COUNCIL CHAMBERS - FEBRUARY 1, 1982
THIRD MEETING
Council met pursuant to adjournment with all members present.
Reeve R.S. Arbour in the chair, opened the meeting with prayer.
The minutes of the last regular meeting of January 18, 1982 were on motion
of Halfacre and Vousden confirmed as printed and received.
Presented copies of letters forwarded as instructed at the last regular
meeting as follows:
-Ministry of Natural Resources, Huronia District re: request that the
annual tonneage extraction be increased from 82,000 tonnes to 125,000
tonnes for the Township of Oro licensed Gravel Pit, Pt. W ~ Lot 11,
Conc. 8 and copy of application as completed for the increase as requested
by M.N.R. letter dated January 19, 1982.
-ROMA with respect to pre-conference registration, requesting refund of
registration fees paid for Reeve R.S. Arbour who will be attending as
a County of Simcoe delegate and for Councillor Allan Johnson who will
not be able to attend - total refund applied for being $170.00.
-Norman E. Shelswell, Norshell Developments forwarding resolution of
Council with respect to Phase II & III, Plan M-118 and requirements prior
to entering into Subdividers Agreement for Phases II & III.
-Ukranian National Federation confirming action of Council as result of
the attendance of executive of U.N.F. regarding proposal to request
portion of property used for Youth Camp to be exempt from taxation and
the said property being used as a Trailer Camp.
-Brian Pratt re: Lease of 10 acre Park Lands - Pt. Lot 37, Concession 1
between No. 93 Highway and Plan 1689, advising that Council is prepared
to lease the Park Lands at a rate of $150.00 per year for a period of
5 years subject to certain conditions.
-Association of Municipalities of Ontario (AMO) forwarding 1982 member-
ship fees.
-Russell,Waite,Christie & Miller forwarding payment of account received
at last regular meeting to an amount of $114.25.
-Mrs. Linda Ingle - advising that the council of the Township of Oro is
prepared to accept offer of $600.00 for Block "B" Plan 1488, subject
to all legal costs being borne by the purchaser.
-Ro nald Young re: Services for Water System, Plans M-66 & M-71 and rates
to be charged for plumbing services for work on the Subdivision.
-Annual Grants to - Salvation Army; St. John Ambulance; North Simcoe Soil
& Crop Improvement Association - grant to Annual Seed Fair.
-Allan K. McLean, M.P.P. - expressing Council's appreciation for presen-
tation of cheque for 50% of community Planning Grant for North Oro Study
and his efforts to speed up the process for completion of Fly-over at
line 9.
-N.V.C.A. - forwarding information requesting name of Reeve, AdministraLive
Officers and Representative to N.V.C.A. for 1982 along with respective
telephone numbers for record purposes.

Presented letter from Jo-Con Developments Limited in reply to Township
letter of December 7, 1981 setting out requirements prior to issuance
of any further building permits on Plan M-66 Phase II. All requirements
listed being the recommendations of Township Engineer. Letter also ad-
vises that the items referred to will be further discussed at the March
meeting according to Council's resolution of December 7, 1981.
On motion of Davie and Vousden, that matters referred to in letter in res-
ponse to Township letter of December 7, 1981 be further considered at
the March meeting since it would appear that items set out would not appear
to have been carried out as indicated in your letter of reply.

Motor Club and Bass Lake Snow Runners Snowmobile Club, advising
that applications from both Clubs have been reviewed and both Clubs have
been authorized to conduct their race events. Claims by Cottagers Associa-
tions could not be substantiated and Council's comments had been taken
into consideration.
On motion of Vousden and Halfacre letter be received and filed for reference.
As recommended by Committee of Council on January 27, 1982 that the Annual
Return of Road Expenditure to a total of $889,441.27 approved by Council,
accordingly, Clerk again presented the Annual report of Expenditures on
Roads during 1981 as completed with petition for annual subsidy under
Provisions of the Public Transportation and Highway Improvement Act on
expenditures made during the year 1981. Petition is in accordance with
OB-MR-69 being in the amount of $889,441.27. The total expenditures accord-
ing to payment vouchers being in the amount of $907,739.07.

The petition showing a total expenditure and eligible amount for subsidy
of $889,441.27 according to declaration taken by Road Superintendent and
Treasurer as required on OB-MR-13 and Clerk instructed to forward same
to the Ministry of Transportation and Communications.
Further to discussion of Committee of Council on January 27th, following
the Chairman of Parks & Recreation reporting on applicants for Park Supt.
having been interviewed and resume for another two applicants having been
received and that further applicants are anticipated to be interviewed,
Council after again considering the position, passed the following reso-
lution:
As recommended by Committee of Council on January 27, 1982 it was moved
by Vousden and seconded by Davie that the Chairman of Parks & Recreation
and Clerk be authorized to attend the 'Open House' to be held at the Barrie
Office of the Ministry of Culture and Recreation to be held on February
16, 1982 between the hours of 2:00 to 6:00 p.m.
Clerk presented letter from R.E. Young, Senior Environmental Officer,
Municipal and Private Abatement, Ministry of the Environment, which had
been considered at Committee of Council held on January 27, 1982. Letter
requires confirmation of number of lots built on and lots sold on Plan
M-118, as well as lots sold. Also any other background information that
will assist in responding to letter of Mr. Norman Shelswell regarding
proposal to proceed with Phase II & III of Plan M-118. Letter also requests
a meeting with Council prior to any committment for development of Phases
II & II of Plan M-118.
On motion of Halfacre and Davie, as recommended by Committee of Council,
Clerk to reply to letter of R.E. Young and request a suitable time be
arranged to meet with Oro Council and Simcoe District Helath Unit as re-
quested.
As recommended by Committee of Council, action taken to distribute Dog
License and tags to six places of business, namely, Shanty Bay Post Office,
Oro Station General Store; Hawkestone General Store; Banbury Food Market;
Edgar General Store and Coulson General Store, be accepted as satisfactory
and that a notice be placed in the Barrie Examiner and Orillia Packet
setting out places of business where dog licenses may be obtained until
March 31, 1982, as well as at the Township office and that a penalty of
$5.00 per license will be added after that date. Also setting out the
fees for such license, which according to By-Law No. 1197 are:
a) for each neutered male or spayed female
b) for each male
c) for each female
d) for Kennel License (At Twsp. Office Only)

The matter of Road Allowance between lots 5 & 6, Concession 14, being
closed by By-Law 888 passed on October 2, 1967 and registered as instru-
ment No. 255112 on October 25, 1967, which had been discussed by Committee
of Council on January 27, 1982, following request by Wes Moreland regarding
same, was further considered by Council.
On motion of Vousden and Halfacre, that the matter be referred to Township
Solicitor for legal opinion as to whether Deed of Conveyance to Mr. William
and Anne Moreland dated the 28th day of September 1967 may be registered
at this time. Solicitor also to advise as to legal status regarding lands
on either side of the Road Allowance closed by By-law No. 888, dated October
2, 1967 and registered as Instrument No. 255112 on October 25, 1967.
Presented letter from Barrie Public Library Board in reply to Township
letter of December 22, 1981 advising that the Barrie Public Library Board
at a meeting held on January 20, 1982 passed a motion accepting Oro Township
Council offer for library services in 1982 as outlined in Township letter.
Accordingly Barrie Library Service Contract would be as follows should

rooms are to be located. A discussion of priorities at Oro Memorial Park also took
place.

On motion of Halfacre and Johnson, that the Plans for change rooms at
Oro Memorial Park, as prepared by Stuart N. Keyes & Associates Limited,
dated January 26, 1982, be accepted as the Plans for the proposed change
rooms at Oro Memorial Park, ana that the said plans are to be used as
the Drawings in tender or quotation call. And, further that a set of the
Plans be forwarded to the Parks Assistance Officer, Conservation Authori-
ties Branch, Ministry of Natural Resources with application of request

On motion of Davie and Halfacre, Clerk to advise that letter and comments
of Road Supt. having been considered, Council are of the opinion that
the Roads in Sugar Bush have been maintained in excess of other Subdivision
and Township Roads.
Presented copy of Employer's Report of Accidental Injury for injury to
Volunteer Fireman, William Sheardown, No.3 Station, Edgar, sustained
at a fire call on January 19, 1982 as forwarded on January 22, 1982.
On motion of Johnson and Davie, copy of report as presented and forwarded
be received and Treasurer to make payment of weekly allowance of $65.00
as authorized effective from date of injury until William Sheardown is
able to return to his normal employment.
Presented letter from Joseph S. Stewart, Solicitor for Mr. & Mrs. B.
Fine, purchaser of lots 1 & 2, Plan 864, requesting Council to consider
necessary steps to obtain title to Foch Avenue on Plan 640A and 864, which
according to Registry Office does not appear to be a dedicated Road Allow-
ance. Solicitor enclosed copy of relevant protions of search.
On motion of Davie and Vousden, that Clerk to reply and advise that Foch
Avenue is maintained as an improved and travelled Township Road
and that any properties abutting Foch Avenue are eligible for Building
Permits subject to usual necessary requirements for a Building Permit.
Presented letter from Ministry of Municipal Affairs and Housing, announc-
ing that for 1982, the Province of Ontario, through the involvement on
Municipal Administration program, will again provide financial assistance
to Municipalities offering students practical and meaningful experience
in local government, along with 1982 Guidelines for such a program and
advising that Municipalities interested in participating should contact
Subsidiaries Branch before February 28, 1982. Also, letter with respect
to students enrolled in law who should be able to assist in reviewing
classifying and consolidating existing By-laws.
On motion of Johnson and Davie, letters be received and filed with no
action taken at this time.
Road Supt. Fred Haughton was present at 1:00 p.m. to present his report
for the month of January and presented Vouchers 1 and lA to cover same.

On motion of Vousden and Davie, that a follow-up letter be forwarded to
Peter Meier-Naef and again request that the chain across the Road Allow-
ance be removed by February 15, 1982, should this not be done by that
date, the Township Road Dept. will remove same and any costs involved
may be charged to Mr. Peter Meier-Naef.
The Planning Administrator was present at 1:45 p.m. to review planning
and development matters. The following was presented:
Ontario Municipal Board - forwarding copies of By-law 1242/81 to finalize
approval of By-Law No. 1213/80 - O.M.B. File R81160;
Form letter to objectors re: Council position on By-Law No. 1244/81;
M.M.A.H. Ministry extension of draft approval, File 43T-74324 Guthrie
Industrial Park proposed subdivision, for a period of 3 months to April
6, 1982.
On motion of Davie and Halfacre, that correspondence as presented be placed
on file.
Advised that Solicitor's Oately, Purser had recently delivered to the
Township on behalf of 55-65 Broadway Ave., Ltd., (Windfields Estates)
the capital lot levies, parkland contribution, engineering, administra-
tion and legal levies payable in respect of the plan of subdivision pro-
posed on part of lots 27 & 28, Concession 5, as required by the Subdivi-
ders Agreement. Also advised that all conditions of draft approval have
now been met and recommended that the final plan be recommended for approval
to the Ministry of Municipal Affairs and Housing, together with a request
for draft approval extension for a period of three months to June 9, 1982.
On motion of Halfacre and Vousden, that Oro Township Council consent to
the final approval of the Honourable Minister of Municipal Affairs and
Housing to registration of the Windfields Estates Subdivision on part
of Lots 27 & 28, Concession 5, Township of Oro, Ministry File 43T-79030,
all conditions of draft approval having been met.
On motion of Davie and Vousden, that Oro Township Coucil concur with the
extension of draft approval, File 43T-78030, for a period of three (3)
months, to June 9, 1982 to allow additional time for registration of the
final plan of subdivision on part of Lots 27 & 28, Concession 5, Township
of Oro.
Presented a well evaluation report prepared by Ian D. Wilson and Associates
Ltd., in respect to well testing on lands owned by Huronia Driftwood Rest-
aurants Ltd., on Part of Lot 20, Concession 11, and correspondence from
the Ministry of Environment dated November 27, 1981 supporting the feasabil-
ity of developing the site, and indicating they have no objection to the
proposed rezoning.
Presented executed copies of a site plan agreement with respect to devel-
opment application P3/80 a proposal by Huronia Driftwood Restaurants Ltd.,
to develop a tourist campground on part of Lot 20, Concession 11. Also
presented a draft of the necessary zoning By-law amendment to rezone the
lands from "A-Agriculture" to "T2-TouristCampground" further to Council's
resolution of July 6, 1981.

On motion of Davie and Vousden, that the Reeve and Clerk be authorized
to execute the Site Plan Agreement in respect of development proposed
on part of Lot 20, Concession 11 by Huronia Driftwood Restaurants, pursu-
ant to the provisions of section 40 of the Planning Act, and that the
Planning Administrator arrange to have the agreement registered on title.
On motion of Davie and Johnson, that a By-Law to rezone part of Lot 20,
Concession 11, amending By-law No. 1031 as amended, as introduced be num-
bered as By-Law No. 1260/82 and read a first time.
On motion of Johnson and Halfacre, that By-Law No. 1260/82 read a first
time, be read a second time.
On motion of Halfacre and Vousden, that by-Law No. 1260/82 read a second
time, be read a third time.
On motion of Vousden and Davie, that By-Law No. 1260/82 now read a third
time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve.
Planning Administrator to circulate the By-Law as required under Section
39 (24) of The Planning Act.
Presented letter from Co-Ordinator of the Forest Recreation Technology
Program, Sir Sanford Fleming College with respect to employment of Commun-
ity College graduates trained in the field of outdoor recreation/forest
or park and recreation management and questionnaire to be completed.
On motion of Vousden and Davie, letter and questionnaire be received and
Clerk to reply and advise that the Township of Oro have no openings for
employment in this field at the present itme.
Presented from Ontario Municipal Board, form 15/1982 - Financial Summary
of Long-Term Liabilities and Debt charges, along with instructions for
completion. Form to be completed and returned before April 30, 1982.
On motion of Vousden and Halfacre, Clerk-Treasurer to have Form 15/1982
completed and returned to the Ontario Municipal Board before April 30,
1982.
Presented memorandum from Ministry of Agriculture & Food and copy of Dog
Licensing and Live Stock and Poultry Protection Act and Regulations made
under the Act with specific reference to submitting applications for Form
I, application for grant to reinburse the Municipality for claims for
damage by wolves paid by the Municipality.
On motion of Johnson and Halfacre, letter and copy of Dog Licensing and
Poultry Protection Act and the Regulations made under the Act, be received
and Clerk to review same and complete any applications for grant for re-
imbursement for claims paid by the Municipality for damage to Live Stock
by Wolves according to the Act and Regulations. And, further that a copy
of the amended act be forwarded to Township Live Stock Valuers.

Presented letter from Ministry of the Solicitor General, Office of the

On motion of Halfacre and Johnson, Clerk to complete Application Renewal
to Ontario Park Association and Treasurer to issue cheque in the amount
of $40.00 for same.
Presented letter from Aggregate Supervisor, Ministry of Transportation and
Communications advising that the Ministry will advertise a resurfacing and
miscellaneous contract at the following location - Highway 11, Crown Hill
for 11.3 km including the Hillsdale Patrol Yard and work on the Highway
400 and 93 interchange and that in connection with this contract, the Minis-
try is preparing an Aggregate Sources List indicating to bidders potential
sources for gravel extraction. Letter indicates four aggregate sites in
the Township of Oro which will be included to bidders as potential sources
for gravel extraction as Way Side Pit and requests Council's comments. Clerk
advised that these sites have been listed in the last several years by
M.T.C. for Highway Construction work. Reason for letter being for Council
to comment regarding the listing of pits located in the Township.
On motion of Davie and Vousden, Oro Council would have no objection to the
pits listed in letter dated January 21, 1982, namely R. Sparrow Lot 9,
Conc. 6; Cook Construction - Lot 7, Conc. 8; Middleton - Lot 8, Conc. 8-
(now Belcourt); and Hodgkinson - Lot 7, conc. 10, being included in the
Aggregate Source List for Wayside Pits, for the proposed Contract from High-
way 11, Crown Hill northerly to Craighurst for 11.3 km including the Hillsdale
Patrol Yard and work on the Highway 400 and 93 interchange, but would request
a meeting with the successful bidder and representative from Ministry of
Transportation and Communications to obtain assurance that the necessary
provisions will be included to provide for dust control, special speed limit
of trucks using the Township roads to the pit or pits, as well as essential
provisions for school bus routes on the roads involved, with respect to
safety of children.

that pursuant to the Public Transportation and Highway Improvement Act,
R.S.O., as amended, the Honourable James Snow, Minister of M.T.C., here
authorized a subsidy Allocation for 1982 in the amounts of:
Construction 180,000 1981 155,000 increase of 25,000
Maintenance 250,000 1981 224,000 increase of 26,000
430,000 379,000 51,000
NOTE: This amount includes funding towards the Township's 15/16 Sideroad
Project.
Also attached form MR-A-16 (formerly OB-MR-28) requesting that one copy
of 1982 Road Program be submitted not later than March 31, 1982. Letter
advises that any supplementary request must be submitted by March 31, 1982
and again will only be for construction on a limited basis and reviewed
considering the priority md/or previous committments. Necessary form for
same also enclosed with original Road Program MR-A-16.

On motion of Davie and Vousden, that the 1981 Subsidy Allocation as presented
be applied to the 1982 Road Program and the Road Supt., Road Committee along
with Clerk-Treasurer to prepare necessary Road Program for 1982 and present
same to Council, as early as possible, for consideration together with a
program for Supplementary Subsidy Allocation.
Presented letter from Executive Director, Community Housing Division, Ministry
of Municipal Affairs & Housing with respect to Ontario Home Renewal Program
(OHRP) requesting Municipalities to complete an attached Report entitled
"Ontario Home Renewal Programme Municipal Reserve Fund Report".
On motion of Vousden and Johnson, letter and attached form be received and

Department and 6 Plectrons purchased from the Innisfil Township Fire Dept.
for the Township of Oro Fire Department as agreed to by Fire & Building
committee.
. On motion of Halfacre and Johnson, recommendation to purchase Plectrons
for the Oro Township Fire Department from the City of Barrie and Township
of Innisfil be approved and Treasurer authorized to forward cheque for
same to City of Barrie for 20 Plectrons at $25.00 to a total of $500.00
and to Innisfil Township for 6 Plectrons at $25.00 to a total of $150.00.

And, Fire Chief be authorized to have the crystals changed in each for the
Frequency of the Oro Township Fire Department.
Presented letter from Siske Pratt forwarding cheque in the amount of $150.00
for rent of part Lot 37, Concession 1 between Highway 93 and Plan 1689 in
accordance with Council's offer to lease the park lands.
On motion of Davie and Vousden, the payment for lease of Park Lands of Plan
1689 for one year under agreement according to Township resolution for a
lease on a 5 year basis of $150.00 per year be accepted and that the annual
lease payment be credited to Park Lands.
Presented letter from James Snow, Minister, Ministry of Transportation and
Communications with respect to No. 11 Highway and overpass at line 9. Ad-
vising that the work is on track with expected completion by Fall and there
is no reason for any change in proposed schedule. A Fall 1982 award would
indicate completion of the project by the Summer 1983. Letter being as a
result of inquiry by Allan K. McLean, M.P.P., Simcoe East.
On motion of Halfacre and Vousden, that letter from Minister, Ministry of
Transportation and Communication be received and filed.
A By-Law to make annual appointments to the various Township Community Recrea-
tion Centre Boards was presented for consideration.
On motion of Halfacre and Vousden, that a By-Law to appoint members to Commit-
tees for the management and control of Community Recreation Centres and
to rescind By-Law No. 1229/81 as introduced, be numbered as By-Law No. 1261/82
and read a first time.
On motion of Vousden and Davie, that By-law No. 1261/82 read a first time,
be read a second time.
On motion of Davie and Johnson, that By-Law No. 1261/82 read a second time,
be read a third time.
On motion of Johnson, and Halfacre, that By-Law No. 1261/82 now read a third
time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve.

Mr. Norman Shelswell was present at 3:35 p.m. as requested with regard to
development of Phase II & III of Plan M-118 particularly matter of Letter
of Credit to include the unsold and/or unserviced lots since only 8 lots
have been built on.
This matter was discussed at considerable length by Council in particular
the requirement of the ministry of the Environment.
