COUNCIL CHAMBERS - JANUARY 5, 1982
FIRST MEETING OF 1982
Council met pursuant to adjournment of the last meeting for 1981, with all
members present.
Reeve R.S. Arbour in the chair opened the meeting with prayer.
The minutes of the last regular meeting for 1981, held on December 21st, were
on motion of Vousden and Johnson, confirmed as printed and received.
Presented copies of letters forwarded as instructed at the last regular meeting
as follows:
-Barrie Examiner and Orillia Packet re: change of first meeting for January
1982 from Monday, January 4th to Tuesday, January 5th, 1982.
-Paul G.M. Hermiston, Q.C.- Stewart, Esten, Solicitors forwarding resolution of
Council's instruction to pursue all avenues to recover Judgement obtained.
-Stuart N. Keyes & Associates Limited re: Phase II, Norshell Developments re:
Alternatives for water supply system-Watermain and services.
-Barrie and Orillia Public Libraries re: Contract for 1982, advising Ora Council
upon recommendation of Ora Township Library Board are prepared to enter into
contract on basis of per capita rating of 1.3 to 1 of Provincial Grant being
$4.48.5 per capita.
-Ministry of Municipal Affairs & Housing re: Assisted Housing Programs further to
request by Ora Marigold Senior Citizens - Also letters from Social Service and

On motion of Vousden and Halfacre, copies of letters as presented and forwarded be
accepted as satisfactory and same be placed on file for reference.
Presented memorandum from Manager, Municipal Roads Office, Ministry of Transporta-
tion and Communications, forwarding approval of Second Interim Subsidy Application
for 1981 Road Expenditures, for a total approval of $108,864.32 which amount has
been recommended to Treasurer of Ontario for payment.
On motion of Johnson and Davie, memorandum and copy of Interim Statement of Expendi-
tures as of November 14, 1981, as approved for a payment of $108,864.32 be received
and filed for reference.

Presented copy of letter to E.J. McCabe, Regional Director, South Western Region,
Ministry of Transportation and Communications with respect to additional Subsidy
Funding for 15/16 Side ROad and having same included in 1982 Budget of the
Ministry. Also letter of reply acknowledging the Township letter of request
and advising that the Road Supterintendents estimates of cost of paving at
$89,000.00 of which $71,200.00 is the Ministry's share (89,000 @ 80%). Township
letter of request will be considered when reviewing 1982 S~~plementary Requests
And,further advising that the Township submit a formal request through the
Owen Sound District Office early in 1982.
On motion of Davie and Vousden, copy of letter to the Ministry of Transportation
and Communications requesting Ministry include the funds of 80% of costs for
15/16 Side Road paving of approximately two miles in the 1982 Budget and reply
advising that letter will be conisdered when reviewingthe Budget, be received
and placed on file for reference and Supplementary Subsidy Request be completed
and presented for preparation of the 1982 Roads Programme.
Presented copy of Township letter to Vespra Township forwarding resolution of
Ora Council advising that Ora Council are prepared to enter into an Agreement
with the Township of Vespra to proceed to advertise for the position of By-Law
Enforcement Officer upon being advised by the Township of Vespra that they are
prepared to proceed on a two Municipality basis. And, letter from the Township
of Vespra advising the Township propose to re-organize their present staff duties
and thus eliminate the need of hiring another person for By-Law Enforcement.
Also, letter from the Township of Medonte advising that Council were of the
opinion that although it would be a good idea, it is felt that the cost could
not be justified at this time.
On motion of Davie and Halfacre, copy of Township letter to Vespra and Township
letters of reply from Vespra and Medonte advising that they are not prepared to
participate jointly to hire a By-Law Enforcement Officer to serve two or more
Municipalities at this time, be received and filed for reference.
Presented letter from Grants Administration Branch, Ministry of Culture and
Recreation, requesting completion of Forecast for Capital Expenditure for un-
finished work, balance of approved Grant for Jarratt Community Hall being in
the amount Of $1,336.67. And, copy of application for Community Recreation
Centres Act, the balance of this being in the amont of $1,331.73, for total of
both grants of $2,668.40. Previously received being CRC $2,343.27 and Wintario
of $2,338.33. Total grant for project being in the amount of $7,350.00.
On motion of Halfacre and Johnson, letters and copy of application for payment
of Wintario Grant for Jarratt Community Hall and CRC Grant Application for
payment, as forwarded, be accepted as satisfactory and Treasurer to forward
balance of Grant to Jarratt Community Hall when received, after deduction of
loan to Jarratt Community Hall Board.
Presented letter from M.H. Seeley, Head Traffic Section, Ministry of Transpor-
tation and Communications in reply to Township letter of October 21, 1981, with
respect to location of Hydro Pole on No. 11 Highway at line 5, which appears to
be a dangerous situation. Letter outlines temporary measures taken for safety
purposes and long term solution to have the Hydro Pole re-Iocated.

On motion of Davie and Vousden, letter be received and filed for reference,
Council are of the opinion that the letter indicates safety measures taken in
this regard should resolve any possible dangers in the future, after pole has
been re-Iocated.
Presented letter from Stuart N. Keyes & Associates Limited in reply to Township
letter requesting opinion on the alternative of PVC pipe for watermains in
place of Ducktile Iron and Polyethelene in place of copper pipe for water ser-
vice.
It was suggested that letter be considered when Mr. Keyes is to be present,
later on at the meeting.
Presented letter from the Hon. Eugene Whelen, Minister of Agriculture,
Government of Canada in response to Oro Council endorsing the resolution of
the Township of Minto regarding long-term operating loans at reduced rate.

Presented letter from Ministry of Natural Resources with respect to Land Use
Permit by Bass Lake Snow Runners Snowmobile Club, to hold Snowmobile Races on
January 30 & 31st, 1982 and enclosing copy of application listing conditions ap-
plicable to this land use permit. Letter further requests concerns and comments
of Council regarding the application.
On motion of Johnson and Halfacre, that the Ministry of Natural Resources be
advised that Ora Council are not supportive of any motorized races on Bass Lake
even though conditions listedshoul~ in theory, take care of pollution concerns.

Presented letter from James E. Domm owner of part Lot 27, Concession 9, further
to his letter of January 14, 1980, also copies of Township letters of reply,
with respect to his concerns and request for guard rails at Line 8 and Lake-
shore Road. The concerns and request are both personal and as a Director of
Barrillia Park Ratepayers Association. Clerk advised that as requested, a copy
of letter had been presented to Township Road Superintendegt, who will be
presenting his report to Council. Road Superintendent reported on Meeting with
Mr. J.E. Domm and advised of proposal agreedtowhich is to be carried out in the
Spring, since in his opinion, Guard Rails would not appear to be a requirement.
On motion of Davie and Halfacre, that Ora Council concur with the Township
Road Superintement and his proposal of action as agreed to with Mr. James E.
Domm following a meeting on the site.
Stuart N. Keyes P. Eng., Township Engineer was present at 11:20 a.m. to pre-
sent and consider several matters with Council:
The matter of alternative to ductile iron pipe for water mains and polyethelene
for service lines and referred to comments in his letter, which was read while
Mr. Keyes was present - the matter was discussed with Council with various
questions asked regarding process of water system installation, namely costs
comparison, etc., Mr. Keyes indicated that PVC pipe could possibly be as costly
or more if proper trench bottom and cover is to be considered.
Pros and cons were reviewed and considered. Mr. Keyes also expressed his con-
cern about entrance culvert installation and compacting of fills in the first
phase of the development.
On motion of Vousden and Johnson, that the letter of comments from Stuart N.
Keyes with respect to alternative water service materials and installation of
same be received and be further considered after presentation of costs from
Engineers from Norshell Developments. Final approval for use of alternative
materials be considered at that time.
Chief Building Official Jim Shellswell was present before Council to present
his report for Building permits issued during the month of December and total
permits for 1981 as follows:

On motion of Davie and Vousden, report of Road Supt. for work done during the
month of December and Vouchers 12 and 12A to cover same, be accepted as satis-
factory and Treasurer authorized to issue same to a total of $46,850.65.
The Planning Administrator was present at 1:20 p.m. to review planning and
development matters. The following was presented:

consideration by Council at their next regular meeting.

in respect to amendment that should be made to By-Law No. 1031 with regard to
the West ~ of Lot 16, R.P. No.1.

McNair & Associates Ltd., with regard to the details of the zoning amendment
proposal, and if satisfactory, to direct Ainley & Associates Ltd., to prepare

Tax and Collection of same by Retailers.
On motion of Halfacre and Johnson, letter be received and filed with no action
taken.
Presented from County of Simcoe Recreation Department, notice of Recreational
Curling Bonspiel to be held at Canadian Forces Base Borden on Saturday,
March 20, 1982. And, Official Registration Form for a rink from the Township
of Oro.
On motion of Vousden and Halfacre, Ora Township again enter a rink for the 1982
County Curling Bonspiel and Clerk to complete Registration Form and forward
same along with cheque to cover registration fee in the amount of $60.00.
Presented from Ontario Good Roads Association, Pre-Registration Form for the
1982 Convention to be held on February 22nd to 24th, 1982. Pre-Registration
fees are $50.00 per delegate and $60.00 if paid at Convention.
On motion of Vousden and Halfacre, Clerk to complete the Pre-registration form
and forward cheque to cover the registration fee for same for Reeve, R.S. Arbour,
Deputy Reeve Stephen Davie, Councillor Vousden and Road Supt. Fred Haughton.
Presented from Ontario Good Roads Association notice of 1982 Membership fee for
total of $85.00 .
On motion of Vousden and Halfacre, Treasurer authorized to issue cheque to an
amount of $85.00 for the 1982 Ontario Good Raods Association Membership.
Presented from Treasurer, East Simcoe Plowmen's Association, request for annual
grant for 1982.
On motion of Vousden and Johnson, that a grant in the amount of $100.00 be author-
ized for the East Simcoe Plowmen's Association and Treasurer authorized to
issue cheque for same to a total of $100.00.
Presented from Canadian Mental Health Association Ontario Division, requesting
Council to give consideration for a grant in 1982 of $35.00 or more towards
the work of the Association.
On motion of Halfacre and Johnson, that a grant in the amount of $35.00 be
authorized for 1982 to Canadian Mental Health Association, Ontario Division and
Treasurer to forward cheque for same.
Presented annual membership fees for Clerk-Treasurer and Deputy Clerk-Treasurer
to the Association of Municipal Clerks and Treasurers of Ontario.
On motion of Vousden and Davie, that payment of membership fees for 1982
for Clerk-Treasurer and Deputy Clerk-Treasurer be authorized and Treasurer to

On motion of Vousden and Halfacre, that the Road Supt. and Clerk to complete
the Report for 1982 and forward same prior to February 1, 1982 as required.
Presented Programme for Municipal Drainage Courses, Drainage Superintendents-
March 29th to April 2, 1982 and Clerk, Committees and other - April 5th to 7th
1982 as sponsored by the Ontario Ministry of Agriculture and Food, also regis-
tration forms for each.
On motion of Johnson and Vousden, Programme and registration forms be received
and matter to be further considered and registration forms to be completed
should attendance of one Administrative person be authorized to attend.
Presented Affidavit from George Langman for application for Fox Bounty for 3
fox trapped on Lot 8, Concession 13 and Lot 6, Concession 14, on dates as
shown on Affidavit.
On motion of Johnson and Halfacre, application for Fox Bounty from George
Langman for 3 fox trapped be approved and Treasurer authorized to issue cheque
in payment of same to .a total of $12.00 ( 3 x 4.00)
Presented Affidavit from Jim Martin for application for Fox Bounty for 6 fox
trapped on Lot 1 and Lot 8, Concession 11 on dates shonw on Affidavit.
On motion of Vousden and Halfacre, application for Fox Bounty from Jim Martin
and Shirley Martin for 6 fox trapped be approved for payment and Treasurer
authorized to issue cheque in payment of same to a total of $24.00 (6 x 4.00)
Presented from George Garland, Prof. Engineer, Agricultural Engineer, Simcoe
County advising that as in the past, the Georgian Bay Area Agricultural Engineers
of the Ontario Ministry of Agriculture and Food have held a one-day workshop
for those interested in constructing farm building in the area. Workshop to
be held on Feb. 10, 1982 at the Nottawasaga Inn at Alliston. Chief Building
Official would like to attend.
On motion of Johnson and Vousden, that the Chief Building Official be authorized
to attend the one day workshop on constructing of Farm Buildings as sponsored
by the Ministry of Agriculture and Food on February 10, 1982, with expenses to
be paid for by the Township.
Presented from Ministry of Transportation and Communications, letter and memor-
andum with respect to 1981 Annual Returns for Road Expenditures and forms for
same., with request that same be completed and in the hands of the M.T.C. District
Office at Owen Sound by Feb. 8, 1982.
On motion of Davie and Vousden, Memorandum and Forms for 1981 Annual Return for
Road Expenditures in 1981 as presented be received and Clerk-Treasurer to have
same completed and presented to Council in order that the form may be forwarded
to M.T.C. District Office at Owen Sound prior to required date of Feb. 8, 1982.
Presented letter from Ministry of Natural Resources with respect to Flood
Emergency Plan requesting that same be updated by the end of February 1982 and
copy of updated copy be forwarded to the Ministry. Also that NVCA should be
consulted for the updating.

. On motion of Vousden and Halfacre, letter be received and Flood Emergency Plan
to be updated and NVCA be contacted for comments in this regard.
Mr. George Tran was present before Council at 3 p.m. with respect to conveyance
of Road Allowance between lots 10 & 11 in Concession 9. The area in question
is shown on Survey Plan 51R-I0064 in part. And, presented letter from County
of Simcoe advising that the County has no present or future plans for the public
road allowance, Part 3 nor any for part 5, of Survey Plan 51R-I0064 dated
January 28, 1981.
On motion of Davie and Johnson, Oro Council would have no objection to execute
a Quit Claim Deed for Parts 3 & 5 of Survey Plan 51R-I0064, should this meet
with all requirements regarding the portion of old road allowance, provided
that the Township Solicitor is of the opinion that this may legally be dealt
with in this matter, since the County of Simcoe have advised in writing that
the County do not have any present or future plans for Part 3 or Part 5 of
Plan 51R~10064. And, further that this matter be referred to the Township
Solicitor for his opinion, comment and or direction as to how this matter may
be dealt with. All legal costs to be borne by the applicant, Mr. George Tran.
The matter of a By-Law to authorize borrowing to meet current expenditures was
considered and a draft By-Law was introduced.

On motion of Vousden and Davie, that a By-Law to authorize necessary borrowing
to meet current expenditures for 1982 in an mount of $800,000.00 as introduced
be numbered as By-Law No. 1251/82 and read a first time.
On motion of Davie and Johnson, that By-Law No. 1251/82 read a first time, be
read a second time.
On motion of Johnson and Halfacre, that By-Law No. 1251/82 read a second time,
be read a third time.
On motion of Halfacre and Vousden, that By-Law No. 1251/82, now read a third
time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve. Clerk
to forward certified copy of the By-Law to the Canadian Imperial Bank of Commerce
Orillia Branch.
The matter of appointing members of Council to Ora Planning Board was next
considered, as deferred by resolution from the last regular meeting.
On motion of Davie and Johnson,that for 1982, Council representatives on the
Oro Planning Board remain as in 1981, namely Deputy Reeve S. Davie and Council-
lor Thelma Halfacre.
By-Law to appoint members to the Oro Planning Board and to rescind By-Law No.
1221/80 was presented.

On motion of Davie and Johnson, that a By-Law to appoint members to the Oro
Planning Board and to rescind By-Law No. 1221/80 as introduced, be numbered as
By-Law No. 1252/82 and read a first time.
On motion of Johnson and Halfacre, that By-Law No. 1252/82, read a first time,
be read a second time.

A By-Law to appoint members to the Ora Township Committee of Adjustment and

On motion of Vousden and Davie, that By-Law No. 1253/82 read a first time, be
read a second time.
On motion of Davie and Johnson, that By-Law No. 1253/82 read a second time, be
r6ad a third time.
On motion of Johnson and Halfacre, that By-law No. 1253/82 now read a third time,
do pass, be engrossed by the Clerk, signed and sealed by the Reeve. Clerk to
notify appointees accordingly.

A By-Law to amend By-Law No. 1227/81 to revise the amount of remuneration and
expenses paid to members of Council, its appointees to Local Boards and Other
Bodies and for expenses paid to employees was presented and considered.
On motion of Davie and Vousden that Counil increase their annual remuneration
by 4%.
Motion was lost.
Accordingly no change in remuneration for Council in 1982.
All other Schedules of By-Law were then reviewed and changes incorporated as
approved by Council as follows:
Schedule "A" Paragraph 6 deleted
Paragraph 7 renumbered as 6 and amended as instructed.
Schedule "B" Oro Planning Board members $50.00 per day meeting and $35.00 per
evening meetings.
Committee of Adjustment $50.00 per day meeting, $25.00 per half
day meeting and $35.00 per evening meeting.
Schedule "c" 1.1 to be corrected by deleting the word 'not' in the third line
and incorporating change in 5th and 6th lines of the draft By-Law.
3.3 (iv) Amount per day to read $35.00.

Presented a draft By-Law to establish a penalty charge for non-payment of
Current Taxes. Clerk advised that the Canadian Imperial Bank of Commerce in
Orillia had been contacted and had been assured that the Prime Rate of Inter-
est charged to credit-worthy business customers was 16~% on January 5, 1982 and
a letter to confirm this has been signed by the Manager and received by the
Township.
After consideration and in accordance with the Municipal Interest and Discount
Rates Act, S.O. 1981, Chapter 26, a By-Law to establish a Penalty charge for
non-payment of current taxes, was on motion of Vousden and Davie, introduced
and numbered as By-law No. 1255/82, and read a first time.
On motion of Davie and Johnson, By-Law No. 1255/82 read a first time, be read
a second time.
On motion of Johnson and Halfacre, By-Law No. 1255/82 read a second time, be
read a third time.
On motion of Halfacre and Vousden, By-Law No. 1255/82, now read a third time,
do pass, be engrossed by the Clerk, signed and sealed by the Reeve and Clerk
to cause notice of same to be included with Interim Tax Notice.
After the passing of a By-law to establish a penalty charge for non-payment of
current taxes, Council deemed it necessary to consider passing a By-law in 1982
to provide for interest to be added to arrears of taxes.
After further consideration a By-Law to provide for interest to be added to
Arrears of Taxes was on motion of Johnson and Halfacre, introduced and numbered
as By-Law No. 1256/82 and read a first time.
On motion of Halfacre and Vousden By-Law No. 1256/82 read a first time, be
read a second time.
On motion of Vousden and Davie, By-law No. 1256/82 read a second time, be
read a third time.
On motion of Davie and Johnson, By-law No. 1256/82 now read a third time, do pass,
be engrossed by the Clerk, signed and sealed by the Reeve and Clerk to include
notice of same with Interim Tax Notice.
A Draft By-Law to authorize an Interim Tax Levy in the Township of Oro for the
year 1982 was presented for Council's consideration as provided for under
Section 159(1) of the Municipal Act, R.S.O. 1980, c. 302, before the adoption
of the estimates for any year.

After consideration, a By-law to provide for an Interim Tax Levy for the
Township of Ora for the year 1982, in accordance with Section 159(1) of the
Municipal Act, R.S.O 1980, c. 302 was on motion of Davie and Johnson, intro-
duced and numbered as By-Law No. 1257/82 and read a first time.
On motion of Johnson and Halfacre, By-law No. 1257/82 read a first time, be
read a second time.
On motion of Halfacre and Vousden, By-Law No. 1257/82 read a second time, be
read a third time.
On motion of Vousden and Davie, By-Law No. 1257/82 now read a third time, do
pass, be engrossed by the Clerk, signed and sealed by the Reeve and Clerk to
prepare necessary information and forward same to IBM to produce the 1982
Interim Tax Notices as authorized by this By-Law.
The appointment of members to the Oro Township Library Board was next considered
and Clerk advised that Mrs. Norma Sanderson had indicated she would be prepared
to serve on the Board.
On motion of Vousden and Halfacre, that Mrs. Norma Sanderson be appointed to
the Oro Township Library Board to replace Sheila Litster along with other
members who served on the said Library Board in 1981.
A By-Law to appoint members to the Township of Oro Public Library Board was
presented for consideration.
On motion of Halfacre and Vousden, that a By-Law to appoint members to the
Township of Ora Public Library Board as introduced, be numbered as By-Law No.
1258/82 and read a first time.
On motion of Vousden and Davie, that By-Law No. 1258/82 read a first time, be
read a second time .
On motion of Davie and Johnson, that By-Law No. 1258/82 read a second time, be
read a third time.

Councillor Halfacre reported on the matter of grant for Day Care Camp and
advised she had been in contact with Mrs. Gloria Tozek of the Employment Centre.
The matter of Council members not on Planning Board attending Planning Board
meetings was discussed.
On motion of Davie and Halfacre, that the two members of Council not appointed
to Oro Planning Board be authorized to attend all Planning Board meetings and
their remuneration to be the same as for members on Planning Board and be paid
for out of Council fees.
On motion of Vousden and Halfacre, adjourn to meet again on January 18th, 1982
at 9:30 a.m.
