11 16 1981 Council Minutes . . . Yg. L~~ COUNCIL CHAMBERS - NOVEMBER 16, 1981 TWENTY-FIFTH MEETING Council met pursuant to adjournment with all members present. Reeve R.S. Arbour in the chair, opened the meeting with prayer. The Minutes of the last regular meeting were on motion of Halfacre and Vousden, confirmed as printed and received. Presented copies of letters forwarded as instructed from the last regular meet- ing of November 2, 1981 as follows: -Paul G.M. Hermiston, Q.C. of Stewart, Esten re: Account for Torpey Subdivision and requesting amount be added to Torpey cost. -C. Hewson Bourne, Solicitor for E. Allinson, purchaser lot 1 & 2, Concession 14 as described in Plan 51R-I0199 forwarding Deed to convey 1 foot reserve for R.P. 1310 and reply advising Quit Claim Deed had been registered Nov. 4/81 as Instrument No. 750645. -Lois Crawford re: concerns and advising to arrange to meet with Council should she wish to pursue matter of information received prior to consent application. -Kenneth Crawford, Lot 8, Plan 217, re: Compliance with Building Permit No. 17/81 requesting he advise in writing as to when work will be done to comply with Building Permit. -Township of Medonte requesting the Township be advised as to interest in joint venture for By-Law Enforcement Officer. -Paul Kitchen, O.L.S. and Community Planning Review Branch re: extension of Draft Approval for File No. 43T-76089 (Block X, Plan 902) -Horseshoe Valley re: Snow Removal and Sanding Roads on Plan 1587. -Toronto Hilton Harbour Castle - reservations for O.G.R.A. -Letters to William O'Brien, William Staines and Dr. A. On motion of Halfacre and Vousden, copies of letters as presented and forwarded be accepted as satisfactory. Presented memorandum from Ministry of Transportation and Communications advising that Interim Subsidy applied for has been approved for payment in the amount of $107,279.67 and account forwarded to Accountant for payment of Subsidy. Copy of Summary of Statement attached. On motion of Vousden and Johnson, memorandum advising of approval for Interim payment in amount of $107,279.67 and Summary of Statement be received and filed. Presented letter from the Hon. James Snow, Minister, M.T.C. in reply to Township letter of October 7, 1981 with respect to overpass at Line 9 and No. 11 Highway advising that contract for same cannot be considered until 1982, but that the project has a high priority in the Ministry's work load and every effort is being made to have the project ready for award as previously stated. . . . Pg. 284 TWENTY-FIFTH MEETING - NOVEMBER 16, 1981 On motion of Halfacre and Johnson, letter be received and filed for reference. Presented letter from D.S. White of Stewart, Esten re: Jacobson plf Abernathy with respect to conveyance of Road Allowance on Lot 8, Plan 860, advising that in their opinion, Section 463 of the Municipal Act is the property Section rather then 462. According to RSO 1980, Section 463 is now 318. Also that a letter has been forwarded to Mr. Jacobson requesting confirmation that his client will pay all legal costs. On motion of Johnson and Halfacre, letter be received and filed until further information is received from Solicitor D.S. White. Presented letter from Stuart N. Keyes, P. Eng. forwarding written comments of his inspection of Plan M-66, as requested by Council. Clerk advised that comments had been forwarded to Jo-Con Developments on October 21, 1981. On motion of Davie and Halfacre, letter be received and Clerk to contact Mr. P. Stefaniak of Jo-Con Developments and request he attend the next regular meeting of Oro Council to be held December 7, 1981. Recommendations from the Committee of Council meeting held on November 1~, 1981 were further considered as follows: With respect to applicants interviewed for the position of Park Superintendent and Caretaker the following action was taken: On motion of Halfacre and Vousden, Clerk to advise Mr. Lloyd Beaman that the posi- tion of Park Superintendent and Caretaker is being filled for 1982 and request Mr. Jim Dunsmore to attend the Committee of Council meeting to be held on Novmeber 25, 1981 with respect to remuneration. As recommended at Committee of Council meeting it was left that the Park Study Committee after reviewing the material presented along with proposed terms of reference, the Committee again meet with Council to review terms of reference for the study. On motion of Halfacre and Davie, correspondence and Communications etc., be received and filed. Presented letter from Ministry of Natural Resources, Huronia District with res- pect to annual license fee in the amount of $100.00 due December 9, 1981 for Township Gravel Pit on Part Lot 11, Concession 8. On motion of Davie and Johnson, letter be received and Treasurer authorized to forward fee for Annual Licnese and same be added to account list for the month of November in the amount of $100.00. Presented report of Live Stock Valuer, Ernest Bidwell, for one calf killed by Wolf or Wolves on November 9, 1981 owned by Durney O'Reilly, Lot 22, Conc. 7 and valued at $200.00. Also Affidavit of owner of Live Stock. On motion of Johnson and Vousden, Report of Live Stock Valuer accepted and Trea- surer authorized to issue cheque in payment of same to an amount of $200.00, owner having taken the necessary Affidavit and Clerk to complete application for Grant (Form 1) for damage by wolves and forward same to Live Stock Commissioner Live Stock Branch, Ministry of Agriculture and Food. Presented copy of Circular letter from, Chief of Fire Advisory Service Office of the Fire Marshall advising that four meetings that the Office of the Fire Marshall will be conducting in Simcoe County and requesting that a member of Council along with the Fire Chief of the Township attend the meeting to be held in the City of Orillia at the Orillia Fire Department Headquarters on November 17, 1981. On motion of Davie and Halfacre, that the Chairman of the Fire & Building Committee and Fire Chief attend the meeting on November 17, 1981. Presented letter from Treasurer, East Simcoe Plowmen's Association requesting a Grant for 1982 as in previous years. On motion of Vousden and Halfacre, that the grant for East Simcoe Plowmen's Assoc. be presented for consideration with usual annual grants when the 1982 Budget is prepared and approved. Presented letter from Jarratt Creighton Women's Institute to Simcoe County with respect to concern about safety of left turn off No. 12 Highway at County Road 22 due to triangular curb installed. On motion of Johnson and Vousden, letter be received and filed until further in- formation is obtained from the County as to action taken regarding reply to the Creighton Women's Institute. . . . """"l1lI Pg. 286 TWENTY-FIFTH MEETING - NOVEMBER 16, 1981 Presented from Assessment Review Court , copy of Notice of Hearing Court No. S 144 to be at the Council Chambers of Innisfil Township of an appeal by Cana- dian National Railways for Assessment under Section 52. On motion of Halfacre and Davie, copy of Notice of Assessment Review Court be re- ceived and Clerk to make all necessary entries when decision of ARC is received. Presented letters from two ratepyaers in area of Shelswell Park expressing concern about the boundry fence on the easterly side of Shelswell Park and Lot 50, Plan 755. On motion of Halfacre and Johnson, letters be received and Clerk to reply and advise that the Township propose to erect a regular fence on the boundry line of Shelswell Park and Lot 50 and owner of Lot 50 will be advised accordingly. On motion of Davie and Vousden, that a letter be written to owner of Lot 50, Plan 755 and advise that the Township propose to erect a normal nine strand wire fence on the easterly boundry line of Shelswell Park and Lot 50, Plan 755. And requesting that the owner advise of any comments or suggestions, as the Township is not prepared to erect any different type of fence. Deputy Reeve Davie brought to the attention of Council the matter of the culvert under CNR Tracks which when not operating properly floods the lands of owner Alex Toffan and that Mr. Toffan is of the opinion that the Township would be required to request such work to be done from the CNR. On motion of Davie and Vousden, that a letter be forwarded to Canadian National Railway requesting that the culvert on the west side of line 5, south of Ridge Road (County Road 20) under the CNR Track be cleared out sufficiently in order to allow water to flow freely and not flood the property of Alex Toftan during run- off periods. Deputy Reeve Davie also brought to the attention of Council the matter of snow removal on the newly constructed walkway on the north side of Ridge Road in Shanty Bay. On motion of Davie and Vousden, that the equipment retained by the Fire Department at No. 1 Station, Shanty Bay, to snow plow the Fire Hall property, be requested to clear the walkway on the north side of the Ridge Road at the same time. The matter of parties being interested in purchasing the property owned by the City of Barrie in the Township of Oro with proposal for an area for recrea- tional purposes, was brought to the attention of Council by Deputy Reeve Davie. Before further presentation of the matter Councillor Vousden indicated that the matter not be further discussed and made the following resolution: It was moved by Councillor Vousden and seconded by Johnson, that the matter of the proposal suggesting to purchase the lands owned by the City of Barrie be referred to Committee of Council meeting. On motion of Davie and Vousden, that the next Committee of Council meeting sche- duled for November 25, 1981, be rescheduled for Wednesday, December 2, 1981 and persons requested to attend be advised accordingly. I . . . ~ Pg. 287 I TWENTY-FIFTH MEETING - NOVEMBER 26, 1981 Chief Building Official, James Shellswell was present at 11:30 a.m. to present his report for the month of October as follows: There were 14 building permits and 1 plumbing permit issued with a breakdown as follows: 1 Residence at a value of 3 Additions at a value of 2 Agricultural at a value of 3 Accessory at a value of 3 Alterations at a value of 1 Renovation at a value of 1 Chimney at a value of $ 52,850.00 26,300.00 27,600.00 8,340.00 5,400.00 7,000.00 1,000.00 $128,490.00 Money received for Permits Value of Permits for October '80 $548.00 $203,100.00 on motion of Halfacre and Vousden, report of Chief Building Official as presented be accepted as satisfactory. Presented from Delno Jermey, Tile Drainage Inspector Form 8, being the Inspection and Completion Certificate for drainage constructed on part E~ Lot 18, Cone. 6 and owned by Leonard and Margaret Mortson, for which an application for a Tile Drainage Loan was made, dated August 4, 1981 and approved by Council on August 17, 1981 on a pro-rated basis for an amount of $6,500.00. The work having been comple- ted with no apparent defects. Also attached to Form 8, invoices for the work and material related thereto, for a cost of $8,704.77 plus inspection charge of $50.00 to a total of $8,754.77 which has been pro-rated to $6,500.00 On motion of Vousden and Halfacre, the Inspection Report of the Tile Drainage Inspector be accepted as satisfactory and Treasurer authorized to issue and for- ward a cheque in the amount of $6,500.00 less the Inspectors fee of $50.00 to an amount of $6,450.00, to Leonard Mortson when the Debenture has been purchased by the Province. The Drainage work having been satisfactorily performed and Form 8 received comple- ted, a By-Law to impose a special Annual Drainage Rate upon the land in respect of which money is borrowed under the Tile Drainage Act 1971, to construct a sub- surface drainage works on such lands and whereas the Council has upon application agreed to lend the owner, the total of $6,500.00, being 75% of the total cost of the work as shown on Form 8, to be repaid with interest, at the rate of 8%, by means of a rate hereinafter imposed by a By-Law as prescribed in Form 11, as presented, be on motion of Johnson and Davie, and introduced and numbered as By- Law No. 1241/81 and read a first time. On motion of Davie and Vousden, By-Law No. 1241/81, read a first time, be read a second time. On motion of Halfacre and Johnson, By-Law No. 1241/81, read a second time, be read a third time. . . . """"l1lI Pg. 288 TWENTY-FIFTH MEETING - NOVEMBER 16, 1981 On motion of Vousden and Johnson, By-Law No. 1241/81 now read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve and Clerk to complete and forward Schedule 'A' of By-Law No. 1241/81, which sets an Annual Rate to be composed of $968.50, and Form 9 "Offer to Sell" and Debenture No. 81-12 in the amount of $6,500.00 which is hereby authorized to be signed by the Reeve and Clerk on behalf of the Corporation of the Township of Oro, along with Form 8 (Inspection and Completion Certificate) to the Ontario Ministry of Agriculture & Food, Food Land Development Branch, Drainage Section, Queen's Park. Road Superintendent Fred Haughton was present before Council at 1:00 p.m. and presented report of work done on Township Roads from November 1, 1981 to November 14, 1981. On motion of Vousden and Davie, report of Road Superintendent as presented be accepted as satisfactory and Treasurer authorized to issue cheque in payment of same to a total of $ 13,483.50. Road Superintendent Fred Haughton reported on his attendance of the Seminar on Asphalt re-cycling for which a written report will be presented to Council. The matter of completing a second petition for Interim Payment under the Public Transportation and Highway Improvement Act on Expenditures made in the year 1981 to November 14, 1981, was presented for consideration. A previous petition having been forwarded for expenditure from January 1, 1981 to August 31, 1981, therefore a further petition would include expenditures from September 1st to November 14, 1981. On motion of Davie and Vousden, that a second petition for interim payment of subsidy on expenditures made on Oro Township roads in 1981 to November 14, 1981 which includes the expenditures from September 1, 1981 to November 14, 1981, the first petition being for expenditures from January 1, 1981 to August 31, 1981, be hereby authorized and same be completed with Road Superintendent and Treasurer taking the necessary declaration required, And, further that the Reeve and Clerk be authorized to sign the petition on behalf of the Corporation of the Township of Oro, when completed, and Clerk to forward same to Ministry of Transportation and Communications. On motion of Johnson and Halfacre, that correspondence as presented be placed on file. Presented Ministry of Municipal Affairs & Housing 1982 'Annual Housing Review' questionnaire, as completed by the Planning Administrator. On motion of Vousden and Halfacre, that the Ministry of Municipal Affairs & Housing 1982 Annual Housing Review questionnaire be returned as completed. . . . Pg. 289 TWENTY-FIFTH MEETING - NOVEMBER 16, 1981 Presented for consideration a draft by-law to re-zone part of Lot 28, Cone V from 'SR-Shoreline Residential' to 'RG-General Residential' in accordance with the decision rendered by the Ontario Municipal Board in respect of By-Law No. 1213/80, and in accordance with Council's resolution of October 19, 1981 to finalize matters as required. Advised that this By-Law, as per O.M.B. decision does not require circulation or hearing. On motion of Halfacre and Vousden, that a By-Law to amend Restricted Area By-Law No. 1031 as amended, as introduced, be numbered as By-Law No. 1242/81 and read a first time. On motion of Vousden and Davie, that By-Law No. 1242/81 read a first time, be read a second time. On motion of Davie and Johnson, that By-Law No. 1242/81 read a second time, be read a third time. On motion of Johnson and Halfacre, that By-Law No. 1242/81 now read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve. Duplicate originals of the By-Law be forwarded to the Ontario Municipal Board as required by the Planning Administrator. Presented for consideration a draft by-Law to re-zone part of Lot 21, Cone. VI from 'T2-Tourist Campground' to 'C1-General Commercial', in accordance w~th Council's resolution of June 15, 1981, the necessary reference plan of the pro- perty and correspondence from the Simcoe County District Health Unit having been received. On motion of Johnson and Halfacre, that a By-Law to amend Restricted Area By-Law No. 1031 as amended, as introduced, be numbered as By-Law No. 1243/81 and read a first time. On motion of Halfacre and Vousden, that By-Law No. 1243/81 read a first time, be read a second time. On motion of Vousden and Johnson, that By-Law No. 1243/81 read a second time, be read a third time. On motion of Halfacre and Johnson, that By-Law No. 1243/81 now read a third time, do pass, be engrossed by the Clerk, signed and sealed by the Reeve. Planning Administrator to circulate By-Law pursuant to the provisions of Section 39(24) of The Planning Act. On motion of Vousden and Davie, that the Engineer of Ministry of Transportation and Communications be requested to inspect with Road Superintendent and Township Engineer, the Roads on Plan M-71, Torpey Subdivision and Plans M-30 & 31 (Sugar Bush) being the second phase and advise Council that the Roads meet the necessary standards required by the Ministry.
