sewage system in Phase I. At conclusion of the discussion, Oro Council passed the following resolution: . On motion of Davie and Halfacre that the previous resolution of Oro Council passed at a meeting of Oro Council held on May 3, 1982 be complied with prior to proceeding with Phase II of the Development and that upon receipt of a letter from the Ministry of the Environment and Simcoe County District Health Unit that it not be a requirement to have securities for septic system and fill on Phase I on each lot in the amount of $3,500.00 or the amount per lot as originally estimated. And further, that upon receipt of such a letter the Township will be prepared to release the securities of $3,500.00 or the originally estimated amount per lot for Phase I. New Business Deputy Reeve Steve Davie brought to attention of Council the matter of a service road between Line 11 and Booth Street. On motion of Davie and Johnson that a letter be forwarded to the Ministry of Public Work requesting consideration for a right-of-way from Line 11 to the property line abutting lands owned by Banbury Food Market to link with Booth Street. By-laws A By-law to define the boundaries of polling subdivisions of the Township of Oro, for the purpose of the Municipal Elections Act, was on motion of Davie and Johnson, introduced and numbered as By-law No. 1274/82 and read a first time. On motion of Johnson and be read a second time. On motion of Halfacre and . be read a third time. Halfacre, By-law No. 1274/82 read a first time, Vousden, By-law No. 1274/82 read a second time, On motion of Vousden and Davie, By-law No. 1274/82 now read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve. Presented as directed, a By-law to Amend Restricted Area (Zoning) By-law No. 1031 as amended, in respect of the West Half of Lot 16, Registered Plan No.1, which on motion of Johnson and Halfacre, was introduced and numbered as By-law No. 1275/82 and read a first time. On motion of Halfacre and Vousden, that By-law No. 1275/82 read a first time be read a second time. On motion of Vousden and Davie, that By-law No. 1275/82 read a second time, be read a third time. On motion of Davie and Johnson, that By-law No. 1275/82 read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve. Planning Administrator to take the necessary actions under Section 39 of The Planning Act as required to place the By-law in force and effect. Report of Committees Deputy-Reeve Davie advised that he had attended the meeting of Lake Simcoe Couchiching Study in place of Councillor VJusden who was unable to attend. He summarized the items considered at the meeting and that a copy of the report will be available for file. . Councillor Johnson reported on attendance at the semi-annual (Spring Meeting) of the Bass Lake Ratepayers Association. - Association still in favour of mosquito control - would be prepared to have costs added in tax bill - copy of study and report of water quality in Bass Lake Councillor Halfacre reported on progress of change rooms at Oro Memorial Park. On motion of Vousden and Halfacre, Council go into Committee of the Whole to consider ap,plications for By-law Enforcement Officer at 4:25 p.m. On motion of Johnson and Vousden Council come out of Committee of the Whole. On motion of Vousden and Johnson that 7 applicants be requested to attend for interviews on Wednesday, June 23, 1982 commencing at 7:45 p.m. and scheduled for 10 minute interval periods.
