COUNCIL CHAMBERS - DECEMBER 21, 1981
TWENTY-SEVENTH MEETING
Council met pursuant to adjournment with Reeve R.S. Arbour absent, all other
members of Council were present.
After the meeting was called to order, it was moved by Halfacre, and seconded by
Vousden, that Deputy-Reeve Steve Davie be the presiding officer for the meeting in
the absence of the Reeve. Motion carried.
The minutes of the last regular meeting were on motion of Vousden and Halfacre,
confirmed as printed and received.
Clerk presented copies of letters forwarded as instructed from the last regular
meeting of December 2, 1981, as follows:
-Head Traffic Section, M.T.C. re: signing No. 11 Highway at 7th line (Fairgrounds
Road) advising that Council will not be requesting change in signing.
-District Engineer, M.T.C. Owen Sound, forwarding copies of By-Law Nos. 1245/81,
1246/81 and 1247/81, being By-Laws to Assume Roads on Plan M-71, M30 & M31.
-Letter requesting approval of adjustments to Gravel Tender 81-03; Surface Treat-
ment Tender No. 81-04 and Winter Sand Tender 81-08.

On motion of Johnson and Halfacre, copies of letters as presented and forwarded, be

On motion of Johnson and Vousden, that a letter be forwarded to Ministry of Agri-
culture and Food and request that the 1982 allocation be reconsidered in light of
the additional applications for 1982 and two applications approved for which the
work was not completed due to extreme wet weather.
On motion of Vousden and Johnson, that a letter be forwared to Mr. Leonard Mortson
and advise that he is entitled to make a further application for Tile Drainage for
the full amount of his project.
Presented from Ministry of Transportation and Communications for copy of Audit Report
for 1980 Road Expenditures and Subsidy Claims, showing no adjustments of Subsidy
Allocation.
On motion of Vousden and Johnson, Audit Report for 1980 Roads be received and filed.
Committee of Council recommendations from meeting of December 14, 1981.
The recommendations with respect to Salaries and Wages was further considered with
the following action taken:
On motion of Halfacre and Vousden, that the recommendations of Committee of Council
be accepted and the increases approved by Council at a meeting held on December 7,
1981 remain as set out for 1982, and that any further wage and salary adjustments
be considered once classification description, basic minimum and maximum wage and
salary levels programme is established.

The Oro Township Arena Committee proposed Budget for 1982 as presented to Committee
of Council was further reviewed.
On motion of Vousden and Halfacre, that the proposed 1982 Budget for the Township of
Oro Arena be approved in principle and included in the Township Budget for 1982 after
review during Budget preparation.
Presented letter from Paul G.M. Hermiston, Q.C. to confirm that Judgement had been
obtained against Larry James Torpey for $35,000.00 plus $2500.00 on account of costs
for a total of $37,500.00 and that the Judgement bears interest at a rate of 20% per
annum from December 3, 1981 until payment. Copy of Judgement is enclosed for Township
files. And, further that the next procedure is to serve Mr. Torpey with an appoint-
ment to cross-examine him as to his assets and his means of income. Solicitor advises
that Registered Writs of Execution against all the assets of Mr. L.J. Torpey, both
in the County of Simcoe and the County of Grey, where it is understood he may hold
certain property.
File copies of letters of correspondence to Mr. Torpey from the Township are retained
along with Subdivision Agreement.
Statement of account for professional services and disbursement attached to a total
of $1,534.00.

On motion of Halfacre and Vousden, letter from Solicior, Paul G.M. Hermiston, Q.C.
confirming Judgement against Larry James Torpey, copy of Judgement, copies of letters
to L.J. Torpey and Subdividers Agreement be received, along with account for profes-
sional services and disbursements to a total of $1,534.00. And, Solicitor be instructed
to continue with proceedings and explore all avenues and means for recovery of Judge-
ment, And, further that Council be advised of all proceedings.

On motion of Johnson and Vousden, correspondence, Communications etc., as presented
be received and placed on file.
Presented letter from Clerk, County of Simcoe forwarding copy of County By-Law 3532,
being a By-Law for Interest Rate On County's share of Supplementary taxes. And,
letter from County Treasurer advising that the County's share of supplementary taxes
for the year 1981 are payable on December 31, 1981 and that under the provisions of
County By-Law No. 3532, penalties for late payment shall be charged at a rate of
18% per annum from the date of default until such payment is made.
On motion of Vousden& Johnson, letters and copy of By-Law No. 3532 as presented
be received and Treasurer authorized to forward County's Share of the Supplementary
Taxes prior to December 31, 1981.
Presented resolution from the Township of Rochester with respect to funds for loans
under the Shoreline Property Assistance Act, 13.S a result of the Ministry of Municipal
Affairs and Housing having announced that funds have been exhausted.
On motion of Vousden and Johnson, letter and copy of resolution from the Township of
Rochester be received and filed with no action t13.ken.
Presented letter from Rural Ontario Municipal Association (ROMA) notice of Annual
Conference to be held February 7th to Febru13.ry 10th, 1982 at the Royal York Hotel.
Also conference registrations and Application for Accommodations. Registration
fee being $75.00 per delegate and $20.00 per spouse.

On motion of Halfacre and Vousden, Clerk to complete registration forms for the
following delegates who will be attending the conference are: Reeve, Deputy Reeve,
Councillor Halfacre and Johnson and the Clerk to attend along with their spouses.
Presented from Oro Township Library Board proposed per capita rates for 1982. The
Library Boards are asking for $4.87 per capita and the Library suggests that the
rate for 1982 be established at $4.48.5 per capita, which is based on 15% increase
for 1982. Oro Township Library suggested that this rate be established and both
Barrie and Orillia Library Boards be advised accordingly. The basis requested is
1.5 to 1. The proposal of $4.48.5 being 1.3 to 1.
On motion of Vousden and Johnson, Oro Council are prepared to assist the Oro
Township Library Board recommendation to establish a per capita rate of $4.48.5 per
capita fee being a ratio of 1.3 to 1 of the Provincial Grant. Clerk to advise both
the Barrie and Orillia Public Libraries accordingly.
Presented application from Duncan Cameron for Fox bounty on five foxes trapped
and/or shot in the Township of Oro for an amount of $20.00 (5 x 4.00 = $20.00)
On motion of Johnson and Vousden, that the application from Duncan Cameron for
bounty on five fox be approved and Treasurer authorized to issue cheque in the amount
of $20.00.
Presented application for Wolf Bounty from Duncan Cameron for one wolf killed. Clerk
advised that affidavit of application had been forwarded to County Treasurer for
payment.
On motion of Halfacre and Vousden, application for Wolf Bounty from Duncan Cameron
as presented and forwarded be accepted and same filed for reference.
Presented copy of Bill 179 which was introduced and given first reading on November
2, 1981. Bill 179 being an Act to Amend the Municipal Act. Comments of Council are
requested to be forwarded as soon as possible.
On motion of Johnson and Halfacre, that copy of Bill 179 be received and again made
available to Council members to be reviewed with comments, if any, to be presented
and forwarded.
The matter of day in-lieu of Boxing Day, which in 1981 falls on Saturday was con-
sidered.
On motion of Halfacre and Vousden, the employees be authorized to take December 28th
1981 as a holiday in-lieu of Boxing Day, December 26, 1981, which falls on a Sat.
Presented letter from the Township of Glanbrook forwarding a resolution with respect
to high interest rate and petitioning the Government of Canada to take immediate
steps to lower interest rates being charged on loans and mortgages.
On motion of Halfacre and Johnson, letters and resolution be received and Council of
the Township of Oro enforce the resolution and Clerk to forward copies as requested.
Presented letters from Edgar Community Hall Committee advising that all members are
recommended for appointment in 1982 and from Oro Township Library Board that all
members except one, prepared to serve in 1982.

On motion of Halfacre and Vousden, letters be received and presented when By-Law
to appoint members to Boards and Committees is presented for passing.
Stuart N. Keyes, Township Engineer, was present before Council at 11:35 a.m. to
report on Township Community Arena as requested in letter dated October 8, 1981 and
the matter of the services on Plan M-71 as completed by Law Construction.
Mr. Keyes presented the final progress statement from Law Construction for tender
contract of work to complete services on Plan M-71. And advised that on December 24th,
the normal terms for holdback will have been met. Accordingly, he would recommend
that the holdback of $5,942.55 be paid after December 24, 1981.
On motion of Vousden and Johnson, that the holdback of $5,942.55 be forwarded to
Law Construction Ltd., after December 24th, 1981 subject to no leans having been
presented.
He also reported that he had attended at the Supreme Court under Subpeona for the
Torpey Case.
He next advised that he has visited the Arena for an ~nspection as required by the
Industrial Health and Safety Branch, for which he will be making a further report
once established information has been obtained.
Presented from Ainley & Associated an Aerial Photo of the 1981 International Plowing
Match, complete with frame.
On motion of Halfacre and Johnson, that a letter be forwarded to Ainley & Associates
to express Council's appreciation for the Aerial Photo.
The Planning Administrator was present at 1:00 p.m. to review planning and develop-
ment matters. The following was presented:
-Committee of Adjustment, Notice of Hearing re: Submissions B27/S1 - Abbott and
B2S/81 - Gollogly.
-A.P. McNair & Assoicates and Ainley & Associates re: Zoning of W~ Lot 16, Conc. 1,
lands owned by M. Graves.
-Ontario Municipal Board, forwarding documentation to finalize O.P.A. NO. 12 and
By-Law No. 1312/S0 - Waterfront Study.
-Ross Cook, re: proposal to re-zone part Lot IS, Conc. 1 to permit use of a conveni-
ence retail store by exception; requesting standard letter of credit against costs
of re-zoning.
On motion of Halfacre and Vousden, that correspondence as presented be placed on file.
Presented report prepared by Ainley & Associates Ltd., dated December 8, 1981 in
respect to the proposed expansion of organic sludge storage lagoons on lands owned
by Lloyd Squires, part W~ Lot 17, Conc. 7, and December 10, 19S1 resolution of Oro
Planning Board, and advised that Mr. Squires has retained Skelton, Brumwell & Assoc.
to carry out further engineering works on the proposal.
Mr. Lloyd Squires was present during the discussion of Oro Planning Board Resolutions
and was given a copy of the report of Ainley & Associates.

On motion of Vousden and Halfacre, that Council acknowledge the resolution of Oro
Planning Board and hold in abeyance any further consideration of the matter pending
submittal of additional information by Mr. Squires and his Engineers.
On motion of Halfacre and Johnson, that the matter be further considered once all
Council members have had an opportunity to study report of Ainley & Associates and
submittal of Mr. Squires and his Engineers is presented for consideration.
Presented recommendation of Oro Planning Board in respect of Zoning By-Law and
Ontario Building Code infractions on lands owned by D. McDougall, Part E~ Lot 14,
Conc. 14, and zoning application P3/81.
On motion of Vousden and Halfacre, that Council concur with the recommendation of
Oro Planning Board and initiate prosecution against the owner of part of the north
half of the east half of Lot 14, Conc. 14, Mr. D. McDougall, for such zoning and
by-law and Ontario Building Code Act infractions or contraventions as may have
occured or exist on the property.
Motion carried unanimously.
Oro Marigold Senior Citizens were present at 2:00 p.m. as scheduled on the Agenda,
members presented were; Donald McArthur, Laurence Leigh, Mrs. Glen. Gilchrist and
Mrs. Lillian Pickering.
Mr. Don McArthur as spokesman, advised that the Senior Citizens are still interested
in a Senior Citizens complex in Oro.
The request of the representatives was for information and funds available for a
project such as the one suggested, and requirements of the Municipality in this
regard.
It was left that Council would endeavour to gather all information regarding such
projects including land aquisition. It was also suggested that the Oro Marigolds in-
vite persons from other areas who are presently involved in such projects to attend
one of their meetings, to comment and/or advise of procedures undertaken.
On motion of Johnson and Halfacre, that a letter be forwarded to the Minister of
Municipal Affairs & Housing and request all relevant data and information with res-
pect to a Senior Citizens Complex. And further, request any organizational assis-
tance in this regard.
Mr. Norman Shelswell was present at 2:30 p.m. according to appointment on the Agenda
with respect to Plan M-118.
Mr. Shelswell was present to request use of PVC pipe in place of Ductile Iron and
presented a letter from Skelton, Brumwell & Associates and also a letter from Ainley
& Associates outlining a study and advising that PVC pipe and polyethelene materials
in place of copper are equivalent to Ductile Iron and Copper. Explanations are out-
lined in both letters. Consultants Skelton, Brumwell & Associates are requesting on
behalf of their Client, Norman Shelswell, that Council give consideration for approval
of the alternative for the second and third phase of Plan M-118.
The second point being that the present letter of credit be transferred to Phase 2,
including or annexing the unsold lots of Phase I.

After consideration and discussion the following action was taken:
On motion of Vousden and Halfacre, that Oro Council would have no objection to
using Polyvinyl Chloride PVC pipe - Class 160 for watermains and Polyethelene
materials for services in place of Ductile Iron and 3/4" copper lines for services.
subject to the Township Engineer having no objection to the alternative of the
present standards.

On motion of Vousden and Johnson, that Oro Council would be prepared to enter into
an addendum to the Subdividers Agreement for Plan M-118, which could, after review
with,the Township Engineer, Engineers for the Developer of Plan M-118 and Township
Solicitor, permit the transfer of the balance of Letter of Credit from Phase I and
Phase II, including the unsold lots of Phase I, after all costs of services for
Phase II have been established. And, further that should all parties be in agree-
ment to the alternative water supply system service and establishing a Letter of
Credit, Developer to provide a committment to Prime and Chip Shelswell Blvd, after
all services on Phase I and Phase II have been completed.

Clerk presented a draft By-Law to provide for interest to be added to Arrears of
Taxes, in accordance with the Municipal Interest and Discount Rates Act, 1981,
S.O. 1981 c. 26, Section 3 of the Act permits Municipalities to establish, by
By-Law, an interest rate not exceeding the prime rate of chartered banks with the
highest prime rate on the day the By-Law is passed plus 1~% per annum. Prime
rate is the rate quoted by a chartered bank for loans to its most credit worthy
business customers. Clerk presented a letter from the Canadian Imperial Bank,
Orillia Branch (Mississaga and West Street) dated December 24 1981, advising the
banks prime lending rate on December 21, 1981 is 17\%.
On motion of Vousden and Johnson, that the letter from the Canadian Imperial Bank
confirming the prime rate as of December 21, 1981 as 17\% be accepted and Council
authorize a By-Law to be brought in to set the interest to be charged on unpaid
taxes as 18% per annum, being 1~% per month or portion thereof, effective
January 1, 1982.
A By-Law to provide for interest to be added to Arrears of Taxes and setting of
the interest rate of 18% per annum (1~% per month or portion thereof)on all unpaid
Arrears of Taxes, which is to be added to such arrears of taxes, was on motion of
Halfacre and Vousden, introduced and numbered as 1249/81 and read a first time.
On motion of Vousden and Johnson, By-Law No. 1249/81 read a first time, be read a
second time.

On motion of Johnson and Halfacre, By-Law No. 1249/81 read a second time, be read a
third time.
On motion of Vousden and Johnson, By-Law No. 1249/81 now read a third time, do pass,
be engrossed by the Clerk, signed and sealed by the Reeve or Presiding Officer of
the meeting, and Treasurer to add interest at a rate of 18% per annum (1~% per month,
or portion thereof) to all unpaid arrears of taxes effective January 1, 1982.

Presented letters to Orillia Packet & Barrie Examiner, and advertisements appearing
on November 18 and December 4, 1981 requesting submission of names of those inter-
ested in serving on Oro Planning Board, Community Arena Committee and Committee of
Adjustment. Responses were reviewed from David Woronka, William Bateman and Herbert
Hardin, expressing willingness to serve on Oro Planning Board, and from Delno
Jermey expressing willingness to serve on the Committee of Adjustment.
On motion of Johnson and Vousden, that letters as presented be received and placed
on file, and that the names W. Bateman and D. Woronka be included in the By-Law
to appoint members to Oro Planning Board and that the name D. Jermey be included in
the By-Law to appoint members to the Committee of Adjustment.
On motion of Vousden and Johnson, that the appointment of member of Council be de-
ferred until the first meeting in January which is scheduled for Tuesday, January
5, 1982.
The next item for consideration was a By-Law to confirm the appointment of certain
Township Officials, servants and Employees and to fix their remuneration and pre-
scribe their duties for the year 1982. As result the following resolutions were
passed to establish certain remunerations:
On motion of Johnson and Halfacre, that the hourly rate for the Township Fire Chief
be increased from $8.75 to $10.00 per hour for services as Fire Chief and plumbing
work for the Fire Department.

On motion of Vousden and Halfacre, the Live Stock Valuers and Fence Viewers receive
he same remuneration as in 1981.
On motion of Vousden and Halfacre, that the Caretaker for the Oro Town Hall receive
$7.20 per opening and $6.10 per hour for cleaning of the Town Hall, and that the
Caretaker of the Township Office receive remuneration of $6.10 per hour while
cleaning the Township Office.
On motion of Vousden and Halfacre, that the Tile Drainage Inspector receive $75.00
for each Tile Drainage Inspection.
On motion of Halfacre and Vousden, that a By-Law to confirm the appointment of
certain Township Officials, Servants and Employees and to fix their remuneration
and prescribe their duties for 1982, be introduced as By-Law No. 1250/81 and read
a first time.
On motion of Vousden and Halfacre, that By-Law No. 1250/81 read a first time, be
read a second time.
On motion of Johsnon and Halfacre, that By-Law No. 1250/81 read a second time, be
read a third time.

On motion of Vousden and Johnson, By-Law No. 1250/81 now read a third time, do pass,
be engrossed by the Clerk, signed and sealed by the Presiding Officer of the meet-
ing.
On motion of Johnson and Vousden, that the Clerk-Treasurer-Administrator be paid
for one weeks holidays for 1981 and be authorized to carry one week over into 1982
in accordance with the Township By-Laws.
